On Holden Beach the policy Is that all atrucgM constructed in a V or A Zone shall met FEMA requirernernts for both
zones.
1. Base flood elevation (BFE) per FIRM at development site +2
2. Regulatory flood protection elevation must be at or above the bottom of the lowest supporting horizontal member
plus 2 feat and all attended utilities to include but not limited to, all honing, air conditioning and electrical equipment.
3. V-Zone Certification is required prior to a C.O. being issued by the Building Inspector for all structures within all
V-Zones and A -Zones.
4. All walls constructed below base flood elevation shall be constructed with break a way wells and have flood vents in
accordance with FEMA's technical bulletins for V- Zones and A -Zones.
S. ALL areas below the base flood elevation plus 2 feet are permitted to be used only for parking vehicles, building
access, or storage based on FEMA regulations and Holden Beach Online=.
When signing below you the property owner and agent agree to these reguistions.
6. Total arcs of openings required are a minimum of two openings having a net arc of not less than one square inch fen
every square foot of enclosed area below base floor elevation. Geroge doors cannot be used to sa isly this requirement,
•The bottom of all required openings must be no higher than 12" above Grade.
•The vents must be installed in at least two walls of the enclosure.

Dear Mr. Blankenship:
This letter confirms that on July 12, 2022, Planning Director Timothy Evans and I
were onsite at the property located at 161 Scotch Bonnet adjacent to a man-
made canal which leads to the Atlantic Intracoastal Waterway (AIWW ) located
in Town of Holden Beach, Brunswick County, North Carolina. The purpose of
the visit was to Investigate unauthorized development of installing a pool and
decking within 30 ft. of Normal High Water (NHW) in 75 ft. Estuarine Shoreline
Area of Environmental Concern (AEC). No person may undertake development

Information gathered by me shows that you are undertaking, or are legally
responsible for, development including installing a pool and constructing
decking around an existing pool on the aforementioned property, and that No
CAMA Permit has been issued for this development activity. This activity is
taking place within the 30ft. Coastal Shoreline Buffer in the 75 ft. Estuarine
Shoreline (AEC) as designated by the NC Coastal Resources Commission.
You are hereby ordered to STOP WORK IMMEDIATELY. NO WORK MAY
PROCEED UNTIL A MINOR CAMA PERMIT IS ISSUED.

Failure to file an application or continuation of work after receipt of this Notice
would constitute a violation of the CAMA and you may be subject to civil and/or
criminal penalties as provided by N.C.G.S. §113A-126. Each day that the
development described in this Notice is continued or repeated may constitute a
separate violation that is subject to an additional assessment of $10,000. An
injunction or criminal penalty may also be sought to enforce any violation in
accordance with N.C.G.S. §313A-126. Provided you comply voluntarily with this
Notice, no further enforcement action or civil assessment would be necessary
beyond the issuance of a permit.

(5) The amount of impervious surface shall not exceed 30% of the lot area within 75 feet of
(Estuarine Shoreline Area of Environmental Concern), in this case the house and total impervious area within
the AEC already exists.
(6) Unless specifically allowed in 15 NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all
developmemilconstructlon shall be located 30 feet landward of normal high-water level.
(7) The pod shag be placed In the existing ground, all wood decking shall be ground level.
(8) This permit is being issued based on section 15 NCAC 07H .0209(d)(2) for the pool.

(10) All unconsolidated material resulfing from associated grading and landscaping shag be retained on site by
effective sedimentation and erosion control measures. Prior to any land -disturbing acdA0es. a barrier Ifne
(1 t)No grading Is permitted within the 30' buffer from the normal high water. Any land disturbance must be
contoured to prevent additional stormwater runoff to the adjacent marsh. This area shall be immediately
vegetatively stabilized and must remain in a vegetated state.
(12)At other disturbed areas shall be vegetatively stabilised hAndsd and mulched) within 14 days of
construction completion.
(13) The pod pump is not permitted under the structure (house) covered area or within the town required
setbacks.
(14) Town ordinances states in part that the primary intent to Control stormwater on individual parcels of land, so
as not to adversely affect the quantity and quality of surface water flows as a resultof napual rainfall, and to
control runoff onto adjacent property, or water Induced soil erosion in any torn. Surface water runoff shall
be controlled within property boundaries and not drained onto adjacent areas, both private and public. (for
example, streets and roads or waterways)
(15)A as bunt survey with pool location and pervious square footage of ground level decking is required once
the work is complete and before the final inspection is completed to verify, compliance.
(16)A RPZ valve is required to be installed by a licensed plumber on the water meter that the pool Is connected
to or will be used to fill the pool with water.
