Skvarla, III Secretary This letter of refinement is in reference to the April 29, 2014 email correspondence from you, requesting.a modification of Major CAMA Permit No. 72-10 issued to Core Creek Land Company, Inc. on June 18, 2010. Permit No. 72-10 authorizes a 10-slip docking facility, boat ramp, maintenance excavation and shoreline stabilization on Core Creek Land Company, Inc property located 329 Core Creek road, near Beaufort, on or near Core Creek in Carteret County, North Carolina. Your request to reconfigure the permitted 10-slip docking facility within the existing footprint and basin as shown.on drawings dated 'RECEIVED" by the Division of Coastal Management on April 25, 2014 is hereby authorized. Please be advised that this docking facility is authorized for a maximum of ten (10) boat slips or docking spaces. Docking shall only occur within the designated docking spaces as described in the aforementioned drawing and at no time should there be more than ten vessels docked at this facility to prevent closure of adjacent open shellfish waters. This letter does not change the number of slips or docking spaces authorized under State Permit No. 72-10 or alter any conditions on the permit. All permit conditions including the extended June 7, 2015 expiration date still apply and remain unchanged. Please attach this. letter and the attached drawing to the permit file to allow Division staff to review when they are monitoring the project. Thank you for your time and cooperation in this matter. Skvarla, III Secretary Please find e-mail correspondence enclosed dated April 29, 2014 from Mr. Richard Collette requesting a permit modification. State Permit #72-10 was issued on June 18, 2010 for the construction of a 10-slip docking facility, boat ramp, maintenance excavation and shoreline stabilization within Core Creek adjacent to 329 Core Creek Road near Beaufort, in Carteret County. The permit expires on June 7, 2015. The request is to reconfigure the permitted 10-slip docking facility within the existing basin. This proposal will remain within the permitted incorporated footprint of the docking facility. Enclosed correspondence from the Shellfish Sanitation section of the NCDMF offers approval of the reconfiguration provided that it does not cause a closure of these Conditionally Approved waters (ref. April 30, 2014 email from Mr. Shannon Jenkins). The Morehead City District staff would recommend issuing this refinement to State Permit #72-10. However, based on the Shellfish Sanitation section's comments, it should be emphasized again to the applicant that this docking facility is strictly authorized for a maximum of ten boat slips and that at no time should more than ten vessels be docked at this facility in order to avoid a closure of open shellfish waters. With that said, we'd like to reiterate that dockage should only occur in the designated spaces, and if more than 10 boats dock at the facility it would be considered a marina and we would have to reclassify the waters to prohibited to shellfishing. The 4 slips of side to dockage on the north side of the basin is rather long at 170', (in fact all the slips are larger in size) but I believe I recall the facility is going to be used by larger vessels. I might recommend designating those four side to slips by painting slip #'s on the dock to avoid any "over docking" there in the future. The name on the permit should be Core Creek Marine Park, LLC if possible. I would like to include permission to maintain the area alongside the Army Corps of engineers ditch within the 30 ft. setback area. I also would like to get an extension of the permit as it now expires July 15, 2015. Thank you for considering this request, w, Richard Collette
