Docking Facility 1) This permit authorizes only the expanded docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of formalized 4 boat slips. 6) The expanded pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 7) No attempt shall be made by the perminee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 9) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 10) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2006-00814). NOTE: The N.C. PROJECT DESCRIPTION The project site is located at 1512 Carolina Boulevard, adjacent to Banks Channel, Topsail Beach, Pender County. To find the property from the Wilmington Regional Office, take Highway 17 North from Wilmington approximately 20 miles and turn right on N.C. State Highway 210. Travel approximately 2.8 miles to the intersection of NC 210 and NC 50. Turn right onto NC 50/NC 210 and travel approximately 1.9 miles onto Topsail Island. Turn right onto S. Topsail Dr. /NC 50 and travel approximately 7.6 miles to Florida Avenue and turn right. Travel approximately 0.10 miles on Florida Avenue and the property will be located on the left hand side of the road. Existing structures on the project site include a single family residence, bulkhead and private docking facility. The project site is approximately 8,820 square feet and is vegetated primarily with native trees, domestic grasses and ornamental landscaping. The project site has approximately 60 feet of shoreline fronting Banks Channel. The existing bulkhead and docking facility was authorized under General Permits 43970 (issued 2/2006), 44839 (5/2006), 53938 (5/2009) and 54007 (5/2009). The current docking facility consists of an existing access 4' x 10' base platform that extends to the existing floating dock (8' x 25'). Two, 12' x 12' boatlifts are located on either side of the existing floater, with one boatlift encroaching within the riparian corridor setback of the property owner to the north. The Pender County 2006 Land Use Plan classifies adjacent waters and high ground portion of the property as Resource Protection. The waters of Banks Channel and the AIWW are classified SA by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to expand the existing docking facility by adding a 10' wide x 16' long floating dock section at the terminal end of the existing float. The proposed floating dock would be irregular in shape and would be approximately 8' wide at the connection of the existing float and would expand to approximately 12' at the terminal end. On average, the dock would measure 10' in width throughout. As designed, the expansion would increase the total number of possible slips at this property to four (4). Currently, water depths surround the existing facility, and the proposed expansion, range from -6.0' to -8.0', relative to Normal Low Water. F w�ti' 10. ANTICIPATED IMPACTS JUL 90 2015 nrr.e-aria. The proposed structure would incorporate approximately 160 sq. ft. of Estuarine Waters and Pubic Trust Area along the western side of the existing docking facility. The proposed structure would extend approximately 16' into a waterbody, which measures approximately 850' in width. This distance would conform to both the 1/4 width rule and the established pier lengths. The proposed structures would not encroach into the adjacent 15' Riparian Corridor Setback Area requirement. Minor increases in turbidity should be expected during construction. With the existing boatlifts we have, it has always been a chore parking, and now even getting the boat on and off the lifts is becoming more difficult due to the small amount of dock that is left to work with. I feel that if we increase the floating dock by 16' this will allow us to navigate this procedure with more accuracy and make it easier to load and unload family without worrying about a little one getting pinched between the lift and the dock. This would only take bringing in a new floating dock and ringing it to our existing floating dock and installing one piling at the end to secure it in place. No heavy equipment is needed and a small barge would only be there for the day, no storage of any equipment is required.
