Travel Lift 1) The structural. integrity, weight carrying, and live load capacities of the . travel lift access piers shall meet the requirements of the N. C. Building Code. 2) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. Emeavation 3) In order to avoid periods of peak biological activity, no maintenance (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1993 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Svan Point Marina ADDITIONAL CONDITIONS Permit #30-90 Page 2 of 3 excavation will be permitted between the dates of April 1 and September 30 of any year without the prior approval of the N. C. Division of Coastal Management in consultation with the Division of Marine Fisheries. 4) The existing diked spoil disposal area shall be inspected by a representative of the Division of Coastal Management prior to spoil deposition, to insure suitability of the site. 5) All excavated materials will be confined landward of the mean high water (MHW) elevation contour within adequate dikes or other retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding waters. 6) The terminal end of the pipeline from the dredge into the diked retention area will be positioned at or greater than 50 feet from any part of the dike and a maximum distance from spillways to prevent dike erosion and to allow adequate settlement of suspended solids. 7) A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. 8) Flow from the diked retention area will be confined by pipe, trough, or similar device to a point at or below the mean low water.(MLW) elevation contour to prevent gully erosion and siltation. 9) No vegetated wetlands will be excavated or filled. 10) Excavation will not exceed 6 feet below the elevation of mean low water (MLW). 11) The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction -related discharge (increases of 25 NTUs or less are not considered significant). NOTE: The proposed project is certified under General Water Quality Certification No. 1273 issued on November 10, 1978, for discharges of liquid effluent from diked upland disposal areas. General 12) Approval of this activity was based on determination that there would be no obstruction to navigation. Under conditions existing in the Atlantic Intracoastal Waterway (AIWW), a possibility exists that the structure may be damaged by wave wash from passing vessels. Unreasonable slowing down of vessel traffic cannot be required because it would tend to nullify the navigational benefits on which the AIWW was justified. Issuance of this permit should not be construed as relieving the permittee of taking proper , steps to insure the structure and moored boats will not be damaged by wave wash normally to be expected in the AIWW. Swan Point Marina Permit 030-90 Page 3 of 3 ADDITIONAL CONDITIONS NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the facility to prevent sand blasting residue and/or other facility waste from entering the adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene state water quality standards, thereby violating state law. Maintenance Clause The Division of Coasrtal Management will be notified in writing at least two (2) weeks in advance of any maintenance work authorized by this permit and that notification shall include: A. the number of the original permit. B. a statement that no dimensional changes are proposed. C. a copy of the original permit plats with cross -hatching indicating the area to be maintained, the area to be used for spoil, and the estimated amount of material to be removed. PROJECT DESCRIPTION The applicant's property consists of an approximately 5 acre tract of land located off, and near the end of NCSR 1523 and adjacent to the AIWW, between New River and Chadwick Bay, near the community of Sneads•Ferry;•in Onslow County. The majority of this property has been developed into a commercial marina, known as Swan Point Marina', and has an associated upland repair facility. A good portion of the marina basin was excavated years ago into upland areas. On the north side of the marina.basin, a bulkheaded peninsula of land approximately 350' long•x.,25' 'wide protects the basin area from adjacent open. -water areas. -Portions of this marina facility were authorized by State Permit #589. The existing marina consists of approximately 60 wet -slips and has. fueling -facilities`to service transient boats :traveling the AIWW.-,,Upland development includes a ships store, an approximately 80' x 70' building where mostly ..marine engine repair work is done, and gravel, concrete and packed sand parking areas. A dragline boom and cradle system allows for the 'dry storage!,. for_ smaller vessels on7.upland, parking.%.areas :while undergoing repairs. Restroom : and .:shower facilities, are also provided to patrons of this marina, but a-pumpout facility is not available. The applicant proposes to install a travel lift in the existing marina basin to facilitate boat removal to augment -their boat repair business. One of the existing boat slips on the eastern side 'of the basin would be deleted to allow for the installation of the travel lift. Two piers,50 feet long, 4 feet 6 inches wide, and 19 feet apart (inside to inside) would provide the water access runway for the travel lift mechanism. Each pier would be constructed on a double row of 10 sets of pilings, on 5 feet centers with 8" x 12" support timbers, and associated cross -bracing., A 12" x 24" steel I-beam, turned on it's side will provide the track for the travel lift wheels. The remainder of the 416" pier width would be covered with wooden decking. Although .no excavation work is proposed at this time, the applicant is also requesting a maintenance dredging clause be incorporated into his permit for future maintenance .of his existing marina basin. Based upon his observed rate of siltation over the past several years, some maintenance work is projected within two years. The existing basin is approximately 320 feet long and 170 feet wide. Based upon a maximum excavation depth of 3 feet to retain -6 feet water depth at mean low water, maintenance dredging of the entire basin could generate approximately 6,000 cubic yards of spoil material. The applicant has written permission from the owner, to use one of two existing spoil disposal sites, Grant Island or Oak Island, located west of the marina site, across the Atlantic Intracoastal Waterway. The suitability of the disposal site would be inspected at the time of any future maintenance request. Triangle Sales of Raleigh, Inc. Page three 9. PROJECT DESCRIPTION - Continued Both the travel lift project and the maintenance dredging clause were included in a recent application for State permit to substantially expand the size of the existing marina. Subsequent denial of that project necessitated the re -application for State permit for the current proposed project. 10. ANTICIPATED IMPACTS Since one of the existing wet slips in the existing marina basin would be deleted to provide the space for the travel lift installation, no new incorporation of public trust and estaurine waters are required, only a change of use of the already impacted space. There will be some short-term turbidity -associated with driving of the pilings for the travel lift piers, but no increase in the long term negative impacts of the current water quality or existing marine resources is anticipated. With respect to future maintenance dredging of the existing marina basing no long term negative impacts are expected provided, such maintenance work is timed to avoid periods of peak biological activity.
