This permit, issued on July 2.2015 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
oe suoject to nnes, imprisonment or civii action; or may cause me permit to be null and void.
Dockina Facility
1) This permit authorizes only the reconstructed docks, piers, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this reconstructed docking
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
reconstructed docking facility. Any sewage discharge at the reconstructed docking facility shagEbrIVED
considered a violation of this permit for which the permittee is responsible. This prohibition all be
applied and enforced throughout the entire existence of the permitted structure. A 18 1015

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires finther Division approval.
All work must cease when the permit expires on
December 31, 2018
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and co ditions of this permit. The permittee is not relieved of this requirement if he abandons the
Teny4fted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of formalized 4 boat slips.
6) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
15A NCAC 0711.0208 of the Rules of the Coastal Resources Commission, no new dredging or
excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat
propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structures.
7) The reconstructed pier and associated structures shall have a minimum setback distance of 15 feet
between any parts of the structure and the adjacent property owner's riparian access corridor, which is
determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel
line that intersects with the shore at the point where the upland property line meets the water's edge.
8) The authorized structure shall not extend more than 1/4 of the width of the waterbody.
9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
General
10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
11) This pen -nit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
12) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -
colored form) is retained by you and it must be available on site when the project is inspected for
compliance. Please sign both the original and the copy and return the copy to this office in the enclosed
envelope. Signing the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must.be filed in accordance with NCGS Chapter 150B
with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-
2698 within twenty (20) days of this decision on your permit. You should also be aware that another
qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and review
all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to
be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact
Department personnel at any time for assistance. By working in accordance with the permit, you will be
helping to protect our vitally'important coastal resources.

Recommendations for State Permit- Henry Lyons et al. Hf -WW lk 1 0" 3/12/15
It is the opinion of this office that the proposed work is consistent with the Use Standards for docks and
piers, as set forth in NCAC 07H .0208(a) and (b)(6). In the absence of any concerns from the commenting
agencies, it is recommended that a permit be issued subject to the following conditions:
T 1. In order to protect water quality, runoff from the construction must not visibly increase the amount
of suspended sediments in adjacent waters.
V/ 2. This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, may become a permanent part of this marina/docking facility without
permit modification. No non -water dependent uses of structures may be conducted on, in or over
public trust waters without permit modification.
The pier/boathouse and associated structures shall have a minimum setback distance of 15 feet
between any parts of the structure and the adjacent property owner's riparian access corridor, which
is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the
channel line that intersects with the shore at the point where the upland property line meets the
water's edge.
4. No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.
5. The authorized structure and associated activity must not cause an unacceptable interference with
navigation shall not exceed the established pier line and 1/4 width of the waterbody.
6. The permittee will maintain the authorized work in good condition and in conformance with the
terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons
the permitted activity without having it transferred to a third party.
This permit authorizes a maximum of 4 boat slips. At no time shall more than 4 vessels be moored
or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel
types, including but not limited to motorboats, sailing vessels and personal watercraft.
8. The authorized project is located within a primary nursery area (PNA). Therefore, in
accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new
dredging or excavation within the PNA shall be permitted. Dredging in any manner, including
"kicking" with boat propellers, is not authorized. This prohibition shall be applied and
enforced throughout the entire existence of the permitted structure.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local
permits, approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this
permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of
any such activity for this determination.
NOTE: The permittee and/or his contractor is urged to meet with a representative of the
Division prior to project initiation.

This project is consistent and not in conflict with the Village of Bald Head Island Land
Use Plan Update.
The applicant is proposing to replace the existing dock within the same footprint. The
project is located in the Village of Bald Head Island in Brunswick County.
Areas of Environmental Concern (AEC's) impacted by the proposal are Ocean Hazard.
The area is not open to the harvesting of shellfish and is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Bald Head Island Land Use Plan
and offer the following comments.
The general area of the project is classified as Developed/Recreation
In general, Bald Head Island allows development in Developed classified AECs, which is
consistent with the State's minimum use standards. The Village of Bald Head Island
Land Use Plan contains some policies, which exceed the State's minimum use standards.
However, none of these standards appear to be applicable to this proposal.
This project is consistent with the Village of Bald Head Island Land Use Plan.

authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and

United States in the State of North'Carohm pursuant to Section 10 of the Rivers and Harbors Act
of 1899.
Your work is authorized provided it is accomplished in strict accordance with your

1. All work authorized by this permit must be performed in strict compliance with the
submitted plans and the revised plans received on 17 March 2015, which are a part of this permit.

within its existing footprint as described in your application received by the N.C. Division of Water
Resources (DWR) on March 13, 2015. After reviewing your application, we have decided that the
impacts are below the threshold for written authorization as long as all conditions of General Water
Quality Certification Number 3883 (GC3883) are met. This certification may also be viewed on our
website at hU://nortal.ncdenr.or web/wq/swp/ws/401/certsandpermits. This Certification allows you
to use the Regional General #197800056 Permit when issued by the US Army Corps of Engineers.
This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and is
thereby responsible for complying with all conditions. If total fills for this project (now or in the
future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be
required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the
conditions listed in the attached certification and any additional conditions listed below.

Bald Head Island is part of an island group known as Smith Island, located east of the mouth
of the Cape Fear River, between Fort Fisher to the north and the Atlantic Ocean to the south
with Oak Island/Caswell Beach to the west. The island is accessed by private boat or private
ferry service from Southport. The project site is located on a 10' wide easement between 2
& 4 Boathouse Tract, adjacent to Bald Head Creek, within the Village of Oak Island, in
Brunswick County.
The project area consists of a 10' wide easement located between two lots. A single-family
residence occupies 2 Boathouse Tract and 4 Boathouse Tract is vacant. The upland portion
of the site is vegetated primarily with lawn grasses and the shoreline is stabilized with a
bulkhead. The shoreline distance for the two lots including the 10' easement measures 283'.
The existing floating dock originating from the easement is shared by the property owners of
2 & 4 Boathouse Tract as well as the non -riparian owners of 1 Boathouse Tract and 317 N.
Bald Head Wynd. The dock was constructed by Bald Head Island Limited, LLC under State
Permit # 151-84.Based on aerial imagery, it appears the dock was constructed prior to the
year 2000. It measures approximately 50' in length by 7' in width, with a landing platform
measuring approximately 17.5' in length by 6' in width. A ramp leads directly from the
bulkhead onto the floating dock. The dock is aligned parallel to the channel. Water depths
measure approximately -7' at Normal Low Water (NLW). The waterbody measures
approximately 80' in width in this location. There are no coastal wetlands adjacent to the
docking facility. The dock crosses into the riparian corridors of 2 & 4 Boathouse Tract- the
owners of these two lots being 2 of the subject joint applicants. The shoreline length for 2 &
4 Boathouse Tract.measures approximately 166'.
The waters of Bald Head Creek are classified SA by the North Carolina Division of Water
Resources. The area is designated as a Primary Nursery Area by the North Carolina
Division of Marine Fisheries and is CLOSED to the harvesting of shellfish.
PROPOSED PROJECT:
The applicant is proposing to replace the existing dock at the same dimensions and within
the same footprint. The floating dock would measure 50' in length by 7' in width, with an
adjoining landing ramp platform measuring 17.5' in length by 6' in width. The dock would
extend 18' into the waterbody and would not encroach into either 15' riparian setback
outside of the subject properties.

The project would result in the incorporation of approximately 455 square feet of Public
Trust Area and Estuarine Waters as a result of the dock replacement. As proposed, the dock

was received as complete on March 11, 2015 and appears to be adequate for processing at this time. The projected
deadline for making a decision is May 25, 2015. An additional 75-day review period is provided by law when such
time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated
above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice
of an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from March 11, 2015, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project.
Such a meeting will be held within five working days from the receipt of your written request and shall include the
property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing' postcard which must be posted at the property of your
proposed development. You should post this notice at a conspicuous point along your property where it can be
observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the road right-of-way where a private road would lead one
into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to
receive a copy of my field report and/or comments from reviewing agencies.

Details of Work Plats:
(1) Topview or Planview Plats. Such drawings must show existing and proposed
features such as dune systems, shorelines, creeks, marshlands, docks, piers,
bulkheads, excavated areas, fill areas, type and location of sewage treatment
facilities and effluent outlets. Existing water depths must be indicated using
mean low water as base or zero. These can be shown either as contours or spot
elevation. Care should be used in indicating which features are existing and
which are proposed. Property boundaries, as they appear on the deed, and the
names of adjacent property owners must be shown on the detailed plat. The work
plat must clearly show any areas to be excavated and exact locality for disposal of
the excavated material. When fill material is to be placed behind a bulkhead or dike,
the plan must be sufficiently detailed to show the exact location of such. bulkheads or
dikes, and the adequacy of the bulkhead or dike to confine the material. Drawings
must indicate approximate mean low and mean high water lines and the presence of
marsh in the area of proposed work. In areas where the difference in daily low and
high tides is less than six inches, only an average water level must be indicated.
(2) Cross -Section Drawing. A cross -sectional diagram showing depth and elevation
of proposed work relative to existing ground level -- mean low and mean high
water line must be included in the plan. The mean low water must be the
reference for water depths and land elevations (Le., mean low water should be
depicted
as "Elevation 0.0 MLW"). First floor elevations relative to mean sea level must be
shown for any proposed buildings.
(3) Location Map. A map of small scale showing the location of the proposed work
is also required. The location map must provide adequate information to locate the
project site.
(4) Title of Drawing. Each drawing must have a simple title block to identify the
project or work, and shall include name of applicant, date the plat was
prepared, and scale of the plat. The date of any revisions must be clearly noted.
The applicant must also include the name of the person who drew the plat.

NOTICE OF FILING OF
APPLICATION FOR CAMA MAJOR
DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as required by NCGS
113A-119(b) that the following application was submitted for a development permit in an Area of
Environmental Concern as designated under the CAMA. According to said application, On March 11, 2015,
Henry Lyons proposed to replace an existing dock located between 2 & 4 Boathouse Tract, adjacent to Bald
Head Creek, on Bald Head Island, in Brunswick County. A copy of the application may be examined or
copied at the office of Heather Coats, N.C. Dept. of Environment & Natural Resources, Div. of Coastal
Management, 127 Cardinal Drive Ext., Wilmington, North Carolina 28405, (910-796-7424) during normal
business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400 Commerce
Avenue, Morehead City, NC 28557-3421, prior to April 6, 2015 will be considered in making the permit
decision. Later comments will be accepted and considered up to the time of permit decision. Project
modification may occur based on review and comment by the public and state and federal agencies. Notice of
the permit decision in these matters will be provided upon written request.
