This permit, issued on September 30, 2015 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to tines, imprisonment or civil action; or may cause the permit to be nun and votu.
Docking Facility
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that ate expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2018
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of 4 formalized boat slips.
6) No portion of the Authorized docking facility, including tie piles, shall extend more than one quarter of
the width of the water body. Measurements to determine width of the water body shall be made from
the waterward edge of any coastal wetland vegetation which borders the water body.
7) Any portion of the permitted access pier and docking facilities built over coastal wetlands shall not exceed
six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured
from the bottom of the decking.
8) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct
view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee
walls are permitted. Lattice is specifically excluded from being used under this authorization.
9) The roof of the covered platform shall not be designed for second story use.
10) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor to the east, which is
determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel
line that intersects with the shore at the point where the upland property line meets the water's edge.
NOTE: Should Lot 1 be sold prior to the initiation of construction, the permittee shall be required to obtain
a signed riparian corridor waiver from the new property owner prior to the placement of any
structures within the 15 foot riparian corridor.
11) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.

12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.

13) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the .United States in the public
interest.
14) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
15) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Manatee Guidelines, and strictly adhere to all
requirements within. The guidelines can be found at:
http://www.fws.gov/nc-es/mammal/manatee_ guidelines.pdf.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project Action ID No. SAW-2015-
01459).
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR-
15-0639.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Divlsion.at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The permittee is advised that any development or land disturbing activity that is considered non -
water dependent is not authorized within 30 feet of the normal high water level unless specifically
exempted by Coastal Resource Commission (CRC) regulations in place at the time of such
development.
NOTE: An application processing fee of $250 was received by DCM for this project.

Reference your application for a Department of the Army permit to construct a docking
facility, in navigable waters of the United States, within Bogue Sound, at 10022 Coast Guard
Road, in Emerald Isle, Carteret County, North Carolina
Your proposal has been reviewed and found to be consistent with the provisions and
objectives of the CAMA-Corps Programmatic Permit process (copy attached) for construction
activities that receive authorization from the State of North Carolina. Therefore, you may
commence construction activity in strict accordance with applicable State authorization, attached
Federal special conditions, and the approved plan. Failure to comply with the State authorization
or conditions of the Federal permit could result in civil and/or administrative penalties.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization

SPECIAL CONDITIONS

1. In order to further protect the endangered West Indian Manatee, Trichechus manatus,
the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and
strictly adhere to all requirements therein. The guidelines can be found at
http://www.fws.gov/nc-es/mammal/manatee auidelines.pdf.
2. Dredging is not authorized.
3. No portion of the reconfigured or newly constructed structure is authorized to be
within the U.S. Army Corps of Engineers Federal Channel Setback.
4. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities.
For further information, the permittee should'cdntact the U.S. Coast Guard Marine Safety Office
at (910) 772-2191.
5. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit. Any modification to these plans must be
approved by the US Army Corps of Engineers (USACE) prior to implementation.
6. The docks and piers extending over wetlands will be elevated sufficiently (a
minimum of 3 feet) above the wetland substrate to prevent total shading of vegetation, substrate,
or other elements of the aquatic environment.
7. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States.
8. Approval of the structure is based on determinations that there would be no
obstruction to navigation: The structure may be damaged by wave wash from passing vessels.
Issuance of this permit should not be construed, as relieving the permittee of taking proper steps
to insure the structure and moored boats will not be damaged by wave wash.
9. The authorized structure and associated activity must not interfere with the public's
right to free navigation on all navigable waters of the United States. No attempt will be made by
the permittee to prevent the full and free use by the public of all navigable waters at or adjacent
to the authorized work for reason other than safety.

10. Except as specified in the plans attached to this permit, no excavation, XNP CITY
mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
11. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
12. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
pernttee shall immediately report it to the N.C. Division of Water Quality at (919) 733-5083,
Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
13. Unless otherwise authorized by this permit, all fill material placed in waters or
wetlands shall be generated from an upland source and will be clean and free of any pollutants
except in trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
14. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
15. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. 'A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
16. The permittee shall employ all sedimentation and erosion control measures necessary
to prevent an increase in sedimentation or turbidity within waters and wetlands outside the
permit area. This shall include, but is not limited to, the immediate installation of silt fencing or
similar appropriate devices around all areas subject to soil disturbance or the movement of
earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must
remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973
(North Carolina General Statutes Chapter 113A Article 4).

17. The activity will be conducted in such a manner as to prevent a significant increase
in turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
18. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such
time and manner as the Secretary cf the Army or his authorized representative may direct, restore
the water or wetland to its pre -project condition.
19. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must.be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

2698 within twenty (20) days of this decision on your permit. You should also be aware that another
qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work

maintenance requires additional approval. Please read your permit carefully prior to starting work and review
all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to
be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we

You have our approval, in accordance with the attached conditions and those listed below to construct a 4-
slip docking facility as described in your LAMA application dated June 24, 2015, and received by the
Wilmington Regional Office (WiRO) Division of Water Resources (Division) on June 26,.2015. After
reviewing your application, we have decided that the impacts are covered by General Water Quality
Certification Number 3900 (GC 3900). This Certification allows you to use the General Permit No.
198000291 permit when issued by the US Army Corps of Engineers and the CAMA Major Permit when
issued by the Division of Coastal Management. In addition, you should obtain or otherwise comply with
any other required federal, state or local permits before you go ahead with your project including (but not
limited to) Erosion and Sediment Control, Non -discharge, Water Supply Watershed, and stormwater
regulations. Also, this approval to proceed with your proposed impacts or to conduct Impacts to waters
as depicted in your application shall expire upon expiration of the 404 or CAMA Permit.
This approval requires you to follow the conditions listed in the attached certification and any additional
conditions listed on the following pages.
The Additional Conditions of the Certification are:
1. This approval is for the purpose and design described in your application. The plans and specifications for
this project are incorporated by reference as part of the Certification. If you change your project, you must
notify the Division and you may be required to submit a new application package with the appropriate fee.
If the property is sold, the new owner must be given a copy of this approval letter and General Certification
and is responsible for complying with all conditions. Any new owner must notify the Division and request
the Certification be issued in their name (15A NCAC 02H .0501 and .0502).
2. Any final construction plans for this project must include or reference the application and plans
approved by the Division under this authorization letter and certification. The applicant will also be
required to evaluate all acquired permits to assure that they are consistent and all relative impacts are
accounted for and shown on the construction plans. [15A NCAC 02H .0502 (b) and 15A NCAC 02H
.0506 (4)] The applicant shall require his contractors (and/or agents) to comply with all of the terms
of this Certification, and shall provide each of its contractors (and/or agents) a copy of this
Certification.

3. SAVs
Please note that the area surrounding the proposed project contains submerged aquatic vegetation
(SAVs). No impacts to SAVs are authorized by this certification outside the approved impacts
specified herein. (15A NCAC 02B .0221 and 15A NCAC 07H .0208(b)]
4. Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded as
described in 15 A NCAC 2B..0221. Appropriate sediment and erosion control practices must be
used to meet this standard. Turbidity curtains shall be used as appropriate. Please notify this

S. This General Certification shall expire on the same day as the expiration date of the corresponding
General Permit. The conditions in effect on the date of issuance of the Certification for a specific
project shall remain in effect for the life of the project, regardless of the expiration of this
Certification.

the construction and maintenance of this project, and shall provide each of its contractors and/or
agents associated with the construction or maintenance of this project a copy of this certification.

7. Continuine Compliance:
The applicant/permitee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with 303(d) of the Clean Water Act), and any other appropriate requirements of State
and Federal law. If the Division determines that such standards or laws are not being met,
including failure to sustain a designated or achieved use, or that State or Federal law is being
violated, or that further conditions are necessary to assure compliance, than the Division may
reevaluate and modify this General Water Quality Certification. (15A NCAC 02H .0507(d)]
8. All mechanized equipment operated near surface waters or wetlands will be regularly inspected
and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic
fluids or other potential toxic chemicals. In the event of a hydrocarbon or chemical spill, the
permitee/contractor shall immediately contact the Division of Water Quality, between the hours of
8 am to 5 pm at the Wilmington Regional Office at 910.796.7215 and after hours and on weekends
call (800) 858-0368. Management of such spills shall comply with provisions of the North Carolina
Oil Pollution and Hazardous Substances Control Act. [15A NCAC 02H .0506 (b)(3) and (c)(3), 15A
NCAC 02B .0200 (3)(f), and GS 143 Article 21A].

9. Fueling, lubrication and general equipment maintenance should not take place within 50 feet of a
waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC 02H .0506 (b)(3) and

10. This certification grants permission to the director, an authorized representative of the Director, or
DENR staff, upon the presentation of proper credentials, to enter the property during normal
business hours 15A NCAC 02H.0502(e),
11. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant and/or authorized agent is required
to return a completed certificate of completion form to the NCDENR DWR 401 and Buffers Unit
North Carolina Division of Water Resources, 1617 Mail Service Center, Raleigh, NC, 27699 within
ten days of project completion. The certification of completion is available at:

Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct

This approval and its conditions are final and binding unless contested.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150E by filing a written
petition for an administrative hearing to the Office of Administrative Hearings (hereby known as OAH). A
petition form may be obtained from the OAH at http://www.ncoah.com/ or by calling the OAH Clerk's
Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A petition is

Permit Application for the subject project on June 26, 2015. Staff review of the plans and specifications has determined that
the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The
Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from
stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000, the
stormwater rules. By copy of this letter, we are informing you that this project will not require a stormwater management
permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also subject to
the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have
an NPDES permit for stormwater discharge from projects meeting these criteria. All temporary built -upon area associated with
the construction of the project must be removed within 30 days of completion of the project, or when it is no longer needed,
whichever occurs first.

Pursuant to the CAMA-Corps Programmatic Permit process, the North Carolina Division of Coastal Management
(NCDCM) has forwarded to our office a copy of the CAMA permit application, Field Investigation Report and Bio Report
for the subject project. The attached notice requests federal agency comments on this project by August 24, 2015.
The applicant proposes to construct a new docking facility located at 10022 Coast Guard Road, adjacent to
Bogue Sound, in Emerald Isle, Carteret County, North Carolina. Coordinates in Decimal Degrees are: 34.6567 N-77.0835
W.
The applicant proposes to construct a 4-slip, private docking facility to serve two lots at 10020 and 10022 Coast
Guard Road. The proposed dock is 6-feet wide and is approximately 790-feet long in its entirety. The dock would begin
at a proposed driveway/parking area (permitted by the Emerald Isle LPO) and extend for 90-feet over high ground, cross
approximately 30-feet of 404 wetlands (to be elevated a minimum of 3 feet above wetland substrate), and then
continue for another 670-feet over areas of coastal marsh and open water before terminating in a 16' X 45' platform
with an 18' X 26' gazebo. Additionally, the applicant proposes two (3' X 30') finger piers to access four proposed slips,
each with a 13'X 13' boat lift. A kayak launch with a 15' access ramp is proposed on the eastern side of the dock and a
14' X 15' jet ski platform is proposed on the western side of the dock (both are proposed landward of the larger
platform). Water depths in the vicinity of the proposed project area range from -2.0 feet to -3.0 feet, at normal low
water (NLW). Dredging is not proposed as a part of this project. A total of 5,139 square feet of wetlands and open water
would be shaded as a result of this project.
Please see the attached field investigation report and the application for more detailed information concerning
the proposed project. A copy of the applicant's permit application and plans are attached.
This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery
Conservation and Management Act. The Corps' initial determination is that the proposed project will not adversely
affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management Councils or the
National Marine Fisheries Service. This determination is based on the temporary impacts associated with piling
installation and the depth of the water at the location of the proposed dock. The project area is not designated as PNA,
bxut is designated as Class SA-ORW waters, and is open to the taking of shellfish. No SAV's or shellfish beds were
observed within the project area. According to the application, there are no shellfish leases adjacent to or within close
proximity of the proposed project.
The Corps has reviewed the project area, examined all information provided by the applicant and consulted the
latest North Carolina Natural Heritage Database. Based on available information, the Corps has determined that the
project may affect but is not likely to adversely affect the' West Indian manatee. The use of the Manatee Guidelines will
be required as a condition of this proposed action. The project will not affect any other species listed as threatened or
endangered or their critical habitat formally designated pursuant to the Endangered Species Act of 1973 (ESA) within the
project area.
Pursuant to Section 106 of the National Historic Preservation Act (NHPA) of 1966, Appendix C of 33 CFR Part
325, and the 2005 Revised Interim Guidance for Implementing Appendix C, the District Engineer consulted district files
and records and the latest published version of the National Register of Historic Places, the Corps has preliminarily
determined that the proposed project will have no effect on cultural resources and requests concurrence from the State
Historic Preservation Office.

Pursuant to the CAMA-Corps Programmatic Permit process, the North Carolina Division of Coastal Management
(NCDCM) has forwarded to our office a copy of the CAMA permit application, Field Investigation Report and Bio Report
for the subject project. The attached notice requests federal agency comments on this project by August 24, 2015.
The applicant proposes to construct a new docking facility located at 10022 Coast Guard Road, adjacent to
Bogue Sound, in Emerald Isle, Carteret County, North Carolina. Coordinates in Decimal Degrees are: 34.6567 N-77.0835
W.
The applicant proposes to construct a 4-slip, private docking facility to serve two lots at 10020 and 10022 Coast
Guard Road. The proposed dock is 6-feet wide and is approximately 790-feet long in its entirety. The dock would begin
at a proposed driveway/parking area (permitted by the Emerald Isle LPO) and extend for 90-feet over high ground, cross
approximately 30-feet of 404 wetlands (to be elevated a minimum of 3 feet above wetland substrate), and then
continue for another 670-feet over areas of coastal marsh and open water before terminating in a 16' X 45' platform
with an 18' X 26' gazebo. Additionally, the applicant proposes two (3' X 30') finger piers to access four proposed slips,
each with a 13'X 13' boat lift. A kayak launch with a 15' access ramp is proposed on the eastern side of the dock and a
14' X 15' jet ski platform is proposed on the western side of the dock (both are proposed landward of the larger
platform). Water depths in the vicinity of the proposed project area range from -2.0 feet to -3.0 feet, at normal low
water (NLW). Dredging is not proposed as a part of this project. A total of 5,139 square feet of wetlands and open water
would be shaded as a result of this project.
Please see the attached field investigation report and the application for more detailed information concerning
the proposed project. A copy of the applicant's permit application and plans are attached.
This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery
Conservation and Management Act. The Corps' initial determination is that the proposed project will not adversely
affect EFH or associated fisheries managed by the South Atlantic or Mid. Atlantic Fishery Management Councils or the
National Marine Fisheries Service. This determination is based on the temporary impacts associated with piling
installation and the depth of the water at the location of the proposed dock. The project area is not designated as PNA,
but is designated as Class SA-ORW waters, and is open to the taking of shellfish. No SAV's or shellfish beds were
observed within the project area. According to the application, there are no shellfish leases adjacent to or within close
proximity of the proposed project.
The Corps has reviewed the project area, examined all information provided by the applicant and consulted the
latest North Carolina Natural Heritage Database. Based on available information, the Corps has determined that the
project may affect but is not likely to adversely affect the West Indian manatee. The use of the Manatee Guidelines will
be required as a condition of this proposed action. The project will not affect any other species listed as threatened or
endangered or their critical habitat formally designated pursuant to the Endangered Species Act of 1973 (ESA) within the
project area.
Pursuant to Section 106 of the National Historic Preservation Act (NHPA) of 1966, Appendix C of 33 CFR Part
325, and the 2005 Revised Interim Guidance for Implementing Appendix C, the District Engineer consulted district files
and records and the latest published version of the National Register of Historic Places, the Corps has preliminarily
determined that the proposed project will have no effect on cultural resources and requests concurrence from the State
Historic Preservation Office.

PROJECT SUMMARY: The applicant is proposing to construct a 4 slip docking facility

9. Narrative Description
The Stephin Malik project is located at 10020 Coast Guard Rd. in Emerald Isle, Carteret
Co. The lot can be located by traveling down Hwy. 58 into Emerald Isle and turning right
onto Coast Guard Rd. This lot is directly across the road from the entrance into Lands End
subdivision. Bogue Sound boarders the property to the west.
This property(Lt 2) has a 289.46' irregularly shaped shoreline. A thin fringe of ACOE
jurisdictional wetlands exists before transitioning into coastal wetlands. The coastal
wetlands mostly contain Black Needle Rush (Juncus roemarianus) and Smooth Cordgrass
(Spartina altemiflora). The substrate in the area is mostly mud and shell.. The high ground
portion of the property is undeveloped with woody vegetation. Minor Permit 15-24 has
been issued by the Emerald Isle LPO for a driveway and parking pad. There are
residential docks on either side of the project area.
The Emerald Isle Land Use Plan classifies this property as Residential. This section of
Bogue Sound is not designated as Primary Nursery Area, is open to the taking of shellfish
and carries a water classification of SA-ORW. The substrate in this area is mostly sand and
silt. No SAV's or shellfish beds were observed within docking area at the time of site visit.
There are no federal or historic channels within the project vicinity.
10. Project Description:
Mr. Stephen Malik is proposing to construct a private 4 slip docking facility to serve two
lots(Lt 1&2) at 10020 Coast Guard Rd. The entire docking facility would be placed within
the riparian cooridor of Lt. 2. Mr. Malik owns both lots.
The proposed 6' wide dock would extend off of the permitted driveway and cross 90' of
high ground before crossing 30' of ACOE jurisdictional wetlands. The dock would
continue for another 670' crossing regularly flooded and irregularly flooded areas of
marsh. A 3'X15' kayak platform would be placed along the North side of the dock. A
14'X15' floating Jet Ski platform would be placed along the South side of the dock with a
10' connection. Extending off the end of the dock would be a 16'X45' platform. Two
3'X30' finger piers would extend off the platform. Four 13'X13' boatlifts would surround
these finger piers creating 4 official slips. Water depths in this area are -2' to -3' at MLW.
The docking facility would extend a total of 84' from the marsh edge into the 336' wide
waterbody. The docking facility has been positioned as to not encroach into channels and
traditional navigation in this area.

11. Anticipated Impacts:
The proposed pier would have 1,155ft2 of associated with the project. This amount is
within the 8ft2 allocations for a 289.46' shoreline. There would be 2,820 Ftz of Coastal
Wetlands, 150 Ft2 of ACOE wetlands and 2,169Ft2 of open water shaded. The proposed
dock does not exceed'/4 width of the 336' wide waterbody. Water depths in the -2' to -3'
range at Mean Low Water are adequate for proposed small boat use. There would be a
temporary increase in turbidity during construction.

We recommend that the following conditions be included in the State authorization:
1. In order to further protect the endangered West Indian Manatee, Trichechus manatus,
the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and
strictly adhere to all requirements therein. The guidelines can be found at
b=://www.fws.gov/nc-es/mammal/manatee guidelines.pdf.
2. Dredging is not authorized.
3. No portion of the reconfigured or newly constructed structure is authorized to be
within the U.S. Army Corps of Engineers Federal Channel Setback.
4. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities.
For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office
at (910) 772-2191.
5. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit. Any modification to these plans must be
approved by the US Army Corps of Engineers (USACE) prior to implementation.
6. The docks and piers extending over wetlands will be elevated sufficiently (a
minimum of 3 feet) above the wetland substrate to prevent total shading of vegetation, substrate,
or other elements of the aquatic environment.
7. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States.
8. Approval of the structure is based on determinations that there would be no
obstruction to navigation. The structure may be damaged by wave wash from passing vessels.
Issuance of this permit should not be construed, as relieving the permittee of taking proper steps
to insure the structure and moored boats will not be damaged by wave wash.

9. The authorized structure and associated activity must not interfere with the public's
right to free navigation on all navigable waters of the United States. No attempt will be made by
the permittee to prevent the full and free use by the public of all navigable waters at or adjacent
to the authorized work for reason other than safety.
10. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
11. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
12. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733-5083,
Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
13. Unless otherwise authorized by this permit, all fill material placed in waters or
wetlands shall be generated from an upland source and will be clean and free of any pollutants
except in trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
14. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
15. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.

16. The permittee shall employ all sedimentation and erosion control measures necessary
to .prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter I I3A Article 4).
17. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the. North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
18. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct, restore
the water or wetland to its pre -project condition.
19. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the pernuttee's discovery of the violation.

Introduction
Stephen Malik is the owner of a waterfront parcel located at 10022 Coast Guard Road in
Emerald Isle. The undeveloped residential lot is also identified as Lot 2 Maurice S. Reilly
Division. Mr. Malik also owns the adjoining Lot 1 located at 10020 Coast Guard Road.
Mr. Malik is requesting a major CAMA permit to construct a dock and elevated slatted walkway
to be located entirely on Lot 2 (10022 Coast Guard Road). The walkway will connect the
proposed dock with a previously permitted driveway and parking pad to be located jointly on
the two lots.
Site Description
Lot 2 contains 26,925 square feet of highground area, with 289 feet of shoreline measured
along Normal High Water (NHW). The wooded lot fronts Bogue Sound and is zoned by the Town
of Emerald Isle for residential use. Single-family residential parcels are located to the east and
west of the Malik properties.
A number of mature trees are located on the parcel, as well as coastal and non -coastal
wetlands along the shoreline. The entire parcel is located within the 575' Coastal Shoreline AEC.
An historic channel used by local residents to access deep water is visible on aerial photos of
the area. The location and orientation of the historic channel were identified in consultation
with Division of Coastal Management staff. It was used to determine the riparian corridor for
the Malik project site and adjacent properties. The width of the waterbody containing the local
channel was determined to be 336', measured from the waterward edge of coastal wetlands to
the edge of a marsh island opposite the shoreline. The Intracoastal Waterway is located well
beyond the deep water historic channel used to site the proposed dock.
A fringe of non- coastal wetlands ranging in width from 20' to 40' is found along the shoreline
of the property. Typical of this section of Bogue Sound, the area waterward of the non -coastal
wetlands is characterized by coastal wetlands interspersed with open water and marsh islands.
Occasional oyster rocks and submerged aquatic grass can also be seen in the area.

The highground topography of the lot is also typical of this area of Emerald Isle. High ridge
areas near Coast Guard Road transition to lower elevations, with a relatively flat area closer to
the shoreline. The waters of Bogue Sound at the project site are classified as SA ORW by the
Environmental Management Commission and are open to the harvesting of shellfish. There are
no shellfish leases adjacent to or within close proximity of the project.
There are no manmade structures currently located on the site, although as previously noted a
driveway and parking pad have been permitted for central placement on the two Malik lots.
Haibo Zhou is the adjacent riparian property owner to the east of the project site. Alan
Summers owns the adjacent parcel west of the Malik properties.
Project Description
Mr. Malik proposes to construct an elevated slatted highground walkway and four -slip dock
with platforms, finger piers, and boatlifts. The dock will be fixed, with the exception of a
floating platform for storage and launching of two personal watercraft. A platform for launching
kayaks is also included in the project plans. A roofed gazebo is proposed for location on the t-
head platform.
No impervious surfaces will result from work proposed in this application, although the
previously permitted driveway and parking pad will create 1,607 square feet of impervious
surfaces on Lot 2, or 6% of the area above NHW and 1,532 square feet of impervious, or 9% of
the total highground area of Lot 1.
The elevated and slatted walkway will measure 6' x 750'measured from the beginning point
adjacent the proposed parking pad and ending at the waterward end of marsh, as shown on
project plans. The walkway will curve as needed to avoid and protect large diameter trees
located on the site. The underside of the walkway will be elevated a minimum of 3' above the
wetland substrate.
The proposed 6' wide dock will provide boating and water access for Mr. Malik and his family
and guests. It will extend 40' into Bogue Sound, measured from the waterward extent of
coastal wetlands. The dock will include four boat slips with lifts, platforms, and finger piers.
A 16' x 45' t-head platform will be located at the end of the pier. Two finger piers measuring 3'
x 30' will extend from the platform, creating access for four boat slips. An 18' x 26' roofed
gazebo as measured from the drip line of the roof will be located on the western end of the

A floating 14' x 15' platform accessed by a ladder will be located behind (landward) of the larger
platform. The floating platform will provide storage and launching for two jet -skis and includes
a 10' x 5' "landing" for ease in accessing and departing from the watercraft. A platform or rails
measuring 3' x 15' will be located on the opposite side of the main pier and will function as a
kayak launch. The 6' width for the walkway and pier is needed to allow pedestrians carrying
gear and kayaks to safely meet and pass while on the structure.
Water depths along the shoreline at the proposed end of the boat dock range in depth from
-2.2' to -2.9' Normal Low Water (NLW). The boat slips will be located in an average of -2.6'
NLW. Water depths at the center of the floating jet -ski platform also measure -2.6' NLW. Water
depths at the location of the kayak launch measure -2.7' NLW.
The dock will be located 5' from the western riparian boundary between Lots 1 and 2 (both
owned by Mr. Malik) and 20' from the riparian corridor of the Summers' property to the west
of Malik. It will be located 15.5' from the riparian boundary for Lot 3, owned by Mr. Zhou.
The dock will be located 130' from the adjacent docking facility on the west. It will be located
830' from the nearest docking facility to the east.
Construction Methods
One barge with pile driving equipment stored in deep water will be used for construction of the
dock. Conventional marine construction methodology will be employed. The highground
walkway will be built using conventional methods. A small excavator will be used in conjunction
with protective mats to construct portions of the walkway located over wetlands.
It is the desire of the owner to protect existing large trees and other vegetation located on the
property. No clearing other than the minimum needed to construct the walkway and previously
permitted driveway and parking pad is planned.

The NC Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development at 10020 Coast Guard Rd. in Emerald Isle. The complete package was received
on 6/19/15. The projected deadline for making a decision is 9/1/15. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been notified of a
final action by the initial deadline stated above, you should consider the review period extended. Under
those circumstances, this letter will serve as your notice of an extended review. However, an additional
letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from 6/19/15, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your
project. Such a meeting will be held within five working days from the receipt of your written request and
shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property, or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could
result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.

In an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management-
Issued to Stephen Malik, authorizing development in the Estuarine Shoreline - ORIN (AEC) at 10020 Coast Guard Rd ,
in Emerald Isle, as requested in the pernittee's application, dated April 27, 2015. This permit, issued on May 5, 2015is
subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations
and special conditions and notes set forth below. Any violation of these terms may subject perrnittee to a fine,
imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes: Driveway and Parking pad.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on April 30, 2015.
(2) All constuction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.

(5) The amount of impervious surface shall not exceed 25% of the lot area within 575 feet of NORMAL HIGH WATER
(Estuarine Shoreline - ORW Area of Environmental Concern), in this case, 3,139 square feet is authorized.
(6) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all
development/construction shall be located a distance of 30 feet landward of NORMAL HIGH WATER.
(7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must
be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area
has been properly stabilized with a vegetative cover.
(8) Any proposed for grading within the 30' buffer from the NORMAL HIGH WATER must be contoured to prevent
additional stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must
remain in a vegetated state.
(9) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction
completion.
