Wilmington , as requested in the permittee's application dated 12/17/14 (MP-1) and MP-4 dated revised 12/21/15 incl. attached workplan drawings (2), 1 of 2, dated 12/15/15 and 2 of 2 dated 10/18/15. This permit, issued on December 22, 2015 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may ie subject to tines, imprisonment or civil action; or may cause the Docking Facility to be null antl void. 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied REZE/E D throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) SEP 3 0 2016 This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature Jeoffrey Nathan ADDITIONAL CONDITIONS Permit No. 146-15 Page 2 of 3 3) In accordance with commitments made by the permittee, and in order to satisfy concerns related to fisheries resources, stops shall be placed on both the floating dock and the single -pole boat lift at a minimum height of 18" above the bottom substrate to prevent the lift and floating dock from disturbing the bottom substrate. The stops shall remain in place for the life of the docking facility. 4) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 5) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 7) This permit authorizes a maximum of 1 formalized boat slip. The floating dock shall be used for water access only and shall not provide for a boat slip. 8) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 9) No portion of the authorized docking facility shall extend more than one quarter of the width of the water body. Measurements to determine the width of the water body shall be made from the waterward edge of any coastal wetland vegetation which borders the water body. 10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 11) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 12) The roof of the covered platform shall not be designed for second story use. �c G�i` O �016 SEe 3 O G`�`l M`� Jeoffrey Nathan ADDITIONAL CONDITIONS General Permit No.146-15 Page 3 of 3 13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 14) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 15) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2015-01050), which was issued on 5/21/15. NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR- 15-0420. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: An application processing fee of $250 was received by DCM for this project. The applicant proposes to construct a private docking facility that includes a 6' wide 495' access pier over coastal wetlands that terminates in a 20' x 10' platform. An 18' x 6' floating platform and 13' x 13' boat lift are proposed to provide docking for two vessels. Water depths in the locations for the proposed floating dock and boat lift range from -0.5' to 1.5' Normal Low Water (NLW). Hewlett's Creek is designated a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries. These areas have been deemed critical to the life cycle of estuarine fish and shellfish providing habitat needed during larval and juvenile life stages. Hewletts Creek is closed to shellfishing but there is a great deal of shellfish resource within the Creek,.large intertidal oyster beds are prevalent. In addition to providing habitat for fish and other shellfish within the PNA the oysters also provide ecological functions such as filtering sediment and nutrient from the water which can improve downstream water conditions. The project as proposed, specifically the proposed boat lift and floating dock, could cause significant adverse impacts to fish, shellfish and critical habitat. The floating dock could smother shellfish on bottom and will mostly likely be resting on bottom each low tide disturbing the soft bottom habitat. Vessels accessing the boat lift and floating dock, even shallow draft skiffs, are likely to disturb the bottom by prop kick when using the facility at or near low tide. Even though boaters will avoid shellfish beds they habitat is likely to be disturbed by increased used of motorized vessels. Removal of the floating dock and boat lift could allow the proposed to go forward as an observation platform which is unlikely to adversely affect fish and shellfish habitat in the area. Platform = 200 sq. ft. Floating dock =108 sq. ft. Total = 308 sq. ft. Due to the limited amount of water, approximately 0.5' to -1.5' at NLW located on this side of Hewletts Creek as shown in the attached hydrographic survey, there will be potential for bottom disturbance and displacement of the substrate "kicking" byvessel propellers to access the channel of the creek. This office supports the recommendations of the resource agencies, particularly the NC Division of Marine Fisheries, regarding potential impacts to shallow bottom and primary nursery area. Should concerns be expressed over potential impacts from any of the resource agencies, the project could then be found to be inconsistent with NCAC 07H .0208(a)(2), which requires that the location, design and need be consistent with the management objective of the Estuarine System AEC and the project be sited and designed so as to avoid significant adverse impacts upon the productivity and biological integrity of spawning and nursery areas. The construction would provide docking space for the total up to two (2) vessels. It appears that the project is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the %width rule, the eight square foot rule and the pier width rule. The proposed floating dock, platform and boaflift would be located entirely over open water. If the project is determined to be consistent with NCAC 07H .0208(b)(6), it is recommended that any permit issued should include the following conditions: This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the structure without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3. The authorized structure and associated activity must not cause an unacceptable interference with navigation and shall not exceed the established pierhead line. 4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 5. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 6. The pernittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The pernittee is not relieved of this requirement if he abandons the project without having the permit transferred to a third -party. This permit authorizes a maximum of two (2) boat slips. At no time shall more than two (2) vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. The applicant proposes to construct a private docking facility piering out to the approximate '/4 width of the water body. Depths at the proposed two slips range between 0.5' to 1.5' NLW. Hewletts Creek is classified SA by the Environmental Management Commission and is designated a primary nursery area (PNA) by the NC Division of Marine Fisheries. The NC WRC has reviewed the permit application and is concerned with the construction of the two slips and their impact to bottom sediments within the PNA. PNAs are defined as those areas inhabited by the embryonic, larval or juvenile life stages of marine or estuarine fish or crustacean species due to favorable physical, chemical or biological factors. As a designated PNA, the creek provides an important rearing area for this variety of estuarine fishes and invertebrates that need relatively undisturbed habitats. Ingress and egress of vessels to this dock within the shallow depths would create a continued source of chronic sediment disruption and elevated turbidity associated with propeller kicking. Due to this concern, our agency requests the project be allowed to construct the structure as a pier with no designated slips and install a rail system to deter vessel tie-ups. The site is located within the City of Wilmington, New Hanover County. To locate the property heading south from Oleander Drive (NC Highway17), turn left onto Greenville Loop Road and travel west past Bradley Creek Elementary School approximately 1.5 miles. Turn left onto Hollyholm Trace and continue to head southeast until you reach the property of interest, which will be located on the right. The applicant currently maintains a single-family residence on the property, which averages approximately 10'-15' above normal high water (NH" and the approximately 104' of shoreline is currently stabilized by vegetation. Adjacent to the shoreline, there is a border of Coastal Wetlands, approximately 450 feet wide. The marsh vegetation consists of Smooth Cordgrass (Spartina aftemiflora), Black Needle Rush (Juncus roemarianus), Spike Grass (Distichfis spicata), Sea Oxeye (Borrichia fnrtescens), Sea Lavender (Limonium, spp.), Saw Grass (Cladium jamaicense), Three -square (Scirpus, spp.), and Salt Meadow Grass (Spartina patens). Several small shrubs just waterward of the highground includes; Marsh -elder (Iva k0escens), Grounsel-bush (Baccharus halimifolia) complete the transition into the base of the yard. The open water area of Hewletts Creek adjacent to the applicant's property is approximately 180' in width. Waterward of the Coastal Wetlands are several areas of oyster reefs visible in the mud flat at low water within the creek. Based on site visits at this location, the water depth within this area of Hewletts Creek was approximately -0.5' along the waterward edge of the marsh and approximately -2.0'within the channel of Hewletts Creek at normal low water (NLW). The previous property owner (R. Gevinson), obtained State Permit No.102-01 on August 23, 2001 for a private two (2) slip docking facility, which was never constructed and State Permit No.102-01 expired on December 31, 2004. The Wilmington/New Hanover County Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of Hewletts Creek are classified SA by the Division of Water Resources. They are designated as a primary nursery area (PNA) by the N.C. Division of Marine Fisheries and they,are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to construct a private docking facilitywithin Hewletts Creek. The pierwould be approximately 495' in length by 6' in width, which would terminate onto a "T-shaped" uncovered platform, measuring approximately 20' in length by 10' in width located over open water. A floating dock, measuring approximately 18' in length by 6' in width, would be installed on the east side of the platform, to provide a wet slip for one small vessel on the waterward side of the floating dock. The applications states that pilings would be installed on the landward side to prevent dockage. Additionally, a boatlift, measuring approximately 13' in length by 13' in width is proposed on the west side of the T-head platform. The application states that the water depth at the location of the waterward end of the proposed docking structures is -1.5' at NLW. Based on previous site visits for the adjacent riparian properties (Palmetto Pointe Sub., Bain and Sullivan) located adjacent to this property on this side of Hewletts Creek, the NC DCM has determined that the current water depths in the location of the proposed docking structures would range from approximately - 0.5' to -1.5', relative NLW. Further, portions of the proposed structures would also be located adjacent to several areas of oyster reefs that are visible in the mud flat at low water within the creek (See Sheets 1 and 2 of 2 and Project Narrative). 10. ANTICIPATED IMPACTS: The proposed private docking facility would incorporate approximately 1,839 sq. ft. of Public Trust Area and Estuarine Waters and would shade approximately 2,760 sq. ft. of Coastal Wetlands. The proposed structures would extend approximately 45' into a waterbody, which measures approximately 180' across in this location of Hewletts Creek. This distance would conform to the 1/4 width rule. Based on the submitted drawings, the proposed structures would not encroach into the 15' adjacent riparian corridor setback requirement. The construction would provide docking space for a total of two (2) vessels. Due to the limited amount of water, approximately -0.5' to -1.5' at NLW located on this side of Hewletts Creek as shown in the attached photography and drawings, there will be potential for bottom disturbance and displacement of the substrate "kicking" by vessel propellers to access the channel of the creek. Based on this site visit and a previous site visit for the Palmetto Point Sub. CAMA Major Permit application, we observed water depths of -1.0' or less based on normal low water (NLW) along with numerous live oyster beds within the project areas. During both site visits, the NLW boundary (0' contour) was approximately 10' waterward of the existing coastal wetlands. The first photograph was taken this a.m. at 11:30 or so (sorry about the lens cover), and the second photograph was taken in 2011 at low tide for the Palmetto Pt. Sub. application, which both are consistent with site conditions of this area of Hewletts Creek. As stated in the additional information letter sent on 1/13/2015, we will need to update the drawings with the accurate water depths and site conditions.
