Morehead City, Carteret County
The following is my assessment and consequent recommendations of the above referenced proposal:
There are 8 slips existing with a two boatiet dock and finger piers along this property. The applicant is
proposing to reconfigure the existing slips, jet dock and finger piers for total of 6 slips (applicant is
including two boats on the jet dock in slip count) along this parcel within Peletier Creek. The proposed
additions to the existing docking facility would not extend more than a maximum distance of 21' from.
NHW to the west, 25' from NHW to the east and would remain within pier head length within this area.
All work would be a minimum distance of 15' from both riparian access lines. The development
conforms to the guidelines set forth under 15A NCAC 07H .0208. Assuming that state and federal
agencies concur with the proposal, the District recommends the project be authorized as proposed,
contingent upon the following conditions:
• The total number of slips shall not exceed a maximum of 6 (includes two boat spots on jet dock
floating platform).
• Due to the canal width, all parts of the docking facility shall not exceed a maximum distance of
21' from NHW to the west, not exceed a max of 25' from NHW to the east and shall remain
within the length of the existing adjacent docking facilities.
• The placement of the boatlifts, finger piers and platforms shall be placed as shown on plats
dated received 9/15/2021.
All portions of the docking facility shall meet the minimum 15' riparian access line setback.

Consistency Determination: The request is consistent with/not in conflict with the Town of Morehead
City Land Use Plan certified by the CRC on September 28, 2007.
Overview: The subject property is located at 303 Georgia Ave, Morehead City, Carteret County, North
Carolina. The residential property is.71 acres (31,000sf) in its entirety and an average of 3' above nhw. Existing
development includes house, driveway, riprap, piers, floating platform for two boats. The upland vegetation
mainly consists of lawn grasses. The total shoreline length for the tract is 244'. Peletier Creek runs along
the south side of the property. The waters of Peletier Creek have approximately 2.5' lunartidal amplitude.
The applicant has an existing 5-slip docking facility with an existing two-boatjet dock. The current proposal
is for the reconfiguration of the existing docks and floating platform. The applicant is proposing a
maximum of 6 slips which includes the two-boatjet dock. There would be 4 slips within the canal and two
on the jet dock. The re -configuration would include two finger piers, one boatlift, one fixed platform, one
floating jet -dock with gangway, and one floating platform with gangway.
AECs involved include: Estuarine Waters and Public Trust Areas. The waters of Pelletier Creek are classified
as SB. This area is not designated as a Primary Nursery Area and is closed to the taking of shellfish. There
is a 10' x 25' fringe of coastal wetlands consisting mostly of Smooth Cordgrass (Sp. Altemiflora) along the
west side of the property. A review of historic and archaeological resources was not provided.
Anticipated Impacts: The proposed platform additions, finger piers, pier and boatlift would shade 877 ft.
and incorporate 1,133 ft. of shallow bottom habitat. The development would maintain a max of 6 slips (4
in -water slips and two jet dock slips). The increase in suspended sediment and turbidity levels from the
piling placement would be temporary, occur while the piling placement is taking place and should be
minimal given the bottom composition. The proposed additions should not be a hindrance to navigation
due to the fact all portions would not exceed a max of 21'to 25' from NHW within the canal. The proposed
development would also meet the minimum 15' setback from the riparian access lines.

The shoreline is 244 linear feet. Rules allow 8 sf per linear foot of shoreline for shading impacts which on
this case would be 1,952sf Therefore, the existing and proposed shaded impacts would not exceed the
maximum of 1,952 sf allowed.
Basis for Determination:
The Town of Morehead City Future Land Use Map (FLUM) designates the site as "Medium Density
Residential".
The following LUP policies are applicable to this request:
Areas of Environmental Concern:
Policy 4.2.6, page 94.
Policy 1: "The Town of Morehead City supports state and federal law regarding land use and
development in AECs".
Policy 2: "...considers coastal wetland areas to be valuable passive recreation areas. These areas
should be protected in their natural state. Only uses which are permitted by 15A NCAC 7H will be
allowed".
Policy 5: "...supports the use standards for estuarine and public trust areas as specified in 15A
N'CAC .0207".

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has
reviewed the permit application for proposed actions that may impact fish and/or fish habitats.
The applicant is proposing to replace and reconfigure the existing 6-slip docking facility with a
new 6-slip structure (4 slips within the canal and 2 slips on the jet dock). The reconfiguration
involves 2 finger piers, a boat lift, a fixed platform, a floating jet dock with gangway, and a
floating platform with a gangway. Shellfish resources were observed during the permit site visit
as well as during additional site visits related to a CAMA violation at the site.
DMF recommends that any issued permit include measures to avoid or minimize impacts to
shellfish resources. Any shellfish that are present within the footprint of proposed pilings or
under the proposed floating structures should be relocated to an area outside of the project
footprint. DMF also recommends that the platform include design elements that would prevent
the structure from being used for docking, such as railings. Finally, the permit should he
conditioned on no additional slips being proposed in the future.

Per Town of Morehead City Unified Development Ordinance (UDO) Article 14-31.2(L), only one dock or
pier may be located on a residential lot. The existing three docks at 303 Georgia Avenue appear to be
nonconforming. Based upon the submitted drawings, the nonconforming use is proposed to be
expanded. UDO Article 8-7 allows for the expansion, extension, or alteration of a nonconforming use
with an approved special use permit from the Morehead City Board of Adjustment. The Board of
Adjustment is a quasi-judicial board which hears testimony and draws conclusions based on that
testimony. There is no guarantee that a special use request will be granted. If a special use permit is
granted for the expansion, extension, or alteration of the docking area at 303 Georgia Avenue, a building
permit application for same will need to be submitted to the Planning and Inspections Office for review.

Good evening, my name is Judy Howell. My husband, Roy, and I have resided at 4706 San Juan Circle
since 2004. 1 am here tonight in opposition to the request from Mr. DA Ballou to alter his dockage or
Pelletier Creek, 303 Georgia Avenue for the following reasons:
Per Section 4-8.3 Special Use Criteria:
Section D: The proposed use will not affect adversely the health and safety of residents and workers in the
Town
Our children and grandchildren have enjoyed a peaceful life on the creek with swimming, kayaking, paddle
barding and boating for many years. It is a common sight to see people kayaking on the creek or paddle boarding
enjoying the ducks, fish cranes, pelicans or other sights of nature. We have had to slow people down who don't
understand what No Wake means. Our granddaughter was paddle boarding off the dock when a boat came in
heading to the end of the creek so I waved to alert the boater a paddle boarder was there. I have personally
witnessed our neighbor waving a boat down to alert him his daughter and friends were swimming near his dock
because the boat was cutting the corner into the creek. With the proposed expansion, this adds boat traffic to an
already narrow creek making it more dangerous to the safety of our families as well as others plus potential
property damage with boats trying to pass on the narrow creek. Mr. Bailou's proposal is at an area of the creek
where it is even narrower than the rest of the creek.
Section J: The proposed use shall be subject to the minimum area, setback, and other locational requirements of
the zoning district in which it will be located.
Our area is zoned R20 single family residential. Mr. Ballou refers to this as a marina. His proposal clearly does not
conform to the requirements of a residential neighborhood. Allowing this alteration creates more congestion as
well as potential property degradation by allowing this to operate as a marina.
For the above stated reasons, I am opposed to this request. Thank you for your time.

Our names are Dr. William and Mrs. Taylor Cheek. We purchased our property, 4707 Park Drive, in 2008 and have
enjoyed our small community on the creek ever since. We have loved the environment it has allowed us to raise our
children in and share with family and friends. Activities such as swimming, kayaking, paddle boarding, fishing, orjust
simply sitting on the dock are pastimes we have always enjoyed over our years on the creek. We have been able to do so
without worry because of the limited boat traffic in our part of the creek as well as the relationships with our neighbors
who look out for each other.
We oppose the expansion proposed by Mr. Ballou. We feel that his proposal does not conform to the requirements of a
residential neighborhood, especially in reference to his expansion as a marina or commercial property. This is not the
type of traffic and activity appropriate for a residential neighborhood.

First, we are very pleased to know that Mr. Ballou is finally working with a professional engineer in pursuit of improvements for
his water recreational use of Pelletier Creek, a waterway owned by the State of North Carolina. We are confident with CAMA's
supervision and the Town of Morehead City, that the measurements will be accurate and reflect the laws and regulations in
place to protect AECs and neighboring properties.
That being said we are strongly opposed to the project as presented because we question the following!
• Is it indeed designed for "the exclusive use of the owner or occupant of the property'?
• In this case, and its' history, is the use of solely rip rap appropriate, when just last year, naturally occurring
vegetation existed along the shoreline, as well as oyster rocks which enhanced the balance and health of the creek?
(after excavation with heavy equipment, herbicides were also used which ultimately killed the pine tree still
standing)
• Is it in the best interest of an already fragile habitat, in a very small space, to cover that much of the surface water?
• Should he be responsible first for correcting damage from erosion and blockage to our access to the creek when he
excavated the area abutting our properties? (Topographical Survey by Arthur Denning in 2007 showed the center of
the creek being 6-T deep, see attached) -
The environmental concerns have been addressed at length for the last year and a half in previous correspondence with
LAMA from the Wdghts, Lee Smith and ourselves. Hopefully you have them in a file for 303 to add to this new application.
After reviewing the CAMA Handbook, NC Environmental quality (deq.ncgov) and NOAA's Coastal Service Center's Residential
Dodos and Piers Inventory of Laws, Regs and Policies for the Southeast United States, I feel there is little more that I can add to
support our reasons for objecting to Mr. Ballou's current application.
Before closing, I would like to return to the `exclusive use" clause by drawing attention to several facts that can be confirmed
with a little bit of your time.
• Mr. Ballou, a native from Carteret County, purchased the property on February 13, 2021. TheDeed ti1664454
clearly shows that the seller retained a life estate for the right and use of a boat slip, with access to and from. He is
still a neighbor. (see attachment)
• Mr. Ballou personally owns 2 boats which he usually keeps on the boat port at the present time.
• There are 2 other boats that are solely used by others who come and park their cars on the grassy section of Georgia
Avenue. This area is not public parking place, but public right ofwayfor access to our lots in the back and Mr_
Schafron's lot The cars are parked there frequently for the entire day. (see attachment)
There has not been a dull moment since Mr. Ballou bought 303 Georgia Avenue. From DIY late evening and week -end
clearings and rakings with heavy equipment on both sides of the creek (he also owned the lot on San Juan circle), to continual
request and proposals for altering the land and waterfront, to misrepresentations, to changing his story line to work the
system, to attorneys, to threats, to bullying, to spreading mistruths, to trying to improve the grassy section of Georgia Avenue
without permit (City of Morehead came) and most alarming, his blatant denial that he has done anything wrong, the
neighbors have been very concerned for some time.
This end of Pelletier Creek is one of the few places left in our area with wetlands. Due to recent development storms and fear
of storms in Mitchell Village, habitats that support wildlife, especially birds, have been compromised. Although populations
and variety have decreased substantially in recent years, throughout the seasons, our end of the creek and our personal yard,
still attract every category of bird. (A variety of Ducks and Duckiike, Seabirds, Gulls, etc, Long-legged wading birds, Smaller
Wading Birds, Fowl -like birds, Birds of Prey, Nonpasserine Land Birds and Perching Birds). I would hope that our choices as a
communitywould increase rather than diminish their presence In the future.

I promise this is the last missive on DA Ballou's 303 Georgia Ave project.
Attached are a photo of our neighbors and our shoreline and Mr. Ballou's shoreline.
Our shorelines were done with respect to CAMA regulations, Mr. Ballou thumbed his nose at the regulations, raped his
shoreline of vegetation and destroyed a huge oyster rock at the head of the creek that helped filter run off from
Mansfield Parkway. All done with no permits. We feel CAMA only slapped his wrist for these infractions.
He has finally gone through the proper channels to apply for a Major Development Permit that will allow him to build an
extensive dock system that will create shadow on a lot of the creek bottom. His end goal is to rent slips (which he denies
at this time, but we have spoken to several folks who were interested in a slip ,but said he was asking too much).
Maybe the damage to our finger of the creek is already too great. I hope not.
It seems that CAMA has relaxed the regulations in favor of developers in Carteret County over the last couple of years.
I'm sure y'all are just implementing the new rules per your jobs. But Mr. Ballou's project will not create a significant
bonus to Morehead or the County.

The use of the jet ski port creates a lot of turbidity when he launches and returns his boats, not jet skis ,to it. I feel
CAMA has relaxed the regulations a lot over the last several years. When our neighbors built their T shaped dock several
years ago, they wanted to add 3 extra planks to round off a corner for safety reasons and were told they couldn't
because it created too much shade on the bottom of the creek. Now DA has covered a significant amount of bottom
with that jet ski pad and wants to build a dockage area that will cover a great deal of bottom.
I have heard that his project has met all the requirements, so I guess it's a done deal.

that I am not a adjacent riparian owner, however in this narrow creek, it is obvious that the impacts to my property will
continue to bean issue is this proposal is approved. I have video of almost every single time DA has loaded the two
boats on the jet docks over the past year. Every time the boats are loaded, the full -throttling of the boat motors
continues to push sand and mud sediment under my boat lift, dock, and along my seawall. I have contacted a marine
contractor providing dredging to come and price the cost to remove this sediment so that the water depth is back to the
depth it was prior to the jet dock install. I have been quoted in excess of $4000 to remove the sediment that has now
accumulated. Even when he backs the two boats off of the floating jet docks, there are issues. When they back off he
does so with such speed and force that when the boats enter the waterway, he immediately has to full -throttle the
boats to avoid hitting my lift and pilings I also have multiple video clips of this. This causes the same movement of
sediment under my lift and against my bulkhead.
It is my strong opinion that the floating lifts are very destructive when allowed in creeks such as this one that are much
to shallow and narrow for that type of lift to be used.

If DA's proposal is allowed, I will be forced to make my property whole through legal action, which given the cost of
dredging at this point, I am already discussing with my attorney.

To whom it may concern,
It has come to my attention that DA Ballou III, owner of 303 Georgia Ave, Morehead City, NC has
requested/applied for a Major CAMA Permit to install new stationary and floating dockage on the narrow
canal behind his home.
I know that I am not an adjacent property owner, but I do feel that as a property owner directly across the
canal from this property that the proposed dockage will impact my usage of the navigable waterway, the
value of my property, the existing ecosystem of this nursery area in Pelletier Creek, and will violate
CAMA rules already in place for new construction dockage. Allow me to elaborate.
DA Ballou purchased the property at 303 Georgia Ave in approximately October of 2020. Since that time
Mr. Ballou has been documented removing oyster and sediment (dredge spoils) from the creek without a
permit using heavy equipment such as excavators and a skid -steer. Mr. Ballou has also completely
removed vegetative growth (not just trimmed) from the shoreline along his property line and has been
documented as doing such. When approached by neighbors regarding this damage, Mr. Ballou's
response has been to both deflect and claim ignorance, or to become verbally aggressive with foul
language attacking those neighbors. Mr. Ballou once stated to me that he could do what he wanted since
he has family members sitting on the Town Council of Morehead City and that they would allow him to
do what he was doing. This was in response to destroying vegetation within a wetland area when I
approached him about it in early 2020. It is my understanding that Mr. Ballou has also removed
shellfish from our creek/canal without permits and piled those shells along his rip/rap waterfront area.
This appears to be a violation of Marine Fisheries rules. These instances cause concern for any project
proposed by Mr. Ballou since his history shows that he is not honest with his plans and that he tries to do
more than what the permits allow or do things that he has not sought proper permission to do.
Mr. Ballou did receive approval to install a floating boat lift to the property at 303 Georgia Ave. While
the floating boat lift was approved by riparian owners, the damaging effects of the lift could not be
foreseen at that time. Since the installation of the floating lift in 2021, my property has been and is being
directly affected by the constant powering on (power loading) of the boats onto this floating lift. I have
attached photos to this letter showing the dark holes (indicating deeper water) directly behind the floating
lift and the motors of the two boats on the floating lift. The photos also show the oyster shells that have
been kicked out of the creek bottom and deposited under my boat lift as well as the shallow
water/shoaling that is now forming under my boat lift from the constant deposits of sediment that are
kicked up on a weekly basis as the boats are used.
I am in strong opposition to the re -installation of the floating boat lift at Mr. Ballou's property. I am
already in the process of requesting quotes to dredge the area under and adjacent to my lift to be able to
restore the water depth that I had there prior to the damage from the floating lift and the motoring damage
caused by loading the boats on that lift. I will be asking Mr. Ballou to cover the cost of the damages, i.e.
dredging costs. A floating/drive-on boat lift is not an environmentally friendly match to the canal where
we live. The area of the canal (the end of the canal) is too shallow and too narrow to allow such a lift to
be positioned perpendicularly to the shoreline. Doing so has caused and will cause damage to the canal
bottom and to my side of the canal and the depth at my dockage.
I am requesting that the request to move or re -install the floating boat dock be denied.
In addition to the direct impact the proposed dockage has to my property from the floating lift, the other
impact will be the quantity of boats being docked and the space provided for dockage on this canal where
it is so narrow. It has been made clear to me and other neighbors that boats already being moored at Mr.
Ballou's are paying customers or that trades have been worked out, or other forms of compensation
provided in exchange for boat dockage. According to CAMA rule 15A NCAC 07H.1204 no private
residence can charge for boat dockage or receive compensation for dockage. This is more in line with
marinas and not with dockage at private residences. CAMA rule 15A NCAC 071-1.1204 also states that
piers and docking facilities shall not provide space for more than two boats. I have been told by CAMA
representatives that the existing dockage at 303 Georgia Ave allowing form more than two boats is a
"grandfathered" situation. Now that Mr. Ballou is seeking to completely remove the existing
grandfathered dockage, it is clear by the rules that any new dockage installed should not exceed docking
space for more than two boats. The narrow and shallow nature of the canal where Mr. Ballou's property
is located is not deep enough or wide enough to support multiple boats coming and going from the area
without a major impact to the canal bottom and an increase in water turbidity. Both of these things will
impact shellfish and existing vegetation at the end of the canal and along adjacent properties and on both
sides of the canal.
There may be places where 5 or 6 boat slips and floating/drive on boat slips would be ok to install and
that would have the room for such installations without significant impact. I am writing the letter to state
that Pelletier Creek and the area at the end of the shallow canal where we live is not that location. I want
to specifically show my opposition to the proposal from Mr. Ballou and to say that Pelletier Creek and the
area at the end of the shallow canal where we live is not the location to support such a major change and
so much dockage. I would like to be notified of any formal review open to the public or nearby
landowners as this is being reviewed, so that I may have the opportunity to state my concerns to those
tasked with deciding whether or not to allow this permit. I am also happy to provide additional
information, including photos and video of the movement of sediment from the existing dockage and
usage from Mr. Ballou and the damage it has caused to the canal up to this point. RECEIVED

for DA Ballou at 303 Georgia Ave. I live at 4710 San Juan circle.... which is the house immediately across the creek from
303 Georgia Ave. The current dockage approved last year is already affecting my property adversely and there are
some concerns with the major permit being requested on this section of Peletier creek. In addition to safety issues, the
destruction of habitat and shore line vegetation as well as oyster habitat that has already occurred, there are also
ongoing damages to my property from the floating drive on boat lifts. In my opinion these types of lift have no business
being installed or used on such a narrow waterway.
I have attached several photos, a letter of opposition I will present to the board of adjustments, as well as video showing
Mr Ballou damaging the waterway, shoveling, etc
I hope that you are able to review these and see that the issuance of the major permit requested would have an adverse
impact on this creek and on the neighboring properties to 303 Georgia Ave.

This is the letter that I plan to present in opposition to the special use permit this evening. It outlines my concerns and
showcases the damage to my property that the existing jet docks that were allowed have already created as well as the
future damage that will continue to occur. I also included the text message sent to a friend from Susan Frederich (the
tenant / girlfriend of DA Ballou that lives full time at 303 Georgia Ave) that shows DA has the intent to rent slips out.
The real reason that he wants so much docking and needs a Major CAMA permit to allow that is that he plans to rent
dockage out in a residential neighborhood. This past summer there were 2 boats on the floating jet docks and at least 2
or 3 other boats tied to the existing floating docks. These were folks renting slips or were slips promised through a deed
(life rights to a slip) that was granted in exchange for a reduced purchase price of the house. This is an issue that Mr.
Ballou intentds to provide a slip to Kevin Schafran that is is obligated to do so through the deeded life time right. So, if Mr.
Ballou wants to keep his 2 boats in slips he has to have 3 slips minimum to allow for the rights of Mr. Schafran. That
agreement should not encumber by property by allowing a nearby property to have so many dockage.
I apologize for all the emails. I just want to be sure you get information that can impact the decision making process of
allowing the major CAMA permit. This narrow section of Peletier creek is not the place to be installing so many docks
and slips. There simply is not room and the impacts to the environment and neighboring properties is to high.

Good evening. My name is Lee Smith. I live at 4710 San Juan Circle. My wife Callie and I
built our house there in 2010.
My property on Peletier creek is directly across from 303 Georgia Ave.
I am here this evening in opposition of the special use permit being requested.
Since DA Ballou first bought property on Peletier creek, he has done several things that are
concerning. Shoreline Vegetation has been mowed and removed from the water's edge, an
oyster bed was removed from the creek and two floating boat docks were added to the existing
4 docks already on the property ... all without any permits from The Town of Morehead City.
I approached Mr. Ballou while he was in the process of performing some of those actions to see
if he had permits from the proper agencies. To which he responded. "I can do what I want
because I have family on the town council and in politics".
I bring this up only to say that I am glad to see that finally, in this instance, the proper
procedures are being followed and permit requests have been made.......... Allowing myself and
other property owners on the creek to provide input to the process and how it could impact us.
I have three reasons to oppose this special use permit.
Firstly, the dockage will present a safety issue for my family and neighbors and anyone else
using that part of Peletier creek. The increased boat traffic will cause congestion and potential
for boating accidents. The creek between our docks in that area ranges from just under 22 feet
wide to just under 50 feet wide. Once slips and docks are taken into consideration the navigable
water in the center of the creek is even smaller .......... going from less than 10 feet wide at the
westward end to just barely 40 feet wide at the eastern end of this section.
That is not much room for boats moored perpendicular to the shoreline to safely enter and exit
boat slips.
In one instance, while leaving his dockage, Mr. Ballou lost control of his boat and was unable to
prevent a collision with my boat, my boat lift, and my bulkhead. (Play video FILE 8)
As you can see, the floating lifts involved with this dockage proposal are a major safety concern.
I was only made aware of the collision when I reviewed my security cameras a few days later.
Mr. Ballou never attempted to call or inform me of the collision until after I had contacted
Morehead City Police and NC Wildlife officers to report the accident. If my children or anyone
had been on my docks or on my boat or my bulkhead at the time of the collision, the outcome
could have been much more serious than just material damages.
Significant personal injury could have occurred. With the current dockage and the proposed
dockage I am worried that even more accidents are likely to happen.
Secondly, the dockage would damage my property. The floating boat docks that were installed
without a permit from the Town have already caused damage. Those same docks are proposed
to be included in the new dockage layout at 303 Georgia Ave.. The constant power loading and
unloading of the boats on the floating lifts that you saw in the video have caused sediment to be
pushed under my lift and dock.
I have contracted a dredging company to come and remove the sediment so I can use my lift
again .... at an estimated cost of $5500. The damage to my boat from being hit by Mr. Ballou
was $1725 to repair.
I have a few pictures that show where the creek bottom has been dug out behind those lifts....
and the sediment and shells deposited under my boat lift. (Show photos 5, 6, and 7)
The amount of dockage that already exists is above what is allowed by current code, which states
that docks and piers are subject to the requirements of. ... only one dock or pier on a residential
lot.
There are no other recently constructed docks on residential lots in Peletier creek that exceed
the single dock and two boat slip standards. My home value would decrease by being next to
the only residential manna on the entire creek.
Thirdly, the dockage will be a nuisance and a hazard because of the number of boats and people
who will be using the docks and the navigation challenges associated with that.
Although Mr. Ballou has told the permitting offices of both CAMA and the Town of Morehead
that he will not be renting or leasing boat slips out to people, ........I can show otherwise. When
Mr. Ballou bought the house at 303 Georgia Ave. from Kevin Schafran he granted a life estate
for the right and use of a boat slip to be used by Mr. Schafran and any of his guests. (Show
photo file 15)
The deeded life estate guarantees to Mr. Schafran that Mr. Ballou has to provide a dock for him
and his guest. Unless Mr. Ballou sacrifices a slip for one of his boats, he would need at least 3
slips since the use of one has beeri deeded to Mr. Schafran already.
I also have a copy of a Facebook message that was sent to another neighbor by Susan Fredrick,
who is the permanent resident at the property. (Show photos 12,13,14). This message shows
the intent to have more than just Mr. Ballou's and Mr. Schafran's boats tied to slips or on lifts.
In the text message Ms. Frederick, states that "DA and I" are offering boat slip rental for weekly,
monthly, and weekend periods.
Renting of slips in residential dockage is not allowed under any current laws or code.
The need for a Major CAMA permit allowing more than 2 slips, and the special use permit
allowing more than 1 dock.....shows that there is intent by Mr. Ballou to place more than just his
boats on the new dockage.
More boats in the most narrow and shallow section of Peletier creek will be a nuisance to my
family and other property owners and a hazard to any person using the waterway.
The 40' floating dock would cause an additional hazard because any boat moored to that dock
will stick out into the navigable area of the creek .... which I already mentioned is less than 25
feet wide. That would impede boat traffic in the creek and be a hazard to moving boats to both
my dock and other docks at the end of the creek.
It will be even more hazardous when 3 or 4 or 6 different boats are coming and going..... all to
the same dock at 303 Georgia Ave.
I think these three concerns, supported by documentation and video, should be enough for this
board to make a validated decision to NOT allow the special use permit in this instance.
I realize that each of you serve as volunteers ........ and for that I thank you for your time and your
dedication to this community.

objection the permit application would be a denial and the denial could not be appealed due to the local govt
objection. There seems to be a path forward, but the project would need to be placed on applicant hold while the
applicant pursues the special use permit. Otherwise we would move forward with the denial based on the Town's
comments.
In addition there are a number of objections to the proposal as you are aware. If you would like to place the project on

The Darious Ballou project is located at 303 Georgia Ave., Morehead City, Carteret County. The
site is found by following Highway 70 East into the Morehead City town limits. Continue along
Highway 70 through the 4-way lights at the intersection of Highway 24 and Bridges Street

Parkway for .25 miles and turn left onto Park Drive. Continue on Park Drive then turn right onto
Georgia Ave. and follow until the pavement ends. The property will be located on the left.
The residential property is .71 acres (31,000 sf) in its entirety and an average of 3' above nhw. Peletier
Creek runs along the south side of the property. The upland vegetation mainly consists of lawn grasses.
The total shoreline length for the tract is 244'. The waters of Peletier Creek have approximately 2.5'
lunar tidal amplitude. There is a 10' x 25' fringe of coastal wetlands consisting mostly of Smooth
Cordgrass (Sp. Altemiflora) along the west side of the property.
The Division of Water Resources classifies this area as SB Waters. This area of Peletier Creek is not
designated as a PrimaryNursery Area and is closed to the taking of shellfish. The MoreheadCity Land
Use Plan classifies this area as Medium Density Residential with Conservation within the AECs. There
is an existing house, driveway and shed on the high ground and three existing finger piers with 6
existing slips and a two -boat floating jet -dock within the canal. The shoreline is stabilized with existing
riprap. Water depths within the proposed dock reconfiguration are-2nlw/mlw to 4' nlw/mlw depending
on location. The bottom substrate is muddy with sand and no SAV were observed however there are
small patches of "coon" oysters along the existing riprap. This canal branch within Peletier Creek is
approximately 86' to 98' wide depending on location within the proposed reconfiguration area.
10) Proposed Development:
The applicant has an existing 6-slip docking facility with an existing two -boat jet dock. The current
proposal is for the reconfiguration of the existing docks and floating platform. The applicant is
proposing a maximum of 6 slips which includes the two -boat jet dock. There would be 4 slips
within the canal and two on the jet dock. The re -configuration would include two finger piers, one
boatlift, one fixed platform, one floating jet -dock with gangway, and one floating platform with
gangway.
The applicant is proposing to reconfigure the existing docking facility by removing the three
existing floating finger piers along this parcel. They are also proposing to install one fixed 4' x
26' 8" finger pier (dock A) along the west side which would delineate slip # 6 and one 4' x 29.5'
finger pier (dock C) along the east side of the property which_ would delineate slip #1. There is also
a 16' x16' boatlift proposed within slip # 1. There would be a 4' x 14'4" pier approximately 145'
from the western riparian line that would intersect with -a fixed 16' x16' platform. A gangway
would extend west and connect with a floating 20' x 19.5' jet dock (immediately east of dock A)
and would accommodate slips 4 and 5. A second gangway would extend east from the fixed
platform and would intersect the second proposed 6' 8" x 40' floating platform which would
delineate side -too slips 2 and 3.
The most waterward portion of the proposed development would not exceed a max of 21' from
NHW along the west side of the property and would not exceed a max of 25' from NHW along the
east side of the property. All work would be approximately 100' from the western riparian line and
a minimum of 15' from the eastern riparian line. Riparian corridors were determined by channel
orientation and existing pier alignment. There would be a total of six slips (1 slip with a boatlift, 2
side -too wet slips, 2 floating jet -dock slips and 1 shore perpendicular wet slip). The applicant states
boat size would be 15' to 25' and of private center console design. The water depths within the slip
areas are -2' nlw to -4' nlw depending on location.

11. Anticipated Impacts:
The proposed platform additions, finger piers, pier and boatlift would shade 877 ft2 and incorporate
1133 ft' of shallow bottom habitat. The development would maintain a max of 6 slips (4 inwater
slips and two jetdock slips). The increase in suspended sediment and turbidity levels from the piling
placement would be temporary, occur while the piling placement is taking place and should be
minimal given the bottom composition. The proposed additions should not be a hindrance to
navigation due to the fact all portions would not exceed a max of 21' to 25' from NHW within the
canal. The proposed development would also meet the minimum 15' setback from the riparian
access lines.
Total Shading impacts would be as follows:
Proposed 4' x 26.7' finger pier from NHW= 107sf
Proposed 4' x 29.5' fixed platform= 118sf
Proposed 6.7' x 40', floating platform= 268sf

The shoreline is 244 linear feet. Rules allow 8sf per linear foot of shoreline for shading
impacts which on this case would be 1,952sf. Therefore, the existing and proposed shaded
impacts would not exceed the maximum of 1,952sf allowed.

INTRODUCTION
The property of 303 Georgia Avenue (PIN # 636615536553000) is a single family residence
located south of Park Avenue between the east side of Georgia Avenue and the shoreline of
Peltier Creek. The shoreline of the property runs southwest to northeast for approximately 244
feet. Structures include one building over crawl space with a deck connected by public right of
way by concrete drive more than 50 feet from the normal high water line. The property is owned
by the applicant, D.A. Ballou.
The project shall consist of the removal of three (3) floating piers accessed by gangways, and
the relocation of two (2) plastic float slips. Three (3) piers, one (1) platform, one (1) floating
dock accessed by a gangway, and one (1) boat lift shall be installed. A site plan of the proposed
improvements is shown on Sheet C3.
A scoping meeting for this project was held on May 25, 2021
PROJECT DESCRIPTION
Three (3) floating piers accessed by gangways shall be removed from the property. There shall
be three (3) fixed piers 4' wide. Pier A shall be approximately 22' long from the normal high
water line, 26'8" in total length, projecting from the shore. Pier B shall be approximately 9' long
from the normal high water line, 14'4" in total length. There shall be a 16' x 16' fixed platform
accessed by pier B. Both of the existing plastic floating slips will be relocated to the platform's
west side and shall be accessed from the platform by a 4' wide gangway. There shall be a 40'0"
long and 6' 8" wide floating dock parallel to the shore, east of the platform, connected to the
east side of the platform by a 4' wide gangway. Pier C is a finger pier that shall be
approximately 24' long from the normal high water line, 29'6" in total length, projecting from the

shore. The boatlift shall be 16' wide by 16' long, accessed by and located west of pier C. No
proposed structure shall extend more than a quarter of the channel width, as measured from the
normal high water line on either side of the channel. No proposed structure shall be located
within 15' of the riparian lines.
The property has 244 linear feet of shoreline. The maximum allowable shaded square footage
is 1,952. Pier A, Pier B, the plastic docks, the fixed platform, and floating dock have a total
square footage of 1,074 square feet. The gangways and Pier C are not included in these
calculations. Please see the included platform dimension tables for a breakdown of these
areas.
EXISTING CONDITIONS
Site Topography and Hydrography - The topography of the upland development site is
relatively flat. The base flood elevation at the site is 7 feet (NAVD 88 datum).

Stormwater — No discharges are proposed as apart of this project. Existing drainage patterns
will remain. Existing drainage is primarily sheet flow from onsite and offsite areas over lawn.
METHODS OF CONSTRUCTION
Construction of the piers will be by conventional marine construction equipment including
barges and cranes. The equipment will be onsite only a sufficient time to complete the pile
driving and pier installation. Timber pier piles will be driven into the substrate to minimize
turbidity.

PROJECT SCHEDULE
Construction of shoreline improvement project is expected to start soon after permit issuance
and within the permitted time frame.
COMPLIANCE WITH THE N. C. ENVIRONMENTAL POLICY ACT
The Regulatory Reform Act of 2011 (SB 781) was passed by North Carolina Legislature in July
2011. This bill eliminates the requirement for an environmental assessment (EA) for any project
requiring a Major CAMA permit. Therefore, the proposed project is not subject to N. C.
Environmental Policy Act review.
CAMA COMPLIANCE
The project proponent hereby certifies that all information contained herein is true, accurate,
and complete to the best of my knowledge and belief. The project proponent hereby requests
that the certifying authority review and take action on this CWA 401 certification request within
the applicable reasonable period. Included in this submittal is a copy of the email from Holley
Snider, environmental specialist for the Division of Water Resources, acknowledging that the

We have revised the submittal package for the Major CAMA permit submittal for 303 Georgia Avenue in
Morehead City, Carteret County. The following revisions have been made:
1. The quarter width line is now shown on Sheets C2, C3, & C6.
2. Normal high water is shown on each Sheet.
3. Email from Holley Snider, Environmental Specialist II for the Division of Water Resources
stating that the scoping meeting held May 25, 2021 complies with the DWR pre -filing meeting
requirements.
4. The two mandatory statements are now included in the narrative.
5. The shading impacts are shown on Sheet C3. This area does not include Pier C which is being
considered the access pier for the boat slip.
6. The date of the scoping meeting is now included in the Narrative.
7. There will be a total of six slips after the reconstruction of the docks. There are currently 8 slips
on the site. This has been clarified on Page 1 of MP4.

PROJECT NARRATIVE
August 23, 2021
INTRODUCTION
The property of 303 Georgia Avenue (PIN # 636615536553000) is a single family residence
located south of Park Avenue between the east side of Georgia Avenue and the shoreline of
Peltier Creek. The shoreline of the property runs southwest to northeast for approximately 244
feet. Structures include one building over crawl space with a deck connected by public right of
way by concrete drive more than 50 feet from the normal high water line. The property is owned
by the applicant, D.A. Ballou.
The project shall consist of the removal of three (3) floating piers accessed by gangways, and
the relocation of two (2) plastic float slips. Three (3) piers, one (1) platform, one (1) floating
dock accessed by a gangway, and one (1) boat lift shall be installed. A site plan of the proposed
improvements is shown on Sheet C3.
PROJECT DESCRIPTION
Three (3) floating piers accessed by gangways shall be removed from the property. There shall
be three (3) fixed piers 4' wide. Pier A shall be approximately 22' long from the normal high
water line, 26'8" in total length, projecting from the shore. Pier B shall be approximately 9' long
from the normal high water line, 14'4" in total length. There shall be a 16' x 16' fixed platform
accessed by pier B. Both of the existing plastic floating slips will be relocated to the platform's
west side and shall be accessed from the platform by a 4' wide gangway. There shall be a 40'0"
long and 6' 8" wide floating dock parallel to the shore, east of the platform, connected to the
east side of the platform by a 4' wide gangway. Pier C is a finger pier that shall be
approximately 24' long from the normal high water line, 29'6" in total length, projecting from the

shore. The boatlift shall be 16' wide by 16' long, accessed by and located west of pier C. No
proposed structure shall extend more than a quarter of the channel width, as measured from the
normal high water line on either side of the channel. No proposed structure shall be located
within 15' of the riparian lines.
EXISTING CONDITIONS
Site Topography and Hydrography - The topography of the upland development site is
relatively flat. The base flood elevation at the site is 7 feet (NAVD 88 datum).
Land Use — The use of the site is as a private single family residence.
Wetlands - There are no known areas of wetlands on the site.
Areas of Archeological or Historic Value — There are no known areas of archeological or
historic value on the site.
Navigation — The three (3) proposed piers, floating dock, and boat lift will be located outside of
the setback from the channel.
Stormwater — No discharges are proposed as apart of this project. Existing drainage patterns
will remain. Existing drainage is primarily sheet flow from onsite and offsite areas over lawn.
METHODS OF CONSTRUCTION
Construction of the piers will be by conventional marine construction equipment including
barges and cranes. The equipment will be onsite only a sufficient time to complete the pile
driving and pier installation. Timber pier piles will be driven into the substrate to minimize
turbidity.
PROJECT SCHEDULE
Construction of shoreline improvement project is expected to start soon after permit issuance
and within the permitted time frame.

COMPLIANCE WITH THE N. C. ENVIRONMENTAL POLICY ACT
The Regulatory Reform Act of 2011 (SB 781) was passed by North Carolina Legislature in July
2011. This bill eliminates the requirement for an environmental assessment (EA) for any project
requiring a Major CAMA permit. Therefore, the proposed project is not subject to N. C.
Environmental Policy Act review.
