Perquimans County eo'17- ADDITIONAL CONDITIONS Boat Ramp Permit # 13-15 Page 2 of 4 2) Unless specifically altered herein, this permit authorizes the construction of the boat ramp, all as indicated on the attached workplan drawings. 3) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. Boat Ramp Access Piers, Vinvl Breakwater, Tie Pilines, and Groin 4) Unless specifically altered herein, this permit authorizes the construction of the floating docks, walkway, vinyl retaining walls, groins, tie pilings, and the other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this public boat ramp facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable water at or adjacent to authorized work. 6) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 7) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structures, including the vinyl groin, in order to make them more visible during hours of darkness or inclement weather. It must be of a size sufficient to prevent its movement from the approved alignment by wave or current action. 13) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite, marl, or broken concrete. Sedimentation and Erosion Control NOTE: An Erosion and Sedimentation Control Plan shall be required for this project. This plan shall be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, Washington Square Mall, Washington, NC 27889 14) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 15) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). General 16) In order to protect anadromous fish, no in -water work shall be permitted between February 15 and June 30 of any year without prior approval from the Division of Coastal Management in coordination with the Wildlife Resources Commission. 17) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 18) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 19) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation. Proposed Hertford Boating Access Area Noy, , o , , CAMA Permit Narrative October2014 NC Wildlife Resources Commission and Perquimans County are in partnership proposing a new public boating access area in Hertford on the Perquimans River. Perquimans County is the site property owner. The proposed site would ultimately be a dual -use facility to serve both the boating public and commercial marine industries. The project site is located adjacent to the planned Perquimans Industrial Marine Park. The project is being proposed as a recreational boat ramp with some larger scale features to accommodate the industrial users as they are established. The proposed project development includes a concrete boat ramp, vinyl walls, floating docks, mooring piles, asphalt parking lot and driveways, restroom building, and a small amount of dredging. The proposed boat ramp will be wide enough for future industrial users and provide 2 launch lanes for recreational users. The last 40' of the boat ramp will be a flat area with mooring piles that will serve Industrial Park users in the future. The ramp will have floating docks and vinyl bulkhead walls parallel to it along both sides. A small amount of dredging beyond the end of the ramp is proposed to tie into the existing -6' contour. This dredging extends a maximum of 10' beyond the end of the proposed ramp and would be less than 20 cubic yards. This ramp would be constructed in the dry using a cofferdam. The cofferdam would provide a working area that provides 5' of clearance outside of the permanent vinyl walls and 10' beyond the end of the proposed ramp. The upland portion of the project will be an asphalt parking lot and driveway. The parking lot will have 25 vehicle -trailer spaces and 5 single car spaces plus adequate ADA parking. The driveway leading directly to the ramp will have an extra wide 36'-wide drive aisle to that the future Industrial traffic can utilities the size to access the ramp. Also proposed as part of the upland development is a restroom building. The restroom building will be a pre -fabricated building and will be ADA-compliant. Utility construction will be necessary for the restrooms. The site will be operated as an NCWRC Public Boating Access Area under a MOA. NCWRC will be responsible for major infrastructure maintenance. Perquimans County will be responsible for daily restroom maintenance. The site will be open to the boating public, free of charge, 24/7. The proposed development will result in the tract have 24.6% impervious surfaces. Perquimans River is class SC at this location. A Low Density Stormwater Permit will also be required and will be applied for simultaneously along with the CAMA Major Permit. The proposed development will result in over 2 acres of area of disturbance. An Erosion & Sediment Control Permit will be required prior to construction. PROJECT SUMMARY: Construct a public boat ramp for recreational and commercial boats, that will include a 43' wide concrete ramp with 8' wide walkways on either side, 8' wide floating docks on the east and west side of the ramp along two vinyl groins. Upland development will include a parking lot for 26 trailer spaces and 6 single car spaces, and an ADA compliant restroom facility. NCWRC Field Investigation Report Page 2 Project Settino The project site is a vacant 4.6 acre (200,925sf) lot located in the Perquimans County Commerce Centre at the end of N. Granby Street (SR 1476), off of Harvey Point Road (SR1336), approximately 3110 of a mile east of US Hwy 17, in Perquimans County. The property has 308 linear feet of shoreline along an 11' bluff on the Perquimans River. The property is currently used as farmland and recently harvested for cotton. The bluff along the river is undisturbed and heavily vegetated with, but is not limited to, american sycamore (Platanus occidentalis), bald cypress (Taxodium distichum), tulip poplar (Liriodendron tulipifera), ash (Fraxinus excelsior), loblloy pine (Pines teada), greenbrier (Smilax rotundifolia), poison ivy (Toxicodendron radicans), pokeweed (Phytolacca americana), spotted spurge (Chamaesyce maculata), and wild grape vine/riverbank grape (Vitis riparia). The shoreline along the property has a sandy substrate that gently slopes to a depth of -6' and drops to a depth of - 20' in a barrow pit excavated for fill during the construction of the NC Hwy 17 Bridge crossing the Perquimans River. There is no submerged aquatic vegetation within or adjacent to the project area. Located to the north of the project site is the Perquimans River, to the south is N. Granby Street and a metal building constructed for ShoreFlyte, a marine sales and service business currently located in Camden County. The property wraps around the west side of the WRC site and also has a boat ramp that has never been completed. Located to the east of the property is the North Carolina Seafood Park Property that received a CAMA Major Permit #15-11, to construct a boat basin and boat ramp for commercial vessels. No work has been undertaken to date at the Seafood Industrial Park. Uses in the area include commercial businesses and recreational uses within the Commerce Center, and the Newbold White House Historical site located less than one mile from the project site. Development Proposal NC Wildlife Resources Commission (NCWRC), in association with Perquimans County, is proposing to construct a public boat access at the end of N. Granby Street within the Perquimans County Commerce Centre, adjacent to the NC Seafood Industrial Park The proposed facility will provide areoncrete ramp 58'-wide, including two 8' wide 40estrian walkways, cut through an 1 V bluff and will include vinyl retaining Orton either side that will extend down to the shoreline. Located at the end of the sloped ramp, along the -5' elevation will be a level 40' x 41' concrete slab poured using a cofferdam system. This area will have six pilings 8' on -center to tie vessels using the ramp. A small area of water bottom will be excavated to a finished depth of -6' at the end of the ramp facility. Spoil resulting from excavation below NWL and excavation of the landward bluff to accommodate the ramp will be stored on the property along the northwest comer of the property. This area will be leveled and vegetated at project completion. The vinyfIROPPINWalls on the east and west sides of the ramp will transition Wns on either side of the ramp and terminate 33' to 44' in the Perquimans River at a depth of -6'. The groins will have 1" per V-0" open, or the equivalent, to allow for flushing and larval transport. The groins as proposed will be 3' above normal water level and have 28" yellow reflective delineators along the walls for safety. To prevent erosion along the outside of the ramp retaining walls 12" Class B riprap will be placed over a filter cloth against the walls and extend a short distance below NWL. On the east side of the ramp the stone will be placed along approximately 80'of the retaining wall, and on the west side of the ramp stone will be placed along f NCWRC Field Investigation Report Page 3 approximately 90' of the retaining wall. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at the end of North Granby Street within the Perquimans County Commerce Centre adjacent the Perquimans River in Hertford, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to construct a new boating access area by installing a 59' ramp with two 8' wide pedestrian walkways, a cut through an I V bluff with vinyl retaining walls, constructing a 40' by 41' slab with six pilings for vessel tie-ups, and excavating an area of the river to a water depth of -6'. DATE: December 9, 2014 Consistency Determination: The request is consistent with/not in conflict with the 1998 Perquimans County Land Use Plan certified by the CRC on October 24, 2002. Overview: The 4.6 acre undeveloped project site is located within the Perquimans County Commerce Park and contains approximately 308 linear feet of shoreline along the Perquimans River. Waterward of Normal Water Level (NWL), the sandy substrate slopes to a depth of 6 feet and drops to a depth of 20 feet in a pit previously excavated for highway construction. The shoreline is situated along an 11 foot high bluff. The bluff is undisturbed and heavily vegetated. The remainder of the site is used as farmland. The majority of the site is outside of the 100-year floodplain. The finished water depth at the end of the ramp will be 6 feet. The boat ramp will be installed through the bluff between vinyl retaining walls. The vinyl retaining walls transitioning into groins will terminate 33 feet to 44 feet into the river at a depth of 6 feet. The groins will have a 1 inch per 1 foot opening, or the equivalent, and be located 3 feet above NWL with yellow reflective delineators along the walls for safety. Riprap on the outside of each retaining wall will extend below NWL for 12 to 16 feet. The concrete apron will connect the boat ramp to the asphalt parking area. Handicapped accessible regular and trailer parking spaces will be provided. Stormwater will be directed away from the shoreline. The restroom facility will also be handicapped accessible. Utility construction will be necessary for the restrooms. A cofferdam will be used during construction to allow for the terminus 41 foot wide by 40 foot long concrete ramp section to be poured level. Excavation spoil will be stored along the northwest corner of the property and will be leveled and vegetated at project completion. The waters of the Perquimans River are classified as SC in this area and are closed to shellfish harvesting. There is no Submerged Aquatic Vegetation (SAV) within or adjacent to the project area. A review of potential historic, cultural and archaeological resources was not provided. The project site is adjacent to the planned Perquimans Industrial Marine Park. The boat ramp will be wide enough for future industrial users while providing two (2) launch lanes for recreational users. The driveway will have an extra 36 foot wide drive aisle to accommodate industrial traffic. Anticipated Impacts resulting from this project are expected to include: the dredging of 1,075 sq. ft. of Public Trust Area/Estuarine Waters Area of Environmental Concern (AEC); the filling of 5,452 sq. ft. of Public Trust Area/Estuarine Waters AEC and 1.41 acre of High Ground; the shading of 60 sq. ft. of Public Trust Area/Estuarine Waters AEC; the grading of .69 acre of High Ground, and; the temporary disturbance of 1,800 sq. ft. of Public Trust Area/Estuarine Waters AEC. Approximately 4,847 sq. ft. of High Ground fill will be located within the Estuarine Shoreline AEC. Basis for Determination: The project site is currently within the Town of Hertford, but is not included in the Town of Hertford 1991 Land Use Plan, therefore the 1998 Perquimans County Land Use Plan applies. The Perquimans County LUP contains policies specific to development of a Commerce Park at the project site. Furthermore, the LUP also indicates that productive agricultural lands are not being threatened by unreasonable or unmanageable urban growth. The Perquimans County Land Classification Map identifies the site area as "Urban Transition'. As noted on Page 49 of the Land Use Plan (LUP), all areas within an AEC also qualify for the designation of "Conservation". Skvarla, III Secretary NC Wildlife Resources Commission (NCWRC), in association with Perquimans County, is proposing to construct a public boat access at the end of N. Granby Street within the Perquimans County Commerce Centre, adjacent to the INC Seafood Industrial Park (CAMA Permit #15-11). The proposed facility will provide a concrete ramp 59' wide, including two 8' wide pedestrian walkways, cut through an 11' bluff and will include vinyl retaining walls on either side that will extend down to the shoreline. The vinyl walls will transition into groins on either side of the ramp and terminate 33' to 44' in the Perquimans River at a depth of -6'. Located at the end of the sloped ramp, along the -5' elevation, a level 40' x 41' concrete slab will be poured using a cofferdam system. This area will have six pilings 8' on -center to be vessels using the ramp. A small area of water bottom will be excavated to a finished depth of -6' at the end of the ramp facility. SECTION .0200 — THE ESTUARINE AND OCEAN SYSTEMS 15A NCAC 07H .0203 MANAGEMENT OBJECTIVE OF THE ESTUARINE AND OCEAN SYSTEM It is the objective of the Coastal Resources Commission to conserve and manage estuarine waters, coastal wetlands, public trust areas, and estuarine and public trust shorelines, as an interrelated group of AECs, so as to safeguard and perpetuate their biological, social, economic, and aesthetic values and to ensure that development occurring within these AECs is compatible with natural characteristics so as to minimize the likelihood of significant loss of private property and public resources. Furthermore, it is the objective of the Coastal Resources Commission to protect present common-law and statutory public rights of access to the lands and waters of the coastal area. Consistent: Project is to provide public access for recreational and commercial vessels on a r!VWCEWD with limited public access. DEC 0 9 2014 15A NCAC 07H .0206 ESTUARINE WATERS DCM-MHD COY (c) Management Objective. To conserve and manage the important features of estuarine waters so as to safeguard and perpetuate their biological, social, aesthetic, and economic values; to coordinate and establish a management system capable of conserving and utilizing estuarine waters so as to maximize their benefits to man and the estuarine and ocean system. Consistent: Project will provide access to the water for recreational, commercial and state management personnel. (d) Use Standards. Suitable land/water uses shall be those consistent with the management objectives in this Rule. Highest priority of use shall be allocated to the conservation of estuarine waters and their vital components. In every instance, the particular location, use, and design characteristics shall be in accord with the general use standards for coastal wetlands, estuarine waters. and public trust areas described in Rule .0208 of this Section. Consistent: The project meets the use standards and is consistent with the intent of this rule. 15A NCAC 071-1.0208 USE STANDARDS (a) General Use Standards (1) Uses which are not water dependent shall not be permitted in coastal wetlands, estuarine waters, and public trust areas. Restaurants, residences, apartments, motels, hotels, trailer parks, private roads, factories, and parking lots are examples of uses that are not water dependent. Uses that are water dependent include: utility crossings, wind energy facilities, docks, wharves, boat ramps, dredging, bridges and bridge approaches, revetments, bulkheads, culverts, groins, navigational aids, mooring pilings, navigational channels, access channels and drainage ditches; Consistent: Water dependent use. (2) Before being granted a permit, the CRC or local permitting authority shall find that the applicant has complied with the following standards: (A) The location, design, and need for development, as well as the construction activities involved shall be consistent with the management objective of the Estuarine and Ocean System AEC (Rule .0203 of this subchapter) and shall be sited and designed to avoid significant adverse impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds, submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning and nursery areas; Consistent: No SAVs, wetlands, or shellfish beds. (B) Development shall comply with state and federal water and air quality; Consistent: Not an issue. (C) Development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural resources; No known sites, but subject to review. (D) Development shall not increase siltation; Consistent: As designed siltation should not be an issue. (E) Development shall not create stagnant water bodies; Consistent: Open design (F) Development shall be timed to avoid significant adverse impacts on life cycles of estuarine and ocean resources; and Consistent: Subject to permit review and conditions. (G) Development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. Consistent: Ramp will provide access to the Perquimans River. Navigation channels, canals and boat basins shall also comply with the following standards: Consistent (A) Navigation channels and canals may be allowed through fringes of regularly and irregularly flooded coastal wetlands if the loss of wetlands will have no significant adverse impacts on fishery resources, water quality or adjacent wetlands, and if there is no reasonable alternative that would avoid the wetland losses; Consistent: NIA (B) All dredged material shall be confined landward of regularly and irregularly flooded coastal wetlands and stabilized to prevent entry of sediments into the adjacent water bodies or coastal wetlands; Consistent: Spoil will be mechanically removed and located in the northwest corner of the4.6 acre property outside of the 75' AEC. (C) Dredged material from maintenance of channels and canals through irregularly flooded wetlands shall be placed on non -wetland areas, remnant spoil piles, or disposed of by a method having no significant, long-term wetland impacts. Under no circumstances shall dredged material be placed on regularly flooded wetlands. New dredged material disposal areas shall not be located in the buffer area as outlined in 15A NCAC 07H .0209(d)(10); Consistent: Spoil will be mechanically removed and located in the northwest comer of the4.6 acre property outside of the 75' AEC. (D) Widths of excavated canals and channels shall be the minimum required to meet the applicant's needs but not impair water circulation; Consistent: NIA (E) Boat basin design shall maximize water exchange by having the widest possible opening and the shortest practical entrance canal. Depths of boat basins shall decrease from the waterward end inland; Consistent: NIA (F) Any canal or boat basin shall be excavated no deeper than the depth of the connecting waters; Consistent: Depth of the ramp at the end will require the removal of less than 20 cy of material. (A) Piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur; Consistent: Proposed piers are 8' to provide safe loading and unloading of vessels. The future use of this site will be in conjunction with the adjacent NC Seafood Industrial Park. (B) The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to marinas; Consistent: The combined area of the dock extending over water will be 1,5O4sf along a 308' shoreline. (C) Piers and docking facilities over coastal wetlands shall be no wider than six feet and shall be elevated at least three feet above any coastal wetland substrate as measured from the bottom of the decking; Consistent: None proposed. (D) A boathouse shall not exceed 400 square feet except to accommodate a documented need for a larger boathouse and shall have sides extending no farther than one-half the height of the walls and covering only the top half of the walls. Measurements of square footage shall be taken of the greatest exterior dimensions. Boathouses shall not be allowed on lots with less than 75 linear feet of shoreline. Size restrictions do not apply to marinas; Consistent: NIA (E) The total area enclosed by an individual boatlift shall not exceed 400 square feet except to accommodate a documented need for a larger boat lift; Consistent: NIA (F) Piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow second story use; Consistent: Single story proposed. (G) Pier and docking facility length shall be limited. Consistent: The length of the dock will be less that other piers along the same shoreline, shall not extend into any navigation channel and will be less than % the width of the waterbody. (H) Piers or docking facilities longer than 400 feet shall be permitted only if the proposed length gives access to deeper water at a rate of at least 1 foot each 100 foot increment of IengtRECENED longer than 400 feet, or, if the additional length is necessary to span some obstructionOk 08 2014 navigation. Consistent: The dock will maintain a minimum of 15' from the riparian line. (9) Groins (A) Groins shall not extend more than 25 feet waterward of the normal high water or normal water level unless a longer structure is justified by site specific conditions and by an individual who meets any North Carolina occupational licensing requirements for the type of structure being proposed and approved during the application process; Consistent: Groins propose will be limited to the length of the ramp facility to protect boaters. (B) Groins shall be set back a minimum of 15 feet from the adjoining riparian lines. The setback for rock groins shall be measured from the toe of the structure. This setback may be waived by written agreement of the adjacent riparian owner(s) or when two adjoining riparian owners are co -applicants. Should the adjacent property be sold before construction of the groin commences, the applicant shall obtain a written agreement with the new owner waiving the minimum setback and submit it to the permitting agency prior to initiating any development of the groin; Consistent: A 15' setback is proposed. (C) Groins shall pose no threat to navigation; Consistent: Groins will be limited to the length of the ramp facility and will not extend into a navigation channel. (D) The height of groins shall not exceed one foot above normal high water or normal water level; Inconsistent with the Letter of the Rule: The height of the groin wall and location on the river is to provide protection for boaters, and as a matter of safety. It is my opinion that the structure would be consistent with the intent of the Divisions Rule. (E) No more than two structures shall be allowed per 100 feet of shoreline unless the applicant provides evidence that more structures are needed for shoreline stabilization. Consistent: Two groins proposed (F) " L" and "T" sections shall not be allowed at the end of groins; and Consistent: None proposed. (G) Riprap material used for groin construction shall be free from loose dirt or any other pollutant and of a size sufficient to prevent its movement from the site by wave and current action.
