This permit, issued on is subject to compliance with the application and site drawing (where consistent
with the permit), all applicable regulations and special conditions and notes setforth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.

Permit Number
Construction Standards, Chapter 37, Volume I or Chapter 41, Volume IIV and the Local Flood
Damage Prevention Ordinance as required by the Nation Flood Insurance Program. If any provisions
of the building code or a flood damage prevention ordinance is inconsistent with any of the
following AEC standards, the more restrictive provision shall control.
(2) The structure must be set back 60 feet from the first line of stable natural vegetation.
(3) The structure must be located entirely off of the frontal dune, and if a primary dune is present,
behind the crest of the primary dune.
(4) Only residential structure of four (4) units or less, or non residential structures of less than 5, 000
square feet total floor area, shall be allowed.
(5) All pilings with the Ocean Hazard Area shall have a tip penetration of at least five feet (5') below
mean sea level or sixteen feet (16;) below average original grade, whichever is least.
(6) No impermeable surfaces shall be allowed over any functional part of the septic tank system.
(7) Dune disturbances will be allowed only to the extent necessary for development and if the dune's
protective value is not weakened or reduced. Disturbed areas will be immediately stabilized.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
From the date of an appeal, any work conducted under this per-
mit m..st cease until the appeal is resolved.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
Any maintenance work or project modifications not covered
under this permit requires further written permit approval.
All work must cease when this permit expires on December
In issuing this permit it is agreed that this project is consistent
with the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another parry without
the written approval of the Division of Coastal Management.

(8) Sand used to strengthen dunes must be brought in from an outside source and must be of the same
nature as the sand in the area in which it is to be placed. No sand is to be removed from the lot.
(9) Sand held in storage in any dune, other than frontal or primary dunes, may be moved laterally in order
to strengthen existing primary or frontal dunes if the work would enhance the protection to the
proposed development activity and the sand is immediately stabilized.
(10) Minimum lot size shall be 15, 000 square feet for each commercial or residential unit for all parcels of
land subdivided or created after July 23, 1981. A duplex can only be constructed on a lot at least
30,000 square feet in area, a triplex on 45,000 quare feet, and a quadraplex on 60,000 square feet.
(11) Traditional public access ways shall not be eliminated or restricted.
(12) This permit may be renewed for one (1) year if requested before the expiration date.
(13) The permittee is required to contact the Local Permit Officer shortly before the plans to begin
construction to arrange a setback measurement which will be effective for sixty (60) days barring a
major shoreline change. Construction must begin within sixty (60) days of the determination or the
measurement is void and must be redone.
(14) All proposed development and associated construction must be done in accordance with the permitted
work plat drawing(s) submitted on July 6, 2000.
(15) Any change or changes in the plans for development, construction, or land use activities will require
reevaluation and modification of this permit.
(16) All development projects, proposals, and designs shall limit the construction of impervious surfaces and
areas not allowing natural drainage to only so much as is necessary to adequately service the major
purpose of use for which the lot is to be developed. Impervious surfaces shall not exceed 30% of AEC
area of the lot, unless the applicant can effectively demonstrate, through innovative design by an
engineer, that the protection provided by the design would be equal to or exceed the protection by the
30% limitation.
(17) Before the final inspection, the designing engineer must certify that the stormwater system was
inspected and installed as designed.
(18) Prior to any land disturbing activities, a barrier line of filter cloth or burlap must be installed between
the land disturbing activity and the adjacent marsh, until such time as the areas have been properly
stabilized with a vegetated cover.
(19) All development must be consistent with the NC Building Code and all other applicable Federal, State,
and Local standards.
(20) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently
threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled
within two (2) years of the time when it becomes imminently threatened, in any case upon its collapse
or subsidence. However, if natural shoreline recovery or beach re -nourishment takes place within two
(2) years of the time the structure becomes imminently threatened, so that the structure is not long
imminently threatened, then it need not be relocated or dismantled at that time. This condition shall
not affect the permit holder's right to seek authorization of temporary protective measures allowed
under CRC rules.
(21) A maximum of 500 square foot of elevated decks are permitted within the 60 foot setback area in Inlet
Hazard; however, the structure must be self supporting and free standing from the p 'mary residence.

be susceptible to erosion and/or flooding. I acknowledge that the local permit officer has explained to me the

Pursuant to NCGS 113A-119 (b), the Town of Sunset Beach, a locality authorized to issue
LAMA permits in Areas of Environmental Concern; hereby gives NOTICE that on the 1 lth day of
December, 2002 Paul&Kathryn Spanos applied for a CAMA Minor permit to add a second story to
the existing structure and also add ten foot independently supported towards the street side of
property. At 424 Dolphin Street, in Sunset Beach. The application may be inspected at the address
below.
Public comments received by February, 19 2003 will be considered. Later comments will be
accepted and considered up to the time of permit decision. Project modifications may occur based
on further review and comments. Notice of the permit decision in this matter will be provided
upon written request.

In processing your CAMA application I found that your site drawing does not include the CAMA setback line
and the Area of Environmental Concern. The AEC is calculated by multiplying the lot width by 75 feet. In your case
it would be 50x75 equals 3,750 sq. R Only 30% of the AEC may be covered with impervious structures. If more than
30% is covered you must have an engineer prepare a plan to control the additional storm water ran off for the amount
over the 30%. You are required to make your calculation worksheet a part of your application.
The letters signed by the adjacent property owners must be on file as part of your application.
I wanted to take this time to make you aware that you must submit your proposed plan to the Brunswick
County Health Department for an existing system check. You are required to make a copy of your system check
approval as part of your application.
It appears that your existing covered porch on the front of your house extends into the required from setback
Your survey does not indicate the backyard set back from your bulkhead
Your house also has a bathroom located below the base flood elevation. I am enclosing a portion of the
original building permit for your home in which the Building Inspector made a list of prohibited fixtures beneath the
fast floor available to the original owner. Since this time the bathroom has been installed in violation of the Flood
Ordinance. This will have to be removed
Since there area number of issues to be addressed I am returning your check in the amount of $100.00 until
you return the items necessary to complete your application.
