Staff has determined that raising the existing structures is allowable and parking can be placed below the structures as long as the parking is consistent with 15ANCAC 07H.0309(2) "driveways and parking areas with clay, packed sand or gravel'. At this time, due to the significant revisions proposed, objections received and the need to update all documentation, DCM has determined that if the project would move forward with these revisions, that the existing project be withdrawn and the revised project be submitted as a new application. This will create a clear and distinct separation between the existing and revised projects for all involved and reduce potential for misunderstandings. Dawson Mr. Vernon Dawson of Cape Hatteras Court, Inc., has proposed an expansion of the motel facility that is located at 46556 NC Hwy 12 S., which is adjacent to Cape Creek and west of Hwy 12 and the Atlantic Ocean in Buxton, Dare County. The project includes the addition of a 2-story, 8-unit hotel, a 2-story commercial building, additional parking and driveways, new onsite septic treatment system, and 2 stormwater basins. The development proposed will involve the Coastal Shoreline (CS) and Ocean Erodible (OE) AECs. I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project, and my findings are as follows: 15A NCAC 07H .0209 COASTAL SHORELINES (ES and PTS) (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in this Rule. These uses shall be limited to those types of development activities that will not be detrimental to the public trust rights and the biological and physical functions of the estuarine and ocean system. Every effort shall be made by the permit applicant to avoid or minimize adverse impacts of development to estuarine and coastal systems through the planning and design of the development project. Development shall comply with the following standards: 1) All development projects, proposals, and designs shall preserve natural barriers to erosion, including peat marshland, resistant clay shorelines, and cypress -gum protective fringe areas adjacent to vulnerable shorelines. Dawson 01 /31 /22 Page 2 2) All development projects, proposals, and designs shall limit the construction of impervious surfaces and areas not allowing natural drainage to only so much as is necessary to service the primary purpose or use for which the lot is to be developed. Impervious surfaces shall not exceed 30 percent of the AEC area of the lot, unless the applicant can demonstrate, through innovative design, that the protection provided by the design would be equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas exceeding the 30 percent impervious surface limitation shall be permitted if impervious areas are not increased and the applicant designs the project to comply with the rule to the maximum extent feasible. 3) All development projects, proposals, and designs shall comply with the following mandatory standards of the North Carolina Sedimentation Pollution Control Act of 1973. 4) Development shall not have a significant adverse impact on estuarine and ocean resources. 5) Development shall not interfere with existing public rights of access to, or use of, navigable waters or public resources. 6) No public facility shall be permitted if such a facility is likely to require public expenditures for maintenance and continued use, unless it can be shown that the public purpose served by the facility outweighs the required public expenditures for construction, maintenance, and continued use. 7) Development shall not cause irreversible damage to valuable, historic architectural or archaeological resources as documented by the local historic commission or the North Carolina Department of Natural and Cultural Resources. 8) Established common-law and statutory public rights of access to the public trust lands and waters in estuarine areas shall not be eliminated or restricted. Development shall not encroach upon public accessways nor shall it limit the use of the accessways. 10) Within the Coastal Shorelines category (estuarine and public trust shoreline AECs), new development shall be located a distance of 30 feet landward of the normal water level or normal high water level, with certain exceptions noted. Consistent: The proposal for development related to the 2-story commercial building will result in 5.6% impervious coverage in the CS AEC. No work is proposed in the 30' buffer. 15A NCAC 07H .0306 GENERAL USE STANDARDS FOR OCEAN HAZARD AREAS (a) In order to protect life and property, all development not otherwise specifically exempted or allowed by law or elsewhere in the Coastal Resources Commission's rules shall be located according to whichever of the following is applicable: (1) The ocean hazard setback for development shall be measured in a landward direction from the vegetation line, the static vegetation line, or the measurement line, whichever is applicable. (2) In areas with a development line, the ocean hazard setback shall be set in accordance with Subparagraphs (a)(3) through (9) of this Rule. Dawson 01 /31 /22 Page 3 (3) In no case shall a development line be created or established on state owned lands or oceanward of the mean high water line or perpetual property easement line, whichever is more restrictive. (4) The ocean hazard setback shall be determined by both the size of development and the shoreline long term erosion rate as defined in Rule .0304 of this Section. "Development size" is defined by total floor area for structures and buildings or total area of footprint for development other than structures and buildings. Total floor area includes the following: (A) The total square footage of heated or air-conditioned living space; (B) The total square footage of parking elevated above ground level; and (C) The total square footage of non -heated or non -air-conditioned areas elevated above ground level, excluding attic space that is not designed to be load - bearing. Decks, roof -covered porches, and walkways shall not be included in the total floor area unless they are enclosed with material other than screen mesh or are being converted into an enclosed space with material other than screen mesh. (5) With the exception of those types of development defined in 15A NCAC 07H .0309, no development, including any portion of a building or structure, shall extend oceanward of the ocean hazard setback. This includes roof overhangs and elevated structural components that are cantilevered, knee braced, or otherwise extended beyond the support of pilings or footings. The ocean hazard setback shall be established based on the following criteria: (A) A building or other structure less than 5,000 square feet requires a minimum setback of 60 feet or 30 times the shoreline erosion rate, whichever is greater. Consistent: The proposal for development related to the new commercial building, hotel, associated decking, parking, drive, concrete walkway to replace the wooden walkway to the existing swimming pool, new septic tanks and drainfeld, are positioned west of the 240' minimum building setback, as well as one of the proposed dry infiltration basins, 5 of the drop inlets, and approximately half of the storm pipes that would be installed for the stormwater system related to the new buildings. (b) No development shall be permitted that involves the removal or relocation of primary or frontal dune sand or vegetation thereon that would adversely affect the integrity of the dune. Other dunes within the ocean hazard area shall not be disturbed unless the development of the property is otherwise impracticable. Any disturbance of these other dunes shall be allowed only to the extent permitted by 15A NCAC 07H .0308(b). Dawson 01/31/22 Page 4 15A NCAC 07H .0308 SPECIFIC USE STANDARDS FOR OCEAN HAZARD AREAS (d) Building Construction Standards. New building construction and any construction identified in .0306(a)(5) of this Section and 15A NCAC 07J .0210 shall comply with the following standards: (1) In order to avoid danger to life and property, all development shall be designed and placed so as to minimize damage due to fluctuations in ground elevation and wave action in a 100-year storm. Any building constructed within the ocean hazard area shall comply with relevant sections of the North Carolina Building Code including the Coastal and Flood Plain Construction Standards and the local flood damage prevention ordinance as required by the National Flood Insurance Program. If any provision of the building code or a flood damage prevention ordinance is inconsistent with any of the following AEC standards, the more restrictive provision shall control. (2) All building in the ocean hazard area shall be on pilings not less than eight inches in diameter if round or eight inches to a side if square. (3) All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under the structure. For those structures so located on or seaward of the primary dune, the pilings shall extend to five feet below mean sea level. (4) All foundations shall be designed to be stable during applicable fluctuations in ground elevation and wave forces during a 100-year storm. Cantilevered decks and walkways shall meet the requirements of this Part or shall be designed to break -away without structural damage to the main structure. Consistent: The proposal for development meets the intent of this rule. 15A NCAC 07H .0309 USE STANDARDS FOR OCEAN HAZARD AREAS: EXCEPTIONS (a) The following types of development shall be permitted seaward of the oceanfront setback requirements of Rule .0306(a) of this Section if all other provisions of this Subchapter and other state and local regulations are met: (1) campsites; (2) driveways and parking areas with clay, packed sand, or gravel; (3) elevated decks not exceeding a footprint of 500 square feet; (4) beach accessways consistent with Rule .0308(c) of this Section; (5) unenclosed, uninhabitable gazebos with a footprint of 200 square feet or less; (6) uninhabitable, single -story storage sheds with a foundation or floor consisting of wood, clay, packed sand or gravel, and a footprint of 200 square feet or less; (7) temporary amusement stands consistent with Section .1900 of this Subchapter; (8) sand fences; and (9) swimming pools. Dawson 01 /31/22 Page 5 In all cases, this development shall be permitted only if it is landward of the vegetation line or static vegetation line, whichever is applicable; involves no alteration or removal of primary or frontal dunes which would compromise the integrity of the dune as a " protective landform or the dune vegetation; has overwalks to protect any existing dunes; is not essential to the continued existence or use of an associated principal development; is not required to satisfy minimum requirements of local zoning, subdivision or health regulations; and meets all other non -setback requirements of this Subchapter. Potentially Inconsistent: • One of the dry infiltration basins, as well as 2 of the drop inlets and 2 sections of the storm pipes for the stormwater system are proposed seaward of the minimum building setback. Existing Conditions note that there is 7,880 tsf concrete currently used for parking and access to the present buildings. Approximately, 6,760 sf of the existing concrete parking is located seaward of the Ocean Hazard small structure setback. The applicant is proposing a total of 43 parking spaces that will be in the Ocean Erodible AEC. New proposed concrete pavement for parking located seaward of the Ocean Hazard setback totals 20,700t sf, with an additional 3,240t sf concrete for the access driveway. It is noted that an additional 3,685t sf of asphalt exists seaward of the setback (buried under sand), and is proposed to be removed for the placement of one of the stormwater basins. o The increase of 13,495tsf of concrete does not meet the Exception. Based on my review of the applicable subsections of the NC Administrative Code, the permit application, and plans submitted by Quible & Associates for OIFC for Cape Hatteras Court, Inc., I recommend a Major Permit be issued to the applicant for those items that are consistent with the Coastal Resources Commission rules, and subject to the standard permit conditions. DATE: January 20, 2022 Consistency Determination: The request is consistent with/not in conflict with the Dare County 2009 Land Use Plan certified by the CRC on February 24, 2011. Overview: The 2.64 acre subject property has approximately 294 linear feet of shoreline along Cape Creek to the west, which connects to the Pamlico Sound, and is also located within 720 feet of the First Line of Stable Natural Vegetation (FLSNV) along the Atlantic Ocean beach to the east. Site elevation is approximately 4 feet above Normal Water Level (NWL). The lot is covered in sand and vegetated with some Coastal Wetland plants along the shoreline. The property is located in the AE(6) Floodzone to the west and the VE(10) to the east. The site is developed as a motel facility. Existing site improvements consist of three (3) 2-story motel buildings with office space, three (3) septic tanks, a swimming pool with wooden walkway, and a concrete and gravel parking area. The site is served by the Dare County water system. Existing shoreline improvements consist of a bulkhead. It is noted that an area of gravel located northwest of the swimming pool was placed in September 2021 without a permit. A stop work order and notice of regulatory requirements letter was issued to the property owner with the requirement that an updated major permit application be submitted showing the additional gravel parking. Cape Creek in this area is classified as SA-HQW and Coastal Waters and is closed to shellfishing. A review of historic and archaeological resources was not provided. Anticipated Impacts resulting from this project are expected to include: the impervious coverage of 1,218 sq. ft. of Estuarine Shoreline Area of Environmental Concern (AEC) and 1.47 acres of Ocean Erodible AEC, and; the disturbance of .49 acre of Ocean Erodible AEC. No wetland impacts are proposed Basis for Determination: The Dare County Land Classification Map identifies the subject property as "Transition Corridor". As indicated on Page 217, the "Conservation" designation applies to all CAMA Areas of Environmental Concern (AECs). As indicate don Page 207 for the "Transition Corridor" designation, "(t)he purpose of the transition corridor category is to provide for more intensive development on lands that are suitable and will be provided with the necessary infrastructure and services to support urban=style development." Gregg, I would like to put the CAMA Permit processing on hold until we further consider and respond to the items that we discussed today. With respect to the designation of a parking lot versus a driveway, I firmly believe that primary drive aisles are in fact driveways. It is agreed that there are proposed parking spaces (parking lot areas) and that total area is less than 5,000 sf. I don't see any designation in the rules that differentiates between residential and commercial driveways. These driveways are necessary and required by County code and State fire/public safety code, to access each building. Field Investigation Report: Cape Hatteras Court, Inc. Page 2 Proiect Settin The Cape Hatteras Court motels for this proposal are located at 46556 NC Hwy 12 S. Buxton, adjacent to Cape Creek and west of NC 12 and the Atlantic Ocean, in Dare County. Current structures on this property site consist of 3 separate, 2-story, motel buildings with office space, 3 septic tanks, a commercial swimming pool with wooden walkway, concrete and gravel parking, and a bulkhead along the western -most shoreline adjacent the Creek. The gravel parking located northwest of the existing swimming pool is noted to have been placed without a permit in September 2021. A stop work order and notice of regulatory requirements letter was issued to the property owner, with the requirement that an updated major permit application be submitted showing the additional gravel parking. The 2.64-acre lot is covered in sand, sea oats, and indigenous grasses. Vegetation waterward of the bulkhead to the north consists of Black Needlerush (Juncus roemerianus), Salt Grass (Distichlis spicata), and Olney's Three -square (Scirpus americanus). Vegetation waterward of the south end of the bulkhead and in canal/creek consists of Black Needlerush, Salt Meadow Cordgrass (Spartina patens), and Smooth Cordgrass (Spartina alterniflora). Patens and Atlantic Cedar were observed 20'± landward of the bulkhead. The total shoreline length on the estuarine side is 294 linear feet (If), and has an elevation of 4' above normal water level (NWL). The property sits within not only the Coastal Shoreline AEC, but also the Ocean Erodible AEC, which measures 720' from the Static and First Line of Stable Vegetation lines, which are approximately in the same location seaward of NC Hwy 12. The setback factor for this property is 8, with a minimum setback measurement of 240' from the static vegetation line, which was established prior to the 2017 beach nourishment project, and the flood zone rating is VE 10. The riparian property to the north is the National Park Service (Cape Hatteras National Seashore), and the riparian property to the south is commercial property (used for retail purposes). The riparian property to the west is County owned, and used for recreational purposes. Cape Creek is a tributary that connects to the Pamlico sound. These waters are located within the Pasquotank River Basin, and are classified as SA and High Quality Waters (HQW). The area is not located in a PNA, but is closed to shellfishing. A Scoping meeting was held on April 21, 2021, with representatives from Quible & Associates, Coastal Management, NCWRC, DWR-401, and Stormwater in attendance. It was confirmed that a State stormwater permit and a State soil erosion & sedimentation control permit would be required; however, a 401-water certification pre -filing would not be required. Previous permit history for the property consisted of Major Permit #22-79, issued to Vernon Dawson on 01/22/1979 for excavation of a basin area in the Creek, waterward of the existing bulkhead. Page 3 Development Proposal The applicant is proposing to expand the existing motel facility on the soundside. This expansion will include a 2-story, 8-unit hotel with 4,800 sf of total floor area, and a 2-story commercial building with 4,573 sf of total floor area. No work is proposed in the 30' CAMA buffer of the Coastal Shoreline AEC. The existing wooden walkway leading to the swimming pool will be replaced with a concrete walkway. Additional parking (including handicap access), driveways, a loading zone, new onsite septic treatment system, and 2 stormwater basins are proposed. These basins will be dry infiltration basins, created with clean sand. Seven drop inlets connected to stormwater pipes will drain rainwater to the basins. Existing Conditions Sheet 1 of 2 confirms that there is concrete (7,880±sf), which is currently used for parking and access to the current buildings. Approximately, 6,760 sf of the existing concrete parking is located seaward of the Ocean Hazard small structure setback. Sheet 2 of 2 confirms that the applicant is proposing a total of 43 parking spaces that will be in the Ocean Erodible AEC. New proposed concrete pavement for parking located seaward of the Ocean Hazard setback totals 20,700± sf, with an additional 3,240± sf concrete for the access driveway. It is noted that an additional 3,685± sf of asphalt exists seaward of the setback (buried under sand), and is proposed to be removed for the placement of one of the stormwater basins. Anticipated Impacts A total of 1.99 acres (86,684 so is proposed to be disturbed. The total percentage of the entire tract to be covered by impervious and/or built -upon surfaces is 55.7%. High Ground Habitat 1,218 sf will be covered by impervious and/or built -upon surfaces, resulting in 5.6% impervious coverage in the 75' Estuarine Shoreline AEC. This is the northernmost privately owned property on the west wide of NC as you enter Buxton. The owner is Cape Hatteras Court, Inc. (attn: Vernon David Dawson) as indicated in the Application and Plan. The property is located in the Pasquotank River Basin and adjoins estuarine waters on the west side (Cape Creek, a tributary of Pamlico Sound). There is a 30 ft CAMA vegetated buffer from the edge of the NWL shoreline and a 75 ft CAMA AEC. Due to the proximity to the oceanfront, there is also an Ocean Hazard AEC that is projected from the published static vegetation line which projects onto the subject property (current setback factor is 8). The static vegetation line was established prior to beach nourishment in 2017. There are currently three separate motel structures on the property which are served by Dare County Water and have on -site septic treatment systems. There is also a commercial swimming pool and existing drives and parking. Some of the existing gravel parking was installed by the owner in September 2021 without a permit and is shown on the existing conditions sheet. This gravel area has been documented by NCDCM. Along the creek on the west side is a shoreline stabilization bulkhead. In the 1990's there was a manmade basin on the property that was connected to the creek. This was permitted to be filled sometime in the 1990's and the creek shoreline was subsequently bulkheaded. There are no substantial jurisdictional wetlands on the property but there are small areas adjacent to the north and south ends of the bulkhead that support wetland vegetation. No wetland impacts are proposed. Since the filling of the basin in the 1990's (and earlier), there have been several tropical storms that have blanketed the site with sand, most notably Hurricane Isabel in 2003 that took out a dune system on NPS property and deposited a great deal of sand on the subject property. On April 21, 2021, there was an interagency scoping meeting to discuss the proposed project that includes motel facility expansion, including 2 new buildings and additional parking, drives, a new on -site septic treatment system to accommodate the new structures, loading zones, stormwater collection and treatment system. It was determined that since there would be the need for a State Stormwater Permit and State Soil Erosion and Sedimentation Control Permit, that a CAMA Major (as opposed to a CAMA Minor) Permit is required. The total land disturbance for the project is prosed to be approximately 1.99 acres. There is no work proposed within the 30 ft buffer and there is 1,218 sq.ft. However, the work has already been completed, and processing a minor application would require notifications. etc.. which could take more time. The avenue that must be taken is for you to issue an NOV letter to the owner for work that is complete that would have been permitable (as long as it also meets Dare County zoning as well). A copy of that template is attached for your review/use, and the NOV # that -you will need to assign is NOV 21-21A. You'll need to note that the unauthorized development was the installation of a gravel driveway and parking, confirming the dimensions and square feet. They also put some type of border around it, looking at the photo... but it hasn't been confirmed if that was landscaping timbers or an actual retaining wall. He also owes Carol L Dillon for FEMA flood insurance money for the house on old lighthouse road and daydreams and Hatteras outdoors property that he illegally signed my name to and took the money, never doing the repairs to the property. My attorney is also trying to hold Vernon Dawson accountable for the $449,000 house loan that he got in 2005 on my house without his name on the property and without my knowledge, 46218 old lighthouse road, Buxton, N.C. He also lied under oath about the worth of Cape Hatteras motel in the divorce claiming it had a negative worth, then put it for sale for over 6 million dollars less than six months later. I do have an attorney that will contact Vernon Dawson and you about this matter. If these monies are paid back, I have no objection to this project.
