A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the
subject permit application for proposed actions that impact fish and fish habitats. The applicant
proposes to modify LAMA Major Permit #10-15 with the addition of a 12' x 32' boat ramp, a 6' x 24'
pier, two mooring pilings adjacent to the pier, and two 10' sections of bulkhead adjacent to the boat
ramp. The project location is in a "marsh pond" connected to open water by a 16' wide opening.
DCM fisheries objects to the project as proposed. The location of the boat ramp in the "marsh pond"
does have sufficient depths to support a boat ramp but there are insufficient depths for ingress and
egress of motorized vessels to the ramp location. A site visit conducted by staff of 10/22/15 found
depths in narrow opening of the marsh pond to be one foot on average. Shallow depths and submerged
aquatic vegetation (mainly eelgrass) also exist on the wide flat leading into the Pamlico Sound. This flat
and the opening to the "marsh pond" are areas unavoidable for vessels using this ramp and crossing
these areas with a motorized vessel is likely to cause significant adverse impacts to habitat by prop -kick
when used.

On December 1, 2014, John and Linda Maxwell were issued a 401 Certification Authorization under DWR No.
14-1192 for the construction of rip -rap revetment adjacent to wetlands and rip -rap baffles. On October 16,
2015, this Office received a request from Katherine McGlade, authorized agent.for John and Linda Maxwell,
to modify the 401 Certification as follows:
1. Construct of a 12 ft by 32 ft boat ramp including a 6 ft:by24 ftdock with 2•moorings poles and two
30,ft sections of bulkhead on either side of the ramp with,amalignment approximating normal water
,level and 16-ftreturn wall.
Based review of the available information and an inspection of the subject property conducted by Robert Tankard
ancPAnthony Scarbraugh of the DWR on October 22, 2015, this Office request clarification on the following items:
No information•was provided regarding the presence or absence of submerged aquatic.vegetation
(SAV) within the project area including the access channel. Please provide aSAVsurvey that project,
area and associated access channel.
'Noiinformatiomwas,provided regarding the depths of proposed boat ramp or adjoining waters. 'Please,
.provide depth measurements to ensure that secondary and cumulative impacts, to'shellfish', and.
submergedaquatic beds will not occur due to propeller dredging. .
• In addition, no impacts to.401/404 wetlands were 'proposed. However, the construction of the
proposed boat ramp, bulkheads, and return wall may encroach on 401/404 wetlands and,therefore
coordination with US Army Corps of Engineers will be required to identify possible areas of impact.
,Pursuant to 15A NCAC 2B. 0220 (1)(2) and Title 15A NCAC 02H .0506 (a)(7) and (b)(2), this request to modify.
the existing 401 certification will not be approved until the applicant furnishes all of the above requested
,information for proper consideration of the modification request.

Minor Modification to Major Permit
1. Katherine McGlade has requested a Minor Modification to Major Permit #10-15, which was
issued on January 23, 2015 and expires on Dec. 31, 2018. The original major permit
authorized the placement of 750 ft of rip rap for shoreline protection.
2. Ms. McGlade has requested the major permit be modified to construct a 12 ft by 32 ft boat
ramp including a 6 ft by 24 ft dock with 2 mooring poles and two 10 ft sections of bulkhead
on either side of the ramp with an alignment approximating normal water level and 16 ft
return walls.
3. I conducted a site visit on June 30, 2015 to review the Minor Modification request pursuant
to the provisions of reference (a) and have determined that the request meets the requirements
contained in 15A NCAC 07H .0300 USE STANDARDS
4. The required fee of $100, paid by check #1438, was received by our office on 7/21/15.
5. It is recommended that the Minor Modification request be granted for the construction of the
deck additions provided all the Permit Conditions of the original permit remain in affef4CE1WD

Any idea when you might be in the Frisco area? I've got a major permit that was issued (John & Linda Maxwell #10-15)
that was for rip rap revetment for wetland protection. They are applying for a modification to add a boat ramp, I've
looked at the area where the boat ramp is proposed and we are not claiming as coastal wetland but was thinking you
might want to take a look just to be sure on your end. I believe it should be alright but just wanted to coordinate with

Thank you for coming to Frisco to review the location of the proposed new boat ramp
and dock and to see the completed marsh toe revetment project.

project does not require any dredging. The opening to the "pond" area and the "pond"
itself has sufficient depth for ingress and egress of a Carolina skiff.

Shoreline Protection
1) Unless specifically altered herein, this permit authorizes only the construction of the riprap
revetments and baffles that are expressly and specifically set forth in the permit application and
workplan drawing.
2) The authorized riprap revetments and baffles shall adhere to the alignment depicted on the attached
workplan drawings.
3) The alignment of the permitted riprap revetments and baffles shall be staked by a representative of
the Division of Coastal Management within a maximum of 30 days prior to the start of any
construction.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the perrmttee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2018
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient
prevent its movement from the approved alignment by wave or current action.
5) The riprap material shall consist of clean rock or masonry materials such as but not limited to
marl, or broken concrete.
6) The baffles shall be marked at both ends with yellow reflectors extending at least three feet
normal high water level.
Sedimentation and Erosion Control
7) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fen
diversion swales or berms, etc.).
General
8) No Coastal Wetlands shall be excavated or filled, even temporarily.
9) The permittee and/or his contractor shall meet with a representative of the Division prior to pro
initiation in order to discuss the conditions set forth in this permit.
10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without
written approval of the Division of Coastal Management.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local pern
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this pert
Contact a representative of the Division at (252) 264-3901 prior to the commencement of ;
such activity for this determination. The permittee is further advised that many non-m
dependent activities are not authorized within 30 feet of the normal water level.

Hello all,
Just wanted to send out a quick recap of yesterday's meeting to be sure we are all on the same page. Broadly, the
resource agencies (DWR, WRC, Fisheries Resource) had concerns regarding depths at the ingress/egress point to the
"pond" area and out to connecting waters, potential presence of/impacts to SAV within the ingress/egress path, and
potential wetland impacts at the site of the boat ramp. To address these habitat concerns the following action items
were discussed and agreed upon:
• DCM will contact USACE to determine the status of wetlands within the boat ramp/bulkhead alignment and any
potential mitigation steps, in consultation with Ms. McGlade
• To address soft bottom impacts, Ms. McGlade will identify an ingress/egress channel with 3' water depths, and
notify DCM of the proposed alignment
Upon completion of these action items we can address the steps necessary to move forward. Please let me know if this
recap accurately reflect yesterday's discussion, and, if there is anything I've missed, please do not hesitate to provide
additional input.

I appreciate the time we spent on the phone yesterday regarding the Maxwell property in Frisco, NC. I have
thought about the comments that you received from the two agencies and am still unable to comprehend turing
down this proposal.
I would like to see the agencies comments in writing so that I can try to understand what it is that they are trying
do.
I know this much:
• there are no restrictions to boat traffic coming or going from the site of this proposed boat ramp and no
dredging has been proposed,
• since this is a public trust waterway, the state has a mandate to facilitate access to it,
• there is no public boat ramp anywhere within 20 miles of this location so the Maxwells have no public
alternative close by
The fact that the bay in front of the home has some submerged aquatic vegetation does not present a rationale
for turning down this permit. Any boat can drive in that bay any time, and the Maxwells have the same privilege
enjoyed by all boaters. My understanding of your process is that the agencies are supposed to review impacts of
the boat ramp and dock itself specifically in the area where they are being placed. I would like to understand
how we can continue to pursue this permit modification.Perhaps an on site meeting with the agency
representatives? Or a phone conference?
Please let me know your thoughts.

The application for modification specifically mentions ingress and egress of a Carolina Skiff. But johnboat or a— uT'-IRIERII•
flat bottom boats range in size from 10ft to over 20ft as well. Not to mention everyone only wants a kayak launch or
small skiff until they want a larger vessel. I am mainly concerned especially since the modification could lead to an
existing use situation and end up with a dredge proposal of not only that little pond area but the adjacent flat out to the
sound. It also include mooring at the dock which is very close to the area of the drawing that included depths of 9-14" in
the original application.

Thanks Shane. I just got off the phone with Kelly and she said she would contact the applicant to get a depth. She also
assured me that the applicant was only planning to launch kayaks and jon boats. I understand that does not address the
concern of potential future property owners with larger boats. I'm going to talk to Doug and see what he recommends
for ensuring we have sufficient depth measurements throughout the area. I will let you know and thanks for sending
along the SEPA information.
