Hey, Courtney & Tara,
I apologize for the major delay here. I hate to slow your process and ours - we have been nuts over here.
I sent these Engineered scale drawings previously - please confirm if they are or are NOT effective or sufficient.
It's great news about the minor modification to the current Major permit. Everything stated below makes sense to us.
After this delay on our end, faster is definitely better.
We just got our septic permit and our Stromwater permit should be submitted any day now. I am checking with RSD
about that as we speak.

Hey Maggie,
JAN 0 2 2019
Were you able to get the drawings in a format that we can print to scale on 11x17? DCM-MHD CITY
I was looking through the permit request, and since there is an active major permit and no development proposed
within 30' of normal high water we can process this as a minor mod to the existing permit. Since the permit expires on
12/31/18, we can also renew the permit for a period of two years (12/31/20).
Since you've already submitted a check for $250, we can use $100 of that for the minor mod fee and $100 for the
renewal fee, and issue you a refund of $50.Once I receive all the materials I should be able to process everything. -
Also, have you already submitted a stormwater plan, and if so have they assigned a # to the project? I will need that
number or the letter they sent you.
Thanks!

Hey, Tara,
We have no plans for a walkway to the dock. See the engineers scaled site plan attached in 1-10... will that be sufficient?
Also, what do you mean by AEC will probably be off -site? I was going through our surveying and looking online and I
cannot place our AEC in my mind on this site plan. Anymore insight on this?

and Land Use -
The following are my objections, concerns and comments per the Adjacent Riparian Property Owner
Statement on 8112 Bald Eagle Lane, Wilmington, NC.
I will send a signed, hard copy of this email along with the building plans which were provided for our
review to you via USPS on Monday, December 10, 2018. The plans should be helpful in your review.
In general, we authorize no encroachment or variances from standards and zoning requirements.
Objections:
1. The "pool equipment located near the "Master Bedroom" appears to encroach into the 15-foot side
setback from the property line.
2. The "pool fence" (also called "4'6" double fence) extends into the 30-foot setback from the
Intercoastal. Since this is integral to the house design, I believe this is prohibited. It would also block
the view from the house we plan to build.
Concerns:
1. 1 am concerned about the amount of runoff from rain as I believe fill was added to the lot making it
slightly higher in elevation than our lot. It is also noted that the view from Google Earth appears to
show some erosion on the Intercoastal side of the lot. Of course, this is just a snapshot in time.
I was pleased to see that the architect/surveyor provided the evaluation of rain water
runoff/impervious calculations, however the lot area is about 100 ft X 200 ft = 20,000 sq ft, not 35,442
sq ft. 25 percent of which would be 5,000, sq ft, whereas the "Total Impervious" is listed as 5375 sq
ft.
2. 1 was planning to object that this construction challenges the Section 51 R20S zoning statement
that this is for "low density single-family residential purposes", but I believe the ship has already
sailed on that overly general "requirement" based on many of the other properties along Bald Eagle
Lane.
The house as designed meets the requirement for a single-family dwelling and may be confirmed by
"as -built" verification of design versus the completed structure by the building inspection personnel
and confirmed periodically by the tax assessor's periodic inspection and well -managed building
permitting codes. For example, the addition of a bathroom to the "fitness studio" might challenge the
"single-family" classification as would installing partitions in the main structure.
an tit
We were pleased to see that there has been no attempt to create a housing cluster (Condominiums)
with the water front lots used as recreational access points.
Questions:
1. 1 do have a question concerning the nomenclature of the "front' and 'Year" of the lots. I have lived
on waterfront properties for a large portion of my life (Florida, Alabama, and North Carolina). It was
always stated that the front of the property faced the water front, which was, of course, where the
value of the property resided. This seems to be reversed on the provided drawings.

Tara,
I hope this finds you doing well. I apologize for the delay. We have been moving into a new office, and
things have just been crazy here.
Can you please confirm the items we need updated/confirmed for this submission?
• drawing showing the 575 ft. AEC distance from NHW and impervious calculations within that
AEC
• provide the elevation above NHW
• put a scale bar on the drawing
• scaled drawing you submit also includes any walkways that may be proposed between the
house and docking facility and the fill elevations - Will the fill that is being brought in require the
bulkhead cap to be raised?
I have also put some markups on our siteplan to represent these items. Let me know at your earliest
convenience!
Many Thanks!!

To: Courtney Spears, Division of Coastal Management CC: New Hanover County Planning/Zoning and Land
Use
The following are my objections, concerns and comments per the Adjacent Riparian Property Owner
Statement on 8112 Bald Eagle Lane, Wilmington, NC.
I will send a signed, hard copy of this email along with the building plans which were provided for our review to
you via USPS on Monday, December 10, 2018. The plans should be helpful in your review.
In general, we authorize no encroachment or variances from standards and zoning requirements.
Objections:
1. The "pool equipment" located near the "Master Bedroom" appears to encroach into the 15-foot side setback
from the property line. We allow pool equipment, hvac equipment to encroach as long as the equipment is on
grade vs. platforms.
2. The "pool fence" (also called "4'6" double fence) extends into the 30-foot setback from the
Intercoastal. Since this is integral to the house design, I believe this is prohibited. It would also block the view
from the house we plan to build. The fencing does not appear to encroach into the 30' CAMA buffer, though I
may need a better/bigger site plan to verify. Additionally, NHC Zoning Ordinance does not view fencing as
structures. RECEIVED
Concerns:
JAN 0 2 2019
DCM-MHD CITY
I am concerned about the amount of runoff from rain as I believe fill was added to the lot making it
slightly higher in elevation than our lot. It is also noted that the view from Google Earth appears to
show some erosion on the Intercoastal side of the lot. Of course, this is just a snapshot in time. I
understand your concern about fill and additional runoff; however, most all of the lot is outside of the
SFHA (floodplain) and as such cannot limit the amount of fill brought in. Once the process of
construction has begun you can address the runoff concerns with our engineering department
(910.798.7139).
I was pleased to see that the architect/surveyor provided the evaluation of rain water runoff/impervious
calculations, however the lot area is about 100 ft X 200 ft = 20,000 sq ft, not 35,442 sq ft. 25 percent of which
would be 5,000 sq ft, whereas the 'Total Impervious" is listed as 5375 sq ft. New Hanover County Tax records
list the size of the lot at .55 acres equaling 23,958 sq. ft. for an allowance of 5,989 impervious
coverage. Would appear there's a discrepancy with the 35,442 ... not sure where that number came from.
2. 1 was planning to object that this construction challenges the Section 51 R20S zoning statement that this is
for "low density single-family residential purposes", but I believe the ship has already sailed on that overly
general "requirement" based on many of the other properties along Bald Eagle Lane.
The house as designed meets the requirement for a single-family dwelling and may be confirmed by "as -built"
verification of design versus the completed structure by the building inspection personnel and confirmed
periodically by the tax assessor's periodic inspection and well -managed building permitting codes. For
example, the addition of a bathroom to the "fitness studio" might challenge the "single-family" classification as
would installing partitions in the main structure. R20s Zoning requires 20,000 sq. ft. per dwelling. We
determine structures to be dwellings if both a dedicated bedroom and hardwired cooking facilities are
present. In this case, a bathroom would be permitted in the fitness studio.
We were pleased to see that there has been no attempt to create a housing cluster (Condominiums) with the
water front lots used as recreational access points.
Questions:
1. 1 do have a question concerning the nomenclature of the "front' and 'Year" of the lots. I have lived on
waterfront properties for a large portion of my life (Florida, Alabama, and North Carolina). It was always stated
that the front of the property faced the water front, which was, of course, where the value of the property
resided. This seems to be reversed on the provided drawings.
NHC Zoning ordinance defines lot frontage as: The front, of a lot shall be construed to be that portion abutting a
street, including the side dimension on a corner lot.

Per our phone conversation of 12/18/18, 1 have amended and attached the Adjacent Riparian
Property Owner Statement to show that we have no objections to the proposal to build a house on the
adjacent lot. Your assurances are sufficient that there are no in -water excavation or fill activities, that
the marking of the form DCM MP-2 box on page 4 of the DCM MP-1 form was not required and that
soil activities for the adjacent lot are generally associated with lot grading.
It is also gratifying to know that silt fences will be installed during the project.
Thank you again for your assistance and your patience.

Good afternoon Mr. Johnson,
Just to follow up on our phone conversation this afternoon, the Rowlett/Norton proposal does not
include any in -water excavation or fill. The only proposed fill/disturbance proposed is on the high
ground as stated on form MP-3. Also, we discussed that should you withdraw your objection, you may
initial the existing form as such and send via fax to this office at 910-395-3964. Please feel free to reach

The existing Adjacent Riparian Property Owner Statement that I provided to you in my
letter of 12/9/18 is still valid. To the objections, concerns and comments that I provided
previously, I would like to add the following items to a review which has been
unnecessarily long, inefficient and complicated:
The contractor did not include the permits as stated in their cover letter. This was
pertinent information. I wasted
time reviewing a house design looking for any specific information. All that was
available was generic house
building information and one specific item on impervious surface calculation.
There was no summary of the scope of the project and there still isn't.
When it was identified by you that my comments were mostly specific to zoning, I
began looking to determine if
something was missing. I identified that the permits had not been provided. The
permits were sent to me
yesterday via email, BUT one permit was missing, the Form DCM MP-2
"Excavation and Fill". I can not complete
the review without this information. (I did work around the problem with the quality
of forms by accessing the
website for readable quality forms.)
Despite being provided with an email copy of my Adjacent Riparian Property
Owner Statement with the pertinent
sections concerning objections and the 15' setback requirement whited out, we still
have objections to the
proposal as noted above AND we DO NOT wish to waive the 15' setback
requirement. This stands until the
necessary information to complete the review is provided. The setback
requirement remains regardless of RECEIVED
whether the objections are resolved or not.

I would also recommend that in the future a single sheet checklist be provided when
reviews are indicated. A summary of the proposed project should be provided as well
as listing all the permits/forms required and when/if an on -site inspection is
3
planned. Everything one would need to perform the review:..... and all legible and
compete.
I still do not know the scope of this project. I would like to do so.

Ms Spears,
I have a couple of problems.
The first is a reminder that I don't have the capability to provide an on-line
signature. Might it be acceptable if I send you a FAX?
The second is that the MP-1 form references construction of a house and
a pool ...... and provides for fill. The fill permit is MP-2 and is not
included. Therefore I can not review the whole package nor can I commit
to completing the review by next Friday, 12/21/18.
It was my impression that some fill work had already been performed. I
may not be correct as I have nothing in writing to that supposition. (On
Google Maps, I can see what appears to be silt fences near the water on
two of the three lots south of mine, but I have no idea when the satellite
imagery was performed.) You might want to send someone out there to
determine whether this is the case or not. You could also talk to Mr
Caudle who is my neighbor to the north of my lot (8120 Bald Eagle Lane).
In the meantime, I will be reviewing the information that you have
provided.

Thank you again for your kind assistance in putting up with
my uninformed questions and concerns. Knowing. how and
what your CAMA reviews ate focused on helps me a
lot. Also, having another electronic copy of the prints,
especially one that works, should be very helpful.
However, if you haven't thrown away the paper copy of the
house building prints, I would appreciate it if you could return
them to me. Having something concrete might be an
advantage in the future versus having it on an ephemeral
media such as email.
I will await the copy of the permit and any decision by your

The following are my objections, concerns and comments per the Adjacent Riparian Property Owner
Statement on 8112 Bald Eagle Lane, Wilmington, NC.
I will send a signed, hard copy of this email along with the building plans which were provided for our
review to you via USPS on Monday, December 10, 2018. The plans should be helpful in your review.
In general, we authorize no encroachment or variances from standards and zoning requirements.
Objections:
1. The "pool equipment" located near the "Master Bedroom" appears to encroach into the 15-foot side
setback from the property line.
2. The "pool fence" (also called "4'6" double fence) extends into the 30-foot setback from the
Intercoastal. Since this is integral to the house design, I believe this is prohibitedfy)g,5lso block
the view from the house we plan to build. .
Concerns:
JAN 022019
t MHD CITY
1. I am concerned about the amount of runoff from rain as I believe fill was adce o the lot making it
slightly higher in elevation than our lot. It is also noted that the view from Google Earth appears to
show some erosion on the Intercoastal side of the lot. Of course, this is just a snapshot in time.
I was pleased to see that the architect/surveyor provided the evaluation of rain water
runoff/impervious calculations, however the lot area is about 100 ft X 200 ft = 20,000 sq ft, not 35,442
sq ft. 25 percent of which would be 5,000 sq ft, whereas the "Total Impervious" is listed as 5375 sq
ft.
2. 1 was planning to object that this construction challenges the Section 51 R20S zoning statement
that this is for "low density single-family residential purposes", but I believe the ship has already
sailed on that overly general "requirement" based on many of the other properties along Bald Eagle
Lane.
The house as designed meets the requirement for a single-family dwelling and may be confirmed by
"as -built" verification of design versus the completed structure by the building inspection personnel
and confirmed periodically by the tax assessor's periodic inspection and well -managed building
permitting codes. For example, the addition of a bathroom to the "fitness studio" might Qjwvaq the
DCM WILMINGTON, NC

"single-family" classification as would installing partitions in the main structure. IOP
We were pleased to see that there has been no attempt to create a housing cluster (Condominiums)
with the water front lots used as recreational access points.
Questions:
1. 1 do have a question concerning the nomenclature of the "front" and "rear" of the lots. I have lived
on waterfront properties for a large portion of my life (Florida, Alabama, and North Carolina). It was
always stated that the front of the property faced the water front, which was, of course, where the
value of the property resided. This seems to be reversed on the provided drawings.

On January 1, 2017, we renewed general permit No. 197800056, (copy enclosed), that
