HomeMy WebLinkAbout107-22 Jethro, PhillipPermit Class NEW STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 Permit Number 107-22 Issued to Phillip Jethro, 115 Ansell Lane, Knotts Island, NC 27950 Authorizing development in Currituck County at ad*. to a man-made canal and Capsies Creek. at 142 Williams Dr., in Knotts Island , as requested in the permittee's application dtd 7/12/22, including attached workplan drawings (3), Sheet 1 of 3 dtd "Rev 7/29/22" and Sheets 2-3 of 3 both dtd 6/23/22. This permit, issued on October 5, 2022 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization — Bulkhead and Rip Rap 1) The bulkhead and rip rap shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 2) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the approved bulkhead and rip rap alignment. 3) The alignment of the authorized bulkhead and rip rap shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on October 5, 2027 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Phillip Jethro Permit No.107-22 Page 2 of 3 ADDITIONAL CONDITIONS 4) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 5) The bulkhead shall be constructed prior to any backfilling activities. 6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) This permit does not authorize any excavation waterward of the approved alignment. 8) The fill material shall be clean and free of any pollutants except in trace quantities. 9) Unless altered herein, all backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 10) No backfill material is to be placed within 30 feet of the normal water level, except that which will be used to backfill the area behind the permitted bulkhead. 11) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead. 12) The rip rap material shall consist of clean rock or masonry materials such as, but not limited to, granite, marl, or broken concrete with no exposed rebar. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. Sedimentation and Erosion Control 13) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 14) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 15) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 16) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 17) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 18) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. Phillip Jethro Permit No.107-22 Page 3 of 3 ADDITIONAL CONDITIONS NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2021-01020). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of Individual Water Quality Certification No. 005081 and assigned the project DWR Project No. 2022-1056. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. August 3,2022 Phillip Jethro Major Permit Recommendations The applicant proposes to construct 450' of new vinyl bulkheading to replace an existing dilapidated wooden bulkhead. In addition, the applicant proposes to install 80' of riprap waterward of a wetland area as well as along a portion of the proposed bulkhead. The site of the proposed development is located on the south side of the cul-de-sac at the terminus of Williams Drive. It is addressed as 142 Williams Drive (SR 1299), Knotts Island, Currituck County, and is adjacent to a man-made canal on the south and Capsies Creek on the east. The development proposal involves the Public Trust Area (PTA), Estuarine Waters (EW), Estuarine Shoreline (ES) and Coastal Wetland (CW) Areas of Environmental Concern (AEC's). I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 15A NCAC 07H. 0208 Use Standards Paragraph (a) addresses General Use Standards, and sub -paragraph (I ) precludes uses that are not water dependent within the EW and PTA and lists uses that may be considered water dependent. Consistent: The proposed development is consistent with the intent of this rule. Of these, subparagraph (7) Bulkheads pertains to this project, and those subparagraphs not listed are not applicable to this project. Paragraph (7) Bulkheads Subparagraph (7)(A) states, "Bulkhead alignment, for the purpose of shoreline stabilization, shall approximate the location of normal high water or normal water level" Inconsistent: The proposed bulkhead alignment averages W waterward of NWL with a maximum of 14'. Subparagraph (7)(B) states, "Bulkheads shall be constructed landward of coastal wetlands in order to avoid significant adverse impacts to the resources." Consistent: The proposed development is consistent with the intent of this rule. The existing fringe coastal wetlands are sparsely vegetated and filling them would not be considered a significant adverse impact. Subparagraph (7)(C) states, "Bulkhead backfill material shall be obtained from an upland source approved by the Division of Coastal Management pursuant to this Section, or if the bulkhead is a part of a permitted project involving excavation from a non -upland source, the material so obtained may be contained behind the bulkhead." Consistent: The applicants have indicated that clean fill will be used. Subparagraph (7)(D) states, `Bulkheads shall be permitted below normal high water or normal water level only when the following standards are met: (i) the property to be bulkheaded has an identifiable erosion problem, whether it results from natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g. steep grade bank, RECEIVED which will cause the applicant unreasonable hardship under the other provisions of this Rule; Consistent: The property does have an identifiable erosion problem. This section of bulkhead was not maintained and is now remnant. The proposed alignment along the east side of the property, while in the same alignment as the remnant bulkhead, will recover erosion that has occurred over a 14 year period. (iii) the bulkhead alignment will not adversely impact public trust rights or the property of adjacent riparian owners; Consistent: The proposed development is consistent with the intent of this rule. (iv) the need for a bulkhead below normal high water or normal water level is documented by the Division of Coastal Management; Inconsistent: The purpose and need for a bulkhead alignment (with a maximum distance of 14') to reclaim ±14 years of erosion along the Capsies Creek side was not provided. A bulkhead alignment closer to the NWL along the Capsies Creek Shoreline would not prohibit future development on this section of the property (i.e. a single-family dwelling). (v) the property to be bulkheaded is in a nonoceanfront area. Consistent: The proposed development is consistent with the intent of this rule. DATE: August 22, 2022 Consistency Determination: The request is consistent with/not in conflict with the Currituck County 2006 Core Land Use Plan (LUP) certified by the CRC on May 18, 2007, as amended through December 7, 2021. Overview: The 1.76 acre subject property has approximately 200 linear feet of shoreline along Capsies Creek to the east, approximately 255 linear feet of shoreline along a man-made canal to the south, and a combined total of approximately 676 linear feet of shoreline along two (2) interior canals that bisect the property and connect to the manmade canal to the south. Water depths along Capsies Creek and the manmade canal to the south range from .5 foot to 1 foot below Normal Water Level (NWL). Two (2) areas of sparse and emergent Coastal Wetland fringe are located along the Capsies Creek shoreline. A Section 404 wetland is located along the northeast property line, with a portion along Capsies Creek. Site elevations range from 1 to 3 feet above NWL. The site is vegetated with lawn grasses. The subject property is in the AE Floodzone. Existing site improvements consist of a derelict double -wide manufactured house, a small shed and a gravel/soil driveway. Existing shoreline improvements consist of crab shedder tables with associated infrastructure including raised decking and a pump to an interior canal, a boat ramp, seven (7) small docks, 320 feet of remnant bulkhead and riprap consisting of bricks, concrete blocks, and broken up concrete landward of a portion of bulkhead along Capsies Creek. Normal Water Level is currently located 2 feet to 14 feet landward of the remnant bulkhead and a 1.5 foot erosion escarpment has formed along the shoreline. CAMA General Permit#86549A was issued in May of 2022 authorizing 500 linear feet of bulkhead along interior canal shorelines. The permit will expire September 19, 2022. The bulkhead will be installed a minimum of 2 feet waterward, a maximum of 14 feet waterward and an overall average of 6 feet waterward of NWL. The bulkhead will extend south of the Section 404 wetland and along Capsies Creek and tie into bulkhead authorized under the CAMA General Permit. The riprap will have a base of 10 feet and will be installed along the northeast property line just waterward of Section 404 wetlands and the vinyl bulkhead. Riprap will be installed from the upland side of the wetlands with a long reach excavator to prevent crossing or disturbing during installation. The waters of the Capsies Creek in this area are classified as SC and are closed to shellfish taking. Submerged Aquatic Vegetation (SAV) was not present within the waters immediately adjacent to the subject property. There are no known archaeological sites on or near the property. A review of historic resources was not provided. Anticipated impacts resulting from this project are expected to include: the filling of 200 sq. ft. of Coastal Wetland Area of Environmental Concern (AEC) within the Public Trust/Estuarine Waters AEC and 2,152 sq. ft. of Public Trust/Estuarine Waters AEC, and; the disturbance of .26 acre of Estuarine Shoreline AEC. Basis for Determination: The property is located within the "Knotts Island/Gibbs Woods" subarea and is designated as "Limited Service Areas (Areas Preferred for Low Density Development)" on the Currituck County Future Land Use Map (FLUM). Areas of Environmental Concern (AECs) are designated as "Conservation Areas" as indicated on Page 11-1. As indicate on Page 11-1, "(t)he purpose of the Conservation class is to provide for the long-term management and protection of significant, limited, or irreplaceable areas. Proper management is needed to conserve the natural, cultural, recreational, scenic or biologically productive values of these areas. The Conservation class should be applied to areas that should not be developed at all (preserved), or if developed, done so in a very limited manner characterized by careful planning and cautious attention to the conservation of environmental features." Definitions of key words are provided on page 9-2. These words include "Encourage: to favor or foster", "Should: Ought to, if no valid reason not to", and "Support: to shore up, may imply financial support". Land Use Plan policies address the use of vegetated buffers along the shoreline to reduce pollutants and protect water quality. PROJECT SUMMARY: The applicant proposes to construct 450' of new vinyl bulkheading to replace an existing dilapidated wooden bulkhead. In addition, the applicant proposes to install 80' of riprap waterward of a wetland area as well as along a portion of the proposed bulkhead. Proiect Setting The site of the proposed development is located on the south side of the cul-de-sac at the terminus of Williams Drive. It is addressed as 142 Williams Drive (SR 1299), Knotts Island, Currituck County, and is adjacent to a man-made canal on the south and Capsies Creek on the east. The property is ±76,665 ft' in size (±1.76 acres) in size and has elevations that range from ±1' to ±3' above normal water level (NWL). Man-made features on the tract include crab shedder tables & associated infrastructure, raised decking, a derelict double -wide dwelling, a small shed and a gravel/soil driveway. The highground area is vegetated with yard grasses and there are no known archaeological sites on or near the property. The property's shoreline is ±1,131' in length. A man-made canal running west to east is adjacent to the south side of the property. Extending off of this canal in a northerly direction are two separate ±160' long finger canals bisecting the property into separate areas of land. The east side of the property is adjacent to Capsies Creek (also known as Capps Creek). A ±320' remnant bulkhead is located along the shoreline adjacent to the southern canal extending around and along the shoreline adjacent to Capsies Creek NWL is currently located ±2' to ±14' landward of the remnant bulkhead and ±1.5' erosion escarpment has formed. Several areas of riprap consisting of bricks, concrete blocks and broken up concrete are located landward of the remnant bulkhead along the Capsies Creek shoreline. This shoreline also has two separate areas of sparse & emergent coastal wetland fringes (totaling ±200 ft2 ) that consist of Bulrush (Scirpus spp.) growing on shallow shelfs landward of the remnant bulkhead. A delineated USACE 404-wetland is located along the northern property line that extends to the shoreline of Capsies Creek. Additional existing structures along the shoreline include a boat ramp and seven small docks. The adjacent riparian property to north is undeveloped with the majority of the property being coastal and non -coastal wetlands. The adjacent riparian property to the west is vacant and partially cleared and the shoreline has not been hardened. The waters of Capsies Creek are considered Joint Waters, are classified as SC and are closed to shellfish taking. Water depths within the project area range from 0.5' to 1' below NWL and the bottom substrate is made up of fine sands and silt. The canal width at the site is ±60' and the width of Capsies Creek is ±1,050'. Submerged Aquatic Vegetation (SAV) was not present within the waters immediately adjacent to the applicant's property. Note: CAMA General Permit #86549A was issued May 19. 2022 authorizing 500' of bulkheading along the properties interior canal shoreline (see sheet 2 of 3 for location). This permit has an expiration date of September 19, 2022, RECEIVED AUG 0 3 2022 DCM-MHD CITY Phillip Jethro Field Investigation Report Page 3 Development Proposal In order to prevent further erosion to the site and reclaim eroded land, the applicant proposes to construct an additional ±450' of vinyl bulkheading within the approximate alignment of the existing remnant bulkhead. The proposed alignment will be a minimum of 2' waterward of NWL with a maximum distance of ±14' and will have an overall average of ±6' waterward of NWL, Backfill material has been indicated as being clean upland sand. The portion of the bulkhead within the canal will tie into the bulkhead authorized through GP#86549A Along the Capsies Creek shoreline, the bulkhead will angle landward in a northwest direction and terminate at the 404 wetland line that extends to the shoreline. In addition, riprap with a base width of 10' will be installed along the shoreline in the northeast corner of the property. The riprap will begin at the northern property line and extend south and will be placed immediately waterward of the USACE 404-wetlands for±30'. The riprap will then continue on the waterward side of the bulkhead for an additional ±50' (Total riprap length = ±80'). SAV's were not observed to be within the project area. The applicant has indicated that riprap will be installed from the upland side of the wetlands with a long reach excavator to prevent crossing or disturbing wetlands during the installation. Anticipated Impacts • The construction of the bulkhead along the proposed alignment will result in the shallow bottom fill of±1,352 ft' within the Estuarine Waters and Public Trust Area AEC's with clean fill from an upland source. • The construction of the bulkhead along the proposed alignment will result in the placement of ±150.2 cubic yards of fill material below NWL. • The construction of the bulkhead along the proposed alignment will result in the filling of ±200 ft' of a sparse fringe of emergent coastal wetland AEC (totaling ±200 ft' ) consisting of Bulrush (Scirpus spp.). • The installation of the riprap will result in additional shallow bottom fill of ±800 ft' within the Estuarine Waters and Public Trust Area AEC's. • It is anticipated that 450' of bulkhead installation will result in the temporary disturbance of ±11,250 ft' within the Estuarine Shoreline AEC.
