This permit, issued on October 19, 2015 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Docking Facility 1) This permit authorizes only the platform and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature ofPermittee John & Brenda Hoepfner ADDITIONAL CONDITIONS Permit No. 114-15 Page 2 of 2 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of two new slips for a total of four slips. 6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 9) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 10) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Tier II Programmatic General Permit 198000291 (SAW 201501936). NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. 2015- 0853. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of $250 was received by DCM for this project. We wish to build a docking area for two PWC for use along our property on Yeopim Creek. Our shoreline length is 188 feet and the docking area is at a distance greater than 15 feet of the riparian water demarcation lines. This is for personal use by ourselves and our family members. PROJECT SUMMARY: The property owners propose the construction a pier and a dual personal water craft lift on Yeopim Creek, in Perquimans County. Brenda and John Hoepfner Field Investigation Report Page 2 Project Setting The project site is located at 148 New River Drive in Albemarle Plantation Subdivision, a residential golf community in Perquimans County. The property is situated along 185' of Yeopim Creek, a tributary of the Yeopim River and the Albemarle Sound. Existing development along Yeopim Creek is residential and agricultural, with one private subdivision marina within a mile of the property. Zoning of property within the subdivision is RA-25 (residential/Agricultural with a minimum lot requirement of 25,000sf. Immediately north and south of the applicant's property are dwellings, each with recreational docking facilities for multiple vessels. Existing on the applicant's property is a dwelling, a bulkhead, a 6' x 82' pier with a 12', x 18' platform and a 4' x 16' stepdown, two tie pilings for a formal mooring facility, and a personal water craft lift (a second formal mooring facility) being used to hold a small sailboat. Current shading from the existing platform and step down is 280sf, shading from the pier is 492sf. Yeopim Creek is approximately 780' wide at the applicant's property, is classified as SC waters and is closed to shellfish harvesting. There are no know archeological sites on or adjacent to the applicant's property and there are no unusual geologic formations associated with the property. There is no submerged aquatic vegetation within the project footprint, or adjacent to the proposed project site. Vegetation on the applicants property is a mix of ornamentals and domestic grasses along the high ground adjacent to the dwelling and typical vegetation found within a non -coastal wetland in the area (loblloy pine, bald cypress, wax myrtle, cattail, and pennywort). Development Proposal Proposed development includes the construction of a second small pier on the north side of the property along an existing bulkhead with a dual personal water craft lift. The pier will be elevated above the water approximately 16" and will be a 6' x 20' with a 3' x 10' cut out to accommodate the lift as shown on the enclosed cross section drawing (Page 2 of 3). The proposed pier and lift system will be approximately 74' to the nearest pierto the north. The pier will be in shallow water to allow easy access on and off of the personal water craft. Area enclosed by the dual lift = 50sf Pier = 90sf If permitted, there will be a total of four formal recreational mooring facilities associated with the applicant's property. Anticipated Impacts 1) Temporary turbidity within the waters adjacent to the projects site during construction. 2) Approximately 90sf of open water will be shaded by the proposed pier. 3) Approximately 50sf of shading by the PWC lift. (1) not extending into the channel portion of the water body; and, Consistent: Will not extend into the navigable channel. (iii) not extending more than one-fourth the width of a natural water body, or humanmade canal or basin. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier -head line. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body. (H) Piers or docking facilities longer than 400 feet shall be permitted only if the proposed length gives access to deeper water at a rate of at least 1 foot each 100 foot increment of length longer than 400 feet, or, if the additional length is necessary to span some obstruction to RECEIVED navigation. Existing shoreline improvements consist of bulkhead, a 6 foot wide by 82 foot long pier with a 12 foot by 18 foot terminus platform, a 4 foot by 16 foot stepdown, two (2) tie pilings, and a personal water craft lift. Installation of a 6 foot wide by 20 foot long pier and dual personal watercraft lift is proposed. A 3 foot by 10 foot cut out in the pier will accommodate the lift. The pier will be elevated 16 inches above the water. The waters of Yeopim Creek are classified as SC and are closed to shellfish harvesting. There are no known significant geological or archaeological sites within or adjacent to the project area. There is no Submerged Aquatic Vegetation (SAV) within or adjacent to the project site. Anticipated Impacts resulting from this project are expected to include: the shading of 140 sq. ft. of Public Trust Area of Environmental Concern (AEC). PROJECT SUMMARY: The property owners propose the construction a pier and a dual personal water craft lift on Yeopim Creek, in Perquimans County. s Brenda and John Hoepfner Field Investigation Report Page 2 Project Setting The project site is located at 148 New River Drive in Albemarle Plantation Subdivision, a residential golf community in Perquimans County. The property is situated along 185' of Yeopim Creek, a tributary of the Yeopim River and the Albemarle Sound. Existing development along Yeopim Creek is residential and agricultural, with one private subdivision marina within a mile of the property. Zoning of property within the subdivision is RA-25 (residential/Agricultural with a minimum lot requirement of 25,000sf. Immediately north and south of the applicant's property are dwellings, each with recreational docking facilities for multiple vessels. Existing on the applicant's property is a dwelling, a bulkhead, a 6' x 82' pier with a 12' x 18' platform and a 4' x 16' stepdown, two tie pilings for a formal mooring facility, and a personal water craft lift (a second formal mooring facility) being used to hold a small sailboat. Current shading from the existing platform and step down is 28Osf, shading from the pier is 492sf. Yeopim Creek is approximately 780' wide at the applicant's property, is classified as SC waters and is closed to shellfish harvesting. There are no know archeological sites on or adjacent to the applicant's property and there are no unusual geologic formations associated with the property. There is no submerged aquatic vegetation within the project footprint, or adjacent to the proposed project site. Vegetation on the applicants property is a mix of ornamentals and domestic grasses along the high ground adjacent to the dwelling and typical vegetation found within a non -coastal wetland in the area (loblloy pine, bald cypress, wax myrtle, cattail, and pennywort). Development Proposal Proposed development includes the construction of a second small pier on the north side of the property along an existing bulkhead with a dual personal water craft lift. The pier will be elevated above the water approximately 16" and will be a 6' x 20' with a 3' x 10' cut out to accommodate the lift as shown on the enclosed cross section drawing (Page 2 of 3). The proposed pier and lift system will be approximately 74' to the nearest pier to the north. The pier will be in shallow water to allow easy access on and off of the personal water craft.
