This permit, issued on October 3, 2022 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Docking Facilities I) This permit authorizes only the dock, pier, platform, boatlifts, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) This permit authorizes a maximum of four (4) formalized boat slips located as shown on the drawing labeled Sheet 2 of 3. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee Saltmeadow Way, LLC ADDITIONAL CONDITIONS Permit No. 104-22 Page 2 of 4 3) No portion of the authorized docking facility, including tie piles, shall extend more than one quarter of the width of the water body. Measurements to determine width of the water body shall be made from the normal high-water line or the waterward edge of any coastal wetland vegetation which borders the water body, whichever is more restrictive. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 7) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the mooring. Any sewage discharged at the mooring shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Bulkhead Replacement 8) The bulkhead alignment shall approximate the normal water level at the time of construction. 9) The bulkhead shall extend a maximum of two (2) foot waterward from the waterward edge of the existing bulkhead at any point along its alignment at the time of construction. 10) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 11) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 12) The bulkhead shall be constructed prior to any backfilling activities. 13) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 14) This permit does not authorize any excavation waterward of the approved alignment. 15) The fill material shall be clean and free of any pollutants except in trace quantities. 16) Unless altered herein, all backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. Saltmeadow Way, LLC ADDITIONAL CONDITIONS Permit No. 104-22 Page 3 of 4 17) No backfill material is to be placed within 30 feet of the normal high-water level, except that which will be used to backfill the area behind the permitted bulkhead. 18) All fill material to be placed below normal high-water level shall be confined behind the permitted bulkhead. 19) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. Sedimentation and Erosion Control 20) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 21) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 22) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 23) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 24) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 25) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 19800056 (Action ID SAW-2016-01616). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of Individual Water Quality Certification and assigned the project DWR Project No. 20160753v2. It is the staffs recommendation that the construction of a second docking facility appears to be CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the eight square foot rule and the pier width rule and the proposed structures would be located entirely over open water. The proposed new docking facility would allow for a total of four (4) formalized slips at this location. This office has no objection to the proposed work, provided it is consistent with all other state and federal permitting requirements. The applicant is proposing to install a new vinyl bulkhead 2 ft. waterward of the existing wall, relocate an existing boatlift and construct a second docking facility for a total of 4 boat slips. The project is located at 32 Saltmeadow Road, adjacent to Banks Channel on Figure Eight Island in New Hanover County. Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PT. Waters at the project site are classified as SA-ORW and are open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the New Hanover County Comprehensive Land Use Plan and offer the following comments. The general area of the project is classified as Residential, Conservation In general, New Hanover County allows development in Residential and Conservation classified AECs, which is consistent with the State's minimum use standards. The New Hanover County Comprehensive Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these more restrictive standards appear to be applicable to this proposal. This project is consistent with the New Hanover County Comprehensive Land Use Plan. Water that inadvertently contacts uncured concrete shall not be discharged to surface waters due to the potential for elevated pH and possible aquatic life and fish kills. Any water that contacts uncured concrete shall be captured, treated, and disposed of properly. Citation: 15A NCAC 02H .0506(b); 15A NCAC 02H .0507(c) Justification: Timely reporting of non-compliance is important in identifying and minimizing detrimental impacts to water quality and avoiding impacts due to water pollution that precludes any best use on a short-term or long-term basis. No waste, spoil, solids, or fill of any kind shall occur in wetlands or waters beyond the footprint of the approved impacts (including temporary impacts). Citation: 15A NCAC 02H .0506; 15A NCAC 02H .0507(c) Justification: Surface water quality standards require that conditions of waters be suitable for all best uses provided for in state rule (including, at minimum: aquatic life propagation, survival, and maintenance of biological integrity; wildlife, secondary contact recreation; agriculture); and that activities must not cause water pollution that precludes any best use on a short-term or long-term basis. 8. When applicable, all construction activities shall be performed and maintained in full compliance with G.S. Chapter 113A Article 4 (Sediment and Pollution Control Act of 1973). Regardless of applicability of the Sediment and Pollution Control Act, all projects shall incorporate appropriate Best Management Practices for the control of sediment and erosion so that no violations of state water quality standards, statutes, or rules occur. Design, installation, operation, and maintenance of all sediment and erosion control measures shall be equal to or exceed the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual, or for linear transportation projects, the North Caroline Department of Transportation Sediment and Erosion Control Manual. All devices shall be maintained on all construction sites,.borrow sites, and waste pile (spoil) sites, including contractor -owned or leased borrow pits associated with the project. Sufficient materials required for stabilization and/or repair of erosion control measures and stormwater routing and treatment shall be on site at all times. For borrow pit sites, the erosion and sediment control measures shall be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. Reclamation measures and implementation shall comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act and the Mining Act of 1971. The island is accessed from the mainland at the end of Edgewater Club Road (SR 1402), by private bridge over the Atlantic Intracoastal Waterway (AIWW) and an earthen causeway, which traverses Middle Sound. Heading east on the causeway, turn right on Beach Road South and travel approximately 1.2 miles south until you reach Saltmeadow Road. Turn right onto Saltmeadow Road and continue until you reach the property of interest located at the end of the cul-de-sac. The project site is approximately 0.8 acres in size and has an average elevation of approximately 6' above Normal High Water (NHW) and is vegetated with maintained lawn grass an ornamental landscaping. The project site has approximately 209 linear feet of shoreline frontage along Banks Channel, which is currently stabilized by a timber bulkhead authorized under GP 52085 issued on March 24, 2008. There are no existing coastal wetlands waterward of the timber bulkhead and NHW is at the bulkhead. Extending in a westerly direction from the timber bulkhead towards Banks Channel is an existing private docking facility, which consists of an access pier (70' x 6'), uncovered 1-head" fixed platform (20' x 16') and floating dock (20' x 8'), which extends perpendicular to the shoreline and Banks Channel. There is an existing boatlift (13' x 13') located on the northern side of the floating dock. The application states the existing docking facility currently accommodates up to two (2) vessels in water depth of approximately -6' @ Normal Low Water (NLW). The previous property owner (Matthews) obtained CAMA General Permit No. 13366-D for the existing docking floating facility on 1110/95. Another previous owner (Baggett) obtained CAMA General Permits No. 38952-D and 45840-D to allow for replacement of the floating dock and installation of a boatlift on 8117/04 and 717/06. The docking facility currently extends approximately 125' into a waterbody currently measuring approximately 400' across. The New Hanover County 2016 Land Use Plan classifies adjacent waters and high ground portion of the property as General Residential and Conservation. The waters of Banks Channel and Middle Sound are classified SA•ORW by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to install a new vinyl bulkhead 2 ft. waterward of the existing wall, relocate an existing boatlift and construct a second docking facility for a total of 4 boat slips. The application states that a new 210 linear ft. vinyl bulkhead would be installed 2 ft. waterward of the existing failing wooden bulkhead. According to the proposal, the existing boatlift would be relocated to a new second docking facility on the southwest shoreline of the property. A 6 ft. by 6. ft, fixed platform would extend from the bulkhead via ramp to a 30 ft. long by 8 ft. wide floating dock running parallel to the shoreline. The existing 13 ft. by 13 ft. boatlift would be relocated to the landward side of the floating dock and a new 13 ft. by 13 ft. boatlift would be installed on the waterward side of the new floating dock (see Sheets 1 and 2 of 3). The second docking facility would provide docking space for two additional vessels for a total of four (4) boat slips at this location within water depth of approximately -6' @ NLW. The second docking facility would extend approximately 26 ft. into the waterbody, which measures approximately 180' across in this area. No SAV was evident on site and no wetland impacts are proposed. 10. ANTICIPATED IMPACTS The new bulkhead would fill 420 sq. ft. of Estuarine Waters and Public Trust Area and would result in the disturbance of approximately 4,200 sq. ft. of high ground. The proposed second docking facility would incorporate approximately 614 sq. ft. of open Estuarine Waters and Public Trust Area and would extend approximately 26' into a waterbody, which measures approximately 180' across. This distance would conform to the % width distance rule. The proposed structures would allow the existing docking facility to accommodate up to four (4) vessels in water depth of approximately 4 @ NLW. Total = 756 sq. ft. It is the staffs recommendation that the construction of a second docking facility appears to be CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the eight square foot rule and the pier width rule and the proposed structures would be located entirely over open water. The proposed new docking facility would allow for a total of four (4) formalized slips at this location. This office has no objection to the proposed work, provided it is consistent with all other state and federal permitting requirements. Any permit issued should include standard conditions for private docking facilities.
