This permit, issued on September 244 2015 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to oe nuu ana voia. Docking Facility 1) Except as specifically altered herein, this permit authorizes only the modified docks and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this modified docking facility without permit modification. No non-water'dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit No. 94-15 Page 3 of 3 General 14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 15) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 16) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. 17) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2015-00721), which was issued on 6/24/15. NOTE: The N.C. Division of Water Resources assigned the proposed project DWQ Project No. 05- 19950. NOTE: Future development of the pemrittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: An application processing fee of $250 was received by DCM for this project. Give complete description: Marlee Acres Recreational Club Inc. is proposing to modify their two existing docking structures on their property at the end of Harbor Drive in the Marlee Acres Subdivision adjacent to the Atlantic Intracoastal Waterway (AIWW). Specifically, they will be modifying both docks they have on the recreational parcel. On their eastern dock, they are proposing to extend their walkway by 22 feet, remove the existing floater and gangway, and add a new floater (10ft.x22ft.) with a gangway (3ft.xl6ft.) on the eastern side of the walkway that will also be aligned parallel with the edge of the AIWW channel setback. On their western dock, they are proposing to add a new floating dock (10ft.x22ft) with a gangway (3ft.xl6ft.) to the western side and aligned parallel with the AIWW channel setback. Since water depths are below 2 feet at MLW at the waterward end of both of the proposed structures, chain limiters will be placed at MLW mark to restrict the floating docks from resting on the bottom at MLW. The applicant proposes to expand and reconfigure two existing community docks. Site plans designate these docks as Dock A (eastern dock) and Dock B (western dock). Adjacent waters are classified as Primary Nursery Area (PNA), supports shellfish harvest (SA), and are closed to shellfish harvest by the Division of Marine Fisheries Shellfish Sanitation Section. A scoping meeting was conducted to discuss the details of the application. Depths recorded at Mean Low Water (MLW) between the scoping meeting and the application resulted in depths reduced by approximately 1.5ft. The proposed construction is described below. Dock A The applicant proposes to extend the pier 22ft., remove an existing 8ft.x14ft. floating dock and construct a 10ft.x22ft. floating dock on the eastern side of the pier, just inside the AIW W 80ft. setback. Dock B The applicant proposes to construct a 10ft.x22ft, floating dock on the western side of pier, just inside the AAIW 80ft. setback. PNA's are estuarine waters where initial post -larval development occurs. Species within this area are early post -larval and juvenile and include finfish, crabs, and shrimp. Species inhabit PNA's areas because they afford food and protection during vulnerable periods of their life history. In order to protect the PNA habitat, and since the floating dock is an existing structure, it is recommended that Dock A's proposed floating dock dimensions be limited to the dimensions of the existing floating dock (8ft.x14ft.), 24" stops be installed to reduce direct and regular impact to the substrate, and it be placed in the proposed deeper water location. These alterations, with the increase in pier length, will reduce the direct impact to the PNA. Dock B's floating dock is proposed at the limit of the AIW W 80ft. offset in a depth of -1.34 to-1.59ft. at MLW. At this depth the floating dock would be resting on the substrate at MLW, directly and regularly impacting the substrate. In addition the limited number of parking spaces does not adequately show the need for six boat slips. With this information it is recommended that Dock B's floating dock not be permitted. PROJECT DESCRIPTION The project site is located at 2049 Harbor Drive SW, adjacent to the Atlantic Intracoastal Waterway (AIWW), on the mainland side of Ocean Isle Beach, in Brunswick County. To locate the property from the intersection of US Highway 17 S and NC Highway 904, turn left onto NC HWY 904 and travel approximately 3.6 miles to NC-179/NC-904/Beach Drive SW. Turn left onto NC-179/NC-904/Beach Drive SW and travel 0.3 miles to Harbor Drive SW. Turn right onto Harbor Drive SW and drive to the end of the road. The project site is located at the street end of Harbor Drive SW The project site is a 0.698-acre parcel of land with approximately 397 feet of shoreline frontage on the AIWW. The property has an average elevation of approximately 4' above mean sea level. The high ground property consists of lawn grasses, landscaping and a gravel driveway and parking area. The entire shoreline of the property has an existing wooden bulkhead measuring approximately 432 linear feet including the return walls. Waterward of the existing bulkhead is an area of low marsh, consisting of Smooth Cordgrass (Sportina alterniflora), which varies in width from approximately 15 to 45 feet in width. Extending from the bulkhead on the west side of the project site is a fixed access pier measuring approximately 8 feet in width by 132 feet in length with a partially covered "L" head platform measuring approximately 13 feet in width by 30 feet in length and extending to the east. The fixed "L" head platform is connected via access ramp to a floating dock measuring approximately 10 feet in width by 22 feet in length. The existing "L" head platform and floating dock are located water ward of the Army Corps of Engineers federal channel setback. On the east side of the project site is a concrete boat ramp measuring approximately 15 feet in width by 67 feet in length. An access pier is located on the east side of the boat ramp and measures approximately 4 feet in width by 79 feet in length. At the end of the access pier, extending to the east and connected via access ramp, is a floating dock measuring approximately 8 feet in width by 14 feet in length. The adjacent properties to the east and west are residential home sites. The waters of the Atlantic Intracoastal Waterway are classified "SA" by the North Carolina Division of Water Quality. The waters are designated as a Primary Nursery Area by the North Carolina Marine Fisheries Commission and are closed to the harvesting of shellfish. PROPOSED PROJECT The applicant proposes to extend the existing fixed access pier adjacent to the boat ramp, remove an existing floating dock, and install a new floating dock. The applicant is also proposing an additional floating dock on the existing western access pier. The applicant is proposing to remove the existing 8 feet wide by 14 feet long floating dock extending from the eastern access pier. As proposed, the western access pier would be extended approximately 22 feet water ward. The proposed pier extension would terminate at the ACOE federal channel setback where an access ramp would connect to a proposed floating dock measuring approximately 10 feet in width by 22 feet in length extending to the east. Water depths in this location are approximately -1.25 feet at Mean Low Water (MLW). ANTICIPATED IMPACTS The applicant's proposal to extend the existing fixed access pier adjacent to the boat ramp and install two (2) new floating docks would result in the incorporation of approximately 528 additional square feet of Estuarine Water and Public Trust Waters AECs. Water depths in the location of the proposed floating docks are less than 2 feet at MLW and the applicant has proposed chain "stops" to prevent the floating docks from resting on the bottom at periods of low water (see figure 3 of 3). The proposed floating dock on the eastern access pier would encroach into the 15-foot adjacent riparian property owner setback. As proposed the facility would provide mooring for six (6) vessels. This application package is considered complete and it contains all of the pertinent information required in order for your office to approve these proposed actions. The following narrative explains the history, our approach, purpose, and need as well as any applicable agency oversight during this development process. Background Marlee Acres Recreation Club (MARC) is located in the lower end of Brunswick County within the Ocean Isle Beach Community right on the banks of the Atlantic Intracoastal Waterway (ICW). While a separate entity, the MARC is considered an amenity facility for the property owners for the Marlee Acres Subdivision. Currently, there are 131 members of MARC, but there are 59 more lots available in the subdivision for a total of 190 members that will utilize the Club. Living in the Marlee Acres Subdivision gives access to residents and citizens with second homes the ability to smell the salty air and live within a waterway community with immediate available access to public resources waters, including: the ICW, Tubb's Inlet, Shallotte Inlet, Atlantic Ocean, and all other accessible waters within the area. Members/property owners can enjoy the ICW along the grassed parking lot for an afternoon picnic or from one of the two existing docks extending into the ICW. For members and their RECEIVED guests to enjoy water sporting activities, the two existing fixed docks have one floating dock each that can accommodate two boats each or a total of four boats at any given time. Permits for the existing docks, boat ramp, and bulkhead were permitted under a CAMA Major Permit in February 2006. Marlee Acres and the entire ICW community of Brunswick County is highly sought after for its proximity to the ocean and the immediate access opportunities for owners right within the subdivision at the MARC along the ICW. The existing dockages are used by the community for temporary docking to provide land/water access. With 131 members and 59 more lots available, the four spaces available for docking are grossly deficient to accommodate the demand for mooring throughout the entire year. More dockages are needed to better accommodate the members of this community. Additionally, two other environmental constraints provide difficulty in developing additional structures on this property. The water -ward property area extending out from the bulkhead towards the ICW channel is located within a designated primary nursery area that prohibits any depth modifications to include dredging in this area. Between the vegetated line next to the bulkhead and the ICW channel, water depths are limited and all mooring structures need to be pushed further towards the channel to access deeper water especially during the low tide. However, the federal channel setback prohibits placing any new structures or modifying any existing structures within the federal channel setback that restricts how far water -ward these structures can be placed. All of the structures planned have been meticulously -placed and designed to minimize and avoid impacts to the sensitive environmental resources found on site, including: the primary nursery area, federal channel protection, and coastal vegetated wetlands located along the shoreline. Description of Proposed Structures MARC intends to remove one deficient floating dock in shallow water and add two additional floating docks (2 @ 10' x 22') aligned to the edge of the federal channel setback to increase their mooring ability from four slips to six slips and to access deeper water when possible. For identification purposes, the two dockages and walkways can be identified as the "western dock" and the "eastern dock". One floating dock (10' x 22') with associated gangway (3' x 16') will be added to the western side of the "western walkway" and aligned parallel to the federal channel setback and RECEIVED accommodate medium to large vessels. The walkway will be extended channel -ward 22 feet and then a new floater (10' x 22') with associated gangway (3' x 16') will be added parallel to the federal channel setback on the eastern side of the "eastern dock" walkway to access deeper waters and accommodate medium to large vessels. The new floater will be anchored with four pilings. Since depths are limited and are below two feet at the water ward end of the structure, a chain limiter will be added to restrict the floating dock from descending past the MLW depth. Regulatory Coordination Prior to submitting this package, we contacted Holley Snider of your office in December 2014 for advice for completing our proposed dock modifications and to review our preliminary drawings and package. The included package is a result of these multiple conversations and correspondence concerning this project between December 2014 and February 2015. We expressed our need for additional mooring capabilities and greater access to deeper water. After going through several design renditions, the proposed design plan was developed to provide the greatest usage with the least environmentally damaging plan. Prior to proceeding, Ms. Snider advised us to have a new survey of the water -ward features to accurately identify the location of the existing structures, the federal channel and setback, vegetation line, and water depths. In February 2015, Registered Surveyor, Rick Thompkins of Thompkins Surveying of Ocean Isle Beach, completed a survey to include the required requested items. Afterwards, all of the proposed dock modifications and additions were drawn with respect the new latest survey. In light of the new survey, the location of the existing fixed pierhead, gangway, and floater on the "western dock" were juxtaposed across the federal channel setback line. Ms. Snider recommended that we contact Justin Annette of the U.S. Army Corps of Engineers to obtain advisement on these matters prior to commencing. According to a conversation in January 2015 with Justin Annette of the Wilmington District of the U.S. Army Corps of Engineers, the existing structures across the setback line as expressed to him do not have to be removed, but cannot be modified whatsoever. Therefore, the placement of the new floating dock and gangway on the "western dock" was modified to attach to the walkway and not the existing structure or fixed pierhead. Further coordination with Ms. Snider was undertaken throughout the month of January and February of 2015 to further explore our regulatory options and to define our final project RECEIVED proposal plans. JUN 04 2015 Furthermore, we had an interagency meeting on April 8, 2015 with all interested parties to Aa"y review the project plans and for suggestions. During the weeks of April 6m and 13t^, Thompkins Surveying collected new data to comply with request. As a result, depths measured at the locations of the proposed structures were marginal and chain limiters were added to the design to restrict the floating dock from descending to lower elevations. Adiacent Landowner Concurrence When any development activity along the riparian corridor is proposed, the adjacent riparian property owners must be notified and given the opportunity to comment. When the proposed activity is located within 15 feet of the adjacent landowners riparian area, the adjacent landowner must waiver the 15 foot setback requirement in writing. The landowner's riparian area is determined by a vector extending perpendicularly from the ICW channel centerline to the common property corner along the water -ward boundary of the subject properties. These lines were drawn on the plans from the most recent survey to determine the distances the proposed structures are to these riparian area designations. The "western dock" proposed floating dock and gangway addition is proposed 47.3 feet from the adjacent property owner's riparian area. However in March 2015, the proposed design plans and application were shown to the owner of the adjacent parcel with Parcel ID# 242MD00101, Patsy Eason of 3897 Red Hill Road, Whiteville, N.C. 28472. After a thorough explanation by a board member of the MARC, Ms. Eason signed and indicated on the "Adjacent Landowners Statement" that she did not object to the proposed activities. The "eastern dock" proposed floating dock, gangway addition, and walkway extension is proposed to be 1.4 feet from the adjacent property owner's riparian area. However, in March 2015, the proposed design plans and application were shown to the owner of the adjacent parcel with Parcel ID# 243PC002, Patricia Green (surviving spouse of deceased L.C. Green) of 10557 Rough and Ready Road, Cerro Gordo, N.C. 28430. After a thorough explanation by a board member of the MARC, Ms. Green signed and indicated on the "Adjacent Landowners Statement" that she did not object to the proposed activities and waived the 15-foot setback requirement. Both "Adjacent Landowner Statements" are signed, dated, and attached to this package.
