compliance with the application and site drawing (where consistent with the permit), all applicable
regulations and special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes the construction of a duplex dwelling and driveway installing landscaping as needed located at
308 N Anderson Blvd. , Topsail Beach
(1) All proposed development and associated construction must be done in accordance with the permitted
work plat drawings(s) dated received 11-04-04.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and
Federal regulations. Contact Jimmy Canady Building Inspector/CAMA LPO for applicable local
ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a
re-evaluation and modification of this permit.

This pemnil action may be appealed by the pemhitlee� or other
qualified persons within Twenty (20) days of the issuing date. From
the date of an appeal, any work conducted under this permit most
cease unfit the appeal is resolved.
This permit must be on the project site and amessble to the permit
officer when the project is inspected for compliance.
Any maintenance work or project modification not covered under
this permit, require further writen permit approval.
All work must cease when this permit wares on December 31,
2DD7.
In issuing this permit t is agreed that this project is consistent with
the local Land Use plan and all applicade ordinances.

(4) The stricture must beset back a minimum of 60 feet from the first line of stable natural vegetation,
as determined by the LPO or other assigned agent of the DCM.
(5) The structure must be elevated on pilings with a diameter of at least (8) inches and the first floor level
of the sills and joists must meet the 100-year flood elevation level of 15 feet
(6) All pilings shall have a tip penetration greater than eight (&) feet below the lowest ground elevation
under the structure
(7) No impermeable surfaces shall be allowed over any functional part of the septic tank system.
(8) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently
threatened by changes in shoreline configuration. The structure(s) shall be rekxmfed or dismantled -
within two (2) years of the time when it becomes imminently threatened, and in any case, upon its
collapse or subsidence. However, if natural shoreline recovery or beach re -nourishment takes place
within two (2) years of the time the structure becomes imminently threatened, so that the structure is no
longer imminently threatened, then it need not be relocated or dismantled at that time. This condition
shall not affect the permit holder's right to seek authorization of temporary protective measures allowed
under CRC Reim

This notice is intended to make you, the applicant, aware
of the special risks and conditions associated with
development in this area, which is subject to natural
hazards such as storms, erosion and currents. The rules of
the Coastal Resources Commission require .that you
receive an AEC Hazard Notice and acknowledge that
notice in writing before a permit for, development can be
issued.
The Commission 'srules onbuildingstandards, oceanfront
setbacks and dune alteration are designed to m imm i ze, bu t
not eliminate, property loss from hazards. By granting
permits, the Coastal Resources Commission does not
guarantee the safety of the development and assumes no
liability for future damage to the development.
The best available information, as accepted by the Coastal
Resources Commission; indicates that the annual ocean
eros,t,�n rate for the area where your property is located is
c feet per year.
The rate was established by careful analysis of aerial
photographs of the coastline taken over the past 50 years.
Studies also indicate that the shoreline could move as
much as , l feet landward in a major storm. ,
The floodwaters in a major storm are predicted to be about

Preferred oceanfront protection measures are beach
nourishment and relocation of threatened structures.
Hard erosion control structures such 'as bulkheads,
seawalls, revetments,, groins, jetties and breakwaters are
prohibited. Temporary devices, including sand bags, may
be allowed under certain conditions.
This structure shall be relocated or dismantled within two
years of becoming imminently threatened.
The applicant must acknowledge this information and
requirements by signing this notice in the below space.

SPECIAL NOTE: This hazard notice is required for
development in areas subject to sudden and massive
storms and erosion. Permits is sued for developpment in this
area expire onDecember 31 of the third year following the
year in which the permit was issued. Shortly before work
begins on the project 'site; the L'ocal''Permit Officer will
determine the vegetationline and setback distance at your
site. If theproperty has seenlittle change and theproposed
development can still meet the setback requirement, the
LPO will inform you thatyou may begin work. It is impor-
for official approval to continue the work after the permit
'has expired. Generally, if foundation pilings have been
placed and substantial progress is continuing, permit
renewal may not be necessary. If substantial progress has
not been made, the permit must be renewed and' a new
setback line established. It is unlawful to continue work
after permit expiration without this approval.

BEFORE YOU BUILD
Setting Back for Safety: A Guide to Wise Development Along the Oceanfront
When you build along the oceanfront you take a calculated
risk. Natural forces of water and wind collide with tons of
force, even on calm days. '
Man-made structures cannot be guaranteed to survive the
force of a hurricane. Long-term erosion (or. barrier island
migratioril may take from two to ten feet of the beach each
year and, sooner or later, will threaten oceanfront struc-
tures. These are the facts of life for oceanfronbproperty
owners.
The CoastalResources .Commission (CRC) has, adopted
rules for building along the oceanfront. The rules are in-
tended to avoid anunreasonable risk to life and property
and to limit public and private losses from storms' and
long-term erosion. These rules lessen but do not eliminate
the element of risk in oceanfront development.
As you consider building along the oceanfront, the CRC
wants you to understand the rules and the risks. With this
knowledge you can make a more informed decision about
where and how to build in the coastal area.
The Rules
When you build along the oceanfront, coastal manage-
ment rules require that the structure be sited to fit safely
into the beach environment.
Structures along the oceanfrontmust be behind the frontal
dune, landward of the crest of the primarydune and set
back from the first line of natural stable vegetation a dis-
tance equal to 30 times the annual erosion rate (aminimum
of 60 feet). Large structures (multi-familyresidential struc-
tures greater than 5,000 square feet and non-resideritiai
structures greater than 5,000 square feet) must be set back
-from the first line of natural stable vegetation a -distance
equal to 60 times the annual erosion rate or 120 feet,

whichever is greater. If the erosion rate is greater than 3.5
feet/year, the setback is 30 times the erosion rate plus 105
feet.
The Reasons
The bea'chfront is an ever -changing landform. The beach
and the dunes are natural "shock absorbers taking the
beatings of the winds and waves and protecting the inland
areas. By setting back 30 or 60 times the annual long-term
erosion rate; you have a good chance of enjoying the full
life of the structure. At first; it seems veryinviting to build
your dream house as close to the beach as possible, but in
five, years you could find the dream has become a
nightmare as high tides and storm tides threaten your
investment.
TheException
The Coastal Resources Commission recognized that these
rules, initially passed in June of 1979, might prove a
hardship forsomeproperty owners. Therefore, theyestab-
lished an exceptionfor lots which cannot meet the setback
requirement. The exception allowsbuildingsinfront of the
setback line if the following conditions apply:
(1),the ;lot.must have been platted as of June J,1979, and
notcapabieof being enlarged bycombining with adjoining
land under the same ownership, (2) development must be
as far back on the property as possible and in no case less
than 60 feet landward of the vegetation' line, (3) no
development can take place on the frontal dune (4) special
construction standards on piling depth and square footage
must be met and (5) all other' CAMA, state and local
regulations must be met.
The exception is not available in the Inlet Hazard Area.
To determine eligibility for the exception, the Local Permit
Officer will make these measurements and observations:

As you requested, we visited the above referenced site on May 26, 2006. The
purpose of the site visit was to determine if the existing 20' x 30' conventional
bed system designed for a four bedroom, single-family dwelling, could be
converted into a Puraflo@ peat bio-filter system for a six bedroom (total) duplex.
The system was installed on 5/5/03 under Pender County Permit Number
510562.
During the site visit the system was inspected and measured to determine if it
was installed as per the permit and could be converted to an initial Type A
Puraflo@, and if there was adequate area for a Type A PurafloO repair area. The
system was installed and appears to be as perthe permit. Based on this
information there is approximately 600 square feet of drain field installed. This
would be adequate for a Type A Puraflo@ with a 25 percent reduction in the field
based on Section E.2 of the Innovative Wastewater Systems Approval (IWWS)
Number: IWWS-98-1-R3. The actual reduction is approximately 16 percent
versus the whole 25 percent reduction allowable. Based on conversation with
the Pander County Health Department, Environmental Health Specialists the
system can be utilized by removing the existing cover soil over the drain field
area (by a septic system installer, preferably the installer who originally installed
the system). Once that has been completed, it is recommended that if the level
of the bed is disturbed and cannot be repaired to install the modules as per the
approval specs, then it is recommended that a layer of approved 57 stone be
placed on the field. This should be placed on the bed in an adequate thickness
to allow accurate leveling of the peat modules. Then the modules should be
installed over the existing bed, and backfilled in accordance with the IWWS-98-1-
R3 specifications. The repair area will be designated as a 720 square foot Type
A Puraflo® bed area, in the area originally designated for the repair area on
permit 510562.

In addition to the changes in the field, one 1,500 gallon septic tank, and one
1,500 gallon pump tank will have to be installed and shall maintain a five-foot
separation from all parts of the dwelling. These tanks should be installed at the
eastern edge of the field in the location of the existing septic tank. The tank will
have to either be removed or crushed in place to accommodate the installation of
the two new septic tanks. If these tanks are to be placed in an area subjected to
vehicular traffic then they will be required to be traffic rated.
