County at adjacent to Currituck Sound, 300 Audubon Drive. Corolla , as requested in the permittee's application dated 2/27115 including attached workplan drawings (P-1 thru P-6) dated 3/19/15 (P-I P-3 and P-4) and 9/19/14 (P-2, P-5 and P-6). This permit, issued on September 30, 2015 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Docking Facility 1) This permit authorizes only the reconstructed docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary,.shall become a permanent part of this reconstructed docking facility without permit modification. No non -water dependent uses of structures shall be conducted . on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the reconstructed docking facility. Any sewage discharge at the reconstructed docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee National Audubon Society Permit No.107-15'- Page 2 of 3 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of eight formalized boat slips. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Breakwater 7) The breakwater shall be constructed with an equal gap between each sheathing board totaling at least one inch of open area for every linear foot of breakwater. 8) The permitted breakwater shall be constructed of treated wood, plastic lumber, metal sheet piles or other suitable materials approved by Department personnel. 9) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. Culvert & Canal Fill 10) A silt screen shall be left between the area to be filled and the existing canal and a 24 hour period after completion of canal fill shall elapse prior to silt screen removal to prevent unnecessary siltation into the adjacent water body. Sedimentation & Erosion Control NOTE: An Erosion and Sedimentation Control Plan may be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environmental Quality, Land Quality Section, 943 Washington Square Mall, Washington, NC 27889. 11) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 12) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. Natibnal Audubon Society Permit No.107-15 Page 3 of 3 ADDITIONAL CONDITIONS Upland Development 13) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the buildings, roads, parking, walkways, and sewage treatment, all as expressly and specifically set forth in the attached permit application and work drawings. 14) Renovations to the existing storage building adjacent to the tidal canal shall not result in creation of new impervious surface within the 30 foot Public Trust AEC. General 15) There shall be no temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands. 16) No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding waters outside of the alignment of the fill area indicated on the workplan drawings. 17) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 18) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Programmatic General Permit 198000291 (Action ID No. SAW-2015-01232), which was issued on 09/28/15. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 3900 and assigned the project DWR Project No. 15-0541. NOTE: The N.C. Division of Energy, Mineral, and Land Resources assigned the proposed project permit No. SW7141103. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of $400 was received by DCM for this project. O'Brien, Jr. 201g Sanctuary & Audubon Center Project Narrative The Pine Island Club was first known as the Palmer Island Club, and the original sEEfad was constructed - in 1906. The "Island" was renamed Pine Island and so changed the name ofthe hunting club. The original clubhouse was destroyed by fire in 1913, and the current structure was conceived and built in 1013 through 1914. The +/- 3,000-acre parcel remained an active hunt club until it was donated to the National Audubon Society by Mr. Earl Slick approximately 30 years ago. The hunt club portion remained in active use until the Audubon took over full management in 2005. The Audubon established a Conservation Management Plan to address the myriad anticipated environmental conditions due to the climate change. The plan includes: protection, restoration, and management of the Currituck Sound marshes to promote high quality habitats for birds and other wildlife; maintenance of high quality water to support healthy population of submerged aquatic vegetation, fisheries, birds, and other wildlife; engagement of diverse stakeholders to work towards sustainability of a healthy ecosystem in the Currituck Sound; protection of important bird areas in the region; and development of sustainable habitats for birds and other wildlife in light of projected sea level rise. Parcel/Project Area: Audubon's Pine Island Preserve consists of approximately 2,733 acres of land along the Outers Banks, as well as marsh islands in Currituck Sound and (presumably) some submerged lands. (Acreage total as per legal descriptions compiled in Currituck County GIS). All proposed development is located within the confines of one large parcel (383.58 acres — legal description), as well as the entirety of the small subdivision known as "Pine Island Estates." For the purpose of permitting and calculations, the "Project Area" will be defined as the single large parcel and small subdivision which is impacted by proposed development. For calculation purposes, Areas as in GIS will be used. For the purposes of lot calculations/coverage calculations, etc., wetland limits have been estimated from aerial photography. This is reasonable due to the fact that the regulated area (coverage) will be a small fraction of what is allowed due to the massive size of the property. Project Setting The site of the proposed development is located at 300 Audubon Drive, Corolla, Currituck County (±2.25 miles north of the Dare County line), adjacent to the Currituck Sound. This property was originally known as the Palmer Island Club and then subsequently renamed The Pine Island Hunt Club. Approximately 30 years ago several parcels totaling ±3,000 acres were donated to the National Audubon Society. The hunt club continued to operate until 2005 at which time the Audubon Society took over full management. All proposed development will take place within the confines of one large parcel that is ±354 acres in size. Within this parcel is a subdivision, known as Pine Island Estates that is also owned by the Audubon Society. Based on aerial photography, this parcel contains±30.3 acres of 404 wetlands, ±162.2 acres of coastal wetlands and ±161.5 acres of highground. Existing man-made features within the highground area include several single-family dwellings, the guide quarters, a caretaker's residence, the 1913 hunting lodge, several storage buildings and sheds, two garages, a kennel and several gravel roads. A private asphalt roadway (Audubon Dr.) provides access to the property from Ocean Trail (NC-12) as well as to the subdivision (Clarion Loop). A ±180'x95' bulkheaded waterfowl impoundment is located within an area of 404-wetlands adjacent to the highground area. The impoundment is connected to a nearby man-made canal via a 6" pipe. This canal is ±660'x8' and extends from the adjacent waterbody into the highground area. The majority of the canal shoreline has been bulkheaded with an exception of a section adjacent to Coastal Wetlands. The end of the canal is shallow (<_i'), filled with detritus and ends .4 from a gravel road. On the north side of the gravel road is an area of 404- wetlands that is connected to the canal via a ±25'x12" culvert. A 3' wide footbridge is located ±100' from the end of the canal. National Audubon Society Field Investigation Report Page 3 An elevated gravel roadway extends from the highground area, passing through a large area of coastal wetlands and over a waterway (connected via three culverts), to the shoreline area where a boat launch and docking facility is located. This facility provides 8 wet -slips and is comprised of: • ±160' of bulkheaded shoreline • a ±4,100 ft2 gravel & grass parking/staging area • located on the west side of the parking area is a 14' wide concrete boat ramp and a 20'x4' courtesy pier • on the north side of the parking area is a ±24'x16' storage building (labeled as boat building one) located immediately landward of normal water level (NWL) with a 20'x14' platform over the water • a ±32'x25' building over the water (labeled as boat building two) with a ±47'x7' and 23'x10' L-shaped platform is located on the south side of the parking area • a ±44'x24' open water basin surrounded by ±116' of solid breakwater, a ±5O'x2.5' L- shaped walkway (located on the south side) and an irregularly shaped split level ±400 ft2 L-shaped walkway (located on the NW side) • a ±65'x2' L-shaped walkway that extends to the south from the basin walkway creating additional slip areas With the exception of the docking facility, the shoreline of the property is miles in length, natural and abuts coastal wetlands that are dominantly Juncus roemerianus and Spartina cynosuroides. The waters of the Currituck Sound in this area are classified as SC and are closed to shellfish taking. There is ±465' of open water between the docking facility and marsh islands located to the west of the project site. Existing water depths within the project area range from ±2' to ±3' below NWL and the bottom substrate is made up of fine sands and silts. Widgeon grass (Ruppia maritima) was observed growing within the project area. Development Proposal The applicant proposes to renovate and modify the docking facility as follows: • Remove the existing L-shaped platform associated with boat building two and replace it with a ± 42'x7' and 23'x10' L-shaped platform, • Remove the ±5O'x2.5' L-shaped walkway that makes up the south side of the existing basin. • Remove the ±65'x2' L-shaped walkway located on the south side of the existing basin and replace it with a ±95'x3' U-shaped walkway enlarging the open water basin. • Remove and replace a portion of the irregularly shaped dock (located in the NW corner) and extend it to the south with a ±23'x4' section. • Remove the solid breakwater and construct ±234" of vinyl breakwater under the proposed walkways. The proposed breakwater will have 1" of spacing per linear foot, will have a ±12' gap at the entrance and will encapsulate ±2,725 ft2 of open watepECeiveD • The existing number of slips (8) will remain the same under the proposed mooifications. 1205 c National Audubon Society Field Investigation Report Page 4 Within the existing canal, the applicant proposes to fill a ±50' section at the landward end and replace the existing culvert with a 75'x15" culvert. The existing 3' wide footbridge will be replaced by a 6' wide footbridge. Work proposed within 404-wetland areas includes: • To create a more natural impoundment, the existing bulkhead will be removed, the water area reshaped, the shoreline area sloped and endemic wetland plant species planted. • Two ±65'x6 elevated walkways Proposed work within the highground areas includes: • Demolition and removal of a propane tank, two sheds and a kennel system. • Renovation of the 1913 Lodge, guide quarters, four storage buildings, 3 cottages, a garage, a grease trap and the conversion of a 4-bay garage into an open air/screened pavilion. • Replacement of two existing grape arbors. • New structures to be constructed include a laboratory building, a dining hall, a workshop, pervious parking area, stormwater retention features, new wastewater systems, an earthen berm, 6' wide walkway system comprised of elevated wooden walkways and crushed oyster shells with three elevated viewing platforms. • Upgrade an existing asphalt road for heavy duty fire truck access. • Convert a section of 10' wide gravel roadway to a 20' wide asphalt roadway to accommodate firetruck access. • Convert a k750' section of 10' wide gravel roadway to a 20' wide heavy duty gravel/grasspave roadway covered in soil and grass turf. Anticipated Impacts • The rebuilding and reconfiguring of the docking facility will result in ±87 ft2 of additional shading in the Public Trust Area and Estuarine Waters AEC's. • The rebuilding and reconfiguring of the docking facility will result in the cumulative shading of ±2,461 ft2 in the Public Trust Area and Estuarine Waters AEC's. (Existing cumulative shading = ±2,374 ft2) • The proposed breakwater will result in ±234 ft2 of shallow bottom fill in the Public Trust Area and Estuarine Waters AEC's. • The proposed breakwater system will encapsulate ±2,725 ft2 of the Public Trust Area and Estuarine Waters AEC's, a net increase of ±1,669 W. O'Brien, Jr. Sanctuary & Audubon Center Project Narrative r' 2015 i The Pine Island Club was fast known as the Palmer Island Club, and the original structure was constructed in 1906. The "Island" was renamed Pine Island and so changed the name ofee hunting club. The original clubhouse was destroyed by fire in 1913, and the current structure was conceived and built in 1913 through 1914. The +/- 3,000-acre parcel remained an active hunt club until it was donated to the National Audubon Society by Mr. Earl Slick approximately 30 years ago. The hunt club portion remained in active use until the Audubon took over full management in 2005. The Audubon established a Conservation Management Plan to address the myriad anticipated environmental conditions due to the climate change. The plan includes: • protection, restoration, and management of the Currituck Sound marshes to promote high quality habitats for birds and other wildlife; • maintenance of high quality water to support healthy population of submerged aquatic vegetation, fisheries, birds, and other wildlife; • engagement of diverse stakeholders to work towards sustainability of a healthy ecosystem in the Currituck Sound; • protection of important bird areas in the region; and • development of sustainable habitats for birds and other wildlife in light of projected sea level rise. Parcel/Project Area: Audubon's Pine Island Preserve consists of approximately 2,733 acres of land along the Outers Banks, as well as marsh islands in Currituck Sound and (presumably) some submerged lands. (Acreage total as per legal descriptions compiled in Currituck County GIS). All proposed development is located within the confines of one large parcel (383.58 acres — legal description), as well as the entirety of the small subdivision known as "Pine Island Estates." For the purpose of permitting and calculations, the "Project Area" will be defined as the single large parcel and small subdivision which is impacted by proposed development. For calculation purposes, Areas as in GIS will be used. This is reasonable due to the fact that the regulated area (coverage) will be a small fraction of what is allowed due to the massive size of the property. To conserve and manage the important features of estuarine waters so as to safeguard and perpetuate their biological, social, aesthetic, and economic values; to coordinate and establish a management system capable of conserving and utilizing estuarine waters so as to maximize their benefits to man and the estuarine and ocean system. (d) Use Standards. Suitable land/water uses shall be those consistent with the management objectives in this Rule. Highest priority -of use shall be allocated to the conservation of estuarine waters and their vital components. Second priority of estuarine waters use shall be given to those types of development activities that require water access and use which cannot function elsewhere such as simple access channels; structures to prevent erosion; navigation channels; boat docks, marinas, piers, wharfs, and mooring pilings. In every instance, the particular location, use, and design characteristics shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public trust areas described in Rule 07H.0208. Consistent: The proposed development is consistent with the intent of this rule. 07H.0207 Public Trust Areas (c) Management Objective. To protect public rights for navigation and recreation and to conserve and manage the public trust areas so as to safeguard and perpetuate their biological, economic and aesthetic value. (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. In the absence of overriding public benefit, any use which jeopardizes the capability of the waters to be used by the public for navigation or other public trust rights which the public may be found to have in these areas shall not be allowed. The development of navigational channels or drainage ditches, the use of bulkheads to prevent erosion, and the building of piers, wharfs, or marinas are examples of uses that may be acceptable within public trust areas, provided that such uses shall not be detrimental to the public trust rights and the biological and physical functions of the estuary. Projects which would directly or indirectly block or impair existing navigation channels, increase shoreline erosion, deposit spoils below normal high water, cause adverse water circulation patterns, violate water quality standards, or cause degradation of shellfish waters are considered incompatible with the management policies of public trust areas. In every instance, the particular location, use, and design characteristics shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public trust areas. Paragraph (a)(2)(C) states that development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural Resources. Potentially inconsistent: The proposed breakwater design around the open -water basin may negatively impact water flows; however, it has been designed with a one inch gap for every linear foot of breakwater and is replacing a solid breakwater. Paragraph (a)(2)(F) states that development shall be timed to avoid significant adverse impacts on life cycles of estuarine and ocean resources. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(G) states that development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. Of these, subparagraphs (6) Piers and Docking Facilities and (11) Filling of Canals, Basins and Ditches pertain to this project, and those subparagraphs not listed are not applicable to this project. Paragraph (6) Piers and Docking Facilities Subparagraph (6)(A) states that piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6)(B) states that the total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be 8 square feet per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions do not apply to marinas. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6)(C) states that piers and docking facilities over coastal wetlands shall be no wider than six feet and shall be elevated at least three feet above any coastal wetland substrate as measured from the bottom of the decking. Consistent: No part of the proposed development is within a coastal wetland. Subparagraph (6)(F) states that piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow second story use. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6)(G) states that pier and docking facility length shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length unless necessary to avoid unreasonable interference with navigation or other uses of the waters by the public); Consistent: The proposed development is consistent with the intent of this rule. (ii) not extending into the channel portion of the water body; Consistent: The proposed development is consistent with the intent of this rule. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier -head line. The one-fourth length limitation does not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6)(I) states that piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's areas of riparian access. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (11) Filling of Canals. Basins and Ditches Subparagraph (11)(A) states that the area to be filled was not created by excavating lands which were below the normal high water or normal water level. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (11)(B) states that if the area was created from wetlands, the elevation of the proposed filling does not exceed the elevation of said wetlands so that wetland function will be restored. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (11)(C) states that the filling will not adversely impact any designated primary nursery area, shellfish bed, submerged aquatic vegetation as defined by the WC, coastal wetlands, public trust right or public trust usage. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (11)(D) states that the filling will not adversely affect the value and enjoyment of property of any riparian owner. Consistent: The proposed development is consistent with the intent of this rule. 15A NCAC 07H.0209 Coastal Shorelines (c) Management Objective. Other objectives are to conserve and manage the important natural features of the estuarine and ocean system so as to safeguard and perpetuate their biological, social, aesthetic, and economic values; to coordinate and establish a management system capable of conserving and utilizing these shorelines so as to maximize their benefits to the estuarine and ocean system and the people of North Carolina. Consistent: The proposed development is consistent with the intent of this rule. (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. These uses shall be limited to those types of development activities that will not be detrimental to the public trust rights and the biological and physical functions of the estuarine and ocean system. Every effort shall be made by the permit applicant to avoid, mitigate or reduce adverse impacts of development to estuarine and coastal systems through the planning and design of the development project. In every instance, the particular location, use, and design characteristics shall comply with the general use and specific use standards for coastal shorelines, and where applicable, the general use and specific use standards for coastal wetlands, estuarine waters, and public trust areas described in Rule .0208 of this Section. Development shall be compatible with the following standards: (1) All development projects, proposals, and designs shall preserve and not weaken or eliminate natural barriers to erosion including peat marshland, resistant clay shorelines, and cypress -gum protective fringe areas adjacent to vulnerable shorelines. Consistent: The proposed development is consistent with the intent of this rule. (2) All development projects, proposals, and designs shall limit the construction of impervious surfaces and areas not allowing natural drainage to only so much as is necessary to adequately service the major purpose or use for which the lot is to be developed. Impervious surfaces shall not exceed 30 percent of the AEC area of the lot, unless the applicant can effectively demonstrate, through innovative design, that the protection provided by the design would be equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas exceeding the 30 percent impervious surface limitation may be permitted if impervious areas are not increased and the applicant designs the project to comply with the intent of the rule to the maximum extent feasible. Consistent: The proposed development is consistent with the intent of this rule. (3) All development projects, proposals, and designs shall comply with the following mandatory standards of the North Carolina Sedimentation Pollution Control Act of 1973: (A) All development projects, proposals, and designs shall provide for a buffer zone along the margin of the estuarine water which is sufficient to confine visible siltation within 25 percent of the buffer zone nearest the land disturbing development. (C) All development projects, proposals, and designs which involve uncovering more than one acre of land shall plant a ground cover sufficient to restrain erosion within 30 working days of completion of the grading; provided that this shall not apply to clearing land for the purpose of forming a reservoir later to be inundated. Consistent: The proposed development is consistent with the intent of this rule. (4) Development shall not have a significant adverse impact on estuarine and ocean resources. Significant adverse impacts include development that would directly or indirectly impair water quality standards, increase shoreline erosion, alter coastal wetlands or Submerged Aquatic Vegetation (SAV), deposit spoils waterward of normal water level or normal high water, or cause degradation of shellfish beds. Consistent: The proposed development is consistent with the intent of this rule. (5) Development shall not interfere with existing public rights of access to, or use of, navigable waters or public resources. Consistent: The proposed development is consistent with the intent of this rule. (7) Development shall not cause irreversible damage to valuable, historic architectural or archaeological resources as documented by the local historic commission or the North Carolina Department of Cultural Resources. Consistent: The proposed development 'is consistent with the intent of this rule. (8) Established common-law and statutory public rights of access to the public trust lands and waters in estuarine areas shall not be eliminated or restricted. Development shall not encroach upon public accessways nor shall it limit the intended use of the accessways. Consistent: The proposed development is consistent with the intent of this rule. (10) Within the Coastal Shorelines category (estuarine and public trust shoreline AECs), new development shall be located a distance of 30 feet landward of the normal water level or normal high water level, with the exception of the following: (A)Water-dependent uses as described in Rule 07H .0208(a)(1) of this Section; Consistent: The proposed development is consistent with the intent of this rule. Consistent: The proposed development is consistent with the intent of this rule. 15A NCAC 07H.0602 Pollution of Waters No development shall be allowed in any AEC which would have a substantial likelihood of causing pollution of the waters of the state in which shellfishing is an existing use to the extent that such waters would be officially closed to the taking of shellfish. This rule shall also apply to development adjacent to or within closed shellfish waters when a use attainability study of those waters documents the presence of a significant shellfish resource in an area that could be expected to be opened for shellfishing given reasonable efforts to control the existing sources of pollution. Date: June 2, 2015 Consistency Determination: The request is consistent with/not in conflict with the Currituck County 2006 Core Land Use Plan (LUP) certified by the CRC on May 18, 2007; as amended through June 24, 2009. Overview: The 354 acre subject property has over 3 miles of shoreline along the Currituck Sound and approximately 1,350 linear feet of shoreline along an 8 foot wide man-made canal that connects to the sound. Based on aerial photography, the property contains 30.3 acres of Section 404 Wetlands, 162.2 acres of Coastal Wetlands, and 161.5 acres of Highground. Two (2) project areas are located on the site, one adjacent to the manmade canal and the other along the Currituck Sound. The project areas are connected by an elevated gravel roadway approximately'/ mile long. Project Area 1: Existing site improvements consist of several single-family residential structures, a guide quarters, a caretaker's residence, an historic hunting lodge, several storage buildings and sheds, two (2) garages, a kennel, several gravel roads, a private asphalt drive, on -site wastewater, and a 95 foot by 180 foot bulkheaded waterfowl impoundment. Existing shoreline improvements consist of bulkhead (approximately 1,328 linear feet) along the manmade canal and a 3 foot wide footbridge crossing the canal. The impoundment is connected to the canal through a 6 inch pipe. Section 404 wetlands are connected to the canal via a 12 inch by 25 foot culvert. The gravel road ends approximately 8 feet from the end of the canal. The canal is less than 1 foot deep in the project area. A majority of the project area is located in Floodzone AE, with areas to the north outside of thl�EECEIVED floodzone. "L"-shaped walkway, and a 2 foot by 65 foot "L" shaped walkway. Existing water depths range from 2 to 3 feet below NWL. There is approximately 465 feet of open water between the existing docking facility and marsh islands to the west. The project area is located in Floodzone AE. Improvements are proposed in both project areas. For Project Area 1, improvements to the canal, impoundment, and highground structures are proposed. At the canal, the existing culvert and footbridge will be removed, an 8 foot by 50 foot section of canal at the northern terminus will be filled, and a 15' X 75 foot culvert and 6 foot wide footbridge will be installed. At the impoundment, the existing bulkhead will be removed, the banks reshaped and planted with wetland species, and two (2) 6 foot wide by 65 foot long elevated walkways will be installed. In highground areas, two (2) sheds the kennel, and the wastewater drainfield will be removed; the historic hunting lodge, guide quarters, four (4) storage buildings, and three (3) cottages will be renovated; the garage will be converted into an open air/screened pavilion, a laboratory building, dining hall and workshop will be constructed; a pervious parking area, stormwater retention system, wastewater system with forcemain, earthen berm, 6 foot wide walkway system, and three (3) elevated viewing platforms will be installed; and roadways will be widened to 20 feet to accommodate fire truck access. For Project Area 2, the docking facility will be modified and renovated. Removal of "L"-shaped platforms/walkways and the solid breakwater; installation of a 7 foot by 42 foot and 10 foot by 23 foot "L"-shaped platform, a 3 foot by 95 foot "Ll"-shaped walkway, and a 4 foot by 23 foot dock section, and; construction of 234 feet of vinyl breakwater are proposed. The breakwater will be located under the walkways. The breakwater will have 1 inch of spacing per linear foot and a 12 foot gap at the facility entrance. The existing number of slips will remain. The waters of the Currituck Sound in this area are classified as SC and are closed to shellfish taking. SAV was observed growing in the Project Area 2. Project Area 1 is the site of an historic hunting lodge. A review of archaeological sites was not provided. Anticipated impacts resulting from this project are expected to include: the encapsulation of 2,725 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC); the filling of 624 sq. ft. of Public Trust Area/Estuarine Waters AEC; the shading of 87 sq. ft. of Public Trust Area/Estuarine Waters AEC and 780 sq. ft. of Section 404 Wetlands, and; the disturbance of 1.80 acres of Section 404 Wetlands and 4.27 acres of Highground. Areas of Environmental Concern (AECs) are also designated as "Conservation Areas" as indicated on Page 11-1. As indicated on Page 11-10 for the Corolla Sub -Area, "(t)he policy emphasis of this plan is to allow for predominantly medium density residential development (2 to 3 units per acre) with minimal commercial development arranged in clusters... Development and redevelopment should be capable of being supported by the area's infrastructure and services —particularly drinking water, sewage treatment, road capacity, parking areas, and required fire suppression capabilities." As indicated on Page 11-3, "Areas designated as Full Service are those parts of the county where a broad range of infrastructure and service investments have been provided or will be made available by the public and/or private sectors... With respect to residential development, base development density is contemplated to be 2 units per acre but could be increased to 3-4 units per acre through overlay zoning depending upon services available and the potential impact on the surrounding area... With respect to nonresidential uses, it is essential that the existing community character be preserved..." As indicate on Page 11-1, "(t)he purpose of the Conservation class is to provide for the long- term management and protection of significant, limited, or irreplaceable areas. Proper management is needed to conserve the natural, cultural, recreational, scenic or biologically productive values of these areas. The Conservation class should be applied to areas that should not be developed at all (preserved), or if developed, done so in a very limited manner characterized by careful planning and cautious attention to the conservation of environmental features." The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal, relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910- 3282 at least two weeks prior to beginning work and upon completion of work. 3. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 4. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 5: Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 6. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to preveht the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work authorized by this permit and again upon completion of the work authorized by this permit. 8. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 9. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 10. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 11. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.
