This permit, issued on Aueust 17, 2015 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

Dockine Facility
1) This permit authorizes only the removal of an existing jet ski lift and the construction on a new 12' x
12' boat lift, all as expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this reconstructed docking facility
without permit modification. No non -water dependent uses of structures shall be conducted on, in or
over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
reconstructed docking facility. Any sewage discharge at the reconstructed docking facility shall be
considered a violation of this permit for which the permittee is responsible. This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires firther Division approval.
All work must cease when the permit expires on
December 31, 2018
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

3) The perrittee aintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise,.on the authorized,facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of formalized 4 boat slips.
6) The reconstructed pier and associated structures shall have a minimum setback distance of 15 feet
between any parts of the structure and the adjacent property owner's riparian access corridor, which is
determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel
line that intersects with the shore at the point where the upland property line meets the water's edge.
7) No attempt shall. be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
General
8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
9) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
10) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
197800056 (.fiction ID No. SAW-2015-01100), which was issued on 6/17/15.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR-
15-0419.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
s dependent activities are not authorized within 39 feet of the normal high water level.

Docking Facility
1) This permit authorizes only the removal of an existing jet ski lift and the construction on a new 12' x

It is the opinion of this office that the proposed work is consistent with the Use Standards for docks and
piers, as set forth in NCAC 07H .0208(a) and (bx6). In the absence of any concerns from the commenting
agencies, it is recommended that a permit be issued subject to the following conditions:
1. In order to protect water quality, runoff from the construction must not visibly increase the amount
of suspended sediments in adjacent waters.
2. This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, may become a permanent part of this marina/docking facility without
permit modification. No non -water dependent uses of structures may be conducted on, in or over
public trust waters without permit modification.
3. The pier/boathouse and associated structures shall have a minimum setback distance of 15 feet
between any parts of the structure and the adjacent property owner's riparian access corridor, which
is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the
channel line that intersects with the shore at the point where the upland property line meets the
water's edge.
4. No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.
5. The authorized structure and associated activity must not cause an unacceptable interference with
navigation shall not exceed the established pier line and 1/4 width of the waterbody.
6. The permittee will maintain the authorized work in good condition and in conformance with the
terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons
the permitted activity without having it transferred to a third party.
7. This permit authorizes a maximum of 4 boat slips. At no time shall more than 4 vessels be moored
or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel
types, including but not limited to motorboats, sailing vessels and personal watercraft.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local
permits, approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this
permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of
any such activity for this determination.
NOTE: The permittee and/or his contractor is urged to meet with a representative of the
Division prior to project initiation.

This project is consistent with the Oak island Land Use Plan Update.
The applicant proposes to install a 12' x 12' boatlift adjacent to the existing dock. The

Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PTA.
Waters at the project site are classified as SA and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Oak Island Land Use Plan and
offer the following comments.
The general area of the project is classified as Developed.
In general, Oak Island allows development in Developed classified AECs which is
consistent with the State's minimum use standards. The Oak Island Land Use Plan
contains some policies, which exceed the State's minimum use standards. However,
none of these standards appear to be applicable to this proposal.
This project is consistent and not in conflict with the Oak Island Land Use Plan.

Pursuant to the CAMA-Corps Programmatic Permit process, the North Carolina Division of Coastal Management
(NCDCM) has forwarded to our office a copy of the CAMA permit application, Field Investigation Report and Bio Report
for the subject project. The attached notice requests federal agency comments on this project by July 10, 2015.
The applicant proposes to expand an existing commercial docking facility located at 579 Lewis Road, adjacent to
Topsail Sound, in Hampstead, Pender County, North Carolina. Coordinates in Decimal Degrees are: 34.406212 N -
77.605428 W.
The project plans propose to expand the existing 7 slip commercial docking facility by installing an 8-foot wide
by 80-foot long floating dock along the northern side of the property for a total of 12 slips. Additionally, the applicant is
requesting approval for the installation of 9 new tie pilings. Water depths in the vicinity of the proposed project area
range from -1.5 feet to -5 feet, relative to normal low water (NLW).
Please see the attached field investigation report and the application for more detailed information concerning
the proposed project. A copy of the applicant's permit application and plans are attached.
This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery
Conservation and Management Act. The Corps' initial determination is that the proposed project will not adversely
affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management Councils or the
National Marine Fisheries Service. This determination is based on the temporary impacts associated with piling
installation and the depth of the water at the location of the dock (precluding vegetative growth). The project area is
not designated as PNA and is closed to the taking of shellfish. No SAV's or shellfish beds were observed within the
project area.
The Corps has reviewed the project area, examined all information provided by the applicant and consulted the
latest North Carolina Natural Heritage Database. Based on available information, the Corps has determined that the
project may affect but is not likely to adversely affect the West Indian manatee. The use of the Manatee Guidelines will
be required as a condition of this proposed action. The project will not affect any other species listed as threatened or
endangered or their critical habitat formally designated pursuant to the Endangered Species Act of 1973 (ESA) within the
project area.
Pursuant to Section 106 of the National Historic Preservation Act (NHPA) of 1966, Appendix C of 33 CFR Part
325, and the 2005 Revised Interim Guidance for Implementing Appendix C, the District Engineer consulted district files
and records and the latest published version of the National Register of Historic Places, the Corps has preliminarily
determined that the proposed project will have no effect on cultural resources and requests concurrence from the State
Historic Preservation Office.

Through coordination with the North Carolina Division of Coastal Management we have
learned of your request to construct a 12x12 boatlift adjacent to an existing dock at 123 W. Island
Drive, adjacent to Davis Canal and the Cape Fear River, Oak Island, North Carolina
On January 1, 2011, we renewed general permit No. 197800056, (copy enclosed), that
authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and
boat shelters, mooring piles, dolphins, jetties and breakwater structures in navigable waters of the
United States in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act
of 1899.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general conditions, and the following special conditions:
1. All work authorized by this permit must be performed in strict compliance with the
submitted plans and the revised plans received on 28 April, 2015, which are a part of this permit.
Please read the enclosed permit to prevent an unintentional violation of Federal law. As
this Department of the Army regional general permit does not relieve you of the responsibility to
obtain any other required approvals, you should contact appropriate State and local agencies
before beginning work.

9. PROJECT DESCRIPTION
The project site is located within Davis Canal, adjacent to the AIWW, located in Oak Island,
Brunswick County. To find the project site, travel south on US Highway 17 to NC Highway
133 South. Travel approximately 22 miles south on NC-133 to Dosher Cutoff SE/ NC-
133.Turn onto Dosher Cutoff and then turn right at Southport -Supply Rd. SE/ NC-133.
Travel approximately 0.8 mile and turn left onto NC-133. Follow NC-133 to Oak Island and
turn right onto East Oak Island Drive. Travel approximately 7 miles and turn left onto SE
28a' Street. At the end of SE 28`h Street, turn right onto W. Island Drive. Drive to the end of
W. Island Drive and the property will be located on the left, between 121 and 126 W. Island
Drive.
The project area consists of a 9,509 square foot lot with an existing shed, partial fence,
private pier and dock on the property. The upland portion of the site is vegetated primarily
with lawn grasses and the shoreline is stabilized with a bulkhead. The shoreline length for
the lot measures approximately 137'. An existing pier originating from the bulkhead extends
over the coastal wetlands to a fixed T-head measuring 12' in length by 16' in width. Steps
lead from the west side of the T-head to a small landing platform measuring 7' in length by
4' in width. A ramp leads from the landing platform to a floating dock measuring 30' in
length and varying from 6'-8' in width. A boatlift is located to the east of the T-head and
floating dock A finger piers lead from the access pier to the boatlift. A 22' long by 5' wide
finger pier extends perpendicular to the main access pier at the bow side of the lift. Two
narrower finger piers then extend in a perpendicular direction on either side of the lift for
access. The western finger pier measures 14' in length, and the eastern finger pier measures
3 P in length. Both vary from 15" to 2' in width. A 6' in length by 5' in width jet ski lift is
located on the outside of the eastern finger pier. The docking facility currently
accommodates three vessels.
Based on aerial imagery, it appears the dock was constructed prior to the year 2000. Water
depths exceed -5' at Normal Low Water (NLW). The waterbody measures approximately
146' in width in this location. There is a narrow strip of Coastal Wetlands, consisting of Salt
Marsh Cordgrass (Spartina alternii fora), adjacent to the docking facility. The dock extends
approximately 33' into the waterbody from the waterward edge of marsh. The dock is sited
closer to the eastern property line than the west and is not located within either of the
adjacent 15' riparian corridor setbacks.
The waters of Davis Canal are classified SA by the North Carolina Division of Water
Resources. The area is NOT designated as a Primary Nursery Area by the North Carolina
Division of Marine Fisheries and is CLOSED to the harvesting of shellfish.

PROPOSED PROJECT:
The applicant is proposing to install a 12' in length by 12' in width boatlift on the west side
of the existing floating dock. The boatlift would not extend waterward of the existing dock.
The existing jet ski lift would also be removed. Two slips are now proposed at the floating
dock which brings the total proposed number of slips to four.
10. ANTICIPATED IMPACTS:
The project would result in the incorporation of approximately 144 square feet of Public
Trust Area and Estuarine Waters as a result of the boat lift installation. As proposed, the lift
would not extend more than '/e width of the waterbody and would not extend into either of
the adjacent 15' riparian corridor setbacks. Temporary increases in turbidity can be expected
during construction.

The Division of Coastal Management hereby acknowledges receipt of your application, acting as agent for
Jetter Lewis, for State approval for development of the subject property located at 123 W. Island Drive, adjacent to
Davis Canal, in Oak Island, Brunswick County. It was received as complete on April 22, 2015 and appears to be
adequate for processing at this time. The projected deadline for making a decision is July 7, 2015. An additiona175-
day review period is provided by law when such time is necessary to complete the review. If you have not been notified
of a final action by the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be
provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from April 22, 2015, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project.
Such a meeting will be held within five working days from the receipt of your written request and shall include the
property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing' postcard which must be posted at the property of your
proposed development. You should post this notice at a conspicuous point along your property where it can be
observed from a public road Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property, or at a point along the road right-of-way where a private road would lead one
into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to
receive a copy of my field report and/or comments from reviewing agencies.

APPLICATION FOR CAMA MAJOR
DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as required by NCGS
113A-119(b) that the following applications were submitted for development permits in Areas of
Environmental Concern as designated under the CAMA: On March 27, 2015, Ery Kehaya proposed to
perform maintenance excavation and expand an existing docking facility at 2307 Middle Sound Loop Rd,
adjacent to Middle Sound / AIWW in Wilmington, New Hanover County; on April 17, 2015, Franklin
McLeod, III proposed to construct a private docking facility at 1228 Carolina Blvd, adjacent to Topsail
Sound, in Topsail Beach, Pender County; and on April 22, 2015, Jetter Lewis proposed to install a boadift at
an existing dock at 123 W. Island Dr., adjacent to Davis Creek, in Oak Island, Brunswick County. Copies of
these applications can be examined or copied at the offices of Robb Mairs (NH Co.), Jason Dail (PN Co.), or
Heather Coats (BR Co.), N.C. Dept. of Environment & Natural Resources, Division of Coastal Management,
127 Cardinal Drive Ext., Wilmington, NC 28405, (910-796-7215) during normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400 Commerce
Avenue, Morehead City, NC 28557-3421, prior to May 16, 2015 will be considered in making the permit
decision. Later comments will be accepted and considered up to the time of permit decision. Project
modification may occur based on review and comment by the public and state and federal agencies. Notice
of the permit decision in these matters will be provided upon written request.

Dear Ms. Coats:
ECS is pleased to provide the CAMA Major Permit Application on the behalf of Mr. Jetter Lewis,
the property owner of 123 West Island Drive in Oak Island, Brunswick County, North Carolina.
The site consists of a vacant lot with utilities and an existing dock.
The scope of the proposed project consists of the construction of a new 12'x12' boat lift and the
four associated pilings using standard construction practices. Additionally, a 6'x5' lift will be
removed from the existing structure. The purpose of the boat lift is for private, residential usage.
Adjacent Property Owner information and forms were submitted to the adjacent owners on
February 26, 2015. As of the date of this submission, ECS has not received a response from the
adjacent owners commenting on the project and therefore consider their lack of comment to be
considered a "no objection' to the proposed project.
