Docking Facility 1) This permit authorizes only the pier, platform, boatlifts, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses. of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) This permit authorizes a maximum of 2 formalized boat slips. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee Mighty Realty, LLC Permit No. 96-22 Page 2 of 3 ADDITIONAL CONDITIONS 3) All portions of the authorized structure shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. 4) No portion of the authorized docking facility, shall extend more than one quarter of the width of the water body. Measurements to determine width of the water body shall be made from the normal high- water line or the waterward edge of any coastal wetland vegetation which borders the water body, whichever is more restrictive. 5) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. 6) In order to satisfy concerns of the resource agencies, electronic or physical stops shall be placed on the boatlifts a minimum height of 18" above the bottom substrate to prevent the boat lifts from disturbing the bottom substrate. The electronic or physical stops shall remain in place for the life of the permitted docking facility. 7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 9) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 10) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Sedimentation and Erosion Control 11) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 12) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. General , 13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations.that may be required, including but not limited to any authorizations required from the U.S. Army Corps of Engineers. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of Individual Water Quality Certification 5108 and assigned the project DWR Project No. 20220826. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the mean high-water level. NOTE: An application processing fee of $400 was received by DCM for this project. Proposed: Access from shoreline = 6' x 275' Access Pier= 6' x 265' (As measured from NHW) = 1,590 sq. ft. (Credit) Floating Dock = 8' x 16' = 128 sq. ft. Open Platform = 21' x 12' = 252 sq. ft. Boatlift =12' x 12' =144 sq. ft. (Not Counted) Total (proposed) = 380 sq. ft. This office supports the recommendations of the resource agencies, particularly the NC Division of Marine Fisheries, regarding potential impacts to shallow bottom. Should concerns be expressed over potential impacts from any of the resource agencies, the project could then be found to be inconsistent with NCAC 07H .0208(a)(2), which requires that the location, design and need be consistent with the management objective of the Estuarine System AEC and the project be sited and designed to avoid significant adverse impacts upon the productivity and biological integrity of spawning and nursery areas. The proposed development would provide docking space for a total of two (2) vessels. The proposed docking facility would extend 135' beyond the marsh, terminating at the established pier -head line and not exceeding the %, width limit. This distance would be CONSISTENT with NCAC 07H .0208 (b)(6)(G)(iii). The application appears to be CONSISTENT with the remaining use standards set forth in NCAC 07H .0208 (b)(6), including those which dictate the maximum allowable platform area, the 15' riparian setback, and the 80' USACE Federal Channel setback. The applicant proposes to install a private pier with an open platform, floating dock and boatlift fir a total of two formalized slips on the AIWW in Sunset Beach, Brunswick County. Areas of Environmental Concern (AEC's) impacted by the proposal.are EW, CW and PT. Waters at the project site are classified as SA; HQW and are not open to the harvesting of shellfish. The area is a Primary Nursery Area. I have reviewed this proposal for consistency with the Town of Sunset Beach Land Use Plan and offer the following comments. The general area of the project is classified Residential, while the AECs impacted by the work are classified as MHL In general, the Town of Sunset Beach allows development in MHI classified AECs which is consistent with the State's minimum use standards. The Town of Sunset Beach Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. Provided all local, state and federal requirements can be met, this project appears to be consistent with the Town of Sunset Beach Land Use Plan. CONDITIONS OF CERTIFICATION [15A NCAC 02H .0507(c)]: 1. Moratoriums You will comply with any moratoriums per the NC Division of Marine Fisheries and the NC Wildlife Resources Commission. Dredging moratoriums shall be observed as required by the NC Division of Marine Fisheries, NC Wildlife Resources, US Fish and Wildlife and National Marine Fisheries. If such activities should take place during periods of high biological activity (e.g. anadromous species and shorebirds), biological monitoring may be required at the request of other state and federal agencies and coordinated with these dredging activities. The Permittee shall adhere specially to 15A NCAC 02B .0221 Tidal Salt Water Quality for Class SA Waters (3)(g) pH: shall be normal for waters in the area, which generally shall range between 6.8 and 8.5 except that swamp waters may have a pH as low as 4.3 if it is the result of natural conditions; (1) Turbidity: the turbidity in the receiving water shall not exceed 25 NTU; if turbidity exceeds this level due to natural background conditions, the existing turbidity level shall not be increased. All wetlands impacted by the placement of temporary construction equipment, materials and/or clearing activities shall be restored to the preconstruction contours and elevations. Culverts shall be designed and installed in such a manner that the original stream profiles are not altered and allow for aquatic life movement during low flows. The dimension, pattern, and profile of the stream above and below a pipe or culvert shall not be modified by widening the stream channel or by reducing the depth of the stream in connection with the construction activity. The width, height, and gradient of a proposed culvert shall be such as to pass the average historical law flow and spring flow without adversely altering flow velocity. If the width of the culvert is widerthan the stream channel, the culvert shall include multiple boxes/pipes, baffles, benches and/or sills to maintain the natural width of the stream channel. If multiple culverts/pipes/barrels are used, low flows shall be accommodated in one culvert/pipe and additional culverts/pipes shall be installed such that they receive only flows above bankfull. Placement of culverts and other structures in streams shall be below the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches, and 20% of the culvert diameter for culverts having a diameter less than or equal to 48 inches, to allow low flow passage of water and aquatic life. If the culvert outlet is submerged within a pool or scour hole and designed to provide for aquatic passage, then culvert burial into the streambed is not required. For structures less than 72" in diameter/width, and topographic constraints indicate culvert slopes of greater than 2.5% culvert burial is not required, provided that all alternative options for flattening the slope have been investigated and aquatic life movement/connectivity has been provided when possible (e.g. rock ladders, cross -vanes, sills, baffles etc.). Notification, including supporting documentation to include a location map of the culvert, culvert profile drawings, and slope calculations, shall be provided to DWR 30 calendar days prior to the installation of the culvert. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 1141 Indigo Circle adjacent to the AIW W in Sunset Beach, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, the Endangered Species Act of 1973, as amended (16 U.S.C. 1531 et seq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 ct seq.), the Magnusun-Sicvcas Fishery Conservation and Management Act (FCMA), as amended (16 U.S.C. 1801 ct seq.), and the Migratory Bird Treaty Act (16 U.S.C. 703-712 et seq.). The applicant proposes to install a 6' by 265' access pier in the place of an existing access pier, crossing over [Harsh, shell bank, and mud flat until it reaches the open water of the AIW W where it extends to a 21' by 12' open platform. To the west of the open platform a 12' by 12' boatift would be installed in water depths -1.0 to -1.08' NLW. South of the open platform a gangway would lead to an 8' by 16' floating dock that would run parallel the channel. As proposed, the lift and dock would have stops at 18" NLW to prevent structure sitting on substrate. The AIWW at this location is classified SA HQW by the Environmental Management Commission and is designated a primary nursery area (PNA) by the NC Division of Marine Fisheries (NCDMF). The NCWRC has reviewed the permit application and has concern with the floating platform and boatlift due to water depths within the structure locations. Chronic disturbance from activities and structures within insufficient water levels are impactful to these sensitive habitat and high water quality areas. A representative from DCM verified water depths. The boatlift is proposed in depths ranging from approximately -1.08' NLW at the waterward end and approximately -1.0' NLW at the landward side. The Division does not have concerns with the 12 x 12 boatlift that include a limit switch or stops at 18" above the substrate. The proposed floating dock would be sited in water depths approximately -1.25' NLW at the landward side and approximately -1.3' NLW at the waterward side. The Division does not recommend floating structures in water depths less than 2' NLW over concerns that floating docks in shallow water continuous impact the bottom, creating a hole under the structure over time, reduced water quality, and damage to the structure resulting in partially sunken docks. The project is proposed within PNA. PNAs are estuarine waters where initial post -larval development occurs. Species within this area are early post -larval to juvenile and include finfish, crabs, and shrimp. Shallow soft bottom is an important foraging habitat for juvenile and adult fish and invertebrates, and aids in storing and cycling of sediment, nutrients, and toxins between the bottom and water column. PROJECT DESCRIPTION The proposed project is located at 1141 Indigo Circle in Sunset Beach, Brunswick County. Residential properties border the project site to the west and east. The existing docking facility has been in place since at least 1993, according to aerial imagery, and consists of a 4' x 275' access pier extending south to the AIW W and terminating with a 20' x 10' open platform (See Sheet 1 of 3). No permit history can be found for the existing docking facility and it appears, based on aerial imagery, that no significant modifications were made between 1993 and present day. The existing dock was significantly damaged in 2020 during Hurricane Isaias and has remained unusable since the storm. Additionally, no permit history can be found for the existing wooden bulkhead but it appears to have been in place since at least 2006, according to aerial imagery. The property consists of a single family residential house located on a .24-acre parcel approximately 9' above normal high water (NHW) and is vegetated with landscape grasses and typical coastal -plain tree species. The property has approximately 78 linear feet of shoreline frontage along the southern edge of the property and is stabilized with a wooden bulkhead. High marsh Coastal Wetlands within the property's riparian corridor extend approximately 15' waterward of the bulkhead and include Saltmeadow Cordgrass (Spartina patens), Black Needlerush (Juncus roemerianus) and Spike Grass (Distichlis spicata). Low marsh consisting of Smooth Cordgrass (Spartina altern j7ora) extends approximately 50' waterward of the high marsh and transitions to an approximately 40' wide mud flat and then to an approximately 20' wide high -ground shell bank and finally back to an approximately 35' wide swath of Smooth Cordgrass (Spartina alternii fora). From the waterward edge of Coastal Wetlands, the AIW W measures approximately 545' at the proposed project site. The waters of the AIW W are classified SA by the Division of Water Quality and ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the April 2022 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. Water depths at the waterward end of the proposed docking facility are approximately -1.3' NLW, according to the applicant. These measurements were confirmed by DCM during a site visit on 4-27-2022. Tidal amplitude in the project area is approximately 4' between NLW and NHW. 4ED PROPOSED PROJECT .IUN 2 0 2022 The applicant proposes to install a private pier with an open platform, floating dock and boatlift f43CM* 1) CITY two formalized slips on the AIW W in Sunset Beach. The applicant proposes to build a 6' x 265' access pier (as measured from MHW) that would originate from an upland point and extend south. The proposed access pier would be constructed in the same footprint as the existing access pier but would be enlarged to 6' wide. The proposed access pier would cross approximately 65ft. of high and low marsh before crossing an approximately 40' wide mud flat that connects to an unnavigable channel (See Image 1) and then continues over an approximately 20' wide high -ground shell bank and back across approximately 35' wide area of low marsh before reaching the open water of the AIW W. The access pier would extend approximately 110' over open water and lead to a 2V x 12' open platform. To the west of the open platform, the applicant has proposed a 12' x 12' boatlift (Slip 1) in an area with water depths ranging from -1.0' NLW to -1.08' NLW. South of the open platform, a gangway would lead down to an 8' x 16' floating dock (Slip 2, See Sheet 2 of 3) that would run parallel with the channel and terminate at the established pier head line between 1137 Indigo Circle and 1147 Indigo Circle. As proposed, the floating dock and boatlift would be outfitted with 'stops' at 18" above the substrate due to insufficient water depths in the project area (See Sheet Mighty Reality, LLC June 15, 2022 Page 3 ---------------------------------------------------------------------------------------------------------------------------------- 2 of 3). Water depths verified by DCM staff are approximately -1.3' NLW at the waterward end of the proposed floating dock. Water depths on the landward side of the proposed boatlift are approximately -1.0' NLW. The property has approximately 78 linear feet of shoreline and the facility's design appears to remain within the applicant's area of riparian access and would not encroach into either 15 ft. adjacent riparian access. No riparian setback waivers were obtained by the applicant. The applicant also made multiple attempts to notify a parcel located entirely over open water (Parcel 1D: 256DA005) with no success. The applicant's design extends to the pier head line of adjacent docking facilities and does not exceed the %width of the waterbody. According to the applicant's measurements, the docking facility would extend across approximately 24% of the waterbody. The proposed design would terminate approximately 65' landward of the USACE 80' Federal Channel setback. 10. ANTICIPATED IMPACTS According to the application, the proposed docking facility would incorporate approximately 2,054 sq. ft. of Estuarine and Public Trust Area and would shade approximately 600 sq. ft. of Coastal Wetlands. The proposed boatlift and floating dock would be located over an area of shallow water (-1.0' NLW to -1.33' NLW as verified by DCM staff) in a Primary Nursery Area. The installation of stops located at 18" above the substrate could reduce impacts to soft bottom habitat while limiting usage to periods of mid and high tides. Despite using stops to physically limit the structure height above the substrate, prop scouring in critical habitat is still a concern during ingress and egress. The proposed development would be located outside of the adjacent 15' riparian corridor setbacks and would be constructed at the existing pier head line. The proposed design would remain landward of the USACE 80' Federal Channel setback. Minor increases in turbidity should be expected during construction. The project location is in the AI W W and has less than 18" at normal low tide so the proposal is to move the water dependent structures toward the channel by 16' to match the neighboring docking facility. The pier and fixed platform were damaged in Hurricane Isaias and the applicant would like to replace the structure in the existing footprint with wider pier and slightly larger platform. The addition of the boat lift and floating dock are new water dependent structures. Along this area of the AIWW there are adjacent piers with floating docks and boat lifts.
