This permit, issued on May 21, 2018 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) Unless specifically altered herein, this Minor Modification authorizes the reconfiguration of the
permitted sills, all as expressly and specifically set forth in the attached permit application and
workplan drawings. Any additional land disturbing activities and/or construction may require a
modification of this permit. Contact a Division of Coastal Management representative at (910) 796-
7215 for this determination.
2) All conditions and stipulations of the active permit remain in force under this Minor Modification,
unless specifically altered herein.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2018
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program

ADDITIONAL CONDITIONS
3) In accordance with commitments made by the permittee, the intermediate flanking protection authorized
under this Minor Modification shall be removed in conjunction with the construction of Phase 3. The
permittee is further advised that any additional deviation from the originally permitted plans may require
further.modification of the permit prior to the initiation of Phase 3.
4) This Minor Modification shall be attached to the original permit, which was issued to the permittee on
10/26/15,.the Minor Modification which was issued on 5/1/17, and copies of all documents shall be readily
available on site when Division personnel inspect the project for compliance.
5) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project Action ID No. SAW-2012-
00739.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR-
15-0672.
NOTE: A minor modification application processing fee of $100 was received by DCM for this project.

Hi Chad,
No excavation- and I don't think there's any fill by your standards- its realigning the reef maker sill structure from the
original proposal. The individual components are disks installed on pilings. Do you need a copy of the mod request?

Mr. Christopher Dustin with North State Engineering, PLLC is requesting a minor
modification to State Permit #121-15 on behalf of the N.C. Department of Natural and Cultural
Resources. State Permit #121-15 was issued on October 26, 2015, authorizing the construction of
an offshore living sill, riprap placement and marine mattress relocation to stabilize the shoreline
adjacent to the Cape Fear River at Fort Anderson, near Winnabow, Brunswick County. State
Permit #121-15 was modified May 1, 2017 authorizing the reconfiguration of 200 linear feet of
offshore living sill, the construction of a riprap wall, and relocation 50 feet of existing mattress.
State Permit #121-15 is due to expire on December 31, 2018.
Mr. Dustin is requesting a modification to State Permit #121-15 to allow for the
construction of "Reef Phase 2" which comprises of approximately 240 feet of additional wave
attenuators. The applicant states that the alignment of the new structures would remain
approximately along the negative 4-foot contour with the last four attenuator units aligned at a 45-
degree angle towards the shore. The purpose of the 45-degree angle would be to protect the
shoreline from flanking. The applicant proposes to use 4 eco-discs from each existing attenuator
to construct the new attenuators and the alignment of the new structures would be congruent with
what is existing (see drawing 3 and 4 of 10, dated 04/10/18). No wetland vegetation planting is
proposed as part of this modification request. The applicant has requested that all proposed
modifications be conducted in Phase 2 of the construction process, due to funding and time
constraints, and the urgent need for protection in those specific areas.

The applicant has submitted a check (check No. 204) in the amount of $100 for the
modification request along with the letters and proof of notification to the adjacent riparian
property owners. As proposed, this office has no objection to the proposed project modification as
long as there are no objections from the other agencies to this proposal. It appears that the project
continues to be CONSISTENT with the use standards set forth in 15A NCAC 07H .0206 and
15A NCAC 07H.0209. This project aims to protect historic resource, which continues to be
CONSISTENT with the general use standard enumerated in 15A NCAC 07H .0208(a)(2)(C).
By copy of this memo, DCM is requesting that the DWR, DMF-Shellfish Section,
DCM-Fisheries Representative, WRC, and US ACOE provide any comment that your
agency may have on the proposed project to Heather Coats of DCM's Wilmington office
within 14 days of receipt of this memo.

Dear Mr. Surgan,
The North Carolina Department of Cultural and Natural Resources would like to request a minor
modification to its existing CAMA Major Permit #121-15 for shoreline stabilization at the Brunswick
Town/Fort Anderson State Historic Site. The primary reason for this request is to utilize existing funds to
further expand our shoreline protection efforts. The modifications requested are an adjustment to the
location of the planned Phase II reef maker sill. A new plan set along with the original plans are included
for reference. The current funds allow us to continue from Phase I which is now complete and emplace
1pproxi 240 feet of additional structur"The alignment will remain approximately along the
negative 4-foot contour with the last four units on a 45 degree angle to serve as an intermediate
flanking protection for the shoreline. Four eco-disks from each reef maker unit of the existing Phase I
structure will be removed and utilized for the construction of Phase II reef maker structure. Phase II will
connect into the existing Phase I structure and the rest of the permitted structure as funding allows. The
North Carolina Department of Natural and Cultural Resources is in continuing discussions with the North
Carolina State Legislature and is optimistic that the approval of additional fund appropriations will be
allocated this year and in future years for construction of the remainder of this project. it is also still the
intent of the North Carolina Department of Natural and Cultural Resources to use this site for research
monitoring and environmental education and outreach to promote the preservation of cultural
resources and the restoration of natural resources.

Dear Mr. Romaine:
Through coordination with the North Carolina Division of Coastal Management, and on
behalf of the North Carolina Department of Cultural and Natural Resources, we have learned of
your request to modify your existing Department of the Army (DA) permit, issued on November
9, 2015. Your recent request involves the construction of "Reef Phase 2," which comprises of
approximately 240' of additional wave attenuators to stabilize the shoreline adjacent to the Cape
Fear River at Fort Anderson, near Winnabow, Brunswick County. Coordinates are:

Your proposal continues to be consistent with the provisions and objectives of general
permit No. 198000291 (copy enclosed). The permit is hereby modified. It is understood that all
other conditions of your permit remain applicable.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization
modified. Your Department of the Army permit will expire on December 31, 2021.
