This permit, issued on December 2, 2019 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
>f these terms may be subject to fines, imprisonment or civil action; or may cause the permit to De nuu ana voia.
Offshore Breakwater Sill
1) The offshore breakwater sill shall be constructed in accordance with the alignment depicted on the
attached workplan drawings.
2) The alignment of the authorized offshore breakwater sill shall be staked by the permittee and verified
by a representative of the Division of Coastal Management within a maximum of 30 days prior to the
start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by
adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by
DCM within a maximum of 30 days prior to the new expected start of construction.
3) The offshore breakwater sill shall be solid and constructed of treated wood, concrete slabs, metal or
vinyl sheet piles, or other suitable materials approved by Division personnel.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2022
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) No vegetated wetlands shall be excavated or filled, even temporarily.
5) No open water shall be excavated or filled, even temporarily, outside of the approved offshore
breakwater sill alignment.
6) The permittee is advised that submerged aquatic vegetation (SAV) habitat exists in close proximity to
the authorized project. All available precautions shall be utilized to ensure that damage to SAV habitat
does not result from the construction of the authorized offshore breakwater sills. The offshore
breakwater sills shall be located in areas with no SAV coverage at the time of construction, to the
greatest extent practicable.
7) The height of the permitted offshore breakwater sills shall not exceed one foot above the normal water
level.
8) The offshore'breakwater sills shall be constructed with an equal gap between each sheathing board
totaling at least one inch of open area for every linear foot of breakwater. The offshore breakwater sills
shall have at least one, five foot opening at every 100 feet. The offshore breakwater sill sections may be
staggered and overlap as long as the five foot separation between sections is maintained. Overlapping
sections shall not overlap more than 10 feet.
9) Offshore breakwater sills shall be marked at 50 foot intervals with yellow reflectors extending at least
three feet above the normal water level.
10) The permittee shall maintain the offshore breakwater sills in good condition and in conformance with
the terms and conditions of this permit or the remaining breakwater structure shall be removed within 90
days of notification from the Division of Coastal Management.
11) In accordance with commitments made by the permittee, the Estuarine Waters located between the
offshore breakwater sill sections and the existing Coastal Wetlands shall be planted with native Coastal
Wetland species, all expressly and specifically detailed in the attached narrative and workplan drawings.
This Coastal Wetland planting area shall be monitored, and replanted as necessary, for a minimum
period of 5 years after the first planting event, or until the Division of Coastal Management has notified
the permittee in writing that the planting efforts has been deemed successful. Documentation of the
monitoring results shall be provided annually to the Division of Coastal Management. If, after 5 years,
the Division of Coastal Management determines the plantings unsuccessful, remediation of the planting
area or removal of the breakwater structures may be required.
12) No backfill of the offshore breakwater sills is authorized by this permit.
Shoreline Stabilization - Bulkhead
13) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan
drawings.
14) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead
alignment.

16) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start of
construction.
17) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles,
or other suitable materials approved by Division personnel.
18) The bulkhead shall be constructed prior to any backfilling activities.
19) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
20) The fill material shall be clean and free of any pollutants except in trace quantities.
21) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
22) No backfill material is to be placed within 30 feet of the normal water line, except that which will be
used to backfill the area behind the permitted bulkhead.
23) A turbidity curtain shall be left between the area to be excavated and the existing waterbody and a 24-
hour period after completion of excavation shall elapse prior to turbidity screen removal to prevent
unnecessary siltation into the adjacent water body.
Culvert and Causeway
24) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, including culvert installation and
causeway repair, all as expressly and specifically set forth in the attached permit application and
workplan drawings.
25) The culverts shall be placed into the ground at minimum of 1 foot below substrate to allow for the
unrestricted passage of water and wildlife.
Sedimentation and Erosion Control
26) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes. For the authorized bulkhead, at a minimum, a silt fence shall be properly
installed immediately landward of the bulkhead cap immediately following completion of backfilling
activities.

27) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

General
28) If the crossing of wetlands with mechanized construction equipment is necessary, temporary
construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed
immediately upon completion of construction.
29) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
30) The permittee shall maintain the authorized .work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
31) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
32) This Major Modification shall be attached to the original Permit No. 107-15, which was issued to the
permittee on 9/30/15, as well as all subsequent renewals and modifications, and copies of all documents
must be readily available on site when Division personnel inspect the project for compliance.
33) All conditions and stipulations of the active permit remain in force, under this Major Modification,
unless specifically altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2019-01758).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2019-1225.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

National Audubon Society Major Modification to MP#107-15 Recommendations
The applicant proposes to construct 422 linear feet of sheetpile sills with marsh plantings for a
living shoreline project, replace bulkheading and three existing culverts along an existing gravel
two -track and then do road maintenance to the gravel surfaces of the two -track and
parking/tumaround area.
The site of the proposed development is located at 305 Audubon Drive, Corolla, Currituck
County (t2.25 miles north of the Dare County line), adjacent to the Currituck Sound.
The development proposal involves the Public Trust Area (PTA), Estuarine Waters (EW), and
Estuarine Shoreline (ES) Areas of Environmental Concern (AEC's).
I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this
project and my findings are as follows:
15A NCAC 07K 0208 Use Standards
Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are
not water dependent within the EW and PTA and lists uses that may be considered water
dependent.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2XA) states that the location, design, and need for development, as well as the
construction activities involved shall be consistent with the management objective of the
Estuarine and Ocean System AEC and shall be sited and designed to avoid significant adverse
impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds,

submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning
and nursery areas.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(B) states that development shall comply with state and federal water and air
quality standards.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(C) states that development shall not cause irreversible damage to dl
archaeological or historic resources as identified by the N.C. Department of Cultural a ED
Consistent: The proposed development is consistent with the intent of this rule. S E P 13 2019
Paragraph (a)(2)(D) states that development shall not increase siltation. UCM-MHD CITY
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(E) states that development shall not create stagnant water bodies.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(F) states that development shall be timed to avoid significant adverse impacts
on life cycles of estuarine and ocean resources.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(G) states that development shall not jeopardize the use of the waters for
navigation or for other public trust rights in public trust areas including estuarine waters.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (b) addresses Specific Use Standards. Of these, subparagraph (7) Bulkheads pertains
to this project, and those subparagraphs not listed are not applicable to this project.
Paragraph (7) Bulkheads
Subparagraph (7)(A) states, 'Bulkhead alignment, for the purpose of shoreline stabilization, shall
approximate the location of normal high water or normal water level."
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (7)(B) states, "Bulkheads shall be constructed landward of coastal wetlands in
order to avoid significant adverse impacts to the resources."
Consistent: The proposed development is consistent with the intent of this rule.

Subparagraph (7)(C) states, 'Bulkhead backfill material shall be obtained from an upland source
approved by the Division of Coastal Management pursuant to this Section, or if the bulkhead is a
part of a permitted project involving excavation from a non -upland source, the material so
obtained may be contained behind the bulkhead."
Consistent: The applicants have indicated that clean fill will be used.
Subparagraph (7)(D) states, `Bulkheads shall be permitted below normal high water or normal
water level only when the following standards are met:
(i) the property to be bulkheaded has an identifiable erosion problem, whether it results from
natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g. steep
grade bank, which will cause the applicant unreasonable hardship under the other provisions of
this Rule;
(ii) the bulkhead alignment extends no further below normal high water or normal water level
than necessary to allow recovery of the area eroded in the year prior to the date of application, to
align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the
unusual geographic or geologic features;

(iii) the bulkhead alignment will not adversely impact public trust rights or the property of

(iv) the need for a bulkhead below normal high water or normal water level is documented
by the Division of Coastal Management; DCM-MHD CITY
(v) the property to be bulkheaded is in a nonoceanfront area
Consistent: The proposed development approximates NWL; however, the rive standards
listed can be met at the proposed bulkhead location.
15A NCAC 07H.0209 Coastal Shorelines
(c) Management Objective. The management objective is to ensure that shoreline development
is compatible with the dynamic nature of coastal shorelines as well as the values and the
management objectives of the estuarine and ocean system. Other objectives are to conserve and
manage the important natural features of the estuarine and ocean system so as to safeguard and
perpetuate their biological, social, aesthetic, and economic values; to coordinate and establish a
management system capable of conserving and utilizing these shorelines so as to maximize their
benefits to the estuarine and ocean system and the people of North Carolina.
Consistent: The proposed development is consistent with the intent of this rule.
(d) Use Standards. Acceptable uses shall be those consistent with the management objectives in
Paragraph (c) of this Rule. These uses shall be limited to those types of development activities
that will not be detrimental to the public trust rights and the biological and physical functions of
the estuarine and ocean system. Every effort shall be made by the permit applicant to avoid,
mitigate or reduce adverse impacts of development to estuarine and coastal systems through the

planning and design of the development project. In every instance, the particular location, use,
and design characteristics shall comply with the general use and specific use standards for
coastal shorelines, and where applicable, the general use and specific use standards for coastal
wetlands, estuarine waters, and public trust areas described in Rule .0208 of this Section.
Development shall be compatible with the following standards:
(1) All development projects, proposals, and designs shall preserve and not weaken or eliminate
natural barriers to erosion including peat marshland, resistant clay shorelines, and cypress -gum
protective fringe areas adjacent to vulnerable shorelines.
Consistent: The proposed development is consistent with the intent of this rule
(2) All development projects, proposals, and designs shall limit the construction of impervious
surfaces and areas not allowing natural drainage to only so much as is necessary to adequately
service the major purpose or use for which the lot is to be developed. Impervious surfaces shall
not exceed 30 percent of the AEC area of the lot, unless the applicant can effectively
demonstrate, through innovative design, that the protection provided by the design would be
equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas
exceeding the 30 percent impervious surface limitation may be permitted if impervious areas "RECEIVED
not increased and the applicant designs the project to comply with the intent of the rule to the
maximum extent feasible.

Consistent: The proposed development is consistent with the intent of this rule.
DCM-MHD CITY
(3) All development projects, proposals, and designs shall comply with the following mandatory
standards of the North Carolina Sedimentation Pollution Control Act of 1973:
(A) All development projects, proposals, and designs shall provide for a buffer zone along the
margin of the estuarine water which is sufficient to confine visible siltation within 25 percent of
the buffer zone nearest the land disturbing development.
Consistent: The proposed development is consistent with the intent of this rule.
(B) No development project proposal or design shall permit an angle for graded slopes or fill
which is greater than an angle which can be retained by vegetative cover or other erosion -control
devices or structures.
Consistent: The proposed development is consistent with the intent of this rule.
(C) All development projects, proposals, and designs which involve uncovering more than one
acre of land shall plant a ground cover sufficient to restrain erosion within 30 working days of
completion of the grading; provided that this shall not apply to clearing land for the purpose of
forming a reservoir later to be inundated.
Consistent: The proposed development is consistent with the intent of this rule.
(4) Development shall not have a significant adverse impact on estuarine and ocean resources.
Significant adverse impacts include development that would directly or indirectly impair water
quality standards, increase shoreline erosion, alter coastal wetlands or Submerged Aquatic

Vegetation (SAV), deposit spoils waterward of normal water level or normal high water, or
cause degradation of shellfish beds.
Consistent: The proposed development is consistent with the intent of this rule.
(5) Development shall not interfere with existing public rights of access to, or use of, navigable
waters or public resources.
Consistent: The proposed development is consistent with the intent of this rule.
(7) Development shall not cause irreversible damage to valuable, historic architectural or
archaeological resources as documented by the local historic commission or the North Carolina
Department of Cultural Resources.
Consistent: The proposed development is consistent with the intent of this rule.
(8) Established common-law and statutory public rights of access to the public trust lands and
waters in estuarine areas shall not be eliminated or restricted. Development shall not encroach
upon public accessways nor shall it limit the intended use of the accessways.
Consistent: The proposed development is consistent with the intent of this rule.
(10) Within the Coastal Shorelines category (estuarine and public trust shoreline AECs), new
development shall be located a distance of 30 feet landward of the normal water level or normal
high water level, with the exception of the following: RECEIVED
(A) Water -dependent uses as described in Rule 07H .0208(a)(1) of this Section; SEP 13 7 J pq
Consistent: The proposed development is consistent with the intent of this rule.
(G) Grading, excavation and landscaping with no wetland fill except when required by a
permitted shoreline stabilization project. Projects shall not increase stormwater runoff to
adjacent estuarine and public trust waters.
Consistent: The proposed development is consistent with the intent of this rule.
(H) Development over existing impervious surfaces, provided that the existing impervious
surface is not increased.
Consistent: The proposed maintenance of the two -track gravel road and parking/turn
around area is consistent with the intent of this rule
Based on my review of the applicable subsections of the North Carolina Administrative Code,
the permit application and plans, I recommend a Major Modification to MP#107-15 be issued to
the National Audubon Society for the development with the following condition:
1) A turbidity curtain is to be properly installed on both sides of the bulkhead & culvert
replacement area until that portion of the project is complete.

Audubon Society to install a 422 foot long wood and/or vinyl sheet pile sill on the
Currituck Sound; install three (3) 24 foot by 36 inch culverts, a 75 foot section of
bulkhead and a 79 foot section of bulkhead along a waterway that connects to the
sound, and; conduct maintenance on gravel parking. and roadway; on the property
at 300 Audubon Drive, in the community of Corolla, Currituck County.
DATE: October 1, 2019
Consistency Determination: The request is consistent with/not in conflict with the Currituck
County 2006 Core Land Use Plan (LUP) certified by the CRC on
May 18, 2007 as amended through July 2, 2019.
Overview: The 384 acre subject property has over 3 miles of shoreline along the Currituck Sound
and approximately 1,350 linear feet of shoreline along an 8 foot wide man-made canal that
connects to the sound. Based on aerial photography, the property contains 30.3 acres of Section
404 Wetlands, 162.2 acres of Coastal Wetlands, and 161.5 acres of Highground. The highground
is developed with several single-family houses, a hunting lodge, several storage buildings, sheds
and garages. A private asphalt roadway (Audubon Drive) provides access to the property from
Ocean Trail (NC 12) as well as to the subdivision on Clarion Loop. A 180 foot by 95 foot
bulkheaded waterfront Impoundment is located within an area'of Section 404 Wetlands adjacent
to the highground area. The impoundment is connected to a nearby man-made canal via a 6 inch
pipe. The canal is 8 foot wide and 660 foot long and extends from the adjacent waterbody into
the highground area. An elevated 12 foot wide gravel, two -track roadway extends approximately
'/2 mile from the highground area through a large coastal wetland and over a waterway via a
bulkheaded "land bridge' .with bulkhead to the north and south and three (3) 24 foot long 15 inch
culverts,_ to .the shoreline area where improvements include: 160 linear feet of bulkheaded
shoreline; a 4,100 sq. ft. gravel parking/tum around area; a 24 foot by 16 foot storage building
immediately landward of Normal Water Level (NWL) with a 20 foot by 14 foot platform over the
water; a 32 foot by 25 foot building over the water with a 7 foot by 47 foot and 10 foot by 23 foot
"Le -shaped platform; a 14 foot wide concrete boat ramp with a 4 foot wide by 20 foot long courtesy
pier, and; a docking, facility that consists of a 75 foot by 32 foot open water basin surrounded by

234 linear feet of slotted vinyl breakwater constructed under walkways with eight (8) formalized
slips. The docking facility was authorized under CAMA Major Permit #107-15.
The project area for this application consists of shoreline east and south of the docking facility,
the land bridge, and the gravel parking and roadway. The project area is located in Floodzone
AE. There is 525 feet of open water between the project shoreline and marsh islands to the west.
Existing water depths within the project area are less than or equal to 1.5 feet below NWL.
Submerged Aquatic Vegetation (SAV) was not found growing within or adjacent to the project
area, however an SAV survey conducted by Quible and Associates found coverages of 95 to
100% of Widgeon grass growing in depths greater than or equal to 1.5 feet below NWL.
Bulkhead along the land bridge is showing signs of failure and the gravel parking and roadway
have potholes.
Installation of a 422 foot long wood and/or vinyl sheet pile sill on the Currituck Sound; installation
of three (3) 24 foot by 36 inch culverts, a 75 foot section of bulkhead and a 79 foot section of
bulkhead along a waterway that connects to the sound, and; maintenance of gravel parking and
roadway are proposed. The sill will be located waterward of unimproved shoreline located east
and south of the docking facility. The sheet pile sill system will consist of five (5) 72 foot long
sections and a 62 foot long section placed in an alternating "V" shape with 10 feet of overlap and
5 foot gaps between the sills. The sills will have a 1 inch gap per linear foot and will be located
an average of 25 feet and a maximum of 33 feet waterward of NWL. Native coastal wetland plant
species will be installed within a 5,500 sq. ft. area landward of the sills once they are completed.
The three (3) culverts will replace existing culverts at the land bridge and the two (2) bulkhead
sections will replace existing bulkhead north and south of the land bridge. The majority of
bulkhead will be placed within the existing alignment, extend landward of NWL and will be aligned
along the landward side of coastal wetlands along the roadway. Excavated material will be loaded
onto a dump truck and transported to a 30 foot by 20 foot highground area where it will be stored.
The excavated material will eventually be used, along with additional materials, to raise the land
bridge roadway to an elevation of 1 to 2 feet above the existing road grade. Gravel repairs will
occur within the potholes with no expansion.
The waters of the Currituck Sound in this area are classified as SC and Joint waters and are
closed to shellfish taking. A review of potential historic and archaeological sites was not provided.
Anticipated impacts resulting from this project are expected to include: the filling of 40 sq. ft. of
Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC); the disturbance of
422 sq. ft. of Public Trust Area/Estuarine Waters AEC, 1,373 sq. ft. of Estuarine Shoreline AEC,
and 600 sq. ft. of Non -Jurisdictional Mighground Area, and; gravel maintenance on .14 acre of
Estuarine Shoreline AEC.
Basis for Determination:
The site is located within the "Corolla Sub -Area". The project area is designated as "Conservation
Areas" on the Currituck County Future Land.Use Map (FLUM). Areas of E ggr�gr p

As indicated on Page 11-1, "(t)he purpose of the Conservation class is to provide for the long-
term management and protection of significant, limited, or irreplaceable areas. Proper
management is needed to conserve the natural, cultural, recreational, scenic or biologically
productive values of these areas. The Conservation class should be applied to areas that should
not be developed at all (preserved), or if developed, done so in a very limited manner
characterized by careful planning and cautious attention to the conservation of environmental
features."
Definitions of key words are provided on page 9-2. These words include "Encourage: to favor or
foster", "Should: Ought to, if no valid reason not to", and "Support: to shore up, may imply financial
support".

"In approving new developments, Currituck County shall support the
retention or creation of a vegetated buffer area along ESTUARINE
SHORELINES as a simple, effective and low-cost means of preventing
pollutants from entering estuarine waters. Exceptions to this requirement
may include developments involving pre-existing man-made features
such as hardened shorelines, ditches, and canals . .... The County also
supports CAMA use standards for all COASTAL SHORELINES, whether
estuarine or otherwise."

The applicant proposes to construct 4221of sheetpile sills with marsh plantings, replace 154' of bulkhead,
replace three 24' x 15" culverts with 24' x 36" culverts, and overall improve the land bridge and existing
two track road. The sills would be divided into five 72' and one 62' sections., creating alternating "Vs"
with 10' overlaps and 5' gaps between the sills. A 1" gap per, 1' of sill will be incorporated to'minimiZe
flow restriction: Average distance from shore is 25' waterward NWL with a maximum 33'' Native,coastal
wetland species will be planted landward the sill, without fill. The sills are,proposed to protect be.
wetland shoreline near an existing pond that is experiencing shoreline erosion. Water depths in the project
area are.<'-1.5' NWL with no stated SAV in the project area, though a survey indicated 95%-100%
widgeon grass coverage in water depths >_-1.5':NWL. The existing culverts associated with the land
bridge will be replaced with larger diameter culverts to improve flow. Bulkhead replacementof 75' and
79' will be done at the bridge, immedidtely watenvard the existing bulkhead. The land.bridge height will
be elevated and pot holes within the existing road repaired. No new impervious surface is proposed. The
Currituck Sound at this location is classified SC by the Environmental, Management Commission.
The NC.WRC has reviewed the application and does not believe the project itself would have significant
adverse impacts to wildlife resources. "However, details were not present within the.application that
illustrated construction methodologies.!. Shallow depths within the project area as well as the

approach to the project area could be problematic depending on methodology, equipment, and timing. If
the site is approached by barge, hull scraping and prop scouring could adversely impact SAV if water
depths are too shallow to support a loaded barge. Therefore, we request the applicant provide details on
construction methodology to insure adequate measures are in place to minimize impacts to SAV (i.e.
water depths, shallow draft barge) during sill installation, or an April 1 — September 30 moratorium be
placed on the sill installation portion of the project to avoid bottom disturbance and elevated turbidities
during the SAV growing season.

3. During construction of the proposed project, fueling, lubrication and general equipment maintenance
should not take place within 50 feet of a waterbody or wetlands to prevent contamination by fuel and
oils. [15A NCAC 02H .0506 (b)(3) and (c)(3) and 15A NCAC 02B .0200 (3)(f)]
4. The permittee shall report to the Washington Regional Office any noncompliance with this certification,
any violation of stream or wetland standards [15A NCAC 02B .0200] including but not limited to
sediment impacts, and any violation of state regulated riparian buffer rules [15A NCAC 02B
.02001. Information shall be provided orally within 24 hours (or the next business day if a weekend or
holiday) from the time the applicant became aware of the circumstances. A written submission shall
also be provided within 5 business days of the time the applicant becomes aware of the circumstances.
The written submission shall contain a description of the noncompliance, and its causes; the period of
noncompliance, including exact dates and times, if the noncompliance has not been corrected, the
anticipated time compliance is expected to continue; and steps taken or planned to reduce, eliminate,
and prevent reoccurrence of the noncompliance. The Division may waive the written submission
requirement on a case -by -case basis.
5. Turbidity Standards
The Permittee shall adhere to Title 15A NCAC 02B .0220 Tidal Salt Water Quality for SC Waters,
including but not limited to:
(g) pH: shall be normal waters for the waters in the area, which generally shall range between 6.8 and
8.5 except that swamp waters may have a pH as low as 4.3 if it is the result of natural conditions [15A
NCAC 02B .0220(g)]
(I) Turbidity: the turbidity in the receiving waters shall not exceed 25 NTU; if turbidity exceeds this level
due to natural background conditions, the existing turbidity level shall not be increased. Compliance
with this turbidity standard can be met when land management activities employ Best Management
Practices (BMPs) [as defined by Rule .0202 of this Section]. BMPs must be in full compliance with all
specifications governing the proper design, installation, operation and maintenance of such BMPs [15A
NCAC 02B .0220(I).
6. This approval and their conditions are final and binding unless contested. [G.S. 143-215.51
These Certifications can be contested as provided in Articles 3 and 4 of General Statute 150E by filing a written
petition for an administrative hearing to the Office of Administrative Hearings (hereby known as OAH). A petition
form may be obtained from the OAH at htta://www.ncoah.com/ or by calling the OAH Clerk's Office at (919) 431-
3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A petition is
considered filed when the original and one (1) copy along with any applicable OAH filing fee is received in the OAH
during normal office hours (Monday through Friday between 8:00am and 5:00pm, excluding official state holidays).

Dear Mr. Howell:
Reference the application of The National Audubon Society to construct 422 linear feet of
sheetpile sills with marsh planting to create a living shoreline, replace 154 linear feet of bulkhead
and three existing 24' x 15" culverts, and maintain a gravel road and turn -around area, adjacent to
the Currituck sound, at 305 Audubon Drive, in Corolla, Currituck County, North Carolina,.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land -clearing activities shall take place at any time in the construction or

maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
4. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
6. The authorized structure and associated activity must not interfere with the public's
right to free navigation on all navigable waters of the United States. No attempt will be made by
the permittee to prevent the full and free use by the public of all navigable waters at or adjacent
to the authorized work for reason other than safety.
7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the
work authorized by this permit and again upon completion of the work authorized by this permit.
8. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
9. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
10. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not

11. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.
12. In order to protect the endangered West Indian manatee (Trichechus manatus) the Permittee
shall implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all
requirements therein. The guidelines can be found at http://www.fws.gov/nc-
es/mammal/manatee_guidelines.pdf.

shoreline erosion and marsh loss. The daily use of the propertywill continue to be the same; kayak tourss, bird watching, and

Proiect Setting

The site of the proposed development is located at 305 Audubon Drive, Corolla, Currituck
County (±2.25 miles north of the Dare County line), adjacent to the Currituck Sound. This
property was originally known as the Palmer Island Club and then subsequently renamed The
Pine Island Hunt Club. Approximately 30 years ago several parcels totaling ±3,000 acres were
donated to the National Audubon Society. The hunt club continued to operate until 2005 at
which time the Audubon Society took over full management.
All proposed development will take place within the confines of one large parcel
(ID#0128000002A0000) that is ±384 acres in size. Within this parcel is a subdivision known as
Pine Island Estates that is also owned by the Audubon Society. Based on aerial photography,
this parcel contains ±30.3 acres of 404 wetlands, ±162.2 acres of coastal wetlands and ±161.5
acres of highground. Existing man-made features within the highground area include several
single-family dwellings, the 1913 hunting lodge, several storage buildings, sheds, and garages.
A private asphalt roadway (Audubon Dr.) provides access to the property from Ocean Trail
(NC-12) as well as to the subdivision (Clarion Loop).
A ±180'x95' bulkheaded waterfowl impoundment is located within an area of 404-wetlands
adjacent to the highground area. The impoundment is connected to a nearby man-made canal
via a 6" pipe. This canal is ±660'x8' and extends from the adjacent waterbody into the
highground area. The majority of the canal shoreline has been bulkheaded with an exception of
a section adjacent to Coastal Wetlands.
An elevated ±12' wide gravel two -track roadway extends from the highground area, through a
large area of coastal wetlands and over a waterway via a bulkheaded "land bridge" with three
15" culverts, to the shoreline area where a gravel parking/turn around area, boat launch and
docking facility are located. The bulkheading along the land bridge is showing signs of failure.
CAMA Major Permit #107-15 authorized the reconfiguration of this docking facility and all
proposed improvements to the facility have been completed. The facility is comprised of:
• ±160' of bulkheaded shoreline.
• A ±4,100 ft' gravel parking/turn around area.
• A 14' wide concrete boat ramp and a 20'x4' courtesy pier that is located on the west side
of the parking area.
• A ±24'x16' storage building that is located immediately landward of normal water level
(NWL) with a 20'x14' platform over the water on the north side of the parking area.
• A ±32'x25' building over the water with a ±47'x7' and 23'x10' L-shaped platform located
on the south side of the parking area.
• A ±75'x32' open water basin surrounded by ±234' of slotted vinyl breakwater
constructed under walkways.

With the exception of the docking facility, the shoreline of the property is miles in length, natural
and abuts coastal wetlands that are dominantly black needlerush (Juncus roemerianus) and
giant cordgrass (Spartina cynosuroides).
The waters of the Currituck Sound in this area are classified as SC, are considered Joint
Waters and is closed to shellfish taking. There is ±525' of open water between the project
shoreline and marsh islands located to the west of the project site. Existing water depths within
the project area are :51.5' below NWL and the bottom substrate is made up of fine sands and
silts. Submerged Aquatic Vegetation (SAV) was not found growing within or adjacent to the
proposed development area; however, an SAV survey conducted by Quible & Associates found
coverages of 95-100% of Widgeon grass (Ruppia maritima) growing in depths >_1.5' below
NWL.
Development PfopoSal
The applicant proposes to create a living shoreline through the construction of a 422' long
wood and/or vinyl sheetpile sill system that is broken up into five 72' sections and one 62'
section. Each section will be in an alternating V shape, with 10' of overlap and 5' gaps between
the sills. The sills will have a 1" gap per linear foot for water transfer and will average ±25'
waterward of NWL with a maximum of±33'. When complete, a±5,500 ft2 area between the sills
and NWL will be planted with native coastal wetland plant species (no shallow bottom filling is
proposed).
In addition, the applicant proposes to replace the bulkheading and culverts on the land bridge.
The three existing 24'x15" culverts will be excavated out and replaced with three 24'x36"
culverts to improve water flow. This will require that a ±24'x15' area of the land bridge be
excavated to a depth of 4'. A 75' section of bulkhead will be constructed on the north side of
the land bridge and a 79' section of bulkhead will be constructed along the south side of the
land bridge. The majority of this bulkheading will be replaced within the existing alignment with
a 0.5' maximum distance waterward of the alignment. The proposed bulkheading will extend
landward of NWL and will be aligned on the landward side of coastal wetlands along the
roadway. All excavated material will be loaded onto a dump truck and transported to a 30'x20'
highground area near the Lodge where it will be stored until the completion of the bulkheading
and culvert replacements. The excavated material will then be returned and additional material
brought in to raise the land bridge roadway elevation V-2' above the existing roadway grade.
Upon completion of the land bridge, the applicant proposes to conduct maintenance to the
gravel two -track roadway and parking/turn around area. This roadway has developed potholes
in the 2' wide gravel tracks along its length. It was indicated that gravel repairs will only be
added to the existing gravel areas and roadway expansion is not proposed.
Anticipated Impacts
The construction of the breakwater sills along the proposed alignment will result in the
disturbance of ±422 ft' of shallow bottom located in the PTA and EW AEC's.
The construction of the bulkhead along the proposed alignments will result in the filling of
±40 ft' of PTA and EW AEC's with clean fill.

• The replacement of the culverts will require the excavation and temporary relocation of ±50
cubic yards of material within the Estuarine Shoreline AEC.
• The temporary relocation and storage of excavated material will result in the disturbance of
±600 fill of highground area.
• Bulkhead and culvert installation, backfilling and grading will result in ±1,373 ft2 of land
disturbance within the Estuarine Shoreline AEC.
• The proposed culvert and bulkhead replacement will temporarily increase turbidity within the
adjacent waterbody.
• The proposed maintenance of the gravel two -track road and parking/turn around area
encompasses a ±9,587 ft2 area within the Estuarine Shoreline AEC; however, it is estimated
that ±5,940 ft2 of this area is existing impervious gravel area.

October 4111, 2019, Ouible provides the following additional information and detail intended.to address
concerns raised by NC WRC staff. Construction of the breakwater/sill at the'Pine Island Audubon
property will be construct ed,from the shore. All materials and equipment will. be:staged an&stored in
an upland area between the two existing structures adjacent to the project area. Marsh/logging mats
will be utilized.to move equipment and•materials along the shoreline to the project area to avoid and
minimize impacts to the substrate and SAV present. As much work a&possible will be completed
fromdand. A shallow draft pontoon barge with vibrating hammer may be utilized for setting vinyl sheet
piling and timber piles for the breakwaters. No barges or boats with deep draft will be used on this
project due to insufficient water depths and presence of SAV.

The site is a +/- 383.58-acre parcel of land located along the Currituck Sound in Pine Island,
Corolla, North Carolina. The site Is owned by the National Audubon Society Inc. (Audubon)and
all land and wetlands are in conservation (CAMA Plan Sheet 1).
The upland portion of the property is predominantly covered by maritime forest with areas of
maintained grasses and an asphalt and gravel access road. A historic hunting lodge is located
on the property and used by Audubon for housing and operations. Wetlands along the shoreline
contain wax myrtle, groundsel bush, black needle rush, giant cordgrass, bull rush, and cattails.
y°rawt A di troad runs from the existing historic hunting lodge through the marsh to two existing
T tt structures, bulkheading, concrete boat ramp, and docking facility along the shore of the property
zr a (CAMA Plan Sheet 2). The boat house, storage building and associated docks and ramp are
currently used by Audubon for access to the Currituck Sound and what is shown as Baum
Creek on the USGS Topographic Quadrangle. In addition, a local ecotourism company that
offers kayak tours of the marsh islands and waterways of the Currituck Sound uses the access.
A land bridge created by bulkhead with three 15' RCP culverts connections provides access
across the water. to the waterfront facilities. The marsh shoreline for the entire property is
experiencing substantial erosion and loss of emergent wetland shoreline. The shoreline around
the boat house and land bridge are especially threatened and much of the marsh mat is being
undermined resulting in large sections of coastal marsh slumping into the sound and creeks.
Proposed Work
Proposed work requiring a Major Modification to CAMA Major #107-15 includes the construction
of 422 linear feet of Marsh Sill (vertical timber and/or vinyl wall) and accompanying marsh
plantings to create a "Living Shoreline". The Marsh Sill structure will be placed offshore of the
marsh as shown on the attached CAMA Plan Sheet 2 to create a quiescent area for marsh
restoration. Five (5) 72 linear feet long sills and one 62 linear feet sills are proposed. Each
Marsh Sill will be in an alternating V shape, with 10 feet overlaps and five feet gaps as shown
on the attached CAMA Plan Sheet 2. The Marsh Sill will create an area of +/- 5,500 SF for
marsh restoration using native emergent wetlands species.
The sills and marsh restoration are intended to help better protect the property from the
prevailing SW winds and to restore and strengthen the shoreline. In addition, two new
bulkheads are proposed to replace the existing failing bulkheads along the land bridge to help
protect the existing road. As well as replacing the bulkheads Audubon wishes to replace the
existing 15" culverts with three new larger 36" culverts to improve flow within the system. To
accommodate the new bulkhead and culverts, 1 to 2 feet of fill is proposed within an *area of
1,373 SF between the two bulkheads. Maintenance of the existing historic gravel road is also
proposed. No expansion of the road is proposed, only maintenance of existing two track
surfaces and the parking/turnaround area at the exsiitng docking facilities. Roughly a 9,587 SF
area of this road falls within the AEC. All proposed work is shown on the attached CAMA Plan
Sheets 2 and 3.
SAV Findings
A SAV evaluation was conducted by Quible & Associates on July 1st, 2019 reconfirming the
SAV survey completed on August 30th, 2017. SAV surveying consisted of a cursory analysis of
SAV throughout the Site to understand the extent and coverage of SAV. Throughout the area of
review, water depths, substrate types, and SAV identification was performed. A survey grade
GPS RTK Network was used to collect water depths within the area of review. Coverages of 95-

100% Rupia maritime (Widgeon Grass) were found in the 1.5 to 3 feet water depth range with
some occurrence (<5%) of Myriophyllum spicatum (Eurasion Watermilfoil). In the near shore (0
to 1.5 ft range) environment, the substrate is predominately muck and old marsh mat with only
small traces (<5% or less) of SAV present very sporadically. The proposed sills are designed in
shallow water to avoid SAV impacts. An SAV Report is attached as Appendix A.
Need
The shoreline is eroding, and the marsh mat is being undermined which accelerates erosion
and results in the loss of emergent wetlands. The concern is that the marsh will erode, and the
existing "pond" will be connected to "Baum Creek' (Refer to CAMA Plan). Audubon would like
to take steps to strengthen the shoreline and curtail erosion to the maximum extent possible in
the locations as shown on the attached Figures. In addition, the land bridge is beginning to
wash out through and possibly underneath the old existing wooden bulkheads. This area needs
to be addressed before the historically used road becomes unusable.

I. Introduction
The purpose of this report is for Quible & Associates, P.C. (Quible) to provide state and
federal regulatory agencies with a review of a Submerged Aquatic Vegetation (SAV)
study conducted in the Currituck Sound immediately adjacent to and in close proximity of
the subject property (Study Area) located in Pine Island, Corolla in Currituck County.
The Physical Property (Site) is located on the west side NC Highway 12 N on Audubon
Drive in Corolla, NC (Exhibit A Relevant portion of USGS Topographic Quadrangle-
Mossey Islands).
The Study Area shown on the attached CAMA Plan, includes approximately 380 linear
feet of shoreline and extends 150 feet into the Currituck Sound. The August 30th SAV
review was conducted to examine the substrate of shallow waters adjacent to the Site
for the presence or absence of SAV, and to document the conditions that may relate to
SAV habitat. The SAV survey was conducted during the growing season as required by
resource management agencies.
Generally, SAV found in this area of the Currituck Sound prefers lower energy shallow
water areas where significant photic penetration through the water column to the
substrate persists. These species generally go dormant in the winter months as water
temperatures decrease and foliage dissipates.
II. Methodologv
The accompanying base map (CAMA Plan Sheet 2) includes 2016 aerial photography
provided by Currituck County with the study area identified. Water depth surveying was
conducted throughout the Site on August 30th, 2017 and reconfirmed on July 1 st 2019.
Depths were collected using survey -grade GPS using an RTK network. Water depths
are shown as contours on accompanying CAMA Plan and are relative to Normal Water
Level (NWL).
SAV surveying consisted of an in -water review (using mask and snorkel) and analysis of
SAV in the near shore where the proposed work is to occur and adjacent to the project
area. Throughout the area of review, water depths, substrate types, and SAV
identification was performed and general notes were taken about the conditions
observed.
Ill. Findings and Observations
On July 1st, 2019, the winds were light (+/-10 mph from the SW) and wind tide and
precipitation rates resulted in slightly above Normal Water Level (NWL) conditions. This
was evident from biological indicators (barnacles) marsh edge water marks etc...
The creeks and open waters in and around the marsh islands on the Audubon Sanctuary
shoreline are historically SAV habitat. A formal series of transects were not established
due to the obvious presence of SAV; however, in areas immediately adjacent to the
shore (less than -1.0 feet of water) only ripped up SAV that was not rooted was
observed.
All areas of substrate that were greater than 1.5 feet in water depth supported SAV to
some degree on the date of the review. In general, the dominant species found was
Widgeon Grass (constituting 95% of all species observed) and thick beds (95%-100%
coverage on average) were observed in water greater than 1.5 feet below normal water

level. Aerial coverage averaged 45 percent with some beds of Widgeon Grass show
heavy seeding and other beds already beginning to dehisce.
IV. DISCUSSION and CONCLUSION
The findings of this study indicate that the Study Area does currently and is known to
historically support SAV.
The proposed Living Shoreline is sited in shallow waters to avoid adversely impacting
SAV and SAV habitat and promote emergent wetlands regeneration. SAV was not
found to grown in loose organic soils immediately around the boat house and in shallow
water less than 1.0 foot below Normal Water Level on the date of this survey.

The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval to construct 422 linear feet of sheetpile with marsh plantings for a living shoreline
project, replace bulkheading and three existing culverts along an existing gravel two -track and do
road maintenance to the gravel surfaces located at 305 Audubon Drive, Corolla, in Cufrituck
County. It was received complete on September 9, 2019 and appears to be adequate for processing
at this time. The projected deadline for making a decision is November 23, 2019. An additional
75-day review period is provided by law when such time is necessary to complete the review. If
you have not been notified of a final action by the initial deadline stated above, you should consider
the review period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from September 9, 2019, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted
at the property of your proposed development. You should post this notice at a conspicuous point
along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your
property, or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.

Re: Review of Major Permit Application for the National Audubon Society
Dear Mr. Murphy:
The NC Division of Coastal Management hereby acknowledges receipt of your application on
August 16, 2019, for State approval for the development of the referenced project. An initial
screening of the submittal package has been conducted as per 15A NCAC 07J.0203 and
07J.0204. This revealed certain deficiencies, which must be corrected before the application
package can be accepted as complete. To assist you in expediting the permitting process as
much as possible, I am notifying you of these deficiencies immediately so that they can be
quickly corrected to facilitate my detailed review.
Because the deficiencies are easily correctable, I am not returning the original application
package. Please make the needed changes, and submit the appropriate documentation. With
the retained copy of the application, I can commence the detailed review. Please understand
that the subsequent detailed review may reveal additional areas where further information
or documentation is required to demonstrate compliance with the rules directly applicable
to the proposed development. If this occurs, you will be notified of such issues separately.
Our initial screening has identified the following deficiencies:
1. A Cross -Section Drawing must be submitted that:
- Depicts the proposed gravel road repairs. Indicate the road width and the
width of the impervious two -track areas.
2. Regarding the submitted Project Narrative:
■ Please indicate that the existing road is a two track. (i.e. "No expansion of the
road is proposed, only maintenance of the existing impervious two -track
surfaces")
■ Is the parking area/turn-around at the docking facilities included in
maintenance area? Either way, indicate that. REC D

■ In the preliminary review, an SAV survey was submitted as part of the
narrative in which a Figure 2 was referenced. A figure 2 was not submitted and
corrections for this were requested. An updated SAV survey was not
submitted with the recent submittal. Please submit an updated SAV Survey.
■ A potential inconsistency was found within the SAV Findings section of the
narrative and the SAV survey & Site Plan, please clarify.
- The SAV Findings narrative section indicated that SAV coverage was
20-30% in water depths of 2'-3', while near shore coverages were
found to be <5% in 0'-2' of water. However;
- The SAV survey previously submitted (and resubmitted site plans)
indicated that SAV coverage was 95-100% in water depths >1.5' in
depth with no rooted SAV present in water depths 51' in depth.
3. Documentation of Notification of Riparian Property Owners must be provided. When
you receive a signed form of no objection or the signed and dated green card return
receipts, please submit them to our office.
To expedite our response to your permitting request, we will commence the detailed review
of your application for a permit pending the receipt of the additional information requested
above. However, the statutorily provided 75/150 days allowed for review cannot commence
until such time as we have received a complete application package. Once your application
has been accepted as complete, you will receive a separate notification letter.
If it is not possible to render a permit decision within 70 days of the date when your
application is received complete, you may request a meeting with the Director of the Division
of Coastal Management and permit staff to discuss the status of your project. Such a meeting
will be held within five working days from the receipt of your written request and shall
include the property owner, developer, and project designer/consultant.
