This permit, issued on September 2, 2022 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Spring Creek Unit
1) A turbidity curtain shall be left between the areas to be repaired and the existing waterbody and a 72-
hour period after completion of excavation shall elapse prior to turbidity curtain removal to prevent
unnecessary siltation into the adjacent water body.
2) This permit authorizes the replacement of the existing water control and associated structures and
bulkhead repair, all within the existing footprints, all as expressly and specifically set forth in the
attached permit application and workplan drawings.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
September 2, 2027
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.
Signed by the authority of the Secretary of DEQ and the Chair
of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
Hunting Creek Unit
3) This permit authorizes the replacement of the existing water control and associated structures and
bulkhead repair, and the use of the coffer dam, all within the existing footprints, all as expressly and
specifically set forth in the attached permit application and workplan drawings.
4) The coffer dam shall be constructed in accordance with the alignment depicted on the attached workplan
drawings.
5) No open water shall be excavated or filled, even temporarily, outside of the approved coffer dam
alignment.
6) No vegetated wetlands shall be excavated or filled, even temporarily.
7) The coffer dam shall be constructed prior to any excavation activities.
8) The coffer dam shall be structurally tight so as to prevent seepage of excavation materials through the
structure.
9) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.
10) No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding
waters.
11) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters
and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of
petroleum products or any other hazardous waste, the permittee shall immediately report it to the National
Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
Sedimentation and Erosion Control
12) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
13) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
General
14) No excavation shall take place outside of the area indicated on the workplan drawings.
15) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters. The barriers shall be maintained and functional until the
site is graded and stabilized.

16) The dredge material disposal area shall be inspected and approved by a representative of the Division of
Coastal Management prior to the commencement of any dredging activities.
17) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the
written approval of the Division of Coastal Management.
18) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in an approved upland location.
19) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2022-01457).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4501 and assigned the project DWR Project No. 2009-1030 v2.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many land disturbing
activities are not authorized within 50 feet of the normal water level unless specifically exempted
by Environmental Management Commission's (EMC) Tar Pamlico River buffer regulations
in place at the time of such development.
NOTE: An application processing fee of $400 was received by DCM for this project.

The majority of the tract is forested with the primary species being pine and oak. Adjacent to the waterways, there is tidal
marsh habitat. There are two man-made tidal impoundments on the tract that contain wetland vegatation and are managed
for migratory birds.

The managed tidal impoundments on the tract are man-made. There are also two parking lots and one boat ramp on the
tract. She is part of a game land and is managed for migratory bird habitat and public access for recreation. Site utilizes an
existing electric pump that is in need of replacement.

The proposed work is to repair an existing facility that Is a public game land. The site is a tidal impoundent managed for
migratory birds and used for public recreational hunting.

NC Wildlife Resources Commission has submitted a CAMA Major Permit application for property located
off NC 33 Hwy E, near Aurora on the boarder of Beaufort and Pamlico County, North Carolina. The applicant
proposes to install new pump, piping, structure for pump and control panel, and one riser to replace existing
components for a NC Wildlife Public Gamelands duck impoundment.
Staff has reviewed the proposed project regarding rules found in Subchapter 7H concerning
development in Public Trust Areas and Public Trust Shoreline. It is staff s recommendation that the proposed
project is consistent with 15A NCAC 07H .0208 as described below.
This office feels the development is consistent with 15A NCAC 07H .208(6) (B) Size of platform and
shaded area does not exceed 8ft2 per foot of shoreline.
Piping and Riser placement is in location and size as current existing features.
Staff recommend the following conditions be included if the project is permitted.
1) Any spoil material from pipe installation to be placed in upland disposal area.
2) Silt fence used during construction to prevent spoil form re-entering waterbody or wetlands.

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has
reviewed the permit application for proposed actions that may impact fish and/or fish habitats.
The North Carolina Wildlife Resources Commission (WRC) has submitted a CAMA Major
Permit application to replace an existing pump, pump support deck, and associated distribution
piping in the Spring Creek and Hunting Creek waterfowl impoundments. The WRC is also
proposing to replace the water control structure on the Spring Creek impoundment. The proposed
project is located at 34783 NC-33 Hwy E. in Aurora, NC at the borders of Beaufort and Pamlico
Counties. Hunting Creek is listed as inland waters and is classified as SC:NSW,HQW. Spring
Creek is listed as coastal waters and is classified as SC:NSW,HQW. Both are located within the
Tar River Basin.
The WRC is proposing to replace the existing shared pump, motor, 6' by 6.1' deck structure and
7.1' by 4' control panel access for the impoundments. Also included in the application is
replacement of the associated discharge piping to Spring and Hunting Creeks. In the Spring
Creek impoundment, the WRC is also proposing to replace an existing water control structure
and repair a damaged bulkhead.
The tidal canal that connects to the Spring Creek impoundment connects with the Pamlico River
where the River is designated as Primary Nursery Area (PNA) and Secondary Nursery Area
(SNA). These areas are of vital importance for numerous commercially, recreationally, and
economically important species during important life history stages. Waters designated as PNA
and/or SNA provide the necessary water quality, habitat, and prey features needed for these
species to thrive. As such, protection of these waters is of the utmost importance.
Rather than include a moratorium on in -water work, DMF believes that impacts to the designated
waters can be minimized by installing a turbidity curtain in the canal when the Spring Creek
water control structure and bulkhead work is being done. The curtain should be left in place for
72 hours after the work is completed in order to allow sufficient time for sediment to resettle.

Consistency Determination: The request is consistent with/not in conflict the Beaufort County Joint Land
Use Plan 2006 Update certified bythe CRC on January 13, 2010.
Overview: The NC Division of Wildlife Resources has submitted a CAMA Major Permit application to
replace existing pump, pump support deck, and associated distribution piping in the Spring Creek and
Hunting Creek waterfowl impoundments. They have also proposed to replace the water control structure
on the Spring Creek impoundment. The property is located at 34783 NC 33 Hwy E. in Aurora, NC at the
borders of Beaufort and Pamlico Co.
The applicant proposes to replace the existing shared pump, motor, 6'x6.1' deck structure and 7.1'x4'
control panel access for the impoundments as well as the associated discharge piping to the Spring Creek
and Hunting Creekimpoundments. In the Hunting Creek impoundment, the applicant proposes to replace

Hunting Creek is listed as Inland Waters and classified as SC:NSW,HQW by the Environmental
Management Commission. Spring Creek is listed as Coastal Waters and classified as SC:NSW,HQW by the
Environmental Management Commission. They are both in the Tar/Pamlico River Basin. The area in a PNA
and closed to shellfishing. Coastal wetlands extend for most of the shoreline.
Basis for Determination:
The project is subject to the Beaufort County Joint Land Use Plan 2006 Update. The counties Future Land
Use Map (FLUM) classifies the site as Towns and Community Centers (land), Conservation I (Public Trust

The following LUP policies may be applicable to this request:
2.1 Conservation I
2.1.3 Only development and land/water use activities that are consistent with the use standards for
coastal wetlands, estuarine waters, and public trust areas (15A NCAC 07H .0208) are allowed in this
classification. Permitted extractive uses in the Aurora area will continue.
2.1.5 Unless in the exempted or allowed, land development and land use activities must comply with the
requirements of the Tar -Pamlico Buffer Rule (15A NCAC 02B .0259).
2.2 Conservation II
2.2.2 Only development that is consistent with the use standards for the estuarine shoreline AEC and the

Reference the application of the NC Wildlife Resources Commission for a Department of
the Army permit to replace existing pump stations and platforms, on property located off NC
HWY 33, adjacent to Spring Creek and Hunting Creek, near the Town of Aurora, in Beaufort
and Pamlico Counties, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land -clearing activities shall take place at any time in the construction or maintenance of this
project, in such a manner as to impair normal flows and circulation patterns within waters or
wetlands or to reduce the reach of waters or wetlands.
3. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -Clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
4. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic

materials. In the event of a spill of petroleum produdts or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733-5083,
Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
5. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
6. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.

Project Setting:
The NC Division of Wildlife Resources has submitted a CAMA Major Permit application to
replace existing pump, pump support deck, and associated distribution piping in the Spring Creek and
Hunting Creek waterfowl impoundments. They have also proposed to replace the water control
structure on the Spring Creek impoundment. The property is located at 34783 NC 33 Hwy E. in Aurora,
NC at the borders of Beaufort and Pamlico Co. The property is located on 20,300 feet of Hunting and
Spring Creek and the 930 acre tract and 1200 acre tract are maintained as public recreation/hunting
land. Approximately 270 acres of the property is diked and flooded waterfowl impoundments. Existing
structures within the impoundment areas are foot bridges, water control structures, a distribution pump
and the piping that is associated with these pump systems. Coastal wetlands extend for most of the
shoreline.
Adjacent upstream property is non developed State owned public recreation/hunting land with
a public boat ramp on it. The property downstream is US Government/US Coast Guard property and
developed as a USCG station. Hunting Creek is listed as Inland Waters and classified as SC:NSW,HQW by
the Environmental Management Commission. Spring Creek is listed as Coastal Waters and classified as
SC:NSW,HQW by the Environmental Management Commission. They are both in the Tar/Pamlico River
Basin.
Project Description:
The applicant proposes to replace the existing shared pump, motor, 6'x6.1'deck structure and
7.1'x4' control panel access for the impoundments as well s the ss ciated discharge piping to the
Spring Creek and Hunting Creek impoundments. In the ree mpoundment, the applicant
proposes to replace an existing water control structure and repair damaged bulkhead.
Anticipated Impact:
The project will create localized turbidity in the connected tidal canals associated with the pipe
and raiser replacement and bulkhead repair.

CAMA MP-1 Project Narrative
Spring and Hunting Creek Pump Station Replacement
This project is being done at the request of and in partnership with the North Carolina Wildlife
Resources Commission (NCWRC). The project site Is owned and managed by NCWRC to provide habitat
to wildlife and recreational opportunities to the public. The proposed work is within the Spring Creek
and Hunting Creek Units, existing managed impoundments within the Goose Creek Game Land.
The proposed project includes replacing the existing pump, motor, electrical service, pump support deck
and the associated piping to both Spring and Hunting Creek Units. The existing distribution pipe to the
Hunting Creek Unit crosses under an existing tidal canal. The area of this crossing will be isolated by a
temporary steel sheet pile coffer dam on each side and the water pumped out. The existing pipe will be
removed in replaced by excavation and the new pipe will be placed in the same trench.
At both interior discharge points, the existing pipe penetrates a bulkhead and is controlled by a rising
gate. Upon removal of the existing distribution pipe, the bulkhead penetrations will be patched and
backfilled. The proposed distribution pipe will utilize 2-45 degree bends to create a "dragon head"
discharge above the bulkhead.
In addition, an existing water control structure located in the Spring Creek unit will be replaced. The
new water control structure will be installed in the same footprint. The internal bulkhead will be tied to
the new water control structure on each side.
The project proponent hereby certifies that all information herein is true, accurate and complete to the
best of my knowledge.
The project proponent herby requests that the certifying authority review and take action on this CWA-
401 certification request within a applicable reasonable period of time.

Background
On April 6, 2022, the United States Supreme Court issued an order staying a lower court's
vacatur of the Trump Administration's 2020 "Clean Water Act Section 401 Certification Rule"

The Trump Administration's Federal Rule imposes additional procedural requirements on
applicants for 401 Certifications and on DWR's processing of those applications. One
requirement is that 401 applicants must request a pre -filing meeting request at least 30 days prior
to submitting their 401 application. [40 C.F.R. §121.4] In turn, the Federal Rule requires that
applicants include documentation of their pre -filing meeting request in their 401 Certification
application. [40 C.F.R § 121.1; 40 C.F.R. §121.5]. Please refer to the Federal Rule for more
information.
Per 40 CFR § 121 and § 121.5, a 401 Certification application that does not include the required
pre -filing meeting request documentation does not constitute a "certification request." As a
result of the reinstatement of the Trump Administration's Federal Rule, all 401 applications
received after April 6, 2022 that do not have documentation that a pre -filing meeting request was
submitted at least 30 days prior to submittal of a 401 Certification application will be returned as
incomplete.

The NC Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development of property located off SR Hwy 33 Hobucken in
Pamlico/Beaufort County, North Carolina. It was received on 27 June 2022 and appears to
be adequate for processing at this time. The projected deadline for making a decision is 10
September 2022. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial
deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day. Kent Vaughan, Field
Representative for the Division of Coastal Management is responsible for processing your

If this agency does not render a permit decision within 70 days from 27 June 2022, you
may request a meeting with the Director of the Division of Coastal Management and permit
staff to discuss the status of your project. Such a meeting will be held within five working
days from the receipt of your written request and shall include the property owner,
developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice
at a conspicuous point along your property where it can be observed from a public road.
Some examples would be: Nailing the notice card to a telephone pole or tree along the road
right-of-way frontingyour property, or ata point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an
incomplete application.
