as authorized by the State of North Carolina, Department of Environmental Quality
and the Coastal Resources Commission for development in an area of environment
concern pursuant to Section 113A-119 of the General Statutes, "Coastal Area
Management"
Issued to Brently Clay and Sherrie Turner authorizing development in both the Estuarine Shoreline (ORW) Areas of
Environmental Concern (AECs) along Chestnut Street, in North Topsail Beach, Onslow County as requested in the
permittee's application package, dated February 22, 2016, and received by DCM on February 22, 2016. This permit,
issued on March 7, 2016, is subject to compliance with the application and site drawing (where consistent with the
permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may
subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes: Installation of a gravel roadway.
(1) All proposed development and associated' construction must be done" in accordance with the permitted work plat
drawings(s) dated received by the Division of Coastal Management on February 22, 2016.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at (910) 766-7221 for a final inspection at
completion of work.

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. This permit must be on the project
,site and accessible to the permit officer when the project is inspected for
compliance. Any maintenance work or project modification not covered under
this permit, require further written permit approval. All work must cease when this
permit expires on:
December 31. 2019

(5) All buildings/structures shall comply with the NC Building Code, including the Coastal and Flood Plain Construction
Standards of the N. C. Building Code, and the Local Flood Damage Prevention Ordinance as required by the
National Flood Insurance Program. If any provisions of the building code or a flood damage prevention ordinance
are inconsistent with any of the following AEC standards, the more restrictive provision shall control.
(6) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Disturbed areas shall be vegetate and stabilized (planted and
mulched) within 14 days of construction completion.
(7) The amount of impervious surface/coverage on this property shall not exceed 25% within 575 feet of the Normal
High Water line.
(8) This permit does not authorize any development on Lot 4 Chestnut Street, in North Topsail Beach.
(9) The permittee is required to contact the Local Permit Officer (910) 796-7221, shortly before he plans to begin
construction to arrange a setback measurement that will be effective for sixty (60) days barring a major shoreline
change. Construction must begin within sixty (60) days of the determination or the measurement is void and must
be redone.
(10) Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise
disposed of to a third -party.
(11) If a court of competent jurisdiction determines that a party other than the permittee has legal title to any part of the
area approved for development under this permit, this permit shall be null and void as to the area the court
determines is not owned by the permittee. This condition shall take effect on the date such court judgment becomes
final. In such event, the permittee shall consult DCM prior to initiating or continuing any further development under
this permit

This notice is intended to Make you, the Iapplicant, aware of the
special risks and conditions associated with development in this
area, which is subject to natural hazards such as storms, erosion
and currents. The rules of the Coastal Resources Commission
require that you receive an AEC Hazard Notice and
acknowledge that notice in writing before a permit for
development can be issued.
The Commission's ruleson building standards, oceanfront
setbacks and dune alterations are designed to minimize, but not
eliminate; property: loss from hazards. By granting permits, die
Coastal ResOnrces Commission does hot guaranteejthe.safety of
the development and assumes no liability for future damage to
the development, Permits issued in the Ocean Hazard Area of
Environmental Concern include the condition that structures he
relocated or dismantled if they become imminently threatened
by changes in shoreline configuration. The structure(s) must be
relocated or dismantled within two (2) years of becoming
imminently threatened, and in any case upon its collapse or
subsidence.
The best.available information, as accepted by the Coastal
Resources. Commission, indicates that the annual long-term
average ocean erosion rate for the area where your property is
located is feet per year.
The rate was established by careful analysis of aerial
Photographs of the coastline taken over the past 50 years.
Studies also indicate that the shoreline could move.as much as

The flood waters in a major storm are predicted to be about

Preferred oceanfront protection measures are beach nourishment
and relocation of threatened structures. Hard erosion control

disturbed area outside the footprint of my property. I did not include the driveway disturbed area, as I assumed it
would be calculated in the other permit required for the house, that I have not yet submitted.

Good afternoon Mr. Turner. Heather Coats had forward me a message from you concerning the CAMA permit decision
date ... Just so you are aware, we (DCM) are due to make a decision on your project sometime after Monday 3/7/16.
I do have one question concerning your plan that needs to be addressed prior to permit issuance and that is the size of
the proposed gravel driveway leading from the road to the residence? Based on my calculations, the property is
approximately 8,035 sq. ft. allowing up to 2,008 sq. ft. of built upon area/impervious coverage. In short, your property is
located within 575' of the normal high water boundary of Stump Sound. As a result, built upon area/impervious
coverage is limited to less than 25% on the lot itself. So, if you have 2,008 sq. ft. of available lot space with
approximately 1,824 sq. ft. dedicated for the home with decking, that would leave you with approximately 184 sq. ft. of
space for a driveway or other impervious coverage.
It's unclear to me if your proposal includes a driveway extension onto your property as nothing was shown on the
submitted site plan indicating such, so I'm not certain if your request is to just grade and gravel Chestnut Street
extension or if it's for actual development on your property? This should be made clear before we move forward with
permit issuance. If you plan to complete/install the gravel drive from Highway 210 to the front of your residence, please
revise the site plan to include the addition of a 184 sq. ft. or less driveway extending from the road to your residence
(only for that portion within the boundaries of your property). If you do not intend to install a gravel drive on your
property, please clarify that in a written response. Again, I need to know this information prior to approval.

Thank you for the insight on the proposed roadway. However, I will need for either a Town or County official to confirm
this before moving forward with issuance of a permit in your name for that work.
Also, the 25% impervious limitation would include the driveway, regardless if it is proposed gravel or concrete.
Uncovered stairs and decking would not count toward the allowed built upon area (impervious coverage), as you have
questioned.

Good Morning Jason, based on meetings with the city and county.
- The roadway will be a private road.
o NC General Statue -Article 7-Chapter 136-96: The road was not used within 15 years of dedications and
reverts back to the adjoining land owners.
- I assume I would be responsible for the permit, as I am the first landowner needing access to my property.
- I have a road maintenance agreement with the other land owners as part of the deed of record and closing
documents.
- Understood house permit will be separate from road/drive permit.
- Regarding the 25% built upon area. this calculation counts impervious area only, uncovered stairs and decks are
not included in this calculation, is this correct?
o My driveway will be gravel, does this need to be counted. I assumed this was concerned pervious. Please
advise?
