This permit, issued on Aueust 30, 2016 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Expanded Docking Facili
.0 This permit authorizes the construction of the kayak launch and uses located in or over the water that
are expressly and specifically set forth in the permit application. No other structure, whether floating
or stationary, shall become a permanent part of this expanded docking.facility without permit
_ modification. No non -water dependent uses of structures shall be conducted on, in or over Public
p Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
;- expanded docking facility. Any sewage discharge at the expanded docking facility shall be
considered a'violation of this permit for which the permittee is responsible. This prohibition shall be
rapplied and enforced throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
ualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.

F 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
€ reflectors shall be attached to the structures in order to make it more visible during hours of darkness or
} inclement weather.

5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.

c ;6) Unless specifically altered herein, this permit authorizes the installation of three (3) "no wake zone" .
buoys and one (1) cautionary sign, all as expressly and specifically set forth in the attached permit

application and workplan drawings. Any additional development and/or construction activities may
require a modification of this permit. Contact a Division of Coastal Management Representative at (252)

The channel markers shall conform with any and all appropriate regulations governing such structures,
including, but not limited to, marking and lighting requirements of the North Carolina Wildlife
Resources Commission and/or United States Coast Guard.

8j No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
'.9) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
10)` The permittee and/or his or her contractor shall meet with a representative of the Division prior to
initiation of any phase of this project.

;11) - This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
l2)' This Major Modification shall be attached to the original of Permit No. 49-15, which was issued to the
permittee on 4/17/15, and copies of both documents shall be readily available on site when a Division
representative inspects the project for compliance.

177-NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The permittee is advised that any development or land disturbing activity that is considered non -
water dependent is not authorized within 50 feet of the normal water level unless specifically
exempted by Environmental Management Commission (EMC) Neuse River buffer regulations in
place at the time of such development.
The N.C. Division of Water Quality has assigned the proposed project DWR Project No. 2015-
0179 V2.
NOTE:
The U.S. Army Corps of Engineers assigned the proposed project under Action Id. No. SAW-
201601511.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -
colored form) is retained by you and it must be available on site when the project is inspected for compliance.
Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B
with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-
2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified
party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must
be carried out in accordance with your application. Modifications, time extensions, and future maintenance
requires additional approval. Please read your permit carefully prior to starting work and review all project
plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that
he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact
Department personnel at any time for assistance. By working in accordance with the permit, you will be
helping to protect our vitally important coastal resources.

SUBJECT: Comments and Recommendations - CAMA Major Permit —Slocum Creek Historic Park,
Craven County
The following is my assessment and consequent recommendations of the above referenced proposal: This
proposal incorporates 95,000 square feet of Public Trust Waters. The proposed kayak launch should not pose
a hazard to navigation within the east prong of the tributary, since the proposed launch will be 20' from the
western shoreline. This distance should allow for suitable ingress/egress for small vessels within this
particular tributary.
These inland waters of Slocum Creek are closed to shellfish harvest. This waterbody is a Primary Nursery Area.
This proposal will not pose a hazard to navigation. Assuming that state and federal agencies concur with the
proposal, I recommend the project be authorized as proposed, contingent upon the following conditions:
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, may become a permanent part of this public boating access facility without permit
modification. No non -water dependent uses of structures may be conducted on, in or over public trust
waters without permit modification;
2) The piers and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor, which is determined by
drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that
intersects with the shore at the point where the upland property line meets the water's edge;

3) In order to protect water quality, runoff from the construction must not visibly increase the amount of
suspended sediments in adjacent waters;
4) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work;
5) Any development or land disturbing activity that is considered non -water dependent is not authorized
within 50 feet of the normal water level unless specifically exempted by Environmental Management
Commission (EMC) Neuse River buffer regulations in place at the time of such development;
6) The permittee will maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party;

Consistency Determination: The request is consistent with/not in conflict with the 2009 City
of Havelock and Use Plan certified by the CRC on October 29, 2009.
Overview: This proposal is a modification request to CAMA Major Permit #49-15, that was
issued April 17, 2015 for the construction of a public park, kayak launch, and pedestrian bridge.
The permit expiration data in December 31, 2018. The project is located at 120 Church St,
Havelock, Craven County, North Carolina. The applicant is proposing to expand an existing
kayak launching facility and designate a "No Wake Zone" in portions of Slocum Creek.
The parcel is 2.59 acres, and is undeveloped with vegetation mainly consisting of native
deciduous trees and shrubs. The parcel has approximately 260' of continuous shoreline along
Slocum Cree. There are no Coastal Wetlands in the vicinity of the area.
The project is located adjacent to Slocum Creek, the waterbody is 120' across at the project site
location, and the surface water classifications are SC (Aquatic Life, Secondary Recreation, Salt
Water) and Sw (Swamp Waters), and NSW (Nutrient Sensitive Waters). The site is a Primary
Nursery Area and is closed to shellfish harvesting. Substrate is soft without shell. The project is
subject to the Neuse River Riparian Buffer Rules.
It is unknown if Submerged Aquatic Vegetation (SAV) habitat is present. There are no cultural
of archaeological resources in the vicinity.
Anticipated impacts resulting from this project are expected to include: The
disturbance/incorporation of 95,000 ft2, and the shading of 540 ft2 of Open Water. The proposed
project should pose no hazard to navigation or the ingress/egress of the east prong tributary.
Temporary turbidity impacts are not anticipated during construction.

Basis for Determination:
The project site is located in the City of Havelock and is subject to the City of Havelock
Comprehensive Plan. The Future Land Use Map (FLUM) designates the site as a "Medium
Density Residential'. The use of the parcel as a park is consistent with the LUP and FLUM, as
the plan states that "Compatible parks continue to be encouraged in all residential land use
categories, and may continue to be allowed in all other future land use categories" (pg. 5-18).
The following LUP policies may be applicable to this request:
Goal 12, pg. 6-21: "Provide and enhance access for residents and visitors alike to public trust
waters identified in the City of Havelock."
Objective 12.1, pg. 6-21: `Increase the number of opportunities for public access to local public
trust waters".

request. DWR issues approval in the form of a Water Quality Certification (WQC) in conjunction.with the
CAMA Major Permit and General Permit(s) 198000291 issued by the US Army Corps of Engineers (USAGE).
This, Certification allows you to use the CAMA Major Permit when the Division of Coastal Management
issues it.
In accordance With the attached General Certification N3900 (GC3900), the impacts described in your
application do not require written authorization to utilize GC 3900., However, you are required to follow
the conditions listed in the attached certification. You should get or otherwise comply with any other
federal, state and local requirements before you go ahead with your project including (but not limited to)
erosion and sediment control regulations.
This Certification can becontested as provided in Articles 3 and 4 of General Statute 150B by filing a
written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as

Project Summary: The applicant wishes to expand an existing kayak launch and delineate
a formal No Wake Zone for public use in Slocum Creek, Craven County.
Narrative Description:
This proposal is a modification request to CAMA Major Permit #49-15. It was issued to the
applicant on April 17, 2015 for the construction of a public park, kayak launch, and pedestrian
bridge. It is set to expire on December 31, 2018.
The property is located adjacent to Slocum Creek at 120 Church Road in Havelock, Craven County.
This 2.59-acre parcel is undeveloped. The adjacent properties are wooded and undeveloped.
The elevation of the high ground of the parcel is about 22' above the normal water level (nwl).
Vegetation on the lot mainly consists of native deciduous trees and shrubs. There are no Coastal
Wetlands in the vicinity of the project area. This parcel has approximately 260' of continuous
shoreline along Slocum Creek. Immediate offshore water depths adjacent to the parcel range from-1'
to —15' normal water level (NWL). The subaqueous substrate is soft without shell.
There is not a cultural resource in the nearby vicinity of the project area. This waterbody is
approximately 120'across at this location. These inland waters are classified as a Primary Nursery
Area and the presence of submerged aquatic vegetation is unknown at this time. This area is closed to
shellfish harvest and is classified as SC; Sw, Nutrient Sensitive Waters. There is not a defined
Federal Channel in the nearby vicinity of this project area. This project area is subject to the Neuse
River Riparian Buffer Rules.
Proposed Development:
The applicant wishes to expand an existing kayak launching facility and designate a No Wake Zone
adjacent to Slocum Creek, in Havelock. The proposed development will take place adjacent to 120
Church Road, Craven County. The proposed development will serve the public at large.
The proposed No Wake Zone (NWZ) will begin adjacent to the public boat ramp near Highway 70
and extend downstream approximately 1,000 feet. This NWZ would be defined by an entry and exit
sign as well as three buoys. The signs and buoys are proposed to be approximately 10 feet from the
shoreline at equidistant intervals spanning the NWZ.
The proposed expansion of the kayak launch by installing a second vessel launcher on the north side.
The proposed floating launcher would be 5' wide and 19' long. It would increase the existing kayak
launching facility to a total of 527 square feet.
Anticipated Impacts:
The proposed NWZ will not pose a hazard to navigation. The proposed kayak launcher will extend
20' waterward into this east section of Slocum Creek. The proposed kayak launch should not pose a

hazard to navigation of ingress/egress of the east prong of the tributary.
Traditional marine construction methodology will be utilized during the construction of this public
No Wake Zone and kayak launch. Temporary turbidity impacts are not anticipated during
construction.

The City of Havelock would like to apply for a modification to the City's CAMA Major Permit
#49-15. The purpose of the modification is to include: (1) No Wake Zone (NWZ) signage
for an area on Slocum Creek, and (2) expansion of the kayak launch. The application fee
of $100.00 is enclosed.
The City is pursuing the No Wake Zone as a safety precaution for all users in the creek,
particularly including new recreational users at the Slocum Creek Park on Church Road
with the addition of the kayak launch. The City has applied to the NC Wildlife Resources
Commission for the NWZ from the existing WRC boat ramp on the south side of US 70
and associated No Wake Zone that extends 50 yards to the north approximately % mile. It
is anticipated that the NWZ will go into effect on July 1, 2016. A copy of the completed
application is attached (Exhibit A).
As illustrated in the attached maps and diagrams, the City is proposing to post enter/exit
signs at each of end of the NWZ and install 3 floating buoys. The proposed locations are
based on a site visit with the local NC Wildlife Resources Officer several months ago. The
decimal degree coordinates of the enter/exit point on the northernmost extent of the NWZ
are N-34.892791 W-76.920953. The signs and buoys are proposed to be located 10' from
the edge of the creek bank. The size and dimensions of the signs and buoys are shown
on the attached quote from the NC WRC (Exhibit B).
In addition to the No Wake Zone regulatory signs, the City is requesting to install a
cautionary sign (High Paddle Sport Activity, 36"x48") at the head of the SW prong of the
creek to alert boaters entering the creek of paddle sport activity in the area.
The signs and buoys, as provided in Exhibit A, are proposed to be purchased from the NC
WRC or a marine construction supplier and a local marine contractor will install them.
One of the enter/exit signs and the cautionary high paddle sport activity signs will be
installed on pile -driven posts. The other enter/exit signs are proposed to be posted on the
US 70 bridge by the NC DOT. The buoys will be floating with anchors. The pile -driven
signs and the floating buoys will meet the NC WRC Technical Specifications for Uniform
Waterway Markers.
The City is also requesting a permit modification to enlarge the permitted area for the
floating platform to include a second kayak launch to be installed on the north side of the
floating platform running perpendicular to the shoreline (see Exhibit C). The proposed
area would include the floating platform (10'x26') with a 40' entry plank for a total of 300
sq. ft., the kayak launch parallel to the shore (5'x24') and the second kayak launch
(5'x12.5').

WHEREAS, under authority of North Carolina General Statutes Section I SA NCAC 10-
F.0340 of the North Carolina Administrative Code, any subdivision of the State of North Carolina may
at any time, after public notice, make formal application to the NC Wildlife Resources Commission
for special rules and regulation with reference to the safe and reasonable operation of vessels of any
water within its territorial limits; and
WHEREAS, City of Havelock has given public notice of its intention to make a formal
application to the Wildlife Resources Commission for special roles and regulation with reference to the

Wildlife Resources Commission the promulgation of special rules and regulations with reference to the safe and
reasonable operation of vessels applicable to the waters of Slocum Creek

erection or maintenance of the markers is to be by someone other than the governmental unit, a
memorandum identifying that person or entity is attached. The North Carolina Wildlife Resources
Commission does not purchase, place or maintain no wake markers.
4. Each waterway marker (buoy) required shall comply in color, size, shape, and structural design with the U. S. Aids
to Navigation System and the supplementary standards for such markers adopted by the North Carolina Wildlife
Resources Commission pursuant thereto. No other waterway marker will be placed or allowed to remain in waters
in which the U. S. Aids to Navigation System has been fully implemented without approval of the Wildlife
Resources Commission.
5. It is understood that the regulations promulgated by the North Carolina Wildlife Resources Commission for
placement of waterway markers may be subject to approval by the United States Army Corps of Engineers and in
coastal counties by the Division of Coastal Management of the Department of Environment and Natural Resources.
The recommending governmental unit agrees to submit applications for such approvals to the appropriate agencies
with copies to the Wildlife Resources Commission. Final approval by the North Carolina Wildlife Resources
Commission for placement of such markers is contingent upon Division of Coastal Management and U.S. Army
Corps of Engineers approval where required.
6. If the special rules and regulations for federal waters are promulgated by the North Carolina Wildlife Resources
Commission and placement of the necessary regulatory waterway markers is approved by the applicable agencies,
such markers shall be erected or installed within go days after receipt of notification of the last such official
action, and thereafter maintained in good condition.

Proiect Summary: The applicant wishes to expand an existing kayak launch and delineate
a formal No Wake Zone for public use in Slocum Creek, Craven County.
Narrative Description:
This proposal is a modification request to CAMA Major Permit #49-15. It was issued to the
applicant on April 17, 2015 for the construction of a public park, kayak launch, and pedestrian
bridge. It is set to expire on December 31, 2018.
The property is located adjacent to Slocum Creek at 120 Church Road in Havelock, Craven County.
This 2.59-acre parcel is undeveloped. The adjacent properties are wooded and undeveloped.
The elevation of the high ground of the parcel is about 22' above the normal water level (nwl).
Vegetation on the lot mainly consists of native deciduous trees and shrubs. There are no Coastal
Wetlands in the vicinity of the project area. This parcel has approximately 260' of continuous
shoreline along Slocum Creek. Immediate offshore water depths adjacent to the parcel range from—F
to —15' normal water level (NWL). The subaqueous substrate is soft without shell.
There is not a cultural resource in the nearby vicinity of the project area. This waterbody is
approximately 12O'across at this location. These inland waters are classified as a Primary Nursery
Area and the presence of submerged aquatic vegetation is unknown at this time. This area is closed to
shellfish harvest and is classified as SC; Sw, Nutrient Sensitive Waters. There is not a defined
Federal Channel in the nearby vicinity of this project area. This project area is subject to the Neuse
River Riparian Buffer Rules.
Proposed Development:
The applicant wishes to expand an existing kayak launching facility and designate a No Wake Zone
adjacent to Slocum Creek, in Havelock. The proposed development will take place adjacent to 120
Church Road, Craven County. The proposed development will serve the public at large.
The proposed No Wake Zone (NWZ) will begin adjacent to the public boat ramp near Highway 70
and extend downstream approximately 1,000 feet. This NWZ would be defined by an entry and exit
sign as well as three buoys. The signs and buoys are proposed to be approximately 10 feet from the
shoreline at equidistant intervals spanning the NWZ.
The proposed expansion of the kayak launch by installing a second vessel launcher on the north side.
The proposed floating launcher would be 5' wide and 19' long. It would increase thpgtt!i&A D

No Wake Zone and kayak launch. Temporary turbidity impacts are not anticipated during
construction.
There is not a cultural resource in the nearby vicinity of the project area. This project area is

The City of Havelock would like to apply for a modification to the City's CAMA Major Permit
#49-15. The purpose of the modification is to include: (1) No Wake Zone (NWZ) signage
for an area on Slocum Creek, and (2) expansion of the kayak launch. The application fee
of $100.00 is enclosed.
The City is pursuing the No Wake Zone as a safety precaution for all users in the creek,
particularly including new recreational users at the Slocum Creek Park on Church Road
with the addition of the kayak launch. The City has applied to the NC Wildlife Resources
Commission for the NWZ from the existing WRC boat ramp on the south side of US 70
and associated No Wake Zone that extends 50 yards to the north approximately'/4 mile. It
is anticipated that the NWZ will go into effect on July 1, 2016. A copy of the completed
application is attached (Exhibit A).
As illustrated in the attached maps and diagrams, the City is proposing to post enter/exit
signs at each of end of the NWZ and install 3 floating buoys. The proposed locations are
based on a site visit with the local NC Wildlife Resources Officer several months ago. The
decimal degree coordinates of the enter/exit point on the northernmost extent of the NWZ
are N-34.892791 W-76.920953. The signs and buoys are proposed to be located 10' from
the edge of the creek bank. The size and dimensions of the signs and buoys are shown
on the attached quote from the NC WRC (Exhibit B).
In addition to the No Wake Zone regulatory signs, the City is requesting to install a
cautionary sign (High Paddle Sport Activity, 36"x48") at the head of the SW prong of the
creek to alert boaters entering the creek of paddle sport activity in the area.
The signs and buoys, as provided in Exhibit A, are proposed to be purchased from the NC
WRC or a marine construction supplier and a local marine contractor will install them.
One of the enter/exit signs and the cautionary high paddle sport activity signs will be
installed on pile -driven posts. The other enter/exit signs are proposed to be posted on the
US 70 bridge by the NC DOT. The buoys will be floating with anchors. The pile -driven
signs and the floating buoys will meet the NC WRC Technical Specifications for Uniform
Waterway Markers.
The City is also requesting a permit modification to enlarge the permitted area for the
floating platform to include a second kayak launch to be installed on the north side of the
floating platform running perpendicular to the shoreline (see Exhibit C). The proposed
area would include the floating platform (10'x26') with a 40' entry plank for a total of 300
sq. ft., the kayak launch parallel to the shore (5'x24') and the second kayak launch
(5'x12.5').

WHEREAS, under authority of North Carolina General Statutes Section 15A NCAC 10-
F.0340 of the North Carolina Administrative Code, any subdivision of the State of North Carolina may
at any time, after public notice, make formal application to the NC Wildlife Resources Commission
for special rules and regulation with reference to the safe and reasonable operation of vessels of any

2. In accordance with O.S. 75A-15, the above -named local governing unit hereby recommends to the North Carolina
Wildlife Resources Commission the promulgation of special rules and regulations with reference to the safe and
reasonable operation of vessels applicable to the waters of Slocum Creek
3. Enclosed herewith are the following:
a. A certified copy of the resolution of the above -named governmental unit:
(1) requesting the special rules and regulations for the waters named in Item 2 and
(2) requesting full implementation of the U.S. Aids to Navigation System in all waters within the
governmental unit (if this has not previously been done)
(3) stating that public notice, its date and media source, was given of the intention to make
application to the Wildlife Resources Commission for the regulations which are being proposed.
b. A draft of the proposed regulations.
C. Two copies of a map of the waters concerned showing the enact location and type and number of
waterway markers which will be necessary for the enforcement of the proposed regulations.
d. Estimated cost of placement of markers (buoys, signs, anchoring system, pilings if applicable.) The North
Carolina Wildlife Resources Commission is required to report the fiscal impact of any Rule. If purchase,
erection or maintenance of the markers is to be by someone other than the governmental unit, a
memorandum identifying that person or entity is attached. The North Carolina Wildlife Resources
Commission does not purchase, place or maintain no wake markers.
4. Each waterway marker (buoy) required shall comply in color, size, shape, and structural design with the U. S. Aids
to Navigation System and the supplementary standards for such markers adopted by the North Carolina Wildlife
Resources Commission pursuant thereto. No other waterway marker will be placed or allowed to remain in waters
in which the U. S. Aids to Navigation System has been fully implemented without approval of the Wildlife
Resources Commission.
5. It is understood that the regulations promulgated by the North Carolina Wildlife Resources Commission for
placement of waterway markers may be subject to approval by the United States Army Corps of Engineers and in
coastal counties by the Division of Coastal Management of the Department of Environment and Natural Resources.
T9re recommending governmental unit agrees to submit applications for such approvals to the appropriate agencies
with copies to the Wildlife Resources Commission. Final approval by the North Carolina Wildlife Resources
Commission for placement of such markers is contingent upon Division of Coastal Management and U.S. Army
Corps of Engineers approval where required.
6. If the special rules and regulations for federal waters are promulgated by the North Carolina Wildlife Resources
Commission and placement of the necessary regulatory waterway markers is approved by the appli
such markers shall be erected or installed within sbcty days after receipt of notification of the last lc= (V E D

Commissioners held a public hearing about a No Wake Zone proposal for Slocum Creek in
Havelock, North Carolina. Subsequently, the Board adopted a resolution requesting the
Wildlife Resources Commission to take action on the proposal.

proposes to install a cautionary sign at the entrance to this prong of the creek to alert
boaters to the narrow waters and high paddle sports activity. A copy of the proposed
signage and map is also included. The City understands this is strictly cautionary and is
not under the NC Wildlife Commission's regulatory authority.

Yes, the Rules Review Commission did meet and found no problems with the Rule. It was codified in the NCAC effective
July 1, 2016. Here is the citation from the NCAC:
15A NCAC 10F.0347 CRAVEN COUNTY
(a) Regulated Areas. This Rule applies to the following waters in Craven County:
(1) that portion of Northwest Creek between the entrance buoys at Fairfield Harbour Marina and the mouth of Spring
Creek, and to all of Spring Creek, including the bulkheaded area of Fairfield Harbour, in Craven County;
(2) that area of water between the entrance buoys of the Olde Towne Lake, from the Trent River and including all of
Olde Towne Lake and the bulkhead area of Olde Towne Harbour itself;
(3) Matthews Point Marina. That triangular area in the waters at the end of the Matthews Point Marina main pier, between
a point 300 feet east of the pier at 34.90619 N, 76.76490 W, and a point 300 feet west of the pier at 34.90610 N,
76.76262 W, and a point 150 feet south of the pier at 34.90571 N, 76.76377 W, which is located at the confluence of
Clubfoot and Mitchell Creeks off of the Neuse River;
(4) that area of water within 50 yards of the fuel dock at Eastern Carolina Yacht Club; and
)' that portion of Slocum CrFk in the City ofHavelock, shore to shore east of a line from a point on the northem shore
at,34.89122 N, 76.92302 W to a point on the'southem shore at 34.89102 N, 76.92304 W and extending northeast;
'shore to shore to a line from a point on the nortt ern shore at 34.8937 N, 76.92109,W to a.point on the southeast shore
at 34.89358 N,76_92089 W?
(b) Speed Limit. No person shall operate any vessel at greater than no -wake speed within the regulated areas described in Paragraph
(a) of this Rule.
(c) Green Springs Boys Club Swimming Area - No person shall operate a vessel within the Green Springs Boys Club Swimming Area
along the Neuse River as designated by marker buoys and float lines.
(d) Placement and Maintenance of Markers. The Board of Commissioners of Craven County is hereby designated a suitable agency
for placement and maintenance of the markers implementing Subparagraphs (a)(1), (2), (3), and (4) of this Rule, subject to the approval
of the United States Coast Guard and the United States Army Corps of Engineers.

The WRC gave final approval at their late April meeting. It is being forwarded to the Rules Review Commission, which
will give their final blessing at their June meeting (per their protocol they hear it a month after receipt.) Barring
complications, it will be codified and effective on July 1, 2016.

I am working on an estimate for the installation of the signs and buoys for the expected No Wake Zone on July 11. Can
you provide the specifications for installing them? As for the signs at each end, are they allowed to be installed in the
water and what are the specs for that? I have contacted CAMA about a modification to an existing CAMA permit to
permit the signs to be installed. Today, I need to work with our City Public Services Director to provide an estimate to
the Board of Commissionners for the installation cost to include posts, etc and labor.
Can you provide the technical specs for this? The NC Wildlife Form D-1 references the US Aids to Navigation System and
supplementary standards adopted by the NC WRC.

I have resumed responsibility as No Wake Zone Coordinator. Kate forwarded your application on to me and I'm happy
to say that this request is on the agenda for the Wildlife Resources Commission meeting on December 10.
Under the provisions of the Administrative Procedure Act, the Wildlife Resources Commission must approve submission
of Notice of Text for the no wake zone in the North Carolina Register, with an open comment period of at least 60 days.
Next week I anticipate that the WRC will approve the Notice of Text and the Fiscal Note Review that is required
whenever a rule has a financial impact on a local or state unit of government.
Once the comment period is closed the Wildlife Resources Commission will consider final adoption of the No Wake Zone
amendment at the April meeting. The adopted rule then is sent to the Rules Review Commission for final statutory
approval and codification into the NC Administrative Code.
The earliest effective date of your rule would be July 1, 2016. However, signage that is informational and not subject to
law enforcement can be placed as soon as need be.

Wildlife Commission Approves No -Wake Zone
in Craven County
RALEIGH, N.C. — The N.C. Wildlife Resources Commission approved a no -wake zone in Slocum Creek in Craven County at
its regularly scheduled Commission meeting on Thursday.
The no -wake zone on Slocum Creek, requested by the City of Havelock, will be on the portion of Slocum Creek near the
US 70 Bridge boat ramp, extending east approximately 1,650 feet. The no -wake zone is intended to mitigate hazards to
water safety caused by motorboat traffic near the boat ramp at unregulated speed, interfering with paddle boat
enthusiasts who use that part of Slocum Creek. The rule is effective July 1, 2016, subject to final review by the Rules
Review Commission at its June meeting.

Hi Katrina,
I am attaching my list of vendors- warning- it is an old list! I will check with Tammy to see if she has a newer one. In the
meantime I know some of these can help you.
The WRC gave final approval at their late April meeting. It is being forwarded to the Rules Review Commission, which
will give their final blessing at their June meeting (per their protocol they hear it a month after receipt.) Barring
complications, it will be codified and effective on July 1, 2016.

Betsy,
I am working on an estimate for the installation of the signs and buoys for the expected No Wake Zone on July 11. Can
you provide the specifications for installing them? As for the signs at each end, are they allowed to be installed in the
water and what are the specs for that? I have contacted CAMA about a modification to an existing CAMA permit to
permit the signs to be installed. Today, I need to work with our City Public Services Director to provide an estimate to
the Board of Commissionners for the installation cost to include posts, etc and labor.
Can you provide the technical specs for this? The NC Wildlife Form D-1 references the US Aids to Navigation System and
supplementary standards adopted by the NC WRC.

Dear Katrina,
I have resumed responsibility as No Wake Zone Coordinator. Kate forwarded your application on to me and I'm happy
to say that this request is on the agenda for the Wildlife Resources Commission meeting on December 10.
Under the provisions of the Administrative Procedure Act, the Wildlife Resources Commission must approve submission
of Notice of Text for the no wake zone in the North Carolina Register, with an open comment period of at least 60 days.
Next week I anticipate that the WRC will approve the Notice of Text and the Fiscal Note Review that is required
whenever a rule has a financial impact on a local or state unit of government.
Once the comment period is closed the Wildlife Resources Commission will consider final adoption of the No Wake Zone
amendment at the April meeting. The adopted rule then is sent to the Rules Review Commission for final statutory
approval and codification into the NC Administrative Code.
The earliest effective date of your rule would be July 1, 2016. However, signage that is informational and not subject to
law enforcement can be placed as soon as need be.
I hope this information is helpful. I will be happy to email you next week once the Commission approves moving
forward. Don't hesitate to contact me if I can help further.

Road in Havelock, Craven County. It was received on July 14, 2016, and appears to be adequate
for processing at this time. The projected deadline for making a decision is September 27, 2016.
An additional 75-day review period is provided by law when such time is necessary to complete
the review. If you have not been notified of a final action by the initial deadline stated above,
you should consider the review period extended. Under those circumstances, this letter will
serve as your notice of an extended review. However, an additional letter will be provided on or
about the 75th day.
If this agency does not render a permit decision within 70 days from July 14, 2016, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice at
a conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-
of-way fronting your property, or at a point along the road right-of-way where a private. road
would lead one into your property. Failure to post this notice could result in an incomplete
application.

The City of Havelock has applied for a modification to CAMA Major Permit #49-15 that was
issued in 2015 for the development of the Slocum Creek Waterfront Park at 120 Church Road. The
modification is requested for the addition of No Wake Zone signs in Slocum Creek and for
adjustments to the floating platform and kayak launches. A copy of the request is enclosed.
As the adjacent property owner to this project, the City is required to notify you in order to give you
the opportunity to comment on the request. Please review the attached permit application and
drawings.
Should you have any objections to this proposal, please send your written comments to Brad
Connell, Field Officer, Morehead City Office, 400 Commerce Ave., Morehead City, NC 28557,
