March 24 2005 4 NAR 2 & 2005 Mr. Carl Peterson Wak ForestlNC 27587 eet COAS -AV MANAGEMENT RE: EXEMPTED PROJECT (MINOR) STRUCTURAL ASSESSORY (15A NCAC 07K.0207) (752 NEW RIVER INLET ROAD) I have reviewed the information submitted to this office in your inquiry concerning the necessity of filing an application for a minor development permit under the Coastal Area Management Act. The activity you propose is exempt from needing a minor development permit as long as it meets the conditions specified below. If your plans should change and your project will no longer meet those conditions please contact me before proceeding. This exemption is for the extension of the current crosswalks. Structural Access way Exempted 1. The access way must not exceed six feet in width and must be for private residential or for public access to an ocean beach. 2. The sitting area must be located behind the crest of the dune and the first line of vegetation. 3. The access way must be constructed so as to make no alterations to the frontal dunes that are not necessary to construct the accessway. This means that wherever possible the accessway must be constructed over the frontal dune without any alteration of the dunes. In no case shall the dune be altered so as to significantly diminish its capacity as a protective barrier against flooding and erosion. Driving of pilings into the dune shall not be considered alteration of a frontal dune for the purposes of this Rule. 4. The accessway shall conform to any applicable local or state building code standards. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal, or Local authorization. This exemption expires 90 days from date of issuance.
