Permit Class NEW Permit Number 108-15 STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to David Knoch, 573 Hunt Club Drive, Corolla, NC 27927 Authorizing development in Hyde County at adj. to the Pungo River, at the terminus of SR 1149, Sandy Point Rd., near Scranton , as requested in the permittee's application dated 06/25/15 including attached workplan drawing (1) dated 07/02/15. This permit, issued on September 29, 2015 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subiect to fines. imprisonment or civil action, or may cause the permit to be null and void. Upland Development 1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the homesite, driveway, and other associated infrastructure, all as expressly and specifically set forth in the attached permit application and work drawings. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee David Knoch Permit No.108-15 Page 2 of 4 ADDITIONAL CONDITIONS Boat Rama 2) Unless specifically altered herein, this permit authorizes one gravel boat ramp, as indicated on the attached workplan drawings. 3) Placement of fill materials below normal water level shall be limited to the ramp structure. Docking Facility 4) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 5) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the reconstructed docking facility. Any sewage discharge at the reconstructed docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 6) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 8) This permit authorizes one formalized boat slip. Osprey Pile 9) The authorized osprey pile shall be constructed as depicted in the attached workplan drawing. Shoreline Stabilization — Rip Rap & Offshore Sill 10) The riprap alignment shall approximate the normal water level at the time of construction. 11) At the time of construction the landward edge of the offshore sills shall be positioned no more than 40 feet waterward of the normal water level contour or 40 feet waterward of the waterward edge of existing emergent wetlands at any point along its alignment. David Knoch ADDITIONAL CONDITIONS Permit No.108-15 Page 3 of 4 12) The alignment of the permitted rip rap and offshore sills shall be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -verified by DCM within a maximum of 30 days prior to the new expected start of construction. 13) The rip rap and offshore sill material shall consist of clean rock or masonry materials such as, but not limited to, granite, marl, or broken concrete. It shall be of a size sufficient to prevent its movement from the site by wave or current action. 14) Offshore sills authorized under this permit shall be allowed only in waters that average less than three feet in depth along the proposed alignment as measured from the normal water level contour. 15) The height of the permitted offshore sills shall not exceed twelve inches above the normal water level. 16) Sills shall be marked at 50 foot intervals with reflectors extending at least three feet above normal water level. 17) No excavation of shallow water bottom or any Coastal Wetlands is authorized by this permit. 18) The permittee shall maintain the offshore sills in good condition and in conformance with the terms and conditions of this permit or the remaining offshore sill structures shall be removed within 90 days of notification from the Division of Coastal Management. Sedimentation & Erosion Control NOTE: An Erosion and Sedimentation Control Plan may be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environmental Quality, Land Quality Section, 943 Washington Square Mall, Washington, NC 27889. 19) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. Stormwater Management 20) The Division of Energy, Mineral, and Land Resources approval of this project under stormwater management rules of the Environmental Management Commission is covered by way of Stormwater Permit No. SW7150707, which was issued on 08/18/15. Any violation of the permit approved by the DEMLR shall be considered a violation of this CAMA permit. Mitigation 21) In order to compensate for impacts associated with this permit, mitigation shall be provided in accordance with the provisions as outlined in the attached U.S. Army Corps of Engineers, Wilmington District Compensatory Mitigation Responsibility Transfer Form dated 09/22/15. David Knoch Permit No.108-15 Page 4 of 4 ADDITIONAL CONDITIONS General 22) If the crossing of wetlands with mechanized construction equipment is necessary, temporary construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed immediately upon completion of construction. 23) The temporary placement or double handling of riprap materials within water or vegetated wetlands is not authorized. 24) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 25) No open water areas shall be excavated or filled, even temporarily, outside of the area as indicated on the attached workplan drawing. 26) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 27) The permittee and/or his or her contractor shall meet with a representative of the Division prior to initiation of any phase of this project. 28) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers assigned the proposed project Action ID No. SAW 201501646, which was issued 09/22/15. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 3900 and assigned the project DWR Project No. 15-0704. NOTE: The permittee is advised that any development or land disturbing activity that is considered non - water dependent is not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission (EMC) Tar Pamlico River buffer regulations in place at the time of such development. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. For reference, the property is approximately centered on 35.445405°N and-76.556575°W. The subject property is currently 20.63 acres and contains 17.79 acres of jurisdictional wetlands and 2.84 acres of uplands. The majority of the property is wooded wetlands and uplands or coastal wetlands. This property is on the Pungo River and is suffering from a high erosion rate which is evident from the recent normal water line (NWL) survey compared to previous surveys. The eroded banks consist of peat beds and sandy deposits. The adjacent property to the north contains a house and riprap shoreline stabilization along with a pier and the adjacent property to the south is undeveloped (similar to the Knoch Property). A Section 404 delineation was performed by USACE and surveyed in 2008 by consultants for the previous owner. Also in 2008, there was a Nationwide 14 and 401 Water Quality Certification issued for a driveway on the subject property. This work was never completed and the permits have expired (copies included). On April 28'" 2015, Steve Trowell, DCM, flagged the coastal wetlands line in areas of the proposed work and surveyors located the flags on the same day (see plotted coastal wetlands line). The Knoch's wish to do the following development activities on the subject property: A. Driveway through Section 404 wetlands This includes proposed fill of 0.49 acres of Section 404 non -coastal wetlands. This is a similar alignment as permitted in the previous Nationwide 14/ 401 Cert. The proposed compensatory mitigation for this activity is on -site preservation of 5.0 acres (10:1 preservation to impact ratio). Other mitigation options have been explored including in -lieu contribution to NC Division of Mitigation Services and private mitigation banks. Based on the cost of mitigation banks costs, the amount (roughly $26,000) in mitigation payment costs would render this project cost prohibitive. Preservation proposed would be achieved in the form of a Protective Covenant (in perpetuity) to be recorded with Hyde County Register of Deeds. A draft Protective covenant is attached. The driveway will include a 10 ft wide gravel surface and a shoulder with side slopes on each side. If necessary, the topsoil in the driveway alignment will be stripped and/or covered with geo-textile fabric prior to receiving sand fill and gravel surfacing. The driveway will include three (roughly equally spaced) 15 inch diameter traffic rated culverts to maintain connectivity of surficial hydrology within the wetland areas. B. Riprap shoreline stabilization and sill This is intended to protect the subject property from erosion and includes: upland protection riprap (600 ft), low profile wetland protection riprap (558 ft) and an offshore sill adjacent to the coastal wetland area consisting of two overlapping sections (153 ft) RECEIVED C. Vehicular bridge to access homesite SEP 17 2015 This is to be a pile -supported timber bridge (10 ft wide), elevated a minimum of 3 ft over coastal wetland elevation. The total length of the proposed bridge is 135 ft, spanning 124 ft of Section 404 wetlands, including 88 ft of coastal wetlands. D. Residential house with on -site septic The residential house footprint is depicted on the CAMA plan along with the proposed on -site septic system. Hyde County Health Dept. has evaluated soil conditions in this location and has found them to be provisionally suitable for an on -site septic system (permit is attached). E. Gravel boat ramp/launch The ramp location is depicted on the plan and is meant to be used by small skiffs and paddle vessels. David Rnoch Pungo River Hyde County Project Setting The ±20 acre project site is located at the terminus of SR 1147, Sandy Point road, in the former Greenville Timberline subdivision known as the Currituck 10 at Sandy Point on the Pungo River in Hyde County near Scranton, North Carolina. Prior to the subdivision development that occurred in the early part of 2000 at Sandy Point, the site was a pine plantation managed and owned by Weyerhaeuser. The site is best describe as a low lying wooded 404 wetland with limited amount of uplands. Of the 20.6 acres comprising the project site, 17.79 acres are wetlands and 2.84 are uplands. There is an upland area next to the unimproved dirt road used to access the project site off the end of Sandy Point road and another upland area adjacent the Pungo River. The surrounding tracts to the project site remain largely undeveloped with the exception of the adjacent tract to the northwest developed with a single family residence, riprap revetment for shoreline stabilization and a pier. The wooded 404 wetlands were part of a managed pine plantation that was clear cut approximately 10 years ago. The cutover area is vegetated with various shrubs, scattered loblolly pine, red cedar and gum trees. There is an extensive area of Coastal Wetlands marsh that extends landward from the Pungo River into and off the tract to the adjacent parcel to the east. This marsh divides the upland area adjacent the Pungo River. The larger portion of the uplands adjacent the river is bordered on three sides by this marsh and the river on the other. The uplands adjacent the river are vegetated with large mature trees with an open understory and were not part of the earlier described timber harvest. The project site shoreline is subject to high wave energy orientated to the southwest with a fetch that exceeds 2 miles. The uplands adjacent the river shore have a sediment bank shoreline with a +3' vertical escarpment comprising mainly of clay soils. These clay soils while being resistant to erosion have resulted in a shoreline with jagged undulations in the shoreline escarpment. Due to the limited amount of sand input from bank erosion, the normal water level (NWL) is at the erosion escarpment with no sandy estuarine beach. However the marsh that separates the uplands does have a sand bank that rolls over and retreats with the shoreline erosion. The remaining Coastal Wetland shoreline is a vertical peat escarpment at f 18". The Coastal Wetland is vegetated primarily with black needlerush Juncos roemarianus), and also contains salt grass istichlis s icata , salt meadow hay S ar#napatens) three square Scir CENED americanus), and smooth cordgrass S ariina alterni ora fringes along the river shoreline. $EP 17 1015 ac,++vv�r o+�• The nearshore area below the NWL is generally shallow (<3') and deepens gradually as you move offshore. The bottom substrate is sand. A cursory review by DCM staff of the nearshore area did not reveal any submerged aquatic vegetation (SAV). The Pungo River in this location classified by the Environmental Management Commission as SA HQW, NSW and is open to shellfishing. The Marine Fisheries Commission classifies this area as Coastal Waters. David Knoch Pungo River Hyde County Page Two Project Description The applicant proposes to develop the tract for a single family residence to be constructed on the largest upland area adjacent the Pungo River. Access to the home site will be by a road to be filled 22' wide x 961 long throughthe wooded wetlands to the river shore. The filled road will have a top width or travel lane 10' wide. Three 15" diameter culvert pipes will be equally spaced along the road to maintain the surface hydrology within the wetland. The previous owner of the project site had obtained a Nationwide Permit No. 14 (Action ID 200802276) from the US Army Corps of Engineers (USACOE) and a 401 Water Quality Certification (DWQ Project # 08- 1006) from the Division of Water Resources (DWR) for road construction in the same alignment proposed in this application. The applicant proposes to mitigate for the 404 wooded wetland impacts by recording a protective covenant on the remaining project site wetlands. A 10' wide x 135' long pile supported wooden bridge is to be constructed over Coastal Wetlands to reach the larger area of uplands and the proposed home site. The bridge decking will be elevated 3' above Coastal Wetland substrate. The home site has an active septic tank permit issued by the Hyde County Health Department. The applicant proposes to construct 10' wide x 20' gravel boat ramp in uplands for the purpose of launching small skiffs and kayaks. A 10' gravel road will be constructed to the boat ramp off the access road. A three space parking area will also be constructed at the foot of the access road to the boat ramp. This associated infrastructure will be constructed in uplands on the north side of the vehicular bridge on the smaller upland area adjacent the river. A total of 1,158 linear feet of shoreline is proposed to be stabilized with a riprap toe revetment armoring the erosion escarpment which includes 321' of wooded 404 wetland shoreline, 237' of Coastal Wetland shoreline and 600' of upland shoreline. The Coastal Wetland shoreline with the sandy bank that separates the uplands adjacent the river will be protected with an overlapping riprap offshore sill. The sills will be 12' wide x 70' and 83' long respectively. The ends of the sills will overlap the toe revetments on each end and in the center maintaining a ±10' wide opening. The sills will have a height 1.5' above the NWL and will be constructed a maximum distance of 40'seaward of the NWL. The applicant also proposes to construct a 6' x 100' pier with an 8' x 12' L-head platform and two tie pilings for one wet slip. A single piling is to be driven ±40' offshore the NWL WED the purpose of constructing an osprey nesting site within view of the proposed residence. SEP 17 2015 oc�..ww; ✓i.. The project will increase small boat traffic in the area and their associated impacts. There will be some localized short term turbidity during construction of the shoreline stabilization, boat ramp and pier. PROJECT SUMMARY: The applicants propose to develop 20 acre tract with an access road through wooded 404 wetlands, vehicular bridge over Coastal Wetlands, gravel parking area, one single family residence, boat ramp, riprap toe revetment and offshore sill for shoreline stabilization, a pier with one wet slip, and a single pile for osprey nesting. David Knoch Pungo River Hyde County Project Setting The ±20 acre project site is located at the terminus of SR 1147, Sandy Point road, in the former Greenville Timberline subdivision known as the Currituck 10 at Sandy Point on the Pungo River in Hyde County near Scranton, North Carolina. Prior to the subdivision development that occurred in the early part of 2000 at Sandy Point, the site was a pine plantation managed and owned by Weyerhaeuser. The site is best describe as a low lying wooded 404 wetland with limited amount of uplands. Of the 20.6 acres comprising the project site, 17.79 acres are wetlands and 2.84 are uplands. There is an upland area next to the unimproved dirt road used to access the project site off the end of Sandy Point road and another upland area adjacent the Pungo River. The surrounding tracts to the project site remain largely undeveloped with the exception of the adjacent tract to the northwest developed with a single family residence, riprap revetment for shoreline stabilization and a pier. The wooded 404 wetlands were part of a managed pine plantation that was clear cut approximately 10 years ago. The cutover area is vegetated with various shrubs, scattered loblolly pine, red cedar and gum trees. There is an extensive area of Coastal Wetlands marsh that extends landward from the Pungo River into and off the tract to the adjacent parcel to the east. This marsh divides the upland area adjacent the Pungo River. The larger portion of the uplands adjacent the river is bordered on three sides by this marsh and the river on the other. The uplands adjacent the river are vegetated with large mature trees with an open understory and were not part of the earlier described timber harvest. The project site shoreline is subject to high wave energy orientated to the southwest with a fetch that exceeds 2 miles. The uplands adjacent the river shore have a sediment bank shoreline with a +3' vertical escarpment comprising mainly of clay soils. These clay soils while being resistant to erosion have resulted in a shoreline with jagged undulations in the shoreline escarpment. Due to the limited amount of sand input from bank erosion, the normal water level (NWL) is at the erosion escarpment with no sandy estuarine beach. However the marsh that separates the uplands does have a sand bank that rolls over and retreats with the shoreline erosion. The remaining Coastal Wetland shoreline is a vertical peat escarpment at t 18". Access to the home site will be by a road to be filled 22' wide x 961 long through the wooded wetlands to the river shore. The filled road will have a top width or travel lane 10' wide. Three 15" diameter culvert pipes will be equally spaced along the road to maintain the surface hydrology within the wetland. The previous owner of the project site had obtained a Nationwide Permit No. 14 (Action ID 200802276) from the US Army Corps of Engineers (USACOE) and a 401 Water Quality Certification (DWQ Project # 08- 1006) from the Division of Water Resources ()J.) for road construction in th OlEggpICA in this _aRplicat on„ The applicant proposes to mitigate for the 404 wooded wetlan impacts by recording a protective covenant on the remaining project site wetlands. A 10' wide x 135' long pile supported wooden bridge is to be constructed over Coastal Wetlands to reach the larger area of uplands and the proposed home site. The bridge decking will be elevated 3' above Coastal Wetland substrate. The home site has an active septic tank permit issued by the Hyde County Health Department. The applicant proposes to construct 10' wide x 20' gravel boat ramp in uplands for the purpose of launching small skiffs and kayaks. A 10' gravel road will be constructed to the boat ramp off the access road. A three space parking area will also be constructed at the foot of the access road to the boat ramp. This associated infrastructure will be constructed in uplands on the north side of the vehicular bridge on the smaller upland area adjacent the river. A total of 1,158 linear feet of shoreline is proposed to be stabilized with a riprap toe revetment armoring the erosion escarpment which includes 321' of wooded 404 wetland shoreline, 237' of Coastal Wetland shoreline and 600' of upland shoreline. The Coastal Wetland shoreline with the sandy bank that separates the uplands adjacent the river will be protected with an overlapping riprap offshore sill. The sills will be 12' wide x 70' and 83' long respectively. The ends of the sills will overlap the toe revetments on each end and in the center maintaining a ±10' wide opening. The sills will have a height 1.5' above the NWL and will be constructed a maximum distance of 40'seaward of the NWL. The applicant also proposes to construct a 6' x 100' pier with an 8' x 12' L-head platform and two tie pilings for one wet slip. Mr. Knoch desires to develop the property with a single family residence, boat ramp, pier and shoreline stabilization with riprap including an offshore sill. The total amount of shoreline to be stabilized with a toe riprap revetment is 1,158 linear feet and includes Coastal Wetland, wooded 404 wetland and upland shoreline. With the exception of one area with a Coastal Wetland shoreline, the entire shoreline has an erosion escarpment. The area of Coastal Wetlands that does not have an erosion escarpment is the area to be protected with an offshore sill. The access road/driveway through the parcel to reach the Pungo River shoreline is to be constructed in 404 wooded wetlands. Also, vehicular access to the proposed home site will require a bridge over Coastal Wetlands. Authorization to construct the access road in wooded 404 wetlands was given to a previous landowner by the USACOE and DWR. This access road is and was proposed outside the Estuarine Shoreline AEC. The current landowner proposes to mitigate for the wetland impacts associated with the road construction with a protective covenant on the remaining wetlands on the project site. The applicant has a septic tank permit from the Hyde County Health Department at the proposed home site. I have met onsite with Raleigh Bland USACOE and the applicant's consultant to confirm the wetland lines and review the project site. Staff has reviewed the applicant's proposal for development considering the development standards found in NCAC 7H.0205, .0206, .0207, .0208 and .0209 baring any significant objections from the review agencies, staff recommends issuance of the permit. Staff recommends the standard permit conditions for riprap toe revetments including height above the wetland escarpment, distance offshore to toe and slope of the revetment. Also a condition requiring the use of construction mats for the crossing of wetlands with mechanized equipment is needed. Staff recommends a standard permit condition prohibiting the double handling of riprap materials in wetlands or open waters. The vehicular bridge should be conditioned to be a minimum of 3' above the wetland substrate to the bottom of the decking. This application package has a lot of different development activities proposed for one single family residence, so staff feels that construction will likely occur in phases with different contractors used that specialize in riprap installation, road construction, pier construction, etc. Staff feels that a note or permit condition should be used to put the applicant on notice requiring a preconstruction conference with the contractor and applicant prior to the initiation of any development activity authorized by this permit. Overview: The 20.63 acre undeveloped site has approximately 1,093 linear feet of shoreline along the Pungo River. The property consists of four (4) sections of uplands totaling 2.84 acres and 17.79 acres of wetlands. Two (2) upland sections are located adjacent to the river. The riverfront uplands are vegetated with large mature trees and open understory. The wetlands are a mix of Coastal Wetlands and Section 404 wetlands. Coastal Wetlands marsh extends from the Pungo River landward, dividing the two (2) upland sections. The remaining Section 404 wetlands contain cutover vegetation from a former pine plantation. The shoreline is subject to high wave energy, with a fetch that exceeds 2 miles. A 3 foot vertical erosion escarpment is located along the upland shoreline. Normal Water Level (NWL) is located at the escarpment. Since the uplands consist of mainly clay soils, there is no sandy estuarine beach. The Coastal Wetlands marsh dividing the two (2) uplands sections has a sand bank that rolls and retreats with shoreline erosion. The remaining Coastal Wetlands shoreline consists of an 18 inch vertical peat escarpment. The nearshore area is less than 3 feet deep. The site is located in the AE Floodzone. The single piling installation will provide for an osprey nesting site. The boat ramp will be installed on the smaller riverfront upland section. The parking spaces will be located across the roadway from the boat ramp. The roadway will extend from the access point at the terminus of Sandy Point Road through wooded Section 404 wetlands and an upland section and across Coastal Wetlands to the largest upland section along the river. Through Section 404 wetlands, the roadway will be placed on a 22 foot wide fill area with culvert pipes equally spaced along the roadway to maintain surface hydrology within the wetland. The bridge decking will be elevated 3 feet above wetland substrate. The single- family house, deck and associated septic and the pier facility will be installed on the larger riverfront upland section. The waters of the Pungo River are classified as SA HQW, NSW and are open to shellfishing. A review of historic and archaeological resources was not provided. No submerged aquatic vegetation (SAV) was observed in the area. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to develop a 20 acre tract with an access road through Section 404 wooded wetlands, a vehicular bridge over coastal wetlands, a gravel parking area, one residence, boat ramp, riprap revetment, offshore sills, a pier with one wet slip, and a single pile for an osprey nest. The revetment will be constructed at the toe of the shore for approximately 1,158'. Two offshore sills are proposed in front of a section of coastal wetlands with a sandy shore. The 12' wide by 70' and 83' long sills will overlap 10' and be 1.5' above NWL 40' from shore. The boat ramp is stated to be for kayaks and small vessels. The 6' by 100' pier will have a "L" platform with one slip. The Pungo River at this location is classified SA HQW NSW by the Environmental Management Commission and is open to shellfish harvesting. The NCWRC has reviewed the permit application and has the following comments: RECEIVED — Water depths at the terminus of the boat ramp are stated be -2' NWL in the application AUG 0 3 2015 but show less than -1.5' NWL on the plat. Contact should be made with the appropriate regulatory agency to insure appropriate mitigation is offered to offset wetland impacts since significant time has passed since the previous permit issuance. In order to compensate for impacts associated with this permit, mitigation shall be provided in accordance with the provisions outlined in the U.S. Army Corps of Engineers, Wilmington District Compensatory Mitigation Responsibility Transfer Form. The requirements of this form, including any special conditions listed on this form, are hereby incorporated as special conditions of this permit authorization. 5. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. RECEIVED JUL 17 105 614;� %J" 4 i 1JCM 'JUN 8'0 2015 NARRATIVE- CAMA Major Permitting KNOCH PROPERTY ARO Revised June 25, 2015 The project is located on sandy Point Rd. in rural unincorporated Hyde County, North Carolina. For reference, the property is approximately centered on 35.445405°N and-76.5565750W. The subject property is currently 20.63 acres and contains 17.79 acres of jurisdictional wetlands and 2.84 acres of uplands. The majority of the property is wooded wetlands and uplands or coastal wetlands. This property is on the Pungo River and is suffering from a high erosion rate which is evident from the recent normal water line (NWL) survey compared to previous surveys. The eroded banks consist of peat beds and sandy deposits. The adjacent property to the north contains a house and riprap shoreline stabilization along with a pier and the adjacent property to the south is undeveloped (similar to the Knoch Property). A Section 404 delineation was performed by USACE and surveyed in 2008 by consultants for the previous owner. Also in 2008, there was a Nationwide 14 and 401 Water Quality Certification issued for a driveway on the subject property. This work was never completed and the permits have expired (copies included). On April 28`h 2015, Steve Trowel[, DCM, flagged the coastal wetlands line in areas of the proposed work and surveyors located the flags on the same day (see plotted coastal wetlands line). The Knoch's wish to do the following development activities on the subject property: A. Driveway through Section 404 wetlands This includes proposed fill of 0.49 acres of Section 404 non -coastal wetlands. This is a similar alignment as permitted in the previous Nationwide 14/ 401 Cert. The proposed compensatory mitigation for this activity is on -site preservation of 5.0 acres (10:1 preservation to impact ratio). Other mitigation options have been explored including in -lieu contribution to NC Division of Mitigation Services and private mitigation banks. Based on the cost of mitigation banks costs, the amount (roughly $26,000) in mitigation payment costs would render this project cost prohibitive. Preservation proposed would be achieved in the form of a Protective Covenant (in perpetuity) to be recorded with Hyde County Register of Deeds. A draft Protective covenant is attached. The driveway will include a 10 ft wide gravel surface and a shoulder with side slopes on each side. If necessary, the topsoil in the driveway alignment will be stripped and/or covered with geo-textile fabric prior to receiving sand fill and gravel surfacing. The driveway will include three (roughly equally spaced) 15 inch diameter traffic rated culverts to maintain connectivity of surficial hydrology within the wetland areas. B. Riprap shoreline stabilization and sill This is intended to protect the subject property from erosion and includes: upland protection riprap (600 ft), low profile wetland protection riprap (558 ft) and an offshore sill adjacent to the coastal wetland area consisting of two overlapping sections (153 ft) C. Residential house with on -site septic The residential house footprint is depicted on the CAMA plan along with the proposed on -site septic system. Hyde County Health Dept. has evaluated soil conditions in this location and has found them to be provisionally suitable for an on -site septic system (permit is attached). E. Gravel boat ramp/launch The ramp location is depicted on the plan and is meant to be used by small skiffs and paddle vessels. The water depth is shallow in this area and would not permit larger boats to by launched. This does not include a concrete ramp or bulkheading. F.
