REGAN babe nt BRAXTON DAVIS ortlernall3RAL awn Muir BUFFER AUTHORIZATION CERTIFICATE FOR PIER AND DOCKING FACTLTIES ACCESS WAY A riparian buffer authorization is required for pier and docking facilities access ways through the Tar-Pamlico& • Meuse River Riparian buffer per Division of Water Resources(DWR)regulations 15A NCAC 028.0233&.0259.The Division of Coastal Management(DCM),through a Memorandum of Understanding with the Division of Water Resources(DWR)has reviewed your project proposal and has determined that the project as proposed complies with the aforementioned regulations. Those activities covered by your Coastal Area Management Act(CAMA)permit have received Buffer Authorization provided the project Is constructed in a manner that continues to meet all of the conditions listed below.Failure to comply with this Buffer Authorization may subject the property owner and the party(contractor)performing the construction and/or land clearing to a civil penalty by DWR of up to$25,000 per day per violation. • t. Crossing is Perpendicular: Pier and docking facility access way must cross the 50 ft,riparian buffer perpendicularly(which Is defined as between 75 and 105 degrees)unless otherwise approved by DCM.The alignment shall minimize the removal of woody vegetation to the greatest extent practicable. 3. Pervious Materials:All reasonable measures shall be taken to ensure the access way is made of pervious materials like open-slatted wood or composite,mulch,or grass to meet the intent of the rules to the maximum extent practicable. 3. Access Width:The width of the pier or docking facility access way shall be limited to six(6)feet. 4. The biggest difference was the inclusion of the new land along greens creek for us, near the site in question. We are filing this survey with the county as the new property deed. The understanding that I have is that our dock is correctly oriented with the waterway, and that the new dock would also have to be oriented with the waterway. One of the worries that we have is that they will build it like Al's dock and have it slant toward our property. I still do not believe that there is enough room for them to fit a dock in there and have it correctly oriented, and have the 15 feet clearance. We have a new stake at the water's edge denoting the new corner of the property. In a couple weeks I plan to also put in some pipes that will mark the extent of our"area" in the water out nearer to our dock. This is in an effort to ensure that we all know where the line is. The biggest difference was the inclusion of the new land along greens creek for us, near the site in question. We are filing this survey with the county as the new property deed. The understanding that I have is that our dock is correctly oriented with the waterway, and that the new dock would also have to be oriented with the waterway. One of the worries that we have is that they will build it like Al's dock and have it slant toward our property. I still do not believe that there is enough room for them to fit a dock in there and have it correctly oriented, and have the 15 feet clearance. We have a new stake at the water's edge denoting the new corner of the property. In a couple weeks I plan to also put in some pipes that will mark the extent of our"area" in the water out nearer to our dock. This is in an effort to ensure that we all know where the line is. i I will be in Oriental Sept 9,10,11,12. If you have a chance to meet in that time it would be great. I have also advised Mr. Lowey that a survey marking the two corners on the water front would be in his best interest with area to establish any pier so tight and most contractors would want to know exact property lines to avoid impeding into the 15ft. set back. I am moving forward with getting my property surveyed and expect the report to be complete by the end of August.
