This permit, issued on August 28, 2015 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Docking Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent pan of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be ,accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Anthony Jeffs Permit #85-15 Page 2 of 2 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. ,At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 3 formalized boat slips. 6) The reconstructed pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 9) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 10) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2015-01097), which was issued on 6/16/15. . NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. 2015- 0512. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination, The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. Anderson Blvd./Highway 50, Topsail Beach, Pender County, adjacent to Banks Channel and Topsail Sound. To get to the site from Wilmington take US Hwy 17 N to Highway 50 (approximately 13 miles north of Porters Neck). Turn right onto Highway 210 and travel to the intersection of Highway 50 and Highway 210. Turn right onto Highway 50 and proceed onto Topsail Island. Continue along Highway 50 (heading south) approximately 4.5 miles before turning right into a private drive off of N. Anderson Blvd. (Highway 50). The private drive is located approximately 600' south of Nixon Drive, Topsail Beach. The lot is approximately 8,500 sq. ft. in size and existing man-made features on the property include a pier and docking system. The high ground portion is elevated approximately 12'-15' above the Normal High Water (NHW). Vegetation on the tract consists of Maritime Forrest (Live Oaks) and scrub vegetation. The highground transitions to an area of high marsh consisting of Spikegrass (Distichlis spicata), Salt Meadow Hay (Spartina patens), and Black Needlerush (Anus roemerianus) which extends approximately 30'40' west of the western property boundary bordering the Normal High Water (NHW) level. The high marsh transitions waterward to an area of low marsh (approximately 120' in width) that consists primarily of Smooth Cordgrass (Spartina alternii fora). The property has approximately 50 linear feet of shoreline, all of which is naturally stabilized. The existing pier is located along the center line of the property, and extends into Banks Channel. The existing pier (6' x 185') terminates approximately 40' feet beyond the edge of the marsh (bordering the property). A 16'x 16' elevated "T- head" shaped platform is located at the terminal end of the pier. The platform provides access to a 6' x 20' section of floating dock that runs perpendicular to the shoreline, in line with the existing pier. A 12' x 12' boatlift is located along the southern side of the existing floating dock, within the applicant's area of riparian access. The width of the waterbody in this area of Banks Channel, in the vicinity of the project area, measures approximately 950', as measured from the edge of marsh to edge of marsh. Current water depths around the existing facility range from approximately -3.0' to -8.0', relative to Normal Low Water (NLW). The waters of Banks Channel, adjacent to the project site, are classified as SA by the North Carolina Division of Water Quality. They ARE NOT designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries, and they are OPEN to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to construct a new 5' x 4' access platform and 5' x 5' jet -ski lift along the northern side of the existing docking facility. Specifically, the proposed lift would be located landward of the existing 16' x 16' platform, between the end of the docking facility and the edge of marsh. As proposed, the platform and jet -ski lift would not extend beyond the end of the existing docking facility, nor would it be located within the adjacent 15' riparian corridor setback. In addition, the proposed lift would be located landward of the edge of the maintained channel. Water depths in the area of the proposed boatlift range from -2.0' to -3.0', relative to NLW. According to the work plat drawings, the jet —ski lift would be located outside of the maintained channel, within the pier - head alignment, within 1/4 of the width of the waterbody and within the applicant's area of riparian access. No impacts to Coastal or "404" wetlands would occur as a result of construction. It is staffs recommendation that the proposed docking facility is CONSISTENT with the Rules in 15 NCAC 7H.0208 (b) (6) Use Standards for Docks and Piers. Based on these factors, it is recommended that a permit be issued to install a second lift adjacent to the subject property. This office has no objections to the proposed project. Any permit issued should also include the following conditions: 1. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the structure without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3. The authorized structure and associated activity must not cause an unacceptable interference with navigation and shall not exceed the established pier head line. 4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 5. The proposed structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 6. This permit does not authorize the interference with any existing or proposed Federal project, and, the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be RECEIVED caused from existing or future operations undertaken by the United States in the public interest.
