This permit, issued on December 10, 2018, is subject to compliance with the application and drawing dated and received by DCM on November 16, 2018 (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject the permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: Beach bulldozing (or compatible beach sand deposition) along the ocean front shoreline of property between 100 Oceanview Lane and 166 Oceanview Lane, North Topsail Beach. (1) Al proposed development and associated construction must be done in accordance with the permitted work plat drawings(s) dated received by DCM on November 16, 2018. (2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. (3) Any change or changes in the plans for development, construction, and/or land use activities will require re-evaluation and modification of this permit. S. Army Corps of Engineers, Wilmington District, 910-251A611. (6) This CAMA permit authorizes a one-time bulldozing or sand deposition (i.e. truck sand) event. No bulldozing is to be performed until the area has been monitored and certified clear of turtles by the Topsail Island Turtle Monitoring Program (only applicable from May 151 -Nov 150, of any year). (7) Any equipment/machinery used for dune reconstruction purposes (i.e. front end loaded, dump truck, bull dozer, etc.) shall be brought onto the beach at an existing authorized location, not across a stabilized dunesiberm or across individual private property outside of the properties authorized under this permit. (8) The movement of material utilizing a bulldozer, front end loader, backhoe, scraper, or any type of earth moving or construction equipment shall not exceed a "scraping" or trenched depth of one foot (1'), as measured from the pre - activity surface elevation. (9) The constructed and/or reinforced dune shall approximate a natural, average -sized feature in height and width. Multiple dunes are not allowed. (10) A gradual slope of 3:1 or flatter should be maintained on the ocean -facing dune side. (11) The beach bulldozing/sand deposition activities shall not exceed the lateral bounds of the permittee's property. (12) The proposed beach bulldozing/sand deposition activities shall not significantly increase erosion on neighboring properties and shall not have a significant adverse effect on important natural or cultural resources. (13) Equipment used to push beach sand or construct beach dunes shall not be operated waterward of the mean low water elevation contour. (14) Any and/or all storm debris in the immediate vicinity of the subject property, such as lumber, tires, etc. shall be removed prior to the bulldozing activity. (15) Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise disposed of to a third -party. (16) In issuing this authorization, the State and Federal Governments do not assume any liability for the following: (a) Damages to other permitted or unpernitted activities or structures caused by the authorized activity; and (b) Damage claims associated with any future modification, suspension, or revocation of this authorization. This work which will be done within the lateral limits and other requirements of LAMA and may include trucked in sand deemed compatible by CAMA and a beach sand push in accordance with CAMA requirments. Attached are copies of the Agent Authorizations/consent agreements from the Oceanfront Owners of OSV. Although the email communication from Lot 5 (Sauer) appears to be a consent, a subsequent email made it clear that he was not appointing me as Agent and was proceeding independently with CAMA. Accordingly he was sent the CAMA consent form for Lots 4 and 6. 3. Copies of CAMA notice forms to adjacent property Owners (certified mail RRR) are attached. The Property owner adjacent to OSV Lot 19 in Hampton Colony is Raymond M. and Carol M Saravtz and the owner adjacent to OSV Lot 1 is G&L Capital Holdings. As indicated above the CAMA notice consent form was also sent to OSV Lot 5 Owners. This information was obtained from Onslow County Property Tax records. 4. The proposed location of the re -constructed dune will run along the entire 1375.62' of OSV as noted on the attached 1/12105 plot plan in yellow. The sand trucked in would come out no further than 25' from existing dune where one exist, and where none exist to line it up with other reconstruction including the berm NTB constructed on G&L Capital Holdings (Jefferies) adjacent to OSV Lot 1. Each OSV Owner will make individual determination of how much sand to put on their property. The maximum for any Owner would be 300 cubic yards which would result in a new dune approximately 6' high, 75' or 60' wide and an average of 18'deep or thick (10' at top of dune and 25' at base). If every Owner went the maximum (which is unlikely) it would require approximately 5220 cubic yards approximately 7300 tons for the 1300' of ocean frontage . The dunes between the homes and the ocean were significantly damaged by Hurricane Florence in September 2018. Lots I to 6 had the dune completely destroyed and Lot 16 had approximately %2 of the dune completely destroyed. Other lots are estimated to have lost 30' to 40' of dune protection . The Town of North Topsail Beach, where OSV is located, has indicated an intention to haul in sand (or to pump sand in) to restore the berm/dunes but due to financial limitations may not be able to do so in the foreseeable future. Similarly the Town has indicated an intention to do a beach sand push, most likely in early 2019. OSV does not want the berm/dune restoration contemplated by this Permit to preclude the Town from doing its berm/dune restoration in early 2019 under its permits. Under our proposed plan, each Owner will pay for the work on their Lot and therefore will decide how much sand to truck in and whether to participate in a bulldozer sand push. Preliminary indications are that most, if not all, will participate in both programs. Owners of Lot 1 and Lot 16 have authorized beach access through their property for the trucked sand to be brought in. We would intend to do the trucked in sand before a sand push, neither of which will restore our dunes to the pre -Florence height or thickness. .
