This permit, issued on November 16, 2015 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may to lines, imprisonment or ctvu action; or may cause me permit to oe unit ane veto. Docking Facility 1) This permit authorizes only the expanded docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dep'eridi nt uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated'or untreated, shall be discharged at any time from any boats using the expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Joan Lee & Carol Hampton Permit No. 130-15 Page 2 of 4 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 3 formalized boat slips. 6) The expanded docks and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor to the north, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. NOTE: Should the adjacent property to the south be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. 7) - No portion of the authorized structures shall extend more than 100' into the waterbody, as measured from the bulkhead. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Excavation 9) Excavation shall not exceed -4 feet below normal low water. In no case shall the depth of excavation exceed the depth of the connecting waters. 10) No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding waters outside of the alignment of the fill area indicated on the workplan drawing(s). 11) The temporary placement of double handling of excavated materials within waters or vegetated wetlands is not authorized. 12) All excavated materials shall be confined above normal high water level and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any wetlands or surrounding waters. �1 1 Joan Lee & Carol Hampton Permit No.130-15 Page 3 of 4 ADDITIONAL CONDITIONS Spoil Disposal 13) The spoil area shall be inspected and approved. by the Division of Coastal Management prior to the beginning of any dredge activities. 14) No spoil material shall be placed within 30 feet of the normal high water line nor within any wetland areas. 15) The disposal area shall be properly graded and provided a ground cover sufficient to restrain erosion within 30 working days of project completion. Sedimentation and Erosion Control 16) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 17) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). Maintenance Clause 20) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. _ D. The date of map revision and the permittee's signature shown anew on the original plan. U.S. Army Corps of Engineers Requirements 21) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 22) If the permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre - project condition. Joan Lee & Carol Hampton ADDITIONAL CONDITIONS Permit No. 130-15 Page 4 of 4 . 23) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work,:'or injury which may be caused from existing or future operations undertaken by the United States in the public interest. General 24) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This pen -nit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers assigned the proposed project Action ID No. SAW-2015- 02117. NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR- 2015-0974. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. The applicant does not indicate the method of spoil disposal from barge to upland site. There are §404 wetlands located on high ground.and aerial imagery indicates coastal wetlands along a portion of the property. The applicant identifies silt fencing has been installed to minimize impact to the §404 wetlands located on site. It would be beneficial if additional information be provided by the.applicant as to spoil transfer,methods, especially concerning any coastal wetlands that maybe present. It is recommended that measures betaken to avoid potentialfilling of either wetland as the spoil is transferred from barge to deposit site: if properly installed, the silt fencing should be sufficient to retain the spoil and allow it to dewater on site without runoff reentering the water. The applicant proposes to extend and reconfigure an existing docking facility and perform new dredging of an approximate 400 square foot area beneath the floating docks. This project is located at 514 Evelyn Lane, adjacent to Topsail Sound, in Topsail Beach, Pender County, North Carolina. Coordinates in Decimal Degrees are: 34.370903 N and - 77.6268 W. Please see the attached field investigation report and the application for more detailed information concerning, the proposed project. A copy of the applicant's permit application and plans are attached. This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery Conservation and Management Act. The Corps' initial determination is that the proposed project may affect, but is not likely to adversely affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management Councils or the National Marine Fisheries Service. The applicant proposes to remove the existing pier and horseshoe - shaped floating dock and construct a new pier in the same location. The proposed new access pier measures approximately 6'x25' and would terminate into an 18'x 22' L-shaped platform, which would span towards the south. A 3'x10' gangway would then extend from the platform to provide access to a new horseshoe -shaped floating docking system (detailed further in the attached application). The waters within the project area are NOT designated Primary Nursery Area by the NC Division of Marine fisheries and are OPEN to shellfish harvesting. No Submerged Aquatic Vegetation (SAV) were visible within the proposed dredging footprint during a Division of Coastal Management site visit on September 10, 2015. The Corps has reviewed the project area, examined all information provided by the applicant and consulted the latest North Carolina Natural Heritage Database. Based on available information, the Corps has determined that the project would have no effect on the West Indian manatee. The project will not affect any other species listed as threatened or endangered or their critical habitat formally designated pursuant to the Endangered Species Act of 1973 (ESA) within the project area. . To find the property from the Wilmington Regional Office, take Highway 17 North from Wilmington approximately 20 miles and turn right on N.C. State Highway 210. Travel approximately 2.8 miles to the intersection of NC 210 and NC 50. Turn right onto NC 50/NC 210 and travel approximately 1.9 miles onto Topsail Island. Tom right onto S. Topsail Dr. /NC 50 and travel approximately 6.1 miles to Haywood Avenue and turn right. Travel approximately 0.10 miles on and Evelyn Lane will be located on the northern side of the road. Turn right onto Evelyn Lane and the property will be located on the left hand side, house number 514. The applicant currently maintains a single-family residence on the property. Existing man-made features include a residence, driveway, bulkhead, pier and floating dock. The high ground portion is elevated approximately 4' — 6' above the normal high water (NHW) level. Vegetation on the tract consists of lawn grasses and ornamental landscaping. There are no Coastal or "404" type wetlands on, or adjacent to the subject property. The property has approximately 140 linear feet of shoreline which is stabilized by an existing concrete bulkhead. Water depths in the vicinity of the existing water dependent structure(s) range from 0' to -2.0', relative to normal low water (NLW). Presently the owner maintains a "horseshoe" shaped dock that is located in the same general vicinity of the proposed pier and platform. Current site conditions have created a shoal just beneath and waterward of the existing platform making it unusable at periods of low tide. The current docking facility is comprised of a 6' x 16' section of floating dock connected to a 6' x 20' section of dock that is connected to a 9' x 19' section of dock, creating a "horseshow" design. Residential properties border the site to the north, south and east and Banks Channel/Topsail Sound to the west. The waters of Topsail Sound (adjacent to the project site) are classified as SA by the North Carolina Division of Water Resources. They ARE NOT designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries, and they are OPEN to the harvest of shellfish. Based on visual observations made by DCM staffduring a site visit on 9/10/15, there does not appear to be any Submerged Aquatic Vegetation (SAV) within the proposed dredged footprint. RECEIVED SEF 21 2015 PROPOSED PROJECT: The applicant proposes to extend and reconfigure the existing docking facility, and also excavate an area around/beneath the new docking facility. As indicated in the application package and site plan drawings, the applicant intends to remove the current pier and "horseshoe" shaped floating docking facility and construct a new pier in the same location. As designed, a new 6' x 25' access pier would originate from the bulkhead in the same vicinity as the existing pier. The pier would terminate into an 18' x 22' "L-shaped" platform that would span toward the south. A 3' x 10' gangway would originate from the platform (in alignment with the pier), providing access to a new "horseshoe" shaped floating docking system. Part of the new docking facility would consist of a 5' x 10' jet -ski float, which would be located along the inshore portion of the floating component. The remaining portions of the floating dock would consist of a 6' x 20' section (which would extend offshore, perpendicular to the shoreline) and a 6' x 30' section that would extend southerly from the terminus of the 6' x 20' section. Completing the docking facility, would be the installation of two boat lifts, one measuring 13' x 13' and the other measuring 15' x 15'. The smaller of the two lifts would be installed inshore of the proposed 6' x 30' floating dock and the larger constructed outboard ofthe proposed 6' x 30' float. Although the application states three slips are proposed, the configuration of the facility sets up to potentially accommodate a total of four vessels. In addition to relocating and reconfiguring the existing docking facility, the applicant is proposing to dredge the shallow bottom area around the proposed dock (including the area around the proposed boat lifts) due to recent shoaling. Current water depths, from the area around the existing dock, range from 0.0' to -2.0' at normal low water. Joan Lee and Carol Hampton Page Three Extending the floating docks approximately 60' beyond the current location will prevent the structure from resting on the bottom at low water (which it does now), but according to aerial photography and current water depths, the applicant would still need to dredge in order to make the new docking facility functional at normal low water (i.e. have at least -2.0' of water during periods of low tide). The proposed dredge footprint would measure approximately 20'(w) x 20'(1) x-4.0'(d) at normal low water. Proposed depths would tie into the adjacent channel which measure approximately -6' at normal low water. The applicant anticipates removing approximately 30 cubic yards of material from the area. As planned, and according to the consent agreement from land owner Kim Quinn, all spoil material would be transported by barge and offloaded/spread on property located at 916 S. Anderson Boulevard. It should be noted there is a small oval shaped section of "404" type wetlands located at 916 S. Anderson (confirmed by COE delineation); however, the Wetland boundaries have been identified and a sediment containment barrier has been installed around the perimeter of the wetlands to avoid any unwanted or potential fill. A 50' x 50' area for spoil disposal has been designated along the eastern side of the property. According to the attached wetland delineation map, the area of deposition is void and any wetlands. 10.
