1. All proposed development and associated construction must be done in accordance with the permitted
work plat drawing(s) submitted on: 11/14/02
2. All construction must conform to the NC Building Code requirements and all other local, State and
Federal regulations.
3. Any change or changes in the plans for development, construction, or land use activities will require re-
evaluation and modification of this permit.
4. All development projects, proposals, and designs shall limit the construction of impervious surfaces and
areas not allowing natural drainage to only so much as is necessary to adequately service the major
purpose of use for which the lot is to developed.
Impervious surfaces shall not exceed 30% of the AEC area of the lot, unless the applicant can effectively
demonstrate, through innovative design by an engineer, that the protection provided by the design would
be equal to or exceed the protection by the 30% limitation.
5. Before the final inspection, the designing engineer must certify that the stormwater system was inspected
and installed as designed.
6. No impermeable surfaces shall be allowed over any functional part of the septic tank system.
7. All unconsolidated material resulting from associated grading and landscaping shall be retained on site by
effective sedimentation and erosion control measures.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
From the date of an appeal, any work conducted under this per-
mit m.st cease until the appeal is resolved.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
Any maintenance work or project modifications not covered
under this permit requires further written permit approval.

8. All disturbed areas shall be vegetatively planted and mulched within 30 days of construction completion.
9. Pursuant to 15 NCAC, Subchapter 7.1 .0406(b), this permit may not be assigned, transferred, or
otherwise disposed of to a third party.
10. Prior to initiating any land disturbing activities, a barrier line of filter cloth or burlap must be installed
between the land disturbing activity and the adjacent marsh, until such time as the areas have properly
stabilized with a vegetated cover.
11. Stormwater disposal Ordinance must be complied with.
12. Development over existing impervious surfaces, provided that the existing imperious surface is not increased and
the applicant designs the project to comply with the intent of the rules to the maximum extent feasible.

I acknowledge that the land owner is aware that the proposed development is planned for an area which may
be susceptible to erosion and/or flooding. I acknowledge that the local permit officer has explained to me the
particular hazard problems associated with this lot. This explanation was accompanied by recommendations
concerning stabilization and floodproofing techniques.
PERMISSION TO ENTER ON LAND
I furthermore certify that I am authorized to grant and do in fact grant permission to the local permit officer
and his agents to enter on the aforementioned lands in connection with evaluating information related to this
permit application.
This application includes: general information (this form), a site drawing as described on the back of this application,
the ownership statement, the AEC hazard notice where necessary, a check for $100.00 made payable to the locality,
and any information as may be provided orally by the applicant. The details of the application as described by these

AEC HAZARD NOTICE

This notice is intended to make you, the applicant, aware
of the special risks and conditions associated with
development in this area, which is subjec to natural
hazards such as storms, erosion and currents. The rules of
the Coastal Resources Commission require that you
receive an AEC Hazard Notice and acknowledge that
notice in writing before a permit for development can be
issued.
The Commission's rules on building standards, oceanfront
setbacks and dune alteration are designed to minimize, but
not eliminate, property loss from hazards. By granting
permits, the Coastal Resources Commission does not
guarantee the safety of the developmeet and assumes no
liability for future damage to the development.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual ocean
erosion rate for the area where your property is located is
feet per year.
The rate was established by careful analysis of aerial
photographs of the coastline taken over the past 50 years.
Studies also indicate that the shoreline could move as
much as /,a.a_ feet landward in a major storm.
The flood waters in a major storm are predicted to be about
1F feet deep in this area.
Preferred oceanfront protection measures are beach
nourishment and relocation of threatened structures.
Hard erosion control structures such as bulkheads,
seawalls, revetments, groins, jetties and breakwaters are
prohibited. Temporary devices, including sand bags, may
De allowed under certain conditions.
This structure shall be relocated or dismantled within two
years of becoming imminently threatened.
The applicant must acknowledge this information and
requirements by signing this notice in the below space.
Without the proper signature, the application will not be
complete.

SPECIAL NOTE: This hazard notice is required for
development in areas subject to sudden and massive
storms and erosion. Permits issued for develop ment in this
area expire on December 31 of the third year following the
year in which the permit was issued. Shortly before work
begins on the project site, the Local Permit Officer will
determine the vegetation line and setback distance at your
site. If the property has seen little change and the proposed
development can still meet the setback requirement, the
LPO will inform you that you may begin work. It is impor-
tant that you check with the LPO before the permit expires
for official approval to continue the work after the permit
has e�cpired. Generally, if foundation pilings have been
placed and substantial progress is continuing, permit
renewal may not be necessary. If substantial progress has
not been made, the permit must be renewed and a new
setback line established. It is unlawful to continue work
after permit expiration without this approval.

In our weekly review of the Minor Permits issued by our LPOs, I noticed that on your Permit 02-0007 to James
Gordon & Mary Murray you did not note the AEC in the first paragraph. It should read as follows:
Issued to James Gordon & Mary Murray, authorizing development in the Estuarine Shoreline Area of
icrivironmental Concern at 305 40th Street, Sunset Beach as requested in the permittee's application....
Also, in the "box" area on the permit face it is important to put a sentence or two spelling out exactly what it is
you're permitting. Such as - This permit authorizes the construction of a 2000 square foot single family
residence, split driveway, and septic system. This becomes so important when the applicant asks for something
that you cannot permit or else are not authorizing through the Minor Permit. Sometimes they show a bulkhead
or dock on the drawing with their house and lot development. In those instances, add a sentence at the top that
says: This permit does not authorize the bulkhead or the dock that is shown on the plan drawings. Contact the
Division of Coastal Management, Wilmington Office for the proper permit.
I would also recommend that the applicant sign and date the second page of conditions. This keeps them from
saying later that they never received or read a second page.
