workplan drawings (3), 1 of 3 dated received in the Morehead City Office on 11/6/14 and 2 -3 of 3 dated 10/15/14.
This permit, issued on October 6, 2015 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terns may
oe subject to tines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) Unless specifically altered herein, this permit authorizes the docks, piers, platforms and other
structures and uses located in or over the water that are expressly and specifically set forth in the
permit application. No other structure, whether floating or ;stationary, shall become a permanent part
of this docking facility without permit modification.. No non -water dependent uses of structures shall
be conducted on, in or over public trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2018
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
Waters at dr adjacent to the authorized work.
4) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
5) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
7) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct
view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee
walls are permitted. Lattice is specifically excluded from being used under this authorization.
8) The roof of the covered platform shall not be designed for second story use.
9) This permit authorizes a maximum of (2) formalized boat slips in association with this docking facility.
General
10) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
11) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily, without permit
modification.
12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.

Ms. Christine Cronick, agent for Mr. Rand Nickerson, is requesting transfer of State Permit No. 2-15,
originally issued to Eugene Haley on January 5, 2015, for authorization to construct a private a docking facility.
State Permit No. 2-15 is due to expire on December 31, 2018. At present, no construction has begun on this
project.
On July 29, 2015, Ms. Cronick submitted the transfer request and fee for $100 (check no. 3218).
This office has no objections to the transfer of State Permit No. 2-15. A copy of the deed is included
with this request.

BEGINNING at a concrete monument in the southern right-of-way line of Bradley Creek Point
Road, (60.0 foot right-of-way) said monument being South 63 degrees 28 minutes West 5.0 feet
(chord distance) from the northeastern end of curve #13 as shown on the map of Bradley Creek

the easternmost corner of the tract described in deed to Alston W. Stafford and wife, Katherine
S. Stafford dated October 7, 1971; thence leaving said traverse line North 21 degrees 02
minutes 30 seconds West 281.98 feet to the beginning concrete monument in the said
southern line of Bradley Creek Point Road, said beginning concrete monument also being a
corner of said Stafford tract and being a portion of the property shown on the aforementioned
map of Bradley Creek Point, together with a right-of-way and easement for ingress and egress
over and across all of Bradley Creek Point Road, (a private road) shown on said map. Together
with all right, title and interest of the party of the first part to that land between the low water
line of Wrightsville Sound and the aforementioned traverse line, being bounded on the East by
an extension to the South of the eastern line of the above described tract and on the West by

Through coordination with the North Carolina Division of Coastal Management we have
learned of the request to transfer the Department of Army permit, originally issued to Eugene and
Christine Haley, to you. This permit authorizes the construction of a private docking facility at
317 Bradley Creek Point Road, adjacent to Bradley Creek, in Wilmington, New Hanover County,
North Carolina. Coordinates are: 34.21024-N,-77.82164-W.
The proposal continues to be consistent with the provisions and objectives of general permit
No. 197800056 (enclosed). The permit is hereby transferred. It is understood that all other
conditions of your permit remain applicable and the permit will expire December 31, 2016.
