1) This renewal shall be attached to the Permit No. 30-15, which was issued to the permittee on 3/2/15,
as well as all subsequent renewals, modifications, and copies of all documents shall be readily
available on site when a Division representative inspects the project for compliance.
2) All conditions and stipulations of the active permit remain in force under this renewal.
NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No.
02-0730.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project SAW Action Id. No.
2010-00175.
NOTE: A permit renewal application processing fee of $100 was received by DCM for this project.
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

Dear Ms. MacPherson:
On behalf of the North Carolina Department of Natural and Cultural Resources (NCDNCR) and the USS North
Carolina Battleship Commission (the Battleship), S&ME formerly requests to expedite the renewal of the expired
CAMA Major Permit (No. 15-30) based on the same conditions originally submitted to the Division by permit
application dated December 11, 2014, and subsequent minor modifications that have been approved by the North
Carolina Department of Coastal Management (NCDCM). In reference to Figure AU from the minor modification
request (see attached), three major phases of the project were completed in May 2018 prior to expiration of
Permit 15-30. These phases included the following:
Coffer dam
Memorial Walkway
Boat docks and kayak launch
Projects listed in Permit No. 15-30 and conceptually presented in Figure A1.1 that have not been completed and
are planned for the future development include the following:

ADDITIONAL CONDITIONS
2) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
3) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
4) This Minor Modification shall be attached to the original permit, which was issued to the permittee on
3/2/15, and copies of both documents shall be readily available on site when Division personnel inspect
the project for compliance.
5) All conditions and stipulations of the active permit remain in force under this Minor Modification,
unless specifically altered herein.
6) No new excavation or filling of any open water area or vegetated wetlands is authorized by this Minor
Modification.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.

Dear Ms. MacPherson:
On behalf of the North Carolina Department of Natural and Cultural Resources (NCDCNR) and the USS North
Carolina Battleship Memorial (the Battleship), S&ME requests you issue a formal exemption determination for
certain activities associated with the repairs of the Battleship's hull, which has suffered severe corrosion damage at
the ship's waterline by elements of nature.
From 2015 to 2018, the Battleship, under CAMA Permit 15-30, constructed a cofferdam for the purpose of
performing maintenance activities to maintain the ship under US Navy requirements to address the emergency
condition of hull failure. This situation was formerly recognized by the North Carolina General Assembly, who
granted funding of $500,000 to initiate engineer design solutions for the necessary emergency repairs. In
addition, funds were also raised by the Battleship to complete tasks specified in Permit No. 15-30, which include
the construction of the Memorial Walkway and the boat docks. Tasks specified under Permit No. 15-30 that were
not completed include the following:
• Dock Master's Office and Park Restroom
• Construction of the bulkhead
• Parking lot upgrades (raising the lot three to four feet) and installing of stormwater control systems)
• Seawall upgrades and construction
• Demolition of Existing USS NC Museum and Visitor Center
• Construction of new USS NC Museum and Visitor Center
• Removal of existing pavilion and construction of an amphitheater stage on the park lawn
• Construction of the Open -Air Pavilion
• Phase I and Phase 2 of the Eagles Island Expedition Trail
To continue with the Memorial Park's upgrade developments, the Battleship will resubmit the CAMA Major permit
application to complete the development tasks listed above, which have not changed in scope since original
permit issuance or from subsequent minor permit modifications.

Exemption Determination

The State Construction Office has recently opened bids to perform hull repairs to the Battleship. The repair work
is scheduled to begin in mid -April 2020. It is the NCDCNR's and Battleship's interpretation of the rules that the
current hull repair, and future hull maintenance, within the coffer dam area is exempted from CAMA permitting
under 15A NCAC 07K .0103 (a).
"Maintenance" and "repairs" are specifically excluded from the definition of "development" under the
conditions and in the circumstances set out in G.S. 113A-103(5)(b)(5)."
G.S. 11 3A- 1 03(5)(b)(5) states:
"Maintenance or repairs (excluding_realacement) necessary to repair damage to structures caused
¢y the elements or to prevent damage to imminently threatened structures by the creation of protective
sand dunes."
Following instruction provided on the DCM's website, "individuals required to take such measures within an AEC
shall contact the local CAMA representative for consultation before beginning work." The intent for the
construction of the coffer dam, which was completed under the original CAMA Major permit, was to perform the
current emergency repairs, and future repairs as needed, without the need to obtain CAMA permits.
The hull repair to the Battleship clearly falls under the NCAC and General Statute reference above. In addition,
with the designed protections of the coffer dam, S&ME anticipates no adverse effects to the environment outside
of the cofferdam enclosure. The NCDCNR and the Battleship requests formal acknowledgement from NCDCM the
exemption from permitting for hull repair activities.

permit. It has been determined that development has occurred on site since the last permit action, however, the
permit has expired. Due to this determination, the inactive permit cannot be renewed under CRC rule, but the
rule does allow for circulation of the request to resource agencies to provide comment to any changes in
circumstances or site conditions, or changes in your agency's rules or development standards that
warrant a new application and CAMA major permit review.
Therefore, DCM is requesting that your agency review the above materials to determine if site conditions or
circumstances, or agency rules would prohibit DCM from issuing a renewal of the CAMA permit. Please provide
comment within 21 days of receipt of this email to any changes in site conditions or rules that would prohibit
DCM from issuing a permit renewal. If no reply is provided within 21 days of receipt, then DCM will assume
