This permit, issued on September 30, 2015 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may :)e subject to fines, imprisonment or civil action; or may cause the permit to be null ano vota. Docking Facility 1) This permit authorizes only the docks, platforms and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this reconfigured docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee. is responsible., This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Page 2 of 3 ADDITIONAL CONDITIONS 3) The pennittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 4 formalized boat slips. 6) The reconstructed dock and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor to the north, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 7) Should the southern adjacent property be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. 8) The authorized structures and associated activity shall not exceed the established Wrightsville Beach pier head line. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 11) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 12) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. li Steven Lii1y NOTE: NOTE: Permit No. 74-15 Page 3 of 3 ADDITIONAL CONDITIONS The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2015-01447), which was issued on 8/4/15. The N.C. Division of Water Resources assigned the proposed project DWQ Project No. 15-0656. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: An application processing fee of $250 was received by DCM for this project. Although processing of the application is nearing completion, additional time is needed for this office to complete the review and make a decision on your request. Therefore, it is necessary that the standard review time be extended. An additional 75 days is provided by G.S. 113A- 122(c) which would make November 27, 2015, the new deadline for reaching a decision on your request. However, we expect to take action prior to that time and will do so as soon as possible. Steven Lilly Page 2 9. PROJECT DESCRIPTION The project site is located at 412 Waynick Boulevard on Wrightsville Beach, adjacent to Banks Channel and Greenville Sound, in New Hanover County. To locate the property from the Wilmington Regional Office (WiRO) travel east from Eastwood Road approximately 3 miles towards Wrightsville Beach. From the drawbridge, continue heading east on Causeway Drive (U.S. Highway 76) approximately 1 mile and proceed to cross the bridge over Banks Channel. Take the immediate right onto Waynick Boulevard (U.S. Highway 76) and travel south approximately .6 miles until you come to the property located on the right. The property is split by Waynick Boulevard with the private residence on one side and the private pier on the other adjacent to Banks Channel. Existing structures on the project site include a single family residence (across Waynick Blvd) and private docking facility. The project site is approximately 0.06 acres and is vegetated primarily with domestic grasses. The project site has approximately 50 feet of shoreline frontage along Banks Channel that has been stabilized by a wooden bulkhead. Normal High Water (NHW) is approximately 6 ft. waterward of the bulkhead. The existing docking facility consists of an existing access pier that extends into Banks Channel measuring approximately 64 ft. in length by 6 ft. in width which terminates into a covered fixed "L-head" platform measuring approximately 16 ft. in length by 14 ft. in width with a sundeck measuring approximately 16 ft. in length by 6 ft. in width. An access ramp leads from the sundeck onto a floating dock, measuring approximately 32 ft. in length by 8 ft. in width, which runs perpendicular to the shoreline. A boatlift measuring approximately 13 ft. in length by 13 ft. in width is located on the southern side of the floating dock. CAMA General Permit #283641D was issued to Bill Prestage (previous owner) on September 13, 2001 which authorized the installation of a 13 ft. long by 13 ft. wide boatlift on the south side of the existing docking facility. The existing docking facility currently accommodates up to two (2) vessels (see Sheet 1 of 4). Tie pilings and guide pilings are located along the riparian lines on both sides of the docking facility (see Sheet 2 of 4). The Wrightsville Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of Banks Channel, which are included in the Wrightsville Recreational Area, are classified SIB by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish PROPOSED PROJECT The applicant proposes to expand the existing docking facility to a private four (4) slip docking facility within Banks Channel. The applicant states that the existing fixed platform area would be expanded by adding two additional uncovered sections on the western and eastern sides, each measuring 14 ft. in length by 6 ft. in width, for final fixed platform dimensions of 28 ft. in length by 20 ft. in width (including covered and uncovered portions). The existing floating dock would be relocated to the south and extended to approximately 40 ft. in length. The floating dock would be accessed by a ramp extending waterward from the covered gazebo. The existing boatlift would be relocated to the southern side of the relocated floating dock on the landward end. The proposed new docking configuration would provide docking space for up to four (4) vessels within existing water depths ranging from approximately -4.0' to -8.0' at normal low water (NLW) (See sheet 3 of 4). According to the application, existing guide pilings that are within the applicants' riparian corridor area to the south will be removed (See sheet 2 of 4). 10. ANTICIPATED IMPACTS The proposed structures would incorporate approximately 828 sq. ft. of Estuarine Waters and Pubic Trust Area. The new floating dock would extend to the Town of Wrightsville Beach pier head line and would extend approximately 130' into a waterbody, which measures approximately 1500' across. This distance would conform to both the 1/4 width rule and the established pier lengths. The proposed boatlift would be located within the southern adjacent 15' Riparian Corridor Setback Area. A waiver has been obtained from the property owner to the south. At this time the applicant has not received confirmation that an adjacent riparian property owner notification was received by the property owner to the north. Staff review of the plans and specifications has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000, the stormwater rules. PROJECT SUMMARY: The applicant proposes to expand the existing platform and floating dock and relocate a boatlift for a private four (4) slip docking facility in Banks Channel. Steven Lilly Page 2 9. PROJECT DESCRIPTION The project site is located at 412 Waynick Boulevard on Wrightsville Beach, adjacent to Banks Channel and Greenville Sound, in New Hanover County. To locate the property from the Wilmington Regional Office (WiRO) travel east from Eastwood Road approximately 3 miles towards Wrightsville Beach. From the drawbridge, continue heading east on Causeway Drive (U.S. Highway 76) approximately 1 mile and proceed to cross the bridge over Banks Channel. Take the immediate right onto Waynick Boulevard (U.S. Highway 76) and travel south approximately .6 miles until you come to the property located on the right. The property is split by Waynick Boulevard with the private residence on one side and the private pier on the other adjacent to Banks Channel. Existing structures on the project site include a single family residence (across Waynick Blvd) and private docking facility. The project site is approximately 0.06 acres and is vegetated primarily with domestic grasses. The project site has approximately 50 feet of shoreline frontage along Banks Channel that has been stabilized by a wooden bulkhead. Normal High Water (NHW) is approximately 6 ft. waterward of the bulkhead. The existing docking facility consists of an existing access pier that extends into Banks Channel measuring approximately 64 ft. in length by 6 ft. in width which terminates into a covered fixed 1-head" platform measuring approximately 16 ft. in length by 14 ft. in width with a sundeck measuring approximately 16 ft. in length by 6 ft. in width. An access ramp leads from the sundeck onto a floating dock, measuring approximately 32 ft. in length by 8 ft. in width, which runs perpendicular to the shoreline. A boatlift measuring approximately 13 ft. in length by 13 ft. in width is located on the southern side of the floating dock. CAMA General Permit #28364D was issued to Bill Prestage (previous owner) on September 13, 2001 which authorized the installation of a 13 ft. long by 13 ft. wide boatlift on the south side of the existing docking facility. The existing docking facility currently accommodates up to two (2) vessels (see Sheet 1 of 4). Tie pilings and guide pilings are located along the riparian lines on both sides of the docking facility (see Sheet 2 of 4). The Wrightsville Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of Banks Channel, which are included in the Wrightsville Recreational Area, are classified SB by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish PROPOSED PROJECT The applicant proposes to expand the existing docking facility to a private four (4) slip docking facility within Banks Channel. The applicant states that the existing fixed platform area would be expanded by adding two additional uncovered sections on the western and eastern sides, each measuring 14 ft. in length by 6 ft. in width, for final fixed platform dimensions of 28 ft. in length by 20 ft. in width (including covered and uncovered portions). The existing floating dock would be relocated to the south and extended to approximately 40 ft. in length. The floating dock would be accessed by a ramp extending waterward from the covered gazebo. The existing boatlift would be relocated to the southern side of the relocated floating dock on the landward end. The proposed new docking configuration would provide docking space for up to four (4) vessels within existing water depths ranging from approximately -4.0' to -8.0' at normal low water (NLW) (See sheet 3 of 4). According to the application, existing guide pilings that are within the applicants' riparian corridor area to the south will be removed (See sheet 2 of 4). 10. ANTICIPATED IMPACTS The proposed structures would incorporate approximately 828 sq. ft. of Estuarine Waters and Pubic Trust Area. The new floating dock would extend to the Town of Wrightsville Beach pier head line and would extend approximately 130' into a waterbody, which measures approximately 1500' across, This distance would conform to both the 1/4 width rule and the established pier lengths. The proposed boatlift would be located within the southern adjacent 15' Riparian Corridor Setback Area. A waiver has been obtained from the property owner to the south. At this time the applicant has not received confirmation that an adjacent riparian property owner notification was received by the property owner to the north.
