Upland Development 1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (252) 946-6481 for this determination. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. North Carolina Wildlife Resources Commission Permit # 54-15 Page 2 of 4 ADDITIONAL CONDITIONS Pier and Canoe Launch 2) Unless specifically altered herein, this permit authorizes the construction of the floating pier and canoe launch and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this fishing platform without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 3) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable water at or adjacent to authorized work. 4) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 5) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structures in order to make them more visible during hours of darkness or inclement weather. 7) This permit does not authorize any formalized boat slips. Boat Ramp 8) Unless specifically altered herein, this permit authorizes the replacement of the existing boat ramp, all as indicated on the attached workplan drawings. 9) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. Shoreline Stabilization 10) The authorized riprap shall adhere to the alignment depicted on the attached workplan drawings. 11) The riprap material shall be free from loose dirt or any pollutant. It must be of a size sufficient to prevent its movement from the approved alignment by wave or current action. 12) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite, marl, or broken concrete. t North Carolina Wildlife Resources Commission Permit # 54-15 Page 3 of 4 ADDITIONAL CONDITIONS Excavation 13) Unless specifically altered herein, the dimensions of the area to be. excavated shall not exceed the area that is, expressly and specifically set forth in the attached permit• application and workplan drawings. Any proposal to change the area to be excavated shall require permit modification. 14) The temporary placement or doubling handling of excavated materials within waters or wetlands is not authorized. 15) No excavation shall take place outside the area indicated on the attached workplan drawings. Excavation shall not exceed -4.5 feet below the normal water level. In no case shall the depth of excavation exceed the depth of the connecting waters. Spoil Disposal 16) All excavated materials shall be confined above normal water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 17) The spoil area shall be inspected and approved by the Division of Coastal Management prior to the beginning of any dredge activities. Sedimentation and Erosion Control 18) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 19) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). General 20) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration: 21) In order to minimize impacts, no in -water work is permitted between February 15 and June 30 of any year. This moratorium would be removed if a turbidity curtain is installed in consultation with the Division of Coastal Management. The curtain shall be maintained and remain in place at least 72 hours after excavation is completed. North Carolina Wildlife Resources Commission Permit # 54-15 Page 4 of 4 ADDITIONAL CONDITIONS 22) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 23) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation. NOTE: - This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including any authorization required from the NC DEMLR Stormwater Section. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity -for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. No. SAW-2015-00409. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. PROJECT SUMMARY: The applicant proposes conduct maintenance excavation, construct a public boat ramp and fishing pier on the Cashie River off Elm Street in Windsor. Windsor Boating Access Area NCWRC Bertie County PROJECT SETTING The North Carolina Wildlife Resources Commission (WRC) has submitted a Major CAMA request to renovate a public boating access area on the Cashie River. The 2.7 acre project site is located off Elm Street off of NC308 in Windsor in Bertie County. The site is currently developed with a manmade canal, boat ramp, and a gravel parking lot. There are wooded wetlands to the west of the canal and an upland spoil berm separates the canal and wooded wetlands to the east of the canal. There are wooded wetlands both up and downstream of the project site. The Cashie River is classified as C SW by the Environmental Management Commission at the project site. The project site is located in inland waters and is designated as an Anadromous Fish Spawning Area by the North Carolina Wildlife Resource Commission. PROJECT DESCRIPTION The WRC proposes to redevelop an existing boating access area. The existing 365ft long by 30ft wide by average -2.5ft normal water level (NWL) manmade canal will be enlarged to 365ft long by 47ft wide by -4.5ft NWL. To the west of the boat ramp, the applicant will create a 16ft by 20ft by boat basin in existing wooded wetlands. The spoil will be taken to an off -site disposal area. An existing 14ft by 45ft launch ramp will be replaced with a new 15ft by 32ft ramp, a 4ft by 30ft fixed pier will be replaced by an 8ft by 80ft floating pier with a 6ft byl5ft floating canoe launch adjacentto the deck. Above NWL there will be a 15ft by 7ft concrete walkway that provides access to the ramp. The existing gravel parking lot will be redeveloped to a smaller footprint reducing the impervious area from the parking lot by 633ft . The parking lot will include 2 concrete parking spots and a concrete walkway connecting the parking spots with the ramp. In order to stabilize the proper slopes, rip rap will be placed along the edge of the ramp and extend below NWL (average of 6.5' waterward of NWL) to the end of the ramp. There will also be an additional 505ft walkway connecting the parking lot to the Cashie River (64ft by 6ft concrete and 441ft by 6ft wooded walkway). The walkway will run parallel to the canal on the existing spoil pile. The shoreline adjacent to the ramp will be stabilized by rip rap extending an average of 6.5 waterward of NWL (423ft ). There is an existing 100ft by 30ft (average) spoil pile to the east of the ramp that will be removed and taken to the offsite disposal site. ANTICIPATED IMPACTS The project will result in localized turbidity due the dredging and installation of the boat ramp, floating pier, and canoe launch and its associated structures. There will be a total of 43,18W of upland disturbance from the launch ramp, parking lot, two concrete spaces, two concrete sidewalks, a wooded walkway and removal of an existing spoil area. This impervious upland disturbance will account for 13.2% of the 30' Public Trust shoreline. The NCWRC has submitted a plan to the Division of Water Resources Stormwater section. The floating dock and canoe launch will shade 73W of canal bottom and public trust area. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal, relocation, or alteration. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 4. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 6. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work authorized by this permit and again upon completion of the work authorized by this permit. 8. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 9. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter I I3A Article 4). 10. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 11. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to conduct maintenance excavation within a canal, renovate an existing boat ramp and construct a fishing pier for public use. The width of existing canal is proposed to be enlarged to 47' for the entire 365' in length. Final water depths are proposed to be 4.5' NWL. Spoil will be taken to an offsite location. The new 15' by 32' ramp will have an 8' by 80' floating pier with a 6' by 15' canoe launch. Renovations to the existing parking area will reduce impervious surfaces and provide ADA access. The Cashie River at this location is classified C Sw by the Environmental Management Commission and is designated an anadromous fish spawning area (AFSA) by the NC WRC. We have reviewed the permit application and request a February 15 — June 30 moratorium for dredging be included as a permit condition to minimize impacts to anadromous resources. Work may be allowed within this time period if the applicant can secure a turbidity curtain at the mouth of the canal during excavation to minimize elevated turbidity levels within the Cashie River. Date: February 24, 2015 Consistency Determination: The request is consistent with/not in conflict with the Town of Windsor Land Use Plan certified by the CRC on August 27, 2009. Overview: The subject property is a 2.7 acre site with approximately 900 linear feet of shoreline along a manmade canal that connects to the Cashie River. The 30 foot wide by 365 foot long canal has an average water depth of -2.5 feet below Normal Water Level (NWL). The site elevation is approximately 6 feet above NWL and is located within the AE Floodzone. The majority of the property is cleared upland, with wooded Section 404 wetlands west of the canal. A 30 foot wide by 100 foot long spoil pile separates the canal from wooded Section 404 wetlands to the east. Upland area and the canal terminus are located within the Town of Windsor municipal boundary while areas along either side of the canal length are within the Town's Extra -Territorial Jurisdiction (ETJ). A public boating access operated by the NC Wildlife Resources Commission (WRC) is located on the property. An unmarked gravel parking area is provided on the upland portion of the site. Existing shoreline improvements consist of a 14 foot wide by 45 foot long boat ramp with a 4 foot wide by 30 foot long fixed pier. According to the applicant, the access site has degraded and is in need of renovation to meet current functionality and safety standards. Two (2) handicapped accessible vehicle with trailer parking spaces will be provided. Walkways will connect parking facilities to the ramp and provide access to the Cashie River from the east bank of the canal. A review of existing and proposed on -site stormwater controls was not provided; however delineation of parking is expected to result in reduced impervious surface area. The Town and the WRC have entered into a Memorandum of Agreement (MOA) to improve recreation access in the Windsor area, including improvements on the WRC's Elm Street public access and the abutting Town owned campground. Specific to the WRC's property, the Town will construct the wooden walkway and terminus platform east of the canal. Also, the canoe/kayak launch is included in an access grant contract (Contract 6004) between the Town and NCDENR that recognizes the MOA. The waters of the Cashie River are classified as C SW waters and are closed to shellfish taking. The site is located in Inland Waters and is designated as an Anadromous Fish Spawning Area. A review of Submerged Aquatic Vegetation (SAV) was not provided. A review of historic and archaeological resources was not provided. Anticipated impacts resulting from this project are expected to include: the dredging of .26 acre of Public Trust Area of Environmental Concern (AEC) and 2,928 sq. ft. of Section 404 Wetlands within the Public Trust Shoreline AEC; the shading of 730 sq. ft. of Public Trust Area AEC, and; the disturbance of .99 acre of Uplands. A portion of Upland disturbance will occur within the Public Trust Shoreline AEC. Basis for Determination: The Town of Windsor Future Land Use Map (FLUM) designates the site as "Conservation Areas". As indicated on Page 113, "(t)he Conservation category includes park lands and lands identified as least and of low suitability for development. Since then the access area has been operated as a free public boating access. Over time the access area has degraded and is in need of renovation to meet current functionality and safety standards. The NC Wildlife Resources Commission and the Town of Windsor have formalized an agreement in the form of an MOA to cooperate in improving recreational access in the Windsor area. A portion of the agreement includes the renovation of the existing access area. The renovation of the Windsor Boating Access Area will include the following: Replacement of an existing 14' X 45' launch ramp with a new 15' X 89' concrete launch ramp. Replacement of an existing 4' X 30' fixed pier with an 8' X 80' floating dock. A floating canoe launch will be attached to the eastern side of the floating dock. The existing canal, average depth -2.5' at NWL, will be dredged to a depth of -4.5' at NWL. A new boat turning basin will be excavated on the western side of the canal to provide safer navigation of larger boats. The existing parking area will be delineated to make better use of impervious area. The delineation will result in a reduction of impervious area by 633 square feet, primarily located near the entrance. The area converted from impervious will be tilled and planted with grass. Additionally, the Town of Windsor proposes to construct a walkway and viewing platform on the high ground adjacent to and east of the canal. The first 64 feet of the walkway tying to the Town's property will be concrete. The remaining 441 feet will be elevated boardwalk. I. PURPOSE OF THE AGREEMENT It is mutually agreed that the COMMISSION and the TOWN will cooperate to provide free public boating/river access and restrooms at the. Windsor Boating Access Area on Elm Street, and free public fishing at a pier to be constructed adjacent the Town boardwalk near South Queen Street. II. RESPONSIBILITIES A. The COMMISSION agrees to: Boating Access Area 1. Provide design development for renovation of the existing public boating access area. 2. Obtain all regulatory permits required for construction and improvements" to the boating access area. 3. Construct all improvements to the boating access area. This will include the replacement of the ramp and docks and parking lot improvements, which will include site lighting ADA accessibility. 4. Install canoe/kayak launch, as provided by the Town. 5. Provide funding towards the cons-truction of restrooms that will serve the boating access area and Town campground.
