State Permit # 121-15 was originally issued on October 26, 2015, for the construction of an offshore living sill, rip rap placement and marine mattress stabilization adjacent to the Cape Fear River at Fort Anderson, near Winnabow, Brunswick County. State Permit was modified on May 1, 2017 authorizing the reconfiguration of 200 linear feet of offshore living sill, the construction of a rip rap revetment and relocation of 50 linear feet of marina mattress. Another modification was issued on May 21, 2018 for additional reconfiguration of the permitted sills. State Permit 121-15 was refined on June 14, 2021 to allow for the change in alignment of "Reef -maker structures in Phase 3B. As the project was divided into phases, Phase 1, 2, 3A have been completed, with 3B currently underway, and the final Phase 4 to begin soon. State Permit # 121-15 is due to expire on December 31, 2022. The current request for modification is clarify the placement of the last section of "Reef -Maker Structures in the section permitted as Phase 3B, and the remaining "Reef -Maker" Structures of Phase 4, as described in your accompanying letter of refinement request and 14 drawings (Sheet 1-12, dated as received by DCM 4127/22, and Originally Permitted Phases (Cover Sheet and Sheet 1 of 34). The section of shoreline for Phase 3B and Phase 4 were originally authorized as Phase 2 in the permitted drawings (See Originally Permitted Phases). The proposed alignment of the "Reef -Makers" in Phase 3b and Phase 4, depicted in sheets 2-5 of 12, continue along a similar alignment as the adjacent constructed features along the -5' MLW contour as originally permitted. Upon review of the information provided, the Division of Coastal Management has determined that the proposed action continues to be consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. I hereby submit this Letter of Refinement authorizing the modification of State Permit No.121.15, as described in your request dated as received by DCM April 27, 2022. By copy of this letter we are notifying the US Army Corps of Engineers and the Division of Water Resources of our action. Please note this refinement does not alleviate the need to obtain any other local, state or federal permits. Dept. of Natural and Cultural Resources, we are requesting a slight modification/Refinement of State Permit #121-15 originally issued on 10/26/15 for shoreline stabilization at the Brunswick Town / Fort Anderson State Historic Site located at 8884 St. Phillip's Road SE, Winnabow, adjacent to the Cape Fear River in Brunswick County. Permit #121-15 was renewed on 12/10/20, received a refinement on 6/22/21 and is due to expire on 12131/22. The permit authorized a phased shoreline stabilization project (for the entire shoreline) consisting of the placement of riprap along the northeastern shoreline and adjacent to Battery "A" as well as the installation of a living shoreline using "Reef -Maker" structures. The project was proposed to be completed as a phased project to be completed as funding became available. Phases 1, 2, 3A have now been completed and Phase 3B is nearing completion and they are now ready to start on Phase 4. This Refinement is being requested to clarify the exact placement and number of "Reef -Maker" structures for Phase 4 as well as the last 9 "Reef -Makers" of Phase 313. It should be noted that the Phase numbers have changed from the originally authorized plan due to funding at the time of construction and I have included the originally authorized site plan showing the original Phase numbers. The current Phase 4 was shown on the original plan drawings as Phase 2. There haven't been any changes to the ownership of the adjacent properties and the project is in compliance with all conditions of the current permit. State Permit No. 121-15 was modified on May 1, 201.7 authorizing the reconfiguration of 200 linear ft. of offshore living sill, the construction of a rip rap revetment and relocation of 50 linear ft. of marina mattress. The action proposed in your submittal consists of the change in alignment of the "Reef-maker'shoreline protection structures. According to the agent, a new shipwreck was discovered along the shoreline within the currently approved alignment. The subject area is located just north of the William Dry Warf and is within Phase 3B and the west end of Phase 3A (see Sheet 5 of 20). Approximately 314 linear ft. of "Reef -maker' shoreline protection structure would be re -aligned approximately 11-12 ft. waterward of the approved location and would taper back on both ends to the existing alignment (see—CS-002 MOD). Upon review of the information provided the Division of Coastal Management has determined that the proposed actions continue to be consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. I hereby submit this Letter of Refinement authorizing the modification of State Permit No.108-17, as described in your request dated March 15, 2021 and revised on March 30, 2021. Please note this refinement does not alleviate the need to obtain any other local, state or federal permits.
