The activity you propose is exempt from needing a minor development permit as long as it meets the conditions specified below. If your plans should change and your project will no longer meet those conditions, please contact me before proceeding. DESCRIPTION OF ACTIVITY AND CONDITIONS: Sand fencine at 480 East 3rd Street (1) The individual fence sections should not exceed ten(10) feet in length and should be placed at least seven(7) feet apart (parallel to each other). Placement of fencing must be at least 45 degrees to the shoreline, facing the predominate wind direction. (2) The sand fencing should consist of evenly spaced wooden slats wired together and supported by wooden posts(2x4). (3) The sand fencing should be placed as far landward as possible, but not on top of the dune. Also the sand fencing must be anchored within 1 foot of the toe of the dune. (4) The sand fencing must be constructed so as to make no alterations to the frontal dunes or be detrimental to vegetation of the dunes. (5) See the attached diagram for assistance. This letter of exemption is valid for a period of 90 days only. A new aplication will need to be submitted if construction is not commenced within that time. The activity you propose is exempt from needing a minor development permit as long as it meets the conditions specified below. If your plans should change and your project will no longer meet those conditions, please contact me before proceeding. DESCRIPTION OF ACTIVITY AND CONDITIONS: Accessway to Beach (1) The accessway must not exceed six feet in width and must be for private residential or for public access to an ocean beach. This exemption does not apply to accessways for commercial use or for motor -powered vehicular use. (2) The accessway must be constructed so as to make no alterations to the frontal dunes that are not necessary. This means that wherever possible the accessway must be constructed over the frontal dune without any alteration of the dunes. In no case shall the dune be altered so as to significantly diminish its capacity as a protective barrier against flooding and erosion. Driving of pilings into the dune shall not be considered alteration of a frontal dune for the purpose of this rule. The access must be a minimum of 18 inches off of the dune. (3) The accessway shall conform to any applicable local or State building code standards. This letter of exemption is valid for a period of 90 days only.
