Hampstead , as requested in the permittee's application dated 1/8/15 (MP-1) and 12/29/14 (MP-4), including the attached worknlan drawings (3). 1 and 3 of 3 dated 12/29/14 and 2 of 3 dated 2/2/15 This permit, issued on May 12, 2615 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void. Dockine Facility 1) Unless specifically altered herein, this permit authorizes the docks, piers and other structures and uses that are expressly and specifically set forth in the attached permit application and workplan drawings. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires fiuther Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. New dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 4) In accordance with commitments made by the permittee, and in order to satisfy concerns of the Division of Coastal Management, stops shall be placed on the boatlifts at a minimum height of 18" above bottom substrate to prevent the boatlifts from resting on the bottom, and at a minimum height of 24" above bottom substrate to prevent the floating dock from resting on the bottom. The stops shall remain in place for the life of the docking facility. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 7) This permit does not authorize the interference with any existing or proposed Federal project, and the pemuttee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 8) The pemtittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. 9) This permit authorizes a maximum of 2 formalized boatslips associated with this docking facility. Army Corps of Engineers Conditions 10) An as built survey of the authorized structure shall be provided to the US Army Corps of Engineers. General 11) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parto, bout the written approval of the Division of Coastal Management. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Resources has authorized the proposed project under DWR Project No. 15-0159. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. The permit authorized construction of a private docking facility adjacent to 104 Blue Heron Road, in Hampstead, NC, adjacent to Old Topsail Creek. The permit is scheduled to expire on December31, 2018. Based on the information provided by your agent (Allied Marine Contractors, LLC), you are requesting a permit modification to include the installation of a 4' x 16' "rat -walk" extension along the western side of the existing pier/platform. The active CAMA permit authorized construction of a 4' x 16' finger pier or "cat -walk" along the western side of the existing pier; however, according to your request, a 4' x 16' extension is necessary to access the permitted floating dock from the access pier. The addition of the proposed 4' x 16' finger pier or "cat -walk" would be allowed based on the square footage allowance for a pier/docking facility on adjacent to the property. Additionally, the proposed finger pier would be within your area of riparian access and would be outside of the'/4 width channel alignment. Letter of no objection were received from both adjoining property owners, thereby satisfying the neighbor notification requirements. Upon review of the submitted request, dated received on October 16, 2015, the Division of Coastal Management has determined that the proposed action continues to be consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. This Letter of Refinement authorizes the modification of State Permit #58-15, as described in your transmittal letter dated September 28, 2015. Please note that this Letter of Refinement does not authorize any additional development. PROJECT DESCRIPTION The project site is located at 104 Blue Heron Lane, adjacent to Old Topsail Creek, in Pender County, NC. To locate the property, travel north on US-17 for approximately 12.5 miles and turn right onto Forrest Sound Road. Travel approximately 2.2 miles and turn left onto Blue Heron Lane. Continue along Blue Heron Lane and bear right at the end. The subject property will be located at the end of the road. Existing structures on the project site include a single family residence and detached garage. In addition, a dilapidated (un-usable) pier/platform extends from the eastern shoreline into Topsail Creek. The pier/platform consists of old pilings and girders. Currently, there is no access to the existing dock by way of a walkway. The project site is approximately 10.68 acre and is vegetated primarily with native trees, domestic grasses and ornamental landscaping. The project site has approximately 300 feet of shoreline frontage along Old Topsail Creek. A fringe of marsh grass consisting of Spike Grass (Distichlis spicata), Sea Lavender (Limonium, spp.), and Smooth Marsh Cordgrass (Spartina alterniflora) exists along the eastern shoreline, spanning a distance of approximately 50'-100' (from the water's edge to the high ground). A records search was performed to determine the permit history of the existing docking facility; however, no CAMA Permit was found. It appears, based on Google Earth satellite imagery that the structure existed prior to 1993. The Pender County 2006 Land Use Plan classifies adjacent waters and high ground portion of the property as Resource Protection. The waters of Old Topsail Creek and the AIWW are classified SA -HOW by the Division of Water Quality. They ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT The applicants are requesting approval to construct a new pier, platform, floating dock and boatlift along the property's northern shoreline to accommodate two (2) small run about vessels (<18' in length). As designed, the proposed docking facility would extend into Old Topsail Creek, and would be located between the creek's southern shoreline and a small island located just to the northeast. The new facility would consist of a 6' x 140' access walkway that would extend from the properties eastern shoreline into Old Topsail Creek. A 20' x 20' covered platform would be located at the terminal end of the access walkway and this structure would span to the southeast, creating an "L-head" shape. Just waterward of the proposed platform, the applicant proposes to install an 8' x 16' section of floating dock. The floating dock would be accessible by way of a 4' x 10' (in alignment with access pier) catwalk that would extend in a northeasterly direction, from the southern side of the proposed platform. Lastly, the applicant proposes to install a 12' x 12' boatlift along the southern side of the proposed floating dock. As designed, the proposed docking facility would be installed along the northern side of a "peninsula" of coastal wetlands that border the southern property line. The access pier would run along the western edge of this marsh fringe before terminating at the platform. As designed, no portion of the proposed platform would be located over any areas of coastal wetlands. On October 6, 2014, Jessi Baker (DCM/DMF liaison) and I met on -site to determine water depths surrounding the proposed docking facility. Based on the results from our field investigation, it appears there is approximately 20" of water along the western side of the proposed floating dock, relative to normal low water and approximately 24" of water along the eastern side of the proposed docking facility, relative to normal low water. Water depths from the area surrounding the proposed boat lift range from 15" to 24", relative to normal low water. Measurements to determine the deepest depth of water (at the terminal end of the proposed floating dock) were taken at a distance of approximately 20'-25' from the near shore edge of marsh, in the immediate location of the planned docking facility. Here the water depths averaged 24", relative to normal V41VAter. Water depths at a distance of 15' from the edge of marsh measured 20" at normal low water. The body of water that is separated by coastal wetlands measures approximately 70' in width at its most narrow point and 76' at its widest point, limiting the proposed pier/dock to 17.5' offshore of the edge of marsh (25% of the width of the water body). As applied, the proposed pier/dock would extend a distance of 17' from the near shore edge of marsh, which is an approximation of the'% width limitation. As previously mentioned, part of this project would include the complete demolition of the existing docking facility located just north of the proposed. Currently, the existing docking facility includes nothing more than a series of piling and stringers, and is isolated from the mainland (i.e. no decking or walkway). Based on the application package, the property owners plan to remove the abandoned pier/platform and restore the area back to its original condition. 10. ANTICIPATED IMPACTS The proposed structures would incorporate approximately 712 sq. ft. of Estuarine Waters and Pubic Trust Area along the eastern side of the dilapidated pier structure. The proposed structure would extend approximately 17' into a waterbody, which measures approximately 70'-76' across. This distance would conform to the 1/4 width rule. As presented, the proposed structure(s) would not encroach into neither of the adjacent 15' Riparian Corridor Setback Areas. Water depths in the vicinity of the proposed docking facility are slightly less than ideal; however, DCM and DMF staff has determined that the reported water depths in this area are accurate and range from 15" to 24", relative to normal low water. Minor increases in turbidity should be expected during construction. Proposed catwalk = 4 ft. x 10 ft. = 40 sq. ft. Proposed floating dock = 8 ft. x 16 ft. = 128 sq. ft. Proposed boatlift = 12 ft. x 12 ft. = 144 so. ft. (not counted) Total = 568 sq. ft. The new docking facility would continue to provide docking space for the total up to two (2) vessels at this location. It appears that the project is consistent with the use standards set forth in NCAC 07H .0208(b)(6), including the % width rule, the eight square foot rule and the pier width rule. The proposed structures would be located entirely over open water. If the project is determined to be consistent with NCAC 07H .0208(b) and (6), it is recommended that any permit issued should include the following conditions: This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the structure without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3. The authorized structure and associated activity must not cause an unacceptable interference with navigation and shall not exceed the established pierhead line. 4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 5. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 6. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without having the permit transferred to a third -party. 7. This permit authorizes a maximum of two (2) boat slips. At no time shall more than two (2) vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. 8. This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorization which may be required. Depths at normal low water in the vicinity of the proposed floating dock ranged from 20" to 24" and 15" to 24" in the area of the proposed boat lift. Due to the marginal depths observed in the project area it is requested that stops be placed on the ' floating dock 24" above the .bottom substrate.at the shallowest point under the dock. This will assure the floating dock does not rest on bottom during more extreme tides. We have considered repairing the existing dock as it is still partially in place and over 70% of the wood decking has been salvaged on our property, ready for installation. Currently, in order to have access so we can swim, fish or crab in front of our property, we have to wade through the various marsh grasses and mud. We don't like to do this because we have noticed that it is causing habitat destruction. We would much prefer to have a floating dock from which we can swim, fish, crab, and launch our kayaks. A fixed platform, which would need to be higher above the water, is very limiting in this regard. Our proposal will improve the appearance of this area of Topsail Creek by removing the old unattractive white concrete filled PVC pipe pilings and replace them with more traditional wood pilings. We also consider wood pilings to be more eco-friendly than PVC pilings which leach toxins into the water. Our plan is also less environmentally intrusive than the existing dock. The water depth at the lowest tide has been around +/-15 inches. We are proposing "stops" on the floating dock to assure environmental integrity of our waterway. It should be noted that two existing docks in clear view of our proposed dock have floating docks with no stops. One dock is far bigger than the one we are requesting. We request that you approve our proposed plan so we may have full enjoyment of our waterfront property in our retirement. We would also like to point out that prior to purchasing the property, we relied on a CAMA representative's on- site visit to the property, during which it was indicated that we would not have any problem rebuilding at this location.
