The activity you propose is exempt from needing a minor development permit as long as it meets the conditions specified below. If your plans should change and your project will no longer meet those conditions, please contact me before proceeding. DESCRIPTION OF ACTIVITY AND CONDITIONS: Accessway to Beach (1) The accessway must not exceed six feet in width and must be for private residential or for public access to an ocean beach. This exemption does not apply to accessways for commercial use or for motor -powered vehicular use. (2) The accessway must be constructed so as to make no alterations to the frontal dunes that are not necessary. This means that wherever possible the accessway must be constructed over the frontal dune without any alteration of the dunes. In no case shall the dune be altered so as to significantly diminish its capacity as a protective barrier against flooding and erosion. Driving of pilings into the dune shall not be considered alteration of a frontal dune for the purpose of this rule. The access must be a minimum of 18 inches off of the dune. (3) The accessway shall conform to any applicable local or State building code standards. This letter of exemption is valid for a period of 90 days only. A new letter of exemption will need to be requested if construction is not commenced within that time. Additionally, when and if property is available for sale, I will give you first right of refusal to purchase with closing not to exceed thirty days from date of notification. By signing this agreement below you are indicating complete compliance with my request.
