This permit, issued on October 19, 2015 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Dockine Facility
NOTE: In accordance with the commitment made by the permittee, and in order to comply with
NCAC 07H .0208(b)(6), the proposed 6' walkway shown on the plans is hereby deleted and
not authorized under this permit.
1) This permit authorizes only the expanded dock, covered platform, and other structures and uses
located in or over the water that are expressly and specifically set forth in the permit application. No
other structure, whether floating or stationary, shall become a permanent part of this expanded
docking facility without permit modification. No non -water dependent uses of structures shall be
conducted on, in or over Public Trust waters without permit modification.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2018
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a
violation of this permit for which the permittee is responsible. This prohibition shall be applied and
enforced throughout the entire existence of the permitted structure.
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more - isible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of 6 formalized boat slips.
6) The expanded dock and associated structures shall have a minimum setback distance of 15 feet between
any parts of the structure and the adjacent property owner's riparian access corridor, which is
determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel
line that intersects with the shore at the point where the upland property line meets the water's edge.
7) Any portion of the permitted access pier and docking facilities built over coastal wetlands shall not exceed
six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured
from the bottom of the decking.
8) The authorized covered platform/gazebo shall not be enclosed. Any material used on the sides shall not
obstruct view- and shall be permeable to air and water. Screen or wire or. the sides along with benches and
knee walls are permitted. Lattice is specifically excluded from being used under this authorization.
9) The roof of the covered platform/gazebo shall not be designed for second story use.
10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
Excavation
11) In order to protect juvenile frnfish resources, no excavation shall be permitted between April 1 and
September 30 of any year without prior approval of the North Carolina Division of Coastal Management
in consultation with appropriate resource agencies.
12) Excavation shall not exceed -6 feet below the normal water ler ei. In no case shall thMOEIV ED
excavation exceed the depth of the connecting waters.
13) No vegetated wetlands/marsh grass shall be excavated or tilled OCT 2 8 2015
14) The temporary placement of double handling of excavated materials within waters
is not authorized.

16) In order to entire compliance with Condition No. 15 of this permit, an as -built survey shall be performed
on any areas of excavation and adjacent wetlands, and a copy provided to DCM and the U.S. Army Corps
of Engineers within 60 days of completion of each excavation event.
Spoil Disposal
17) All excavated materials shall be confined above nurmai high water level and !andward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids
into any marsh or surrounding waters.
18) No spoil material shall be placed within 30 feet of the normal high water line.
Sedimentation and Erosion Control
19) In order to protect water quality; runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
20) Appropriate sedimentation and erosion control devices. measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence.
diversion swales or berms, etc.).
21) All disturbed areas shall be properly graded and provided a ground cover suffrcigpt ieXs9i>p'n

22) The Division of Coastal Management shall be notified in writing at least two (2) QQW RyY
maintenance work authorized by this permit, and such notification shall include,
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be .removed. The
location, design and holding capacity ot the spoil disposal site shall be approved by a representative
of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permince's signature shown anew on the original plan.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permits
197800056 & 198200277 (Action ID No. SAW-2015-01540), which was issued on 8/4/15.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR-
15-0652.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prier to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

6. Additional Information
In addition to this completed application form, (MP-1) the following items below, B applicable, must be submitted in order for the application
package to be complete. Items (a) - (0 are always applicable to any major development application. Please consult the application
instruction booklet on how to property prepare the required items below.
a. A project narrative.
b. An accurate, dated work plat (including plan view and cross -sectional drawings) drawn to scale. Please give the present status of the
proposed project. Is any portion already complete? If previously authorized work, clearly indicate on maps, plats, drawings to distinguish
between work completed and proposed.
c. A site or location map that is sufficiently detailed to guide agency personnel unfamiliar with the area to the site.
d. A copy of the deed (with state application only) or other instrument under which the applicant claims title to the affected properties.

PROJECT DESCRIPTION:
The project site is located at 59 Causeway Drive, adjacent to a man-made canal, in the Town of Ocean Isle
Beach, Brunswick County. To find the project site, travel south on US Highway 17 to Ocean Isle Beach Road
SW. Turn left onto Ocean Isle Beach Road SW and travel approximately 4 miles to the Ocean Isle Beach
high rise bridge. Cross the bridge and turn left at the foot of the bridge onto the service road. The project
site will be the second building and parking area on the right side of the road, 59 Causeway Drive.
The lot is approximately 0.34 acres with approximately 100 feet of shoreline frontage. The lot averages 3.0
feet above mean sea level and the shoreline has been stabilized with a wooden bulkhead. The applicant
maintains a commercial building with parking on the high ground. The highground vegetation consists
primarily of lawn grass and ornamental landscaping. A bulkhead extends from north to south along the
shoreline and an area of coastal wetlands exists waterward of the existing bulkhead on the east side of the
property. The area of coastal wetlands is vegetated with primarily with Smooth Cord Grass (Spartina
alterniflora). The coastal wetlands range in width from 30 feet near the northern property boundary to 15
feet in width near the southern property boundary and Mean High Water (MHW) meets the face of the
bulkhead. An existing docking facility extends to the east from the center of the property. The docking
facility consists of a 40 feet long by 6 feet wide fixed pier connected via access ramp to an existing 8 feet
wide by 40 feet long floating dock. A boatlift measuring 14 feet wide by 14 feet long is located on the
southern end of the existing floating dock. Water depths adjacent to the existing floating dock and boatlift
range from approximately -2.0 to -4.7 feet at Mean Low Water (MLW) (see sheet C-3). The adjacent
properties to the north and south are both commercial/retail buildings with parking and docking facilities.
The property is bordered by Causeway Drive to the west and a man-made canal to the east.
The Town of Ocean Isle Beach Land Use Plan classifies the adjacent high ground portion of the project area
as Commercial. The waters of the man-made canal are classified SA by the Division of Water Resources.
They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are
CLOSED to the harvest of shellfish. The width of the man-made canal in this location is approximately 135
feet at this location. There are no known archaeological resources within the project vicinity.
10. PROPOSED PROJECT:
The applicant proposes to reconstruct the existing docking facility, construct a shore side boardwalk
and excavate a new boat basin connecting to a man-made canal. The dimensions of the proposed
boat basin would be approximately 100 feet in length and would range in width from 44 to 50 feet The
proposed boat basin would have a final project depth of -6 feet at mean low water (MLW) and would
tie into the existing water depths within the adjacent man-made canal. As proposed, the applicant
would maintain a 10 foot buffer from the existing bulkhead and coastal wetland vegetation.
Excavation of the basin would be accomplished by using a long reach excavator with a dragline. The
applicant states that the excavated material would be placed in a watertight truck and transported to
an offsite high ground location. The spoil material would be transported to the Ike Williamson
disposal facility off Hale Swamp Road. A letter from the property owner of recordgNctvlAtilliamson,

The applicant is also proposing to expand the existing docking facility by constructing a shore side
boardwalk, roof covered platform, and extending the floating dock to the south. The applicant is
proposing 6 feet wide by 94 feet long shore side boardwalk that would be oriented parallel to the
existing bulkhead. As proposed, the gazebo would span the existing walkway and would measure
approximately 26 feet in length and 12 feet in width as measured from the drip line and would be
located water ward of the coastal wetlands. The floating dock Extension would connect to the
existing floating dock and would measure approximately 8 feet in width by 29 feet in length. The
proposed floating dock extension would extend to the south. As proposed, the floating dock
extension would be in alignment with the existing floating dock and would not exceed the established
pier head line. As proposed the docking facility would provide docking space for six (6) vessels.
11. ANTICIPATED IMPACTS:
The proposed boat basin excavation would result in the disturbance of approximately 4,610 square
feet of shallow bottom. Approximately 530 cubic yards of spoils material would be excavated from
below MHW. The final project depth would be -6 feet at MLW and would connect to the existing
depths of the dredged channel. The spoil disposal area would result in approximately 10,000 square
feet of high ground fill at the approved offsite location. Short term increases in turbidity can be
expected during dredging activity. The excavation of the basin by mechanical means will create steep
side slopes and subsequent sloughing, thereby increasing the top width dimensions of the proposed
project. As proposed, the applicant would maintain a 10 foot buffer from the existing coastal wetlands
to prevent disturbance to the areas resulting from sloughing. However, the proposed use of long
reach excavator with dragline could result in material being deposited in the wetlands when the
bucket is moved from the water to the truck stored on the high ground. The proposed docking facility
would incorporate approximately 1,276 square feet of Estuarine and Public Trust Waters Areas of
Environmental Concern, of which 732 square feet would shade coastal wetlands. The proposed gazebo
roof drip edge would be located approximately 1 foot from the edge of wetlands in order to prevent
sheet flow from entering the adjacent wetlands. As proposed, the floating dock extension would not
extend in the 15-feet adjacent riparian property owner setback to the south. The proposed floating
dock would exceed the X width limitation however; the docking facility would remain within its
existing alignment and would not exceed an established pier head alignment which conforms to the
1/3 width rule. As proposed, the docking facility would provide mooring for six (6) vessels.

DESIGN NARRATIVE
1. EXISTING CONDITIONS:
The existing facility for OIB ABC, LLC. is located in Brunswick County at 59 Causeway
Drive, Ocean Isle Beach, NC. The site is located between Sharkeys Waterfront
Restaurant and Sheffield's Seafood and Grocery. The site is zoned CR-2, Commercial
Business District by the Town of Ocean Isle Beach. The site is served by the Town of
Ocean Isle Beach municipal water distribution and sewer collection systems.
This site backs up to a manmade canal that leads out to the Atlantic Intracoastal
Waterway. There is an existing bulkhead located at mean high water, and there is 100
linear feet of shoreline. Currently there is a 6 foot wide, 52 foot long pier that leads out
to an 8 foot wide, 40 foot floating dock. There is a boat lift at the south end of the floating
dock.
The facility was previously occupied by an ABC store owned by the Town of Ocean Isle
Beach. The property has been transferred to OIB ABC, LLC, and is currently being
redeveloped for a proposed restaurant, Charlie Grainger's Famous Hotdogs. The existing
upland parking area is currently being redeveloped under a CAMA Minor permit issued
by the Town of Ocean Isle Beach.
The project is located in High Hazard Flood Area, with a designation of VE17. The site
is located in the Lumber River Basin.
2. PROPOSED DEVELOPMENT:
For the project there will be the construction and addition of water dependent structures.
A gazebo will be built over the water and over part of the pier leading out to the floating
dock. The covered gazebo will have roof dimensions of 12' by 26' and cover a 12' by 6'
section of the existing fixed pier. A 6' wide wooden walkway will be constructed along
the length of the existing bulkhead. The existing boat lift will be removed and the floating
dock that is currently approximately 40' in length will be extended an additional 29'.
This floating dock will be able to accommodate six boat slips at approximately 2V each.
A 4,610 SF area of the canal will be excavated to provide sufficient water depths at the
floating dock. The depth will be 6.0' after excavation as measured from Mean Low Water
(MLW). The excavation of the channel will be done using a long -reach excavator and a
dragline. Approximately 530 cubic yards of material are to be excavated. The excavated
material will be moved directly to a watertight truck and transported off the site. The
material will be brought to Ike Williamson Disposal Facility on Hale Swamp Road. The
facility is a NCDENR permitted LCID Landfill and Mining Facility.
The proposed development requires a CAMA Major permit, which triggers the
requirement of a State Stormwater permit. The site is existing will not have any increase
in built -upon area, therefore a Stormwater Exclusion is requested from NCDENR,
Division of Energy, Mineral and Land Resources. RECEIVED

The total area for the docking facility was calculated as follows:
Shoreline length =100 ft. x 8 sq. ft. = 800 sq. ft. allowable.

Proposed floating dock = 8 feet x 29 feet = 232 square feet

It is the staffs recommendation to reconstruct the existing docking facility, construct a shore side boardwalk
and to excavate a new boat basin is CONSISTENT with the Rules of 15A NCAC 7H.0206 (d) Use Standards for
Estuarine Waters, Rules of 15A NCAC 71-1.0207 (d) Use Standards for Public Trust Areas and The Rules of 15A
NCAC 07H.0600 Development Standards Applicable to all AECS..
It is staffs recommendation that the boat basin excavation is CONSISTENT with the Rules of 15A NCAC 7H
.0208 (b) Specific Use Standards (1) which states Navigation channels, canals and boat basins shall be aligned
or located so as to avoid primary nursery areas, shellfish beds, beds of submerged aquatic vegetation as
defined by the MFC, or areas of coastal wetlands except as otherwise allowed in this Subchapter. However,
particular care should be taken during excavation to ensure that material/spillage from the dragline is
prevented from entering the wetlands as it is transported to the truck stored on the high ground.
It is staffs recommendation that the reconstruction of the existing docking facility is CONSISTENT with the
Rules of 15 NCAC 7H.0208 (b) (6) Specific Use Standards for Piers and Docking Facilities.
I have no objections to the proposed project. Any permit issued should include the standard major permit
conditions for piers and docking facilities and for excavation and fill.

Consistency Determination:
This projecvappears to be consistent with the Town of Ocean ISIe'Beach Land Use Plan. .
The applicant proposes to reconstruct the existing docking facility, construct a shore side
boardwalk and excavate a new boat basin connecting to a man-made canal. The project
is located at 59 Causeway Drive in Ocean Isle Beach.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW, CW and
PT. Waters at the project site are classified as SA and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Town of Ocean Isle Land Use Plan
and offer the following comments.
The general area of the project is classified Residential, while the AECs impacted by the
work are classified as Conservation.
In general, the Town of Ocean Isle Beach allows development in Conservation classified
AECs, which is consistent with the State's minimum use standards. The Town of Ocean
Isle Beach Land Use Plan contains some policies, which exceed the State's minimum use
standards. However, none of these standards appear to be applicable to this proposal.
This project appears to be consistent with the Town of Ocean Isle Beach Land Use Plan.

Approval of 401 Water Quality Certification with Additional Conditions
Dear Mr. Myers,
You have our approval, in accordance with the attached conditions and those listed below to
reconstruct an existing docking facility, to construct a boardwalk, and to excavate a new boat basin
as described in your CAMA application received by the Division on July 2, 2015. After reviewing
your application, we have decided that the impacts are covered by General Water Quality
Certification Numbers 3883 (GC3883) and 3894 (GC 3894). These C rtifications allow you to use
the General Permit Numbers 198200277 and 197800056 when issued b the US Army Corps of
Engineers and the CAMA Major Permit when issued by the Division of Coastal Management. In
addition, you should obtain or otherwise comply with any other required federal, state or local
permits before you go ahead with your project including (but not limited to) Erosion and Sediment
Control, Non -discharge, Water Supply Watershed, and stormwater regulations. Also, this approval
to proceed with your proposed impacts or to conduct impacts to waters as depicted in your
application shall expire upon expiration of the 404 or CAMA Permit.
This approval requires you to follow the conditions listed in the attached certification and any
additional conditions listed on the following pages.
The Additional Conditions of the Certification are:
This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification. If you
change your project, you must notify the Division and you may be required to submit a new
application package with the appropriate fee. If the property is sold, the new owner must be given a
copy of this approval letter and General Certification and is responsible for complying with all
conditions. Any new owner must notify the Division and request the Certification be issued in their
name (I 5A NCAC 02H .0501 and .0502).
2. Any final construction plans for this project must include or reference the application and plans

also be required to evaluate all acquired permits to assure that they are consistent and all relative
impacts are accounted for and shown on the construction plans. [15A NCAC 02H .0502 (b) and
15A NCAC 02H .0506 (4)] The applicant shall require his contractors (and/or agents) to
comply with all of the terms of this Certification, and shall provide each of its contractors
(and/or agents) a copy of this Certification.
3. Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded as
described in 15 A NCAC 2B .0220. Appropriate sediment and erosion control practices must
be used to meet this standard. Turbidity curtains shall be used as appropriate. Please notify
this Office if any turbidity issues arise at 910.796.7215
4. This General Certification shall expire on the same day as the expiration date of the
corresponding General Permit. The conditions in effect on the date of issuance of the
Certification for a specific project shall remain in effect for the life of the project, regardless
of the expiration of this Certification.
5. The permittee shall require its contractors and/or agents to comply with the terms of this
permit in the construction and maintenance of this project, and shall provide each of its
contractors and/or agents associated with the construction or maintenance of this project a
copy of this certification. A copy of this certification including all conditions shall be
available at the project site during the construction and maintenance of this project. [15A
NCAC 02H .0507 (c) and 15A NCAC 02H .0506 (b)(2) and (c)(2)]
6. Continuing Compliance:
The applicant/permittee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with 303(d) of the Clean Water Act), and any other appropriate requirements of
State and Federal law. If the Division determines that such standards or laws are not being
met, including failure to sustain a designated or achieved use, or that State or Federal law is
being violated, or that further conditions are necessary to assure compliance, than the
Division may reevaluate and modify this General Water Quality Certification. [15A NCAC
02H .0507(d)]
7. All mechanized equipment operated near surface waters or wetlands will be regularly
inspected and maintained to prevent contamination of waters and wetlands from fuels,
lubricants, hydraulic fluids or other potential toxic chemicals. In the event of a hydrocarbon
or chemical spill, the permittee/contractor shall immediately contact the Division of Water
Quality, between the hours of 8 am to 5 pm at the Wilmington Regional Office at
910.796.7215 and after hours and on weekends call (800) 858-0368. Management of such
spills shall comply with provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act. [15A NCAC 02H .0506 (b)(3) and (c)(3), 15A NCAC 02B .0200

8. Fueling, lubrication and general equipment maintenance should not take place within 50 feet
of a waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC 02H
.0506 (b)(3) and (c)(3) and 15A NCAC 02B .0200 (3)(f)].
9. This certification grants permission to the director, an authorized representative of the
Director, or DENR staff, upon the presentation of proper credentials, to enter the property
during normal business hours 15A NCAC 02H.0502(e).
10. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant and/or authorized
agent is required to return a completed certificate of completion form to the NCDENR DWR
401 and Buffers Unit North Carolina Division of Water Resources, 1617 Mail Service
Center, Raleigh, NC, 27699 within ten days of project completion. The certification of
completion is available at: http://portal.ncdenr.ore/web/wq/swp/ws/401 /certsandpermits/apply/forms).
Violations of any condition herein set forth may result in revocation of this Certification and
may result in criminal and/or civil penalties. The authorization to proceed with your proposed
impacts or to conduct impacts to waters as depicted in your application and as authorized by this
Certification shall expire upon expiration of the 404 or CAMA Permit.
This approval and its conditions are fmal and binding unless contested.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing
a written petition for an administrative hearing to the Office of Administrative Hearings (hereby
known as OAH). A petition form may be obtained from the OAH at http://www.ticoah.com/ or by
calling the OAH Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A
petition is considered filed when the original and one (1) copy along with any applicable OAH
filing fee is received in the OAH during normal office hours (Monday through Friday between 8:00
am and 5:00 pm, excluding official state holidays).

On June 12, 2015, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources
received a request to exclude the subject proposed redevelopment project from Stormwater Management Permit
requirements. Staff review of the plans and supporting documentation has determined that the project proposes
activities that are excluded from State Stormwater permitting requirements as set forth in Section .(d)(3) of
Session Law 2008-211, effective October 1, 2008, and the stormwater rules under Title 15A NCAC 2H.1000, as
amended.
Therefore, the director of the Division of Energy, Mineral and Land Resources is hereby providing confirmation
that the subject project is excluded from State Stormwater permitting requirements under the following conditions:
1) The project must be constructed as shown on the plans submitted to this Office; 2) The proposed built -upon
area of 8,550 square feet does not exceed the existing built -upon area of 8,550 square feet; and, 3) The proposed
stormwater control, the existing trench drain, provides equal protection of surface waters as the existing
stormwater control, which is a trench drain. If permeable pavement is proposed to keep the post -developed BUA
amount equal to the existing BUA amount, then this exclusion is also conditioned on that amount of permeable
pavement being installed and maintained per the approved plans, supplement and O&M agreement.
Under Section .1003 (b) of the stormwater rules, the entire common plan of development must be permitted.
Therefore, any future development or changes to the proposed development, including, but not limited to, the
relocation of built -upon area and the construction of additional built -upon area, may require approval or a
Stormwater Management permit application and permit issuance from the Division of Energy, Mineral and Land
Resources prior to any construction. Construction of the project prior to receipt of the required approval or permit
or failure to maintain compliance with the exclusion conditions, are violations of Title 15A NCAC 2H.1000 and
Session Law 2008-211, and may result in the initiation of appropriate enforcement action.
Please keep in mind that this determination does not affect your legal obligation to obtain other permits and
approvals, which may be required by Federal, State, or local government agencies, rule or law. If you have any

8. PROJECT SUMMARY: The applicant proposes to reconstruct the existing docking facility, construct a
shore side boardwalk and excavate a new boat basin connecting to a man-made canal.

9. PROJECT DESCRIPTION:
The project site is located at 59 Causeway Drive, adjacent to a man-made canal, in the Town of Ocean Isle
Beach, Brunswick County. To find the project site, travel south on US Highway 17 to Ocean Isle Beach Road
SW. Turn left onto Ocean Isle Beach Road SW and travel approximately 4 miles to the Ocean.lsle Beach
high rise bridge. Cross the bridge and turn left at the foot of the bridge onto the service road. The project
site will be the second building and parking area on the right side of the road, 59 Causeway Drive.
The lot is approximately 0.34 acres with approximately 100 feet of shoreline frontage. The lot averages 3.0
feet above mean sea level and the shoreline has been stabilized with a wooden bulkhead. The applicant
maintains a commercial building with parking on the high ground. The highground vegetation consists
primarily of lawn grass and ornamental landscaping. A bulkhead extends from north to south along the
shoreline and an area of coastal wetlands exists waterward of the existing bulkhead on the east side of the
property. The area of coastal wetlands is vegetated with primarily with Smooth Cord Grass (Spartina
alterniflora). The coastal wetlands range in width from 30 feet near the northern property boundary to 15
feet in width near the southern property boundary and Mean High Water (MHW) meets the face of the
bulkhead. An existing docking facility extends to the east from the center of the property. The docking
facility consists of a 40 feet long by 6 feet wide fixed pier connected via access ramp to an existing 8 feet
wide by 40 feet long floating dock. A boatlift measuring 14 feet wide by 14 feet long is located on the
southern end of the existing floating dock. Water depths adjacent to the existing floating dock and boatlift
range from approximately -2.0 to -4.7 feet at Mean Low Water (MLW) (see sheet C-3). The adjacent
properties to the north and south are both commercial/retail buildings with parking and docking facilities.
The property is bordered by Causeway Drive to the west and a man-made canal to the east.
The Town of Ocean Isle Beach Land Use Plan classifies the adjacent high ground portion of the project area
as Commercial. The waters of the man-made canal are classified SA by the Division of Water Resources.
They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are
CLOSED to the harvest of shellfish. The width of the man-made canal in this location is approximately 135
feet at this location. There are no known archaeological resources within the project vicinity.

10. PROPOSED PROJECT: JUL 2 3 20b

The applicant proposes to reconstruct the existing docking facility, construct a shore side boardwalk
and excavate a new boat basin connecting to a man-made canal. The dimensions of the proposed
boat basin would be approximately 100 feet in length and would range in width from 44 to 50 feet The
proposed boat basin would have a final project depth of -6 feet at mean low water (MLW) and would
tie into the existing water depths within the adjacent man-made canal. As proposed, the applicant
would maintain a 10 foot buffer from the existing bulkhead and coastal wetland vegetation.
Excavation of the basin would be accomplished by using a long reach excavator with a dragline. The
applicant states that the excavated material would be placed in a watertight truck and transported to
an offsite high ground location. The spoil material would be transported to the Ike Williamson
disposal facility off Hale Swamp Road. A letter from the property owner of record, Mr. Williamson,
has been provided authorizing the spoil disposal location.

The applicant is also proposing to expand the existing docking facility by constructing a shore side
boardwalk, roof covered platform, and extending the floating dock to the south. The applicant is
proposing 6 feet wide by 94 feet long shore side boardwalk that would be oriented parallel to the
existing bulkhead. As proposed, the gazebo would span the existing walkway and would measure
approximately 26 feet in length and 12 feet in width as measured from the drip line and would be
located water ward of the coastal wetlands. The floating dock extension would connect to the
existing floating dock and would measure approximately 8 feet in width by 29 feet in length. The
proposed floating dock extension would extend to the south. As proposed, the floating dock
extension would be in alignment with the existing floating dock and would not exceed the established
pier head line. As proposed the docking facility would provide docking space for six (6) vessels.
11. ANTICIPATED IMPACTS:
The proposed boat basin excavation would result in the disturbance of approximately 4,610 square
feet of shallow bottom. Approximately 530 cubic yards of spoils material would be excavated from
below MHW. The final project depth would be -6 feet at MLW and would connect to the existing
depths of the dredged channel. The spoil disposal area would result in approximately 10,000 square
feet of high ground fill at the approved offsite location. Short term increases in turbidity can be
expected during dredging activity. The excavation of the basin by mechanical means will create steep
side slopes and subsequent sloughing, thereby increasing the top width dimensions of the proposed
project. As proposed, the applicant would maintain a 10 foot buffer from the existing coastal wetlands
to prevent disturbance to the areas resulting from sloughing. However, the proposed use of long
reach excavator with dragline could result in material being deposited in the wetlands when the
bucket is moved from the water to the truck stored on the high ground. The proposed docking facility
would incorporate approximately 1,276 square feet of Estuarine and Public Trust Waters Areas of
Environmental Concern, of which 732 square feet would shade coastal wetlands. The proposed gazebo
roof drip edge would be located approximately 1 foot from the edge of wetlands in order to prevent
sheet flow from entering the adjacent wetlands. As proposed, the floating dock extension would not
extend in the 15-feet adjacent riparian property owner setback to the south. The proposed floating
dock would exceed the Y4 width limitation however; the docking facility would remain within its
existing alignment and would not exceed an established pier head alignment which conforms to the
1/3 width rule. As proposed, the docking facility would provide mooring for six (6) vessels.

1. EXISTING CONDMONS:
The existing facility for OIB ABC, LLC. is located in Brunswick County at 59 Causeway
Drive, Ocean Isle Beach, NC. The site is located between Sharkeys Waterfront
Restaurant and Sheffield's Seafood and Grocery. The site is zoned CR-2, Commercial
Business District by the Town of Ocean Isle Beach. The site is served by the Town of
Ocean Isle Beach municipal water distribution and sewer collection systems.
This site backs up to a mamnade canal that leads out to the Atlantic Intracoastal
Waterway. There is an existing bulkhead located at mean high water, and there is 100
linear feet of shoreline. Currently there is a 6 foot wide, 52 foot long pier that leads out
to an 8 foot wide, 40 foot floating dock. There is a boat lift at the south end of the floating
dock.
The facility was previously occupied by an ABC store owned by the Town of Ocean Isle
Beach. The property has been transferred to OIB ABC, LLC, and is currently being
redeveloped for a proposed restaurant, Charlie Grainger's Famous Hotdogs. The existing
upland parking area is currently being redeveloped under a CAMA Minor permit issued
by the Town of Ocean Isle Beach.
The project is located in High Hazard Flood Area, with a designation of VE17. The site
is located in the Lumber River Basin.
2. PROPOSED DEVELOPMENT:
For the project there will be the construction and addition of water dependent structures.
A gazebo will be built over the water and over part of the pier leading out to the floating
dock. The covered gazebo will have roof dimensions of 12' by 26' and cover a 12' by 6'
section of the existing fixed pier. A 6' wide wooden walkway will be constructed along
the length of the existing bulkhead. The existing boat lift will be removed and the floating
dock that is currently approximately 40' in length will be extended an additional 29'.
This floating dock will be able to accommodate six boat slips at approximately 21' each.
A 4,610 SF area of the canal will be excavated to provide sufficient water depths at the
floating dock. The depth will be 6.0' after excavation as measured from Mean Low Water
(MLW). The excavation of the channel will be done using a long -reach excavator and a
dragline. Approximately 530 cubic yards of material are to be excavated. The excavated
material will be moved directly to a watertight truck and transported off the site. The
material will be brought to Ike Williamson Disposal Facility on Hale Swamp Road. The RECEIVED
facility is a NCDENR permitted LCID Landfill and Mining Facility. JUL 2 3 1015
The proposed development requires a CAMA Major permit, which triggers the
requirement of a State Stormwater permit. The site is existing will not have any increase
in built -upon area, therefore a Stormwater Exclusion is requested from NCDENR,
Division of Energy, Mineral and Land Resources.

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the
subject permit application for proposed actions that impact fish and fish habitats. The applicant
proposes to construct; a 6ft. wide by 94ft. long shore side boardwalk, a 12ft. wide by 26ft. long gazebo,
a 8ft. wide by 29ft. long floating dock extension, remove the existing boat lift, and excavate 530yds' of
soft bottom to a depth of -6ft. at mean low water (MLW). The adjacent habitat and waters are classified
as coastal wetlands (CW), supports shellfish (SA), and is closed to shellfish harvest by the Division of
Marine Fisheries Shellfish Sanitation Section. Though the adjacent waters are not classified as Primary
Nursery Area (PNA), the habitat exists approximately 1,200ft. to the north.
The proposed additional 4 slips are within a closed shellfish harvest area. If the INC DMF Shellfish
Sanitation Section determines that the addition of these slips increases the shellfish closure, then I
object to any number of slips that would result in the additional closure of shellfish harvest grounds.
Coastal wetlands are a productive detritus based system that trap nutrients and sediment, aid in
shoreline erosion control, dissipate wave and storm action, and provide a barrier to flood damage. In
addition coastal wetlands are important to waterfowl feeding and nesting activities, and numerous
estuarine dependent species such as shrimp, flounder, oysters, crabs, and menhaden. The site is located
in a man-made canal that looks to be developed from existing coastal wetlands. Coastal wetlands exist
continuously along the canal and have naturalized the area to some extent.
The boardwalk is proposed to be constructed parallel to the bulkhead and would shade 732ft' of coastal
wetlands. There is no need identified by the applicant for the boardwalk to be located over coastal
wetlands to justify the shading. It is recommended that the boardwalk be moved landward of the
bulkhead to the maintained lawn to reduce impact to coastal wetlands.
The dredge footprint is approximately 10011. long by 40ft.-50ft. wide to a depth of -6ft. at MLW, and will
result in the removal of 530yds' of spoil. The application states a loft. buffer between the coastal
wetland and the edge of the dredge footprint. At the edge of the dredge footprint the application
states water depth is +0.68ft. at MLW. Dredging to a depth of -6ft. at MLW with only loft. of buffer
could create a steep slope that may cause the coastal wetland to erode and slough off into the channel.

In this case it is recommended that the buffer be extended to 18ft. from the edge of the coastal
wetlands with a final cut slope of 3:1. A reduction in dredge depth would also be considered if
applicant preferred to reduce the wetland buffer, providing the 3:1 final cut slope was observed. This
will increase the coastal wetland buffer and reduce the potential for direct loss of coastal wetlands.
DCM recommends a moratorium on in water work, to include dredging, from 1 April to 30 September.
This moratorium reduces the negative effects on critical fish life history activities, to include spawning
migrations and nursery functions.
The application states that dredging operations will be conducted by a long reach dragline excavator
that will deposit the spoil Into a watertight truck on land. This process could result in spoil being
deposited into the coastal wetlands, amounting to filling coastal wetland habitat. It is recommended
that the spoil removal be confined to the water or precautions be taken by the contractor to reduce
the potential to fill coastal wetland habitat, to include a potential site visit by DCM staff during
dredging operations. In addition, the removal of spoil onto land may result in runoff collecting
additional land based contaminants and depositing it into the coastal wetland and surrounding waters.
It is recommended that the dredging contractor utilize barriers between the watertight truck and the
coastal wetlands to reduce runoff from entering the system.

existing man-made boat basin. The docking facility reconfiguration consists of 312 sq. ft. gazebo
structure, and a a 232 sq. ft. floating dock over open water. The basin dredging consists of 530
cy of material removed from a 4'610 sq. ft. man-made basin with upland disposal at Ike
Williamson Spoil Disposal Area. Project location is at 59 Causeway Drive, Ocean Isle Beach,
Brunswick County, North Carolina. Coordinates are: 33.892760 N,-78.437850 W.
On January 1, 2011, we renewed general permit No. 197800056, (copy enclosed) that
authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and
boat shelters, mooring piles, dolphins, jetties and breakwater structures in navigable waters of the
United States in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act
of 1899.
On January 1, 2011, we renewed general permit No. 198200277 (copy enclosed) that
authorizes the dredging and discharge of dredged or fill material including the construction;
backfilling and maintenance of bulkheads and riprap within manmade basins and canals located'
entirely in uplands and to authorize maintenance dredging of ditches, basins, canals and channels
in open water areas, where all excavated material is placed and retained entirely on high ground.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the -enclosed general conditions, and the following special conditions:

With these choices as his options at this time, the applicant would like to remove the proposed 6' walkway that is along
the bulkhead.

conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to
a telephone pole or tree along the road right-of-way fronting your property, or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State or Federal

This notice is intended to make you, the applicaut, aware of the
special risks and conditions associated with development in this
area, which is subject to natural hazards such as storms, erosion
and currents. The rules of the Coastal Resources Commission
require that you receive an AEC Hazard Notice and acknowledge
that notice in writing before a permit for development can be
issued.
The Commission's rules on building standards, oceanfront
setbacks and dune alterations are designed to minimize, but not
eliminate, property loss from hazards. By granting permits, the
Coastal Resources Commission does notguamntee the safety of
the development and assumes no liability for future damage to
the development. Permits issued in the Ocean Hazard Area of
Environmental Concern include the condition that structures be
relocated or dismantled if they become imminently threatened by
changes in shoreline configuration. The structure(s) most be
relocated or dismantled within two (2) years of becoming
imminently threatened, and in any case upon its collapse or
subsidence.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual long-term
average ocean erosion rate for the area where your property is
located is 9 feet per year.
The rate was established by careful analysis of aerial photographs
of the coastline taken over the past 50 years.
Studies also indicate that the shoreline could move as much as
300 feet landward in a major storm.
The flo d waters in a major storm are predicted to be about
V t I'I feet deep in this area.
Preferred oceanfront protection measures are beach nourishment
and relocation of threatened structures. Hard erosion control
structures such as bulkheads, seawalls, revetments, groins, jetties
and breakwaters are prohibited. Temporary sand bags may be
authorized under certain conditions.
The appl icant must acknowledge this information and requirements
by signing this notice in the space below. Without the proper
signature, the application will not be complete.

SPECIAL NOTE: Thia hazard notice is required for development
in areas subject to sudden and massive storms end erosion. Permits
issued for development in this area expire on December 31 of the
third year following the year in which the permit was issued.
Shortly before work begins on the project site, the Local Permit
Officer must be contacted to determine the vegetation line and
setback distance atyour site. If the property has seen little change
since the tune ofpermit issuance, and the proposed development
can still meet the setback requirement, the LPO will inform you
that you may begin work. Substantial progress on the project
must be made within 60 days of this setback determination, or
the setback must be remeasured. Also, the occurrence of a major
shoreline change as the result of a storm within the 60-day period
will necessitate remeasurement of the setback. It is important
that you check with the LPO before the permitexpves for official
approval to continue the work after the permit has expired.
Generally, if foundation pilings have been placed and substantial
progress is continuing, permit renewal can be authorized. It is
unlawful to continue work after permit expiration.

Attached is the revised plan that Ray asked me to forward to you. How many full size copies would you like delivered to
your office? What meeting date/time are you looking to bring the plan to?
Also, have you had a chance to look at the file for the OIB ABC store? I spoke to Holley on Friday afternoon, and she said
if there had been any documentation that dredging had been performed at this location previously, she could issue as a
General Permit rather than a Major. I don't mind doing the Major Permit for the dredging if we need to, but the General
Permit would save time and money if acceptable. I will also contact the DENR office to check for anything.

Dear Mr. Myers:
Through coordination with the North Carolina Division of Coastal Management we have
learned of your request to reconfigure an existing docking facility and to maintenance dredge an
existing man-made boat basin. The docking facility reconfiguration consists of 312 sq. ft. gazebo
structure, and a a 232 sq. ft. floating dock over open water. The basin dredging consists of 530
cy of material removed from a 4,610 sq. ft. man-made basin with upland disposal at Ike
Williamson Spoil Disposal Area. Project location is at 59 Causeway Drive, Ocean Isle Beach,
Brunswick County, North Carolina. Coordinates are: 33.892760 N,-78.437850 W.
On January 1, 2011, we renewed general permit No. 197800056, (copy enclosed) that
authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and
boat shelters, mooring piles, dolphins, jetties and breakwater structures in navigable waters of the
United States in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act
of 1899.
On January 1, 2011, we renewed general permit No. 198200277 (copy enclosed) that
authorizes the dredging and discharge of dredged or fill material including the construction,
backfilling and maintenance of bulkheads and riprap within manmade basins and canals located
entirely in uplands and to authorize maintenance dredging of ditches, basins, canals and channels
in open water areas, where all excavated material is placed and retained entirely on high ground.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general conditions, and the following special conditions:
1. An as built survey of the structure will be sent to our office for review to ensure compliance
with the proposed plans and special condition b. o f the GP 277 (15' setback on excavation
near wetlands to avoid erosion).
