No other structure, whether floating or stationary, shall become a permanent part of this fishing platform without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 3) The authorized covered gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and must be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 4) The roof of the covered gazebo shall not be designed for second story use. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable water at or adjacent to authorized work. 6) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 7) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structures in order to make them more visible during hours of darkness or inclement weather. 9) This permit does not authorize any formalized boat slips. Shoreline Stabilization 10) The authorized riprap shall adhere to the alignment depicted on the attached workplan drawings. 11) The riprap material shall be free from loose dirt or any pollutant. It must be of a size sufficient to prevent its movement from the approved alignment by wave or current action. 12) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite, marl, or broken concrete. aECpJVo North Carolina Wildlife Resources Commission Permit # 25-15 Page 3 of 3 ADDITIONAL CONDITIONS Sedimentation and Erosion Control 13) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 14) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). General 15) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 16) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 17) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including any authorization required from the NC DEMLR Stormwater Section. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. 198000291. Proiect Narrative Project Information: Coinjock Boating Access Area - Currituck County Engineer: Mark Hamlett, PE North Carolina Wildlife Resources Commission 1720 Mail Service Center Raleigh, NC 27699 Project Summary: The Coinjock Boating Access Area — Boardwalk project is located just off of Waterlily Road in Coinjock, Currituck County, NC. The property has been used as a boating access area since the 1950's and provides free public access to the ICW. Existing on site are two concrete ramps, docks and a gravel parking lot. This project involves the construction of a fishing pieriboardwalk, gazebo, small parking area and rip rap shoreline stabilization. The project property is adjacent to SC waters and will result in a net decrease in impervious surface. Impervious Surface: The total property owned by the Wildlife Resources Commission is 132,989 sf (3.05 acres). This does not include portions of the Coinjock BAA that are within NCDOT right of way. The pre -development impervious surface on the property is 34,469 sf (25.9 %). The post -development impervious surface on the property is 32,938 sf (24.8 %). This project results in a net decrease of impervious surface of 1,531 sf. Shoreline Stabilization: The ICW runs adjacent to this property, which results in extensive wave action along the shoreline. Years of this have resulted in shoreline erosion and the loss of high ground. This project proposes to stabilize the shoreline with the installation of approximately 600' of Class B rip rap. Stormwater Conditions: The existing site has no stormwater controls. And runoff is either infiltrated into the natural sandy soils, or sheet flows into the ICW. This project results in a net decrease in impervious surface, therefore slightly reducing the runoff from thftKCD DEC 2 2 2014 DCM-MmD CITY Boardwalk/Pier: The proposed project includes the construction of a 250' x 10' boardwalk/fishing pier along the shoreline, parallel to the ICW. Also proposed is a 16' diameter gazebo. The gazebo and pier will be supported by piles, which will be driven in the water. Two boardwalks are being proposed to provide accessibility to the parking lot. Wetlands: Ron Renaldi, from DCM, performed a wetland delineation on December 3, 2014. Existing on site now are three small pockets of wetlands, which total 11 sf, and a larger area of wetlands, which is 605 sf. There are a total 616 sf of coastal wetlands existing on site. These existing wetlands will be protected during this project. No rip rap will be placed in these wetlands and no wetland disturbance will be allowed. PROJECT SUMMARY: The applicant proposes to upgrade the existing boat access area by stabilizing the eroding shoreline with riprap, constructing a public fishing platform and gazebo, two access piers/boardwalks, and a small parking area. Project Setting The project site is a NC Wildlife Resources Commission Boating Access Area (BAA) that is located t1.8 miles off of Caratoke Highway (US-158) on Waterlily Road (SR#1142), within Coinjock, Currituck County and is adjacent to the Atlantic Intracoastal Waterway. The BAA is t3.05 acres in size and has an elevation of t3' above Normal Water level (NWL). The highground area is vegetated with upland grasses and loblolly pines (Pinus taeds). Within the northeast area of the site adjacent to Waterlily Road is a large area that appears to be USACE jurisdictional 404-wetlands. Man-made features within the highground area include a gravel access drive and parking area. Based on available information, there appears to be no archaeological sites on this property. The shoreline of the BAA is t1,325' and fronts the Atlantic Intracoastal Waterway (ICW) to the west and a canal to the north. The northern shoreline along the canal has been partially stabilized with t260' of riprap and is the location of two concrete boat ramps, two 38'x10' bulkheaded docks, a 38'x6' fixed dock, and a 75'x6' fixed dock that runs parallel to the shoreline. A derelict boathouse is located t135' to the east of the boat ramp. The shoreline adjacent to the ICW has not been stabilized and has an erosion escarpment that ranges from V to 3' above NWL. A coastal wetland fringe is found along this shoreline that consists of giant cordgrass (Spartina cynosuroides) and a few tufts of black needlerush (Juncus roemerianus). Additional vegetation growing includes loblolly pines, groundsel bushes (Baccharis halimifolia), red maples (Acer rubrum) and salt meadow hay (Spartina patens). This shoreline is subject to large boat wake from ICW traffic and appears to be rapidly eroding. The lands adjacent to the BAA are undeveloped and remain in a natural state. Salt marsh and 404-wetlands dominate much of the area. The waters of the ICW are classified as SC and are closed to shellfish taking. Water depths adjacent to the shoreline are tl' below NWL and remain shallow for t30' out into the ICW at which point water depths begin to drop to t15' below NWL within the channel. The waterbody width is t390'. The bottom substrate within the project area is made up of fine sands and is void of Submerged Aquatic Vegetation (SAV). Prior permit history on the site includes: - CAMA Major Permit #117-81 issued to the NC Wildlife Resources Commission for dredging within the canal area at the boat ramp. - CAMA Major Permit #14-93 issued to the NC Wildlife Resources Commission for the development of the existing BAA. The proposed riprap will tie into the existing riprap at the mouth of t4g.anal and follow the shoreline south for 600'. The riprap toe will average 4' waterward of NWL with a maximum distance of 5'. Total riprap width will be 8' and will be placed to avoid damaging coastal wetland areas. The applicant indicated the erosion rate is 0.5 ft/yr based on the comparison of 1993 aerial photographs to 2014 aerial photographs. A 25O'x1 O' public fishingplatfogYt roposed to run parallel with the shoreline along the ICW. At the south end of the platform a %f l 6' octagonal gazebo will be constructed. Docking will not be permitted and the platform will have handrails on all sides. The platform will average t23' waterward of NWL and is located landward of both the ICW setback and right-of-way and meets the 1/4 width rule. Access will be provided by two 5' wide pier sections that will be located near the north and south ends of the platform. Within the highground area, two raised wooden walkways will be constructed from the parkin areas to the access piers. A tl00'x5' walkway will connect the north access to the parking area and a ±58'x5' walkway will c6WWfluth access. The applicant proposes to remove ±2,300 ft2 of existing impervious gravel area within the BAA parking area and then create seven additional parking spaces consisting of twOMWrete and five gravel spaces. A 62'x5' concrete &pIkway will be placed adjacent to the parking spaces. A t2OO' long split -rail fence will be iWalled adjacent to the existing parking area. Anticipated Impacts • The proposed riprap will result in ±2,400 ft2 of shallow bottom fill within the Public Trust Area and Estuarine Waters AEC's. • The proposed riprap will result in ±2,400 ft2 of fill along the shoreline of the Estuarine Shoreline AEC. • The proposed fishing platform, access piers and gazebo will shade ±2,914 ft2 of Public Trust Area and Estuarine Waters AEC's. • Cumulative shading will be ±3,520 ft2 of Public Trust Area AEC. • The proposed southern access pier will result in the shading of ±45 ft2 of Coastal Wetlands. • Total land disturbance associated with the proposed development is ±5,600 ft2. • The proposed development within the Estuarine Shoreline AEC will result in a decrease of impervious surfaces to 12.94%. • The proposed development will result in the net decrease of ±1,531 ft2 of impervious surfaces on the tract resulting in a decrease from 25.9% to 24.8% impervious coverage. The project site is a NC Wildlife Resources Commission Boating Access Area (BAA) that is located ±1.8 miles off of Caratoke Highway (US-158) on Waterlily Road (SR#1142), within Coinjock, Currituck County and is adjacent to the Atlantic Intracoastal Waterway. The development proposal involves the Coastal Wetland, Estuarine Waters, Public Trust Area & Estuarine Shoreline Areas of Environmental Concern (AEC's). I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 15A NCAC 07H.0203 Management Obiective of the Estuarine and Ocean System It is the objective of the Coastal Resources Commission to conserve and manage estuarine waters, coastal wetlands, public trust areas, and estuarine and public trust shorelines, as an interrelated group of AECs, so as to safeguard and perpetuate their biological, social, economic, and aesthetic values and to ensure that development occurring within these AECs is compatible with natural characteristics so as to minimize the likelihood of significant loss of private property and public resources. Furthermore, it is the objective of the Coastal Resources Commission to protect present common-law and statutory public rights of access to the lands and waters of the coastal area. (d) Use Standards. Suitable land uses shall be those consistent with the management objective in this Rule. Highest priority of use shall be allocated to the conservation of existing coastal wetlands. Second priority of coastal wetland use shall be given to those types of development activities that require water access and cannot function elsewhere. Examples of acceptable land uses may include utility easements, fishing piers, docks, and agricultural uses, such as farming and forestry drainage, as permitted under North Carolina's Dredge and Fill Act or other applicable laws. In every instance, the particular location, use, and design characteristics shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public trust areas. Consistent: The proposed development is consistent with the intent of this rule. The proposed riprap will be placed to avoid filling Coastal Wetland areas. 07H.0206 Estuarine Waters (c) Management Objective. To conserve and manage the important features of estuarine waters so as to safeguard and perpetuate their biological, social, aesthetic, and economic values; to coordinate and establish a management system capable of conserving and utilizing estuarine waters so as to maximize their benefits to man and the estuarine and ocean system. (d) Use Standards. Suitable land/water uses shall be those consistent with the management objectives in this Rule. Highest priority of use shall be allocated to the conservation of estuarine waters and their vital components. Second priority of estuarine waters use shall be given to those types of development activities that require water access and use which cannot function elsewhere such as simple access channels; structures to prevent erosion; navigation channels; boat docks, marinas, piers, wharfs, and mooring pilings. In every instance, the particular location, use, and design characteristics shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public trust areas described in Rule 07H.0208. Consistent: The proposed development is consistent with the intent of this rule. RECEIVED 07H.0207 Public Trust Areas !AN 0 9 1015 (c) Management Objective. To protect public rights for navigation and recreation and to DC"' C" conserve and manage the public trust areas so as to safeguard and perpetuate their biological, economic and aesthetic value. (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. The development of navigational channels or drainage ditches, the use of bulkheads to prevent erosion, and the building of piers, wharfs, or marinas are examples of uses that may be acceptable within public trust areas, provided that such uses shall not be detrimental to the public trust rights and the biological and physical functions of the estuary. Projects which would directly or indirectly block or impair existing navigation channels, increase shoreline erosion, deposit spoils below normal high water, cause adverse water circulation patterns, violate water quality standards, or cause degradation of shellfish waters are considered incompatible with the management policies of public trust areas. In every instance, the particular location, use, and design characteristics shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public trust areas. Consistent: The proposed development is consistent with the intent of this rule. 15A NCAC 07H.0208 Use Standards Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are not water dependent within the EW and PTA and lists uses that may be considered water dependent. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(A) states that the location, design, and need for development, as well as the construction activities involved shall be consistent with the management objective of the Estuarine and Ocean System AEC and shall be sited and designed to avoid significant adverse impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds, submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning and nursery areas. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(B) states that development shall comply with state and federal water and air quality standards. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(C) states that development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural Resources. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(D) states that development shall not increase siltation. Paragraph (a)(2)(G) states that development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (b) addresses Specific Use Standards. Of these, subparagraph (6) Piers and Docking Facilities pertain to this project, and those subparagraphs not listed are not applicable to this project. Paragraph (6) Piers and Docking Facilities Subparagraph (6)(A) states that piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6)(B) states that the total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be 8 square feet per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions do not apply to marinas. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6)(C) states that piers and docking facilities over coastal wetlands shall be no wider than six feet and shall be elevated at least three feet above any coastal wetland substrate as measured from the bottom of the decking. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6)(F) states that piers and docking facilities shall be single story. (ii) not extending into the channel portion of the water body; Consistent: The proposed development is consistent with the intent of this rule. (iii) not extending more than one-fourth the width of a natural water body, or human -made canal or basin. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier -head line. The one-fourth length limitation does not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6)(1) states that piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's areas of riparian access. Consistent: The proposed development is consistent with the intent of this rule. 15A NCAC 07K 0209 Coastal Shorelines (c) Management Objective. The management objective is to ensure that shoreline development is compatible with the dynamic nature of coastal shorelines as well as the values and the management objectives of the estuarine and ocean system. Other objectives are to conserve and manage the important natural features of the estuarine and ocean system so as to safeguard and perpetuate their biological, social, aesthetic, and economic values; to coordinate and establish a management system capable of conserving and utilizing these shorelines so as to maximize their benefits to the estuarine and ocean system and the people of North Carolina. RECEIVED Consistent: The proposed development is consistent with the intent of this rule. JAN 0 9 7015 DCM-MHD CITY (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. These uses shall be limited to those types of development activities that will not be detrimental to the public trust rights and the biological and physical functions of the estuarine and ocean system. Every effort shall be made by the permit applicant to avoid, Daniel Govoni, Assistant Major Permits Coordinator NC WRC - Coinjock BAA Major Permit Recommendations January 6, 2015 Page 6 mitigate or reduce adverse impacts of development to estuarine and coastal systems through the planning and design of the development project. In every instance, the particular location, use, and design characteristics shall comply with the general use and specific use standards for coastal shorelines, and where applicable, the general use and specific use standards for coastal wetlands, estuarine waters, and public trust areas described in Rule .0208 of this Section. Development shall be compatible with the following standards: (1) All development projects, proposals, and designs shall preserve and not weaken or eliminate natural barriers to erosion including peat marshland, resistant clay shorelines, and cypress -gum protective fringe areas adjacent to vulnerable shorelines. Consistent: The proposed development is consistent with the intent of this rule. (2) All development projects, proposals, and designs shall limit the construction of impervious surfaces and areas not allowing natural drainage to only so much as is necessary to adequately service the major purpose or use for which the lot is to be developed. Impervious surfaces shall not exceed 30 percent of the AEC area of the lot, unless the applicant can effectively demonstrate, through innovative design, that the protection provided by the design would be equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas exceeding the 30 percent impervious surface limitation may be permitted if impervious areas are not increased and the applicant designs the project to comply with the intent of the rule to the maximum extent feasible. Consistent: The proposed development is consistent with the intent of this rule. (3) All development projects, proposals, and designs shall comply with the following mandatory standards of the North Carolina Sedimentation Pollution Control Act of 1973: (A) All development projects, proposals, and designs shall provide for a buffer zone along the margin of the estuarine water which is sufficient to confine visible siltation within 25 percent of the buffer zone nearest the land disturbing development. Consistent: The proposed development is consistent with the intent of this rule. (B) No development project proposal or design shall permit an angle for graded slopes or fill which is greater than an angle which can be retained by vegetative cover or other erosion -control devices or structures. Consistent: The proposed development is consistent with the intent of this rule. Significant adverse impacts include development that would directly or indirectly impair water quality standards, increase shoreline erosion, alter coastal wetlands or Submerged Aquatic Vegetation (SAV), deposit spoils waterward of normal water level or normal high water, or cause degradation of shellfish beds. Consistent: The proposed development is consistent with the intent of this rule. (5) Development shall not interfere with existing public rights of access to, or use of, navigable waters or public resources. Consistent: The proposed development is consistent with the intent of this rule. (7) Development shall not cause irreversible damage to valuable, historic architectural or archaeological resources as documented by the local historic commission or the North Carolina Department of Cultural Resources. Consistent: The proposed development is consistent with the intent of this rule. (8) Established common-law and statutory public rights of access to the public trust lands and waters in estuarine areas shall not be eliminated or restricted. Development shall not encroach upon public accessways nor shall it limit the intended use of the accessways. Consistent: The proposed development is consistent with the intent of this rule. (10) Within the Coastal Shorelines category (estuarine and public trust shoreline AECs), new development shall be located a distance of 30 feet landward of the normal water level or normal high water level, with the exception of the following: (A) Water -dependent uses as described in Rule 07H .O2O8(a)(1) of this Section; Consistent: The proposed development is consistent with the intent of this rule. 15A NCAC 07H06O1 No Violation ofAnv Rule No development shall be allowed in any AEC which would result in a contravention or violation of any rules, regulations, or laws of the State of North Carolina or of local government in which the development takes place. Skvarla, III Governor Secretary MEMORANDUM TO: Daniel Govoni, DCM Assistant Major Permits Coordinator Division of Coastal Management FROM: Charlan Owens, AICP, NE DCM District Planner Division of Coastal Management SUBJECT: Major Permit Request by the NC Wildlife Resources Commission to install 600 linear feet of riprap, a fishing pier facility to include a 20 foot wide by 250 foot long pier with a 16 foot by 16 foot gazebo on the Atlantic Intracoastal Waterway (ICW), two (2) 5 foot wide pier sections, a 5 foot wide by 100 foot wooden walkway, a 5 foot wide by 58 foot wooden walkway, and a 5 foot wide by 62 foot long concrete walkway, and reconfigure a parking area to include two (2) concrete spaces and five (5) gravel spaces; at the public boating access facility located at 482 Waterlily Road, in the community of Waterlily, Currituck County. Date: December 30, 2014 Consistency Determination: The request is consistent with/not in conflict with the Currituck County 2006 Core Land Use Plan (LUP) certified by the CRC on May 18, 2007 and amended on September 25, 2008 and June 24, 2009. Overview: The project site consists of a 3.05 acre lot with approximately 870 linear feet of shoreline along the Atlantic Intracoastal Waterway (ICW) and approximately 455 linear feet of shoreline along a connecting canal at the northern property line. The site elevation is 5 feet above Normal Water Level (NWL). The site is located within the AE Floodzone. Section 404 wetlands are located at the northeast corner of the site and a Coastal Wetland fringe is located along the ICW shoreline to the west. The shoreline along the ICW is subject to large wake from boat traffic and appears to be eroding at a rate of .5 feet per year. The resulting erosion escarpment ranges from 1 to 3 feet above NWL. The ICW is 360 feet wide at the project site. Water depths in the ICW adjacent to the shoreline are 1 foot below NWL and remain shallow for a distance of 30 feet before dropping to 15 feet below NWL in the channel. A public boating access operated by the NC Wildlife Resources Commission (WRC) is located on the property. Existing site improvements consist of a gravel access drive and parking area. There are no stormwater controls on the site. Runoff is either infiltrated into the natural sandy soils or sheet flows into the ICW. Existing shoreline improvements are located along the canal to the north and consist of 260 linear feet of riprap, two (2) concrete boat ramps, two (2) 10 foot by 38 foot bulkheaded docks, a 6 foot by 38 foot fixed dock, a 6 foot by 75 foot fixed dock, and a derelict boathouse. Installation of 600 linear feet of riprap, a fishing pier facility to include a 20 foot wide by 250 foot long pier with a 16 foot by 16 foot gazebo, two (2) 5 foot wide pier sections, a 5 foot wide by 100 foot wooden walkway, a 5 foot wide by 58 foot wooden walkway, and a 5 foot wide by 62 foot long concrete walkway, and reconfiguration of the parking area to include two (2) concrete spaces and five (5) gravel spaces are proposed. Riprap will tie into the existing riprap section at the mouth of the canal and follow the ICW shoreline south. The toe will average 4 feet waterward of NWL with a maximum distance of 5 feet. Total riprap width will be 8 feet. The ripap will be placed to avoid damaging Coastal Wetland areas. The fishing pier will be oriented parallel to the ICW shoreline with the gazebo at the southern terminus. The pier platform will average 23 feet waterward of NWL. Access will be provided by the wooden walkway sections, the 100 foot long section to the north and the 58 foot long section to the south. The concrete walkway will be placed adjacent to the parking area and connect to the southernmost walkway. The project results in a net decrease in impervious surface, therefore slightly reducing site runoff. Docking will not be allowed along the fishing pier. The waters of the ICW are classified as SC waters and are closed to shellfish taking. Submerged Aquatic Vegetation (SAV) are nonexistent within the project area. Based on available information, there are no archaeological resources on the property. Anticipated impacts resulting from this project are expected to include: the filling of 2,400 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC) and 2,400 sq. ft. of Public Trust/Estuarine Shoreline AEC, and; the shading of 2,914 sq. ft. of Public Trust Area/Estuarine Waters AEC, 4,279 sq. ft. of Public Trust/Estuarine Shoreline AEC, 45 sq. ft. of Coastal Wetlands AEC, and 1,321 sq. ft. of Highground outside of an AEC. Basis for Determination: The Currituck County Future Land Use Plan Map identified the project site as "Conservation Areas". Areas of Environmental Concern (AECs) are also designated as "Conservation Areas" on the Currituck County Future Land Use Plan Map as indicated on Page 11-1. As indicated on Page 11-2, "(t)he Conservation class should be applied to areas that should not be developed at all (preserved), or if developed, done so in a very limited manner characterized by careful planning and cautious attention to the conservation of environmental features. Infrastructure and services, public or private, should not be provided in these areas as a catalyst that could stimulate development.". The site is also located within the "Aydlett-Waterlily-Churches Island" subarea. Definitions of key words are provided on page 9-2.
