Any violation of these terms ma be subiect to fines. imprisonment or civil action; or may cause the permit to be null and void. Docking Facilities 1) Unless specifically altered herein, this permit authorizes only the access piers and docking facilities, all as expressly and specifically set forth in the permit application and workplan drawings. No other structure(s), whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on/in, or over public trust waters without permit modification. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination.RECEivEo JUN 10 7.01i (See Attached Sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 .. In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature ofPermittee Kenneth Lovitt ADDITIONAL CONDITIONS Permit #65-15 Page 2 of 3 2) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 3) The permittee shall install and maintain at his expense any signal. lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at, or adjacent to, the authorized facilities. 5) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure(s) and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, or deep water, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 6) This permit authorizes a maximum of two (2) additional formalized boat slips (4 total) and a four (4) bunk floating platform for personal watercraft. Any request to add additional slips shall require a modification of this permit. 7) This permit does not authorize the placement of any tie pilings in association with this structure. 8) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This. prohibition shall be applied and enforced throughout the entire existence of the permitted structure. General 9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 10) This permit does not authorize the excavation or filling of any wetlands or open water areas, even temporarily. 11) The permittee shall schedule a pre -construction conference with a representative from the Division of Coastal Management at (910) 796-7215, prior to initiation of work. NOTE: The permittee is advised that any development or land disturbing activity that is considered non - water dependent is not authorized within 30 feet of the normal high water level unless specifically exempted by Coastal Resource Commission (CRC) regulations in place at the time of such development. NOTE: The construction and/or operation of the authorized facilities shall not directly result in any closure of any waters that are open to the. taking of shellfish. Any such closure directly attributable to the marina facility shall require that the permittee undertake remedial actions to remedy the situation. Such actions may include, but are not limited to, a removal of any unauthorized slips or mitigative measures to reduce or, eliminate the cause(s) of the closure. NOTE: An express permit application processing fee of $2,000 was received by the Department of Environment and Natural Resources for this project. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A- 121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance requires additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance. The project site is located at 7639 Scout Camp Hatila Road, off of Seabreeze Road, adjacent to the AIWW/Myrtle Grove Sound, in New Hanover County. To locate the project site from the Wilmington Regional Office (WiRO), travel from Wilmington towards Carolina Beach south on College Road / NC Hwy 132 to NC Hwy 421 for approximately 12 miles until you reach the stop light just north of the Snow's Cut Bridge. Turn left onto South Seabreeze Road and travel east approximately 0.5 miles. Take the 2"d left onto North Seabreeze Road and travel approximately 0.1 miles to Scout Camp Hatila Road; the subject property's driveway is located in the curve of the road on the right just before Scout Camp Hatila Road. The property has a chain across the driveway which is locked and Mr. Lovitt will have to be notified prior to a site visit to unlock the gate. The subject property encompasses approximately 4.2 acres and has an average elevation of approximately 5 feet above normal high water (NHW). Approximately halfway down the driveway towards the residence is an area of §404 and Coastal Wetlands on each side of the driveway and the driveway has been stabilized with a timber bulkhead. The property has approximately 100 linear feet of shoreline bordering the AIWW/Myrtle Grove Sound, which is partially stabilized with approximately 70 lineal feet of rip -rap along the northeast side. The applicant currently maintains a single family residence on the property. Existing high ground vegetation on the tract consists of lawn grasses, Wax Myrtle, Cedars, Pines and Oaks. Waterward of the area of rip -rap is a span of Coastal Wetlands measuring approximately 60' in width, consisting primarily of Smooth Cordgrass (Spartina alternii fora) along with Sea Oxeye (Borrichia frutescens), Salt Meadow Grass (Spartina patens) and Black Needle Rush (Juncus roemarianus). Within this area of Coastal Wetlands is a sandy berm area measuring approximately 10' in width. The applicant maintains an existing access pier, which measures approximately 200' in length by 6' in width, which terminates into a fixed uncovered platform, measuring approximately 10' in length by 8' in width. Waterward of the platform is an existing boatlift measuring approximately 14' in length by 14' in width. Based on aerial photography this portion of the existing facility appears to have been built between 1978 and 1984. On April 22, 2014, the applicant obtained CAMA General Permit #63242-D which authorized the addition of a fixed platform measuring approximately 8' in length by 8' in width to be located on the south side of the existing pier, approximately 60' landward of the terminal end of the pier. The Permit also authorized an access ramp which connects this platform to a floating dock measuring approximately 6' in width by 25' in length and extends waterward, parallel to the pier. The existing facility accommodates two (2) vessels in waters depths ranging from approximately -3' to -6' @ normal low water (NLW). The Wilmington -New Hanover County 2006 Land Use Plan Update classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of the AIWW/Myrtle Grove Sound are classified SA-ORW by the Division of Water Resources. They ARE designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. The application states that a new fixed platform would extend from the existing pier on the north side of the pier measuring approximately 9' in width by I I' in length and would be located directly across from the existing 8' by 8' platform. The application states that both of the platforms and the pier area connecting them would be covered with a roof which would extend approximately 1 %' beyond the platform decking. As proposed, an access ramp would extend waterward from the new platform to a new floating dock measuring approximately 6' in width by 25' in length on the north side of the pier and extends waterward, parallel to the pier. The applicant is also proposing to install a new four (4) bunk floating jet dock measuring approximately 10' in width by 20' in length adjacent to the existing floating dock located on the south side of the pier. The application states that the proposed docking facility would accommodate up to three (3) vessels and four (4) jet skis at this location in water ranging from approximately -3' to -5' @ NLW (See Sheets 1 & 2 of 2 and Project Narrative). 10. ANTICIPATED IMPACTS: The proposed structures would incorporate an additional approximately 449 sq. ft. of Public Trust Area and Estuarine Waters. The structures would not encroach into the 15' riparian corridor setback requirement of the adjacent riparian properties. Based on the provided drawings, the proposed structures would not encroach into the 80' setback from the AIWW federal channel. The proposed structures would not extend beyond the existing pier length.
