Mitchum Jr., PO Box NC 27834 Permit Number 40-22 Authorizing development in Carteret County at adi. to Adams Creek, at 1008 Sea Gate Dr, near Newport as requested in the permittee's application dated 12/14/21 (MP-1) and 3/9/22 (MP-4), including attached workplan drawings (3), Sheets 1-3 of 3 all dated 10/19/21. This permit, issued -on April 14, 2022 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility Expansion 1) This permit authorizes only the finger pier and boat lift, and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharged at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2025 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Mitchum Jr. Permit No. 40-22 Page 2 of 3 ADDITIONAL CONDITIONS 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) This permit authorizes an additional formalized boat slip for a maximum of three (3) formalized boat slips at this docking facility. 5) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 8) No portion of the permitted structure shall be located within 80 feet of the near bottom edge of the federally maintained AIWW channel. Sedimentation and Erosion Control 9) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 10) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. General 11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 12) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2022-00533). NOTE: The N.C. The proposal is adjacent to a Federal Channel. These waters of Adams Creek are closed to shellfish harvest. This waterbody is not a Primary Nursery Area. This proposal will not pose a hazard to navigation. Assuming that state and federal agencies concur with the proposal, I recommend the project be authorized as proposed, contingent upon the following conditions: 1. This permit authorizes a maximum of three boat slips. At no time shall more than three vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. 2. The authorized structure and associated activity must not cause an unacceptable interference with navigation. 3. The permiftee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this marina/docking facility without permit modification. No non -water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 5. The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. Overview: The property is located at 1008 Sea Gate Drive near Newport, Carteret County. This lot is currently developed with a residential dwelling, bulkhead, rip rap revetment, and docking facility. The existing pier is 6' by 60' and the existing platform is 1 0' by 16'. The adjacent riparian properties are similarly developed. AECs onsite include Estuarine Waters and Public Trust Areas. Adams Creek ICW surface water classifications are SA; HQW; NSW. This proposal is located near a Federal Channel. The site is not designated as a Primary Nursery Area and is closed to shellfish harvest. SAV was not observed at this location. There are no historic/cultural resources. The elevation of the adjacent high ground of the parcel is approximately G above the normal water level (NWL). Vegetation on the parcel mainly consists of lawn grasses. The parcel has 100' of continuous shoreline along Adams Creek ICW, a tributary of the Neuse River. Immediate offshore water depths adjacent to the parcel range from -2' to -6' NWL. The subaqueous substrate is firm without shell. The applicant is proposing to extend a private docking facility by constructing a 1-slip docking facility by extending the current dock. The proposed pier extension would be 4' by 195' and the proposed "L" platform would be 15' x 15' with a 13' x 13' boat lift on the south side of the proposed platform. This proposed expansion would take the docking facility approximately 460' waterward of the normal high water mark in order to access the -3' nlw depth contour. Traditional marine construction methodology would be utilized during the construction of this project. Turbidity impacts are not anticipated during the construction activities in Adams Creek. There is a Federal Channel in the nearby vicinity of this proposed docking facility. This proposal should not pose a hazard to traditional navigation as it is immediately adjacent to the existing docking facility and does not encroach into the ICW Federal Channel setback. Basis for Determination: The project site is subject to the 2021 Carteret County Land Use Plan Update. The Future Land Use Map (FLUM) designates the site as Rural (land) and Conservation (Areas of Environmental Concern). Uses allowed in Areas of Environmental Concern are those consistent with the State's minimum use standards and state and federal regulations. The following LUP policies may be applicable to this request: Policy 2.2 Carteret County's policies for development in coastal shoreline areas are as follow: 1. Residential and commercial development meeting the state's minimum use standards shall be allowed in coastal shorelines and ORW estuarine shoreline classified lands. Field Investigation Report: Mitchum Narrative Description: The property is located adjacent to the Adams Creek ICW at 1008 Sea Gate Drive near Newport, Carteret County. This lot is currently developed with a residential dwelling, bulkhead, rip rap revetment, and docking facility. The existing pier is 6' by 60' and the existing platform is 10' by 16'. The adjacent riparian properties are similarly developed. The elevation of the adjacent high ground of the parcel is approximately 6' above the normal water level (NWL). Vegetation on the parcel mainly consists of lawn grasses. The parcel has 100' of continuous shoreline along Adams Creek ICW, a tributary of the Neuse River. Immediate offshore water depths adjacent to the parcel range from —2' to —6' NWL. The subaqueous substrate is firm without shell. This proposal is located near a Federal Channel. There is not a cultural resource in the project area. This waterbody is approximately 510' across at this location. These estuarine waters are not classified as a Primary Nursery Area. Submerged aquatic vegetation was not observed at this location. This area is closed to shellfish harvest and is classified as SA; HQW, NSW. This parcel is within the Neuse River basin. Proposed Development: The applicant is proposing to expand a private docking facility within Adams Creek, near Newport. The proposed development would take place adjacent to 1008 Sea Gate Drive, Carteret County. This proposal is for private use in a rural residential setting. The applicant is proposing to construct a finger pier and third boat lift at an existing docking facility. The proposed finger pier would be 5' wide and 55' long in order to access a proposed 10' by 14' boat _lift. This proposed finger pier and boat lift would be on the south side of the existing second boat lift, which the applicant is also proposing to replace as a part of this project. This proposed development would be approximately 80' landward of the Adams Creek ICW Federal channel setback. Anticipated Impacts: There is a Federal Channel in the nearby vicinity of this proposed docking facility. This proposal should not pose a hazard to traditional navigation as it is immediately adjacent to the existing docking facility and does not encroach into the ICW Federal Channel setback. The proposed docking facility expansion would usurp an additional 1,020 square feet of Public Trust Area. Traditional marine construction methodology would be utilized during the construction of this project. Turbidity impacts are not anticipated during the construction activities in Adams Creek. This waterbody is not classified as a Primary Nursery Area. There are no shellfish or submerged aquatic vegetation resources within the project area. Mitchum is a modification of an existing dock and pair of boat lifts. The Mitchums desire to increase the number of boat lifts by one to bring the total number of boat lifts to three, one for each owner on the deed. The existing pier is 62.5 ft long with a left and right 9 ft x 5.5 ft platform that serves two boat lifts. To expand the number of boat lifts to three, the project will require the construction of an access pier as a branch from the existing pier. This access pier will allow ingress/egress from the land and main pier to the proposed third lift. The proposed lift is an " L" shaped access pier to the proposed third boat lift, 55 ft long and 5 ft wide. No platform is planned for this additional pier. Additional work will include the renewal of the existing southern boat lift with a lift of higher capacity to accommodate a slightly larger vessel.
