Permit Class NEW STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission r "for X Major Development in an Area of Environmental Concern pursuant to NCGS I I3A-118 X Excavation and/or filling pursuant to NCGS 113-229 Permit Number 112-22 Issued to Paul Bradley and William Privott, 769 Bells Island Rd., Currituck, NC 27929 Authorizing development in Currituck County at adi. to a man-made canal and Currituck Sound, Bells Island Campground, 769 Bells Is. Rd., in Currituck, as requested in the permittee's application dated 5/13/22, including attached workplan drawings (4), Sheets 1-4 of 4 all dated "Revised 5/13/22". This permit, issued on October 17, 2022 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation rI mese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void. Boat Ramp 1) Unless specifically altered herein, this permit authorizes one concrete boat ramp, as indicated on the attached workplan drawings. 2) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. 3) Placement of fill materials below normal water level shall be limited to the ramp structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Paul Bradley and William Privott ADDITIONAL CONDITIONS Permit No.112-22 Page 2 of 3 4) Excavation, fill and/or ground disturbing activities, associated with the placement of the boat ramp, above and below the normal water line shall be limited to that absolutely necessary to establish adequate ramp slope and provide a ramp no greater in size than specified in the attached permit application and workplan drawings. Shoreline Stabilization — Bulkhead and Rip Rap 5) The bulkhead and rip rap shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 6) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 7) No vegetated wetlands shall be excavated or filled, even temporarily. 8) The alignment of the authorized bulkhead and rip rap shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. 9) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 10) The bulkhead shall be constructed prior to any backfilling activities. 11) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 12) This permit does not authorize any excavation waterward of the approved alignment. 13) The fill material shall be clean and free of any pollutants except in trace quantities. 14) Unless altered herein, all backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 15) No backfill material is to be placed within 30 feet of the normal water level, except that which will be used to backfill the area behind the permitted bulkhead. 16) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead. 17) The rip rap material shall consist of clean rock or masonry materials such as, but not limited to, granite, marl, or broken concrete with no exposed rebar. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. Paul Bradley and William Privott ADDITIONAL CONDITIONS Upland Development Permit No.112-22 Page 3 of 3 18) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the gravel access, all as expressly and specifically set forth in the attached permit application and workplan drawings. Sedimentation and Erosion Control 19) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 20) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 21) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 22) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 23) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 24) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including, but not limited to, any authorizations from the U.S. Army Corps of Engineers. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of Water Quality Certification No. 005003 and assigned the project DWR Project No. 2020-0585 v2. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. The concrete will be poured in place with minimal impact to the existing grade. There are no plans to grade or excavate material associated with construction of the boat ramp. The proposed ramp will utilize existing contour of canal bank. The existing boat ramp concrete wil be removed with long reach excavator prior to the installation of the new bulkhead. The proposed bulkhead and rip -rap will be constructed waterward of the existing bulkhead. Filter cloth will be installed behind new bulkhead and backfilled as needed. A small tractor and dump truck will be used to construct access drive to boat ramp and backfill bulkhead. d. The project site is located at 769 Bells Island Road, Currituck County, adjacent to the Currituck Sound and a connecting man -trade canal The development proposal involves the Public Trust Area (PTA), Estuarine Waters (EW), and Estuarine Shoreline (ES) Areas of Environmental Concern (AFC's). I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows:15A NCAC 07H.0208 Use Standards Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are p not water dependent within the EW and PTA and lists uses that may be considered water LU dependent. w U Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (7) (C) states, "Bulkhead backfill material shall be obtained from an upland source approved by the Division of Coastal Management pursuant to this Section, or if the bulkhead is a part of a permitted project involving excavation from a non -upland source, the material so obtained may be contained behind the bulkhead." Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (7) (D) states, "Bulkheads shall be permitted below normal high water or normal water level only when the following standards are met: (i) the property to be bulkheaded has an identifiable erosion problem, whether it results from natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g. steep grade bank, which will cause the applicant unreasonable hardship under the other provisions of this Rule; Consistent: The proposed development is consistent with the intent of this rule. (ii) the bulkhead alignment extends no further below normal high water or normal water level than necessary to allow recovery of the area eroded in the year prior to the date of application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the unusual geographic or geologic features; Consistent: The proposed development is consistent with the intent of this rule. (iii) the bulkhead alignment will not adversely impact public trust rights or the property of adjacent riparian owners; Consistent: The proposed development is consistent with the intent of this rule. Paragraph (d) (2) states "All development projects, proposals, and designs shall limit the construction of impervious surfaces and areas not allowing natural drainage to only so much as is necessary to service the primary purpose or use for which the lot is to be developed. Impervious surfaces shall not exceed 30 percent of the AEC area of the lot, unless the applicant can demonstrate, through innovative design, that the protection provided by the design would be equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas exceeding the 30 percent impervious surface limitation shall be permitted if impervious areas are not increased and the applicant designs the project to comply with the rule to the maximum extent feasible." Consistent: The proposed development is consistent with the intent of this rule. Paragraph (d) (3) states "All development projects, proposals, and designs shall comply with the following mandatory standards of the North Carolina Sedimentation Pollution Control Act of 1973: (A) All development projects, proposals, and designs shall provide for a buffer zone along the margin of the estuarine water that is sufficient to confine visible siltation within 25 percent of the buffer zone nearest the land disturbing development. DATE: July 7, 2022 Consistency Determination: The request is consistent with/not in conflict with the Currituck County 2006 Core Land Use Plan (LUP) certified by the CRC on May 18, 2007, as amended through December 7, 2021. Overview: The subject property is a 20.29 acre site with approximately 725 linear feet of shoreline along the Currituck Sound and 735 linear feet of shoreline along a manmade canal connecting to the sound to the northeast, and approximately 980 linear feet of shoreline along Coinjock Bay and 400 linear feet of shoreline along a manmade canal connecting to the bay to the southwest. The property is bisected by Bells Island Road. The southwest section of the property consists of undeveloped, vegetated wetlands. Vegetation on the northeast section consists of trees and yard grasses. The property is in the AE Floodzone. The project area is located on the northeastern section of the property, along the manmade canal and the Currituck Sound. Water depths within the project area range from -1 foot to -3.2 feet and average -2.5 feet below Normal Water Level (NWL). The northeast section of the property is developed as a campground. Existing site improvements consist of two (2) single-family houses, a garage, a bathhouse, a tennis court, multiple designated camping areas, and a gravel road. Existing shoreline improvements consist of approximately 725 linear feet of bulkhead, a 100 foot long "L" shaped pier with a 12 foot by 12 foot terminus platform, and a deteriorated boat ramp. All shoreline improvements are located on the Currituck Sound. The corner of the wooden bulkhead where the canal meets the sound has been breached, resulting in erosion up to 23 feet landward of the original bulkhead alignment. Vinyl bulkhead will be located 740 feet along the sound and 110 feet along the manmade canal. The bulkhead alignment along the sound will be 2 feet waterward of the existing bulkhead and will be within the existing bulkhead alignment along the canal. The maximum distance waterward of NWL for the bulkhead alignment will be 25 feet at the corner where the existing bulkhead has failed, for an average distance of 6 feet waterward of NWL. Riprap will be installed immediately waterward of the bulkhead, with a 10 foot wide base and a height of 4 feet. The boat ramp will be located along the manmade canal, approximately 230 feet from the sound. The boat ramp will be poured in a high ground area and, once cured, pushed into place. The boat ramp will extend 20 feet waterward of NWL. Water depths at the end of the ramp will be -3.2 feet below NWL. The gravel road will expand to 14 feet wide at the boat ramp and will taper to 12 feet wide where it will connect to the existing gravel road. As indicated in the application, the boat ramp will be for the use of Bells Island Campground guests. The waters of the Currituck Sound in this area are classified as SC and Joint Waters and are closed to shellfish taking. No submerged aquatic vegetation was observed growing at the project site. A review of historic, cultural or archaeological resources was not provided. Anticipated impacts resulting from this project are expected to include: the filling of .32 acre of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC), 956 sq. ft. of High Ground within the Estuarine Shoreline AEC, and the disturbance of .39 acre of High Ground within the Estuarine Shoreline AEC. Basis for Determination: The site is designated as "Limited Service Areas" on the Currituck County Future Land Use Map (FLUM); with Areas of Environmental Concern (AECs) also designated as "Conservation Areas" as indicated on Page 11-1. The site is within the "Courthouse" subarea. As indicated on Page 11-1, the purpose of the Conservation designation is to provide for the long- term management and protection of significant, limited, or irreplaceable areas. Proper management is needed to conserve the natural, cultural, recreational, scenic or biologically productive values of these areas. The designation is applied to areas that should not be developed at all (preserved), or if developed, done so in a very limited manner characterized by careful planning and cautious attention to the conservation of environmental features. As indicated on Page 11-2, the standards of the Conservation class shall be applied in accordance with the site specific information made available during special studies and/or the land development process. Definitions of key words are provided on page 9-2. Bells Island Campground Field Investigation Report Page 2 Project Setting The site of the proposed development is located at 769 Bells Island Road, Currituck County, adjacent to the Currituck Sound and a connecting man-made canal. The proposed project is within Bells Island Campground located near the southern end of Bells Island. This property is split into two sections by Bells Island Road (SR1245) which runs down the middle of the property. The western side of the property is undeveloped, mostly vegetated with wetlands and has t1380' of shoreline adjacent to Coinjock Bay. The east side of the property contains the campground and has t 1,450' of shoreline, half of which has been hardened by an aging wooden bulkhead. Over several years of storm damages, the northeast corner of the bulkhead where the mouth of the man-made canal begins the bulkhead has been breached. This breached area has resulted in erosion up to 23' landward of the original bulkhead alignment. The other half of the shoreline remains unhardened and is adjacent to a manmade canal which leads to the Currituck Sound. In total the parcel is 20.29 acres in size. As of now, the property contains a gravel path, a tennis court, 2 residential homes, a garage, multiple designated camping areas, a bath house, 1 L shaped pier & platform, anc a deteriorated boat ramp. According to the USDA's Natural Resources Conservation Services' Web Soil Survey, the majority of the soil along the shoreline where the proposed work is to be completed is made up of Dragston loamy fine sand. The adjacent riparian property to the northwest is contains a single family dwelling with a bulkheaded shoreline. The adjacent riparian property to the southeast appears to be a commercial fishing operation with 2 large work sheds, a 330' pier, and a riprap shoreline. The location of the proposed work is within Currituck Sound leading into a man-made canal which connects to the Currituck Sound and is classified as Joint waters by agreement with the Marine Fisheries Commission and Wildlife Resources Commission. The Division of Environmental Management's water quality classification for this area is SC and it is closed to shellfish taking. Water depths within the project site range from -1' to -3.2' and average - 2.5'. The bottom substrate within the project area is made up of muddy sand. Patches of rooted milfoil were observed growing within the project area. Submerged aquatic vegetation, as per DMF's definition, was not observed at the project location. No wetlands were observed at or near the project site. RECEIVED Development Proposal JUN 0 9 202Z The applicant proposes to remove an existing deteriorated boat ramp located along the.,,M-MHD southeastern shoreline of the property adjacent to the Currituck sound and relocated it along the canal shoreline to the northwest. The proposed boat ramp will be a new 14' wide and 34' long concrete boat ramp. The boat ramp will be placed in the man-made canal facing north northwest and will extend 20' waterward of NWL. The canal in this area is 40' wide. No excavation is proposed with this project. The ramp will be poured in a high ground area and once the concrete has cured, the ramp will be pushed into place. The water depth at the end of the proposed ramp is -3.2' measured from NWL. Bells Island Campground Field Investigation Report Page 3 In addition to the construction of the boat ramp, the applicant proposes to construct a gravel access connecting the existing gravel driveway to the proposed boat ramp. The access will be ±60' long and 12' wide. The width of the proposed gravel access way will flair out on the north side to 14' to match the width of proposed boat ramp. Lastly, the applicant proposes to replace 850' of an aging wooded bulkhead with a new vinyl bulkhead. The replacement bulkhead will begin on the southern side of the property and continue in a north-western direction following the alignment of the existing wood bulkhead ±740' before turning 90' southwest into a manmade canal for 50', then turn 90' towards the shore for 20', and lastly the alignment will turn 900 back paralleling the shoreline for the remaining 40'. The sound side of the replacement bulkheads alignment will be 2' waterward of the existing bulkhead alignment. This alignment will close off the existing boat ramp located on the property which is 14' wide. Once the replacement bulkhead reaches the man-made canal the bulkhead will be located in the existing bulkheads footprint. The proposed bulkhead maximum distance waterward is 25' measured from of NWL and is located at the north east corner of the property where the bulkhead has failed. The average distance waterward in this area is 6'. Immediately adjacent to the replacement bulkhead the applicant proposes to install 850' of riprap. The riprap will be 4' high and have a maximum base of 10' wide. The 20 acre parcel is the location of the Bells Island Campground. There is currently 850 linear feet of bulkhead on the property shoreline, an a existing 100 foot pier with a 12'02' platform and a boat ramp located on the south east corner of the property located on the Currituck Sound. The CAMA major permit application is a request to remove an existing boat ramp on the east side of the property and replace it with another boat ramp located on an existing canal on the north property boundary. The existing concrete boat ramp will be removed with a long reach excavator prior to the construction of the new bulkhead. Once the concrete is removed the new bulkhead and rip -rap will be installed to protect the shoreline from additional erosion. The proposed boat ramp location on the north side of the property is an existing sloped natural soil and sand shore that was and has been historically used for water access, fishing, and kayak/canoe launching. The sloped area is to be modified from sloped natural soil/sand to a sloped concrete area to access the water with boats, kayaks, and canoes. In addition, 850 linear feet of new bulkhead will replace the existing bulkhead that has failed in several locations. The owner is also proposing to install 850 linear feet of rip -rap waterward of the new bulkhead. The proposed rip -rap will have a base of 10 feet and match the height of the new bulkhead. The existing bulkhead damage and loss of backfill is from storm damage that has occurred over several years. The new bulkhead and rip -rap should provide additional protection of the campground shoreline. This described modification of the boat ramp location does not in any way modify an existing campground, Bells Island Campground in a manner that would, "increase the nonconformity with respect to the number of campsites that existed on January 1, 2013" as described in the 2013 LIDO Section 8.2.6 under Subsection (A)(5) of the General Standards existing campgrounds. Further, this modification does not increase the longevity of the nonconformance in any way and is not relevant in any way to the nonconformance. In no way do we feel that this sets a new precedence It only reflects the intent of the 2013 Currituck LIDO as written. The modified water access will provide improved water access on a manmade canal located on the north side of the property for the use the Bells Island Campground guests. The existing boat ramp to be removed is located in an exposed area on the west side of the Currituck Sound that receives wind and waves from multiple directions making this a boat ramp unsafe and difficult to use. The additional boat ramp on the manmade canal will provide a safe location for launching boats into the adjacent Currituck Sound. The base of the water access will be concrete, and the gravel access drive will connect to the existing gravel drive in the campground. It was received complete May 31, 2022, and appears to be adequate for processing at this time. The projected deadline for making a decision is August 14, 2022. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. If this agency does not render a permit decision within 70 days from May 31, 2022, you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant.
