Sedimentation and Erosion Control 3) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 4) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 5) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the written approval of the Division of Coastal Management. 6) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Project CAMA Narrative October 2015 IG Holdings, LLC - Warehouse Addition 605 W. Lake Drive Kill Devil Hills, NC 27948 The owners of this property constructed an 11,800 sf warehouse on the site in 2005-06. The site has been used site that time to house retail merchandise in support of their retail stores and facilities. The owners are now purchasing additional land to the east of the existing site in order to construct another 6,600 sf warehouse building. The site is located within the Fresh Pond AEC and is regulated by the Town of Kill Devil Hills zoning code. The existing site and proposed site will not have domestic water supply or any sewage conveyance to subsurface septic systems. The current and proposed stormwater management techniques collect all stormwater runoff via curbs, gutters, underground piping and sheet flow and convey it to shallow infiltration basins. The site consists of sandy soils with groundwater levels approximately four feet below the existing ground surface. The site improvements will increase the size and add an additional infiltration basin to the site. Some porous concrete is proposed for stormwater infiltration with the new parking areas. The original development was issued a CAMA Minor permit at the time of the initial development. At that time State Erosion Control and Stormwater permits were not required. With this proposed addition, there will be more than 10,000 sf of additional coverage and a State Stormwater permits is concurrently being sought. The owners intend to construct and utilize this new warehoused facility in accordance with the Federal, State, and Local laws and regulations. Narrative Description: This permit is being processed as an EXPRESS PERMIT. John Delucia with Albemarle & Associates, Ltd., on behalf of Israel Golasa for IG Holdings, LLC, has requested the attached application be processed under the EXPRESS PERMIT PROGRAM, for the construction of a commercial storage facility. The subject project is proposed at 605 W. Lake Drive in Kill Devil Hills, in Dare County. The parcel is approximately 1.09 acres and is approximately 14' above NWL and is vegetated with pines and other native undergrowth. Existing and adjacent land uses include other commercial buildings. The property is zoned Light Industrial I and is located in the Small Surface Water Supply Watersheds Area of Environmental Concern. 10. Project Description: The applicant is proposing to construct a 6,600 square foot warehouse on the property, as well as 6 additional parking spaces. The parking spaces will be constructed of approximately 1,620 square feet of pourous concrete with an additional 3,333 square feet of standard impervious concrete proposed. The commercial facility will not have any water or sewer service. The applicant is also proposing to construct an additional infiltration basin to collect stormwater, as well as to regrade the existing infiltration basin. The total disturbed area is 20,000 square feet. As proposed, the site will have a total impervious coverage of 67.5% 11. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessaryto assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of bypass structure, infiltration media, flow spreader, catch basins; piping and vegetated filter. g. A clear access path to the bypass structure must be available at all times. 4. Records of maintenance activities must be kept for each permitted BMP. The reports will indicate the date, activity, name of person performing the work and what actions were taken. 5. The facilities shall be constructed as shown on the approved plans. This permit shall . become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 5. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. Page 3 of 7 Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted.facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has .been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 8. Access to the stormwater facilities shall be maintained via appropriate easements at all times. 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision,acquisition, lease orsale of all or part of the project area. The project area is defined as all property owned by the permittee, forwhich Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times. . 12. The Director may notifythe permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall Provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS This permit is not transferable to any person or entity except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a completed Name/Ownership Change form to the Division of Energy, Mineral, and Land Resources, signed by both parties, and accompanied by the appropriate documentation as listed on page 2 of the form. The approval of this request will be considered on its merits and may or may not be approved. 2. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 3. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Energy, Mineral, and Land Resources, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 5. In the event that the facilities fail to perform satisfactorily, including the.creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The perm ittee grants DEQ Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit issued shall continue in force and effect until revoked orterminated. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater controls must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. Approved plans and specifications forthis project are incorporated by reference and are enforceable parts of the permit. . 10. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, orterminating the permit as allowed by the laws, rules and regulations contained in Title 15A NCAC 2H.1000, and NCGS 143-215.1 et. al. 11. The remaining .38 acre to the east is undeveloped and vegetated with pines and native undergrowth. Construction of a 6,600 sq. ft. warehouse building and installation of a six (6)-space parking area and a stormwater infiltration basin are proposed for the undeveloped area. The building height will not exceed 36 feet. The parking area will be constructed of 1,620 sq. ft. of porous concrete and 3,333 sq. ft. of impervious concrete. In addition to a new stormwater infiltration basin, the existing basin will be regraded. No water or sewer service will be provided.
