Upland Development
1) Unless specifically altered herein, this permit authorizes only the land disturbing activities associated
with the construction of the authorized lift station and force main to serve the National Park Service
facility at the eastern end of Harkers Island, including all associated grading and filling, all as
expressly and specifically set forth in the permit application and depicted on the attached work -plat
drawings. Any additional land disturbing activities and/or construction shall be evaluated on a case -
by -case basis by a representative of the Division of Coastal Management (DCM) to determine
additional permit requirements. Contact a representative of the Division at (252) 808-2808 prior to
the commencement of any such activity for this determination.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2018
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
EROSION & SEDIMENTATION CONTROL
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this
plan to the Department of Environment and Natural Resources, Division of Energy, Mineral and
Land Resources, Land Quality Section, 127 Cardinal Drive. Extension, Wilmington, NC 28405.
2) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
3) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).
4) A ground cover sufficient to restrain erosion shall be provided within the shorter of 15 working or 30
calendar days of completion of any phase of grading on cut or filled slopes.

5) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
6) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including but not limited to any required
encroachment or right-of-way agreements required from the N.C. Department of Transportation,
any required stormwater management permits from the Division of Energy; Mineral and Land
Resources, or any required sewer transmission line permits.
NOTE: Future development of the permittee's property may require a modificationof this permit.

Drinking water is supplied by the Harkers Island Water System, a division of the Carteret -Craven Electric Cooperative.

There are currently no storm water management or treatment systems on the site.
5. Activities and Impacts

The project includes a lift station to pump wastewater from the existing facility to an existing wastewater treatment facitlity on
Harkers Island. The existing septic tanks on the site are failing and the National Park Service wishes to have a long tens
solution to their wastewater needs. The force main will run approximately 12,597 linear feet mainly along Island Road to the
lift station at the West Bay subdivision.
c.
Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type
of equipment and where it is to be stored.
The lift station will be constructed using standard construction equipment including bull dozers and graders. Construction
methods to be used for force main installation will be open trench, bore and jack and horizontal directional drilling installation
primarily in the NCDOT rights -of -way. Encroachment agreements have been applied for construction within the NCDOT
rights -of -way including Island Drive, Guthrie Drive, Fulford Street, Middle Street, and Old Ferry Dock Road.

Development activities include the installation of a 6' interior diameter lift station and associated appurtenances and 12,597
linear feet of 4" PVC and ductile iron pipe.

The project includes a lift station to pump wastewater from the existing facility to an existing wastewater treatment tactility on
Harkers Island. The existing septic tanks on the site are failing and the National Park Service wishes to have a long term
solution to their wastewater needs. The force main will run approximately 12,597 linear feet mainly along Island Road to the
lift station at the West Bay subdivision.
c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type
of equipment and where it is to be stored. -
The lift station will be constructed using standard construction equipment including bull dozers and graders. Construction
methods to be used for force main installation will be open trench, bore and jack and horizontal directional drilling installation
primarily in the NCDOT rights -of -way. Encroachment agreements have been applied for construction within the NCDOT
rights -of -way including Island Drive, Guthrie Drive, Fulford Street, Middle Street, and Old Ferry Dock Road.

Development activities include the installation of a 6' interior diameter lift station and associated appurtenances and 12,597
linear feet of 4" PVC and ductile iron pipe.

The following are the comments and recommendations regarding the aforementioned proposal. The
proposal is consistent with NCAC 7H .0208 use standards for the Coastal Shoreline AEC. Based on'these
factors, it is recommended that the applicant be authorized to install a sewer pump lift station and install
sewer lines and force mains as proposed, contingent upon the standard permit conditions and the following
specific conditions for this project:
Any boring beneath coastal wetlands would require authorization under Section 10 of the Rivers
and Harbors Act from the USACE prior to commencing work.
2. This permit does not authorize the interference with any existing or proposed Federal project, and
the permittee shall not be entitled to compensation for damage to the authorized structure or work,
or injury that may be caused from existing or future operations undertaken by the United States in
the public interest.
3. Appropriate sedimentation and erosion control devices, measures or structures shall be
implemented to ensure that eroded materials resulting from the excavation of the estuarine
shoreline for the directional boring drilling site or the lift station site do not enter adjacent wetlands,
watercourses and property (e.g. silt fence, diversion swales or berms, etc.).
All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain
erosion within thirty days of project completion.
5. No Coastal Wetlands or non -coastal wetlands shall be excavated or filled, even temporarily.
6. The Erosion and Sediment Control permit, Encroachment Agreements with the NCDOT, and the Sewer
Transmission Line permit must be obtained prior to commencing work.

Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located at 1800 Island
Drive Road in Harkers Island, NC. Our comments are provided in accordance with provisions of the
Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, and the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to construct a lift station and force main to service the National Parks Service
facility at the eastern end of the island. Approximately 12,597' of 4" PVC will be trenched in the NCDOT
right of way. A wetland crossing is proposed to be directionally bored. Sewage will be pumped to the
West Bay Wastewater Treatment facility located at West Bay Circle on Harkers Island.
The NCWRC has reviewed the permit application and does not object to permit issuance since the
wetland crossing will be directionally bored. We do request that if sewer service is expanded to areas
other than the National Park Service, that any development utilizes recommendations from our
publication, Guidance Memorandum to Address and Mitigate Secondary and Cumulative Impacts to

9. Project Description
The proposed lift station would be located on the southwest comer of a 2.17 acre, vacant,
undeveloped tract owned by the National Park Service (NPS) on Cape Point Drive. To find
this site, travel to Harkers Island and follow Island Road (SR1335) to the east end of Harkers
Island. Near the end Island Road, turn left (north) onto Cape Point Drive and travel
approximately 630 feet. The site is located at the intersection of Cape Point Drive and
Charles Street, east of Cape Point Drive and north of Charles Street. The 4' PVC force main
piping would be installed from the lift station site on the west ROW of Cape Point Dr, back to
the Island Rd. The piping would then be installed on the south ROW of Island Rd. Turn right
and travel west on Island Rd approximately 2 miles to Guthrie Dr. Turn right onto Guthrie Dr
(piping installed on the west ROW) and travel north approximately 630 feet to Fulford Dr.
Turn left (west) onto Fulford Dr and travel approximately 380 feet to Middle St. Turn left
(west) onto Middle St and travel west approximately 315 feet to Old Ferry Dock Rd. Turn right
(north) onto Old Ferry Dock Rd and travel approximately 330 feet north to the entrance of the
West Bay Wastewater Treatment facility.
The lift station site off Cape Point Dr. is located outside (landward) of the Estuarine Shoreline
(ES) 575' Oustanding Resource Water (ORW) Area of Environmental Concern (AEC). The
project site is predominately maritime forest vegetation consisting of mixed pine, hardwoods,
and underbrush. The topography is relatively flat with an elevation of +5' NAVD88.
The force main is located within the NCDOT Rights -of -Way and almost entirely within the ES
ORW AEC. This area is comprised mostly of lawn grasses, paved surfaces, woody
perennials and maritime forest. The elevation varies along the force main route from
approximately +1 NAVD88 to approximately +11 NAVD88. The installation of the force main
would be open trench, bore and jack, and horizontal drilling. There is a location of the south
side of Island Road, approximately 1,500 feet west of Cape Point Dr. where the force main
may have to be bored beneath coastal wetlands. The wetlands consist of Salt Meadow Hay
(Spartina patens) and are located in a transitional zone to high ground. The landward extent
of the coastal wetlands is located approximately 18r20' feet from the edge of the existing
pavement. There appears to be sufficient high ground for the trench construction between the
wetlands and the pavement; however, circumstances might still require a directional bore
beneath the coastal wetlands, This is the closest extent of the force main to the normal high
water of Back Sound at approximately 44' feet. Along the force main route, the land uses are
mixed among residential and commercial properties abutting the NCDOT Rights -of -Way.
The waters of Back Sound adjacent to the project areas are classified as "SA, ORW" by the
Division of Water Resources. There are no nearby Primary Nursery Areas. According to the
maps provided by the Shellfish Sanitation Section of the NC Division of Marine Fisheries, the
waters are predominately open to shellfish harvesting adjacent to the proposed project.
Closed shellfish harvesting areas in vicinity of project are NPS boat basin; Calico Jacks
Marina; Barbours Harbor Marina; and Harkers Island Fishing Center according to the
Section's maps.

There is no development proposed within navigable waters and there are no know historic or
archaeological areas of value known within the project sites.
Proposed Project
The applicant is proposing to construct and install a lift station and force main to service the
Cape Lookout National Park Service (NPS). This sewer service is requested to replace failing
on -site septic tank systems according to the applicant and to provide service to the new
restrooms currently under construction at the NPS facility. The permit request would be for
the construction of the lift station and approximately 12,597 linear feet of 4" PVC force main.
The lift station would be located outside, or landward of the Estuarine Shoreline ORW 575'
Area of Environmental Concern. The lift station would pump wastewater from the NPS to the
West Bay Wastewater Treatment Facility located on West Bay Circle, Harkers Island. The
force main would be installed within the NCDOT's Rights -of -Way and discharge into the
equalization tank at the West Bay Treatment Facility.
The project involves the construction of a 6' interior diameter wet -well and lift station with
duplex wastewater pumps. The project would include the installation of two sewer services on
the NPS property. The services are duplex grinder low pressure sewer units that pump
through approximately 881 linear feet of 2" force main directly to the lift station. The duplex
grinders would be located approximately 150' feet from normal high water on the NPS
property.
10. Anticipated Impacts:
The proposed development would result in the disturbance of approximately 2.97 acres
(129,373 sf) for both the lift station and force main. At the wetland crossing on the south side
of Island Road, the piping would be bored using a trenchless hydraulic boring machine so
there would be no impacts to wetlands. A bore pit would be constructed on one side of the
wetlands and the pipe pulled at least 3' beneath the substrate. Roads and paved driveways
would also be bored using the same methodology. Trenching for the force main would be with
a 2' wide bucket on a backhoe or a 6" trencher depending upon the location and existence of
other installed utilities in the area and excavated to a depth of 36" inches below the grade
level. Total disturbed area for the trencher and backhoe would be a 10' wide work corridor for
the length of the force main.
The applicant reports they have submitted an Erosion and Sediment Control plan to
NCDEMLR; applied for Encroachment Agreements with the NCDOT; and reports that the
Sewer Transmission Line permit has been applied for and is currently being processed.

We have revised the CAMA Major Permit package for the National Park Service Lift Station & Force
Main on behalf of the Harkers Island Sewer Company, LLC per your email of May 21, 2015. The
National Park Service is currently finalizing the easement agreement with Harkers Island Sewer
Company, LLC. Once this is completed, we will provide it to your office The following revisions have
been made:
1. DCM Form MP-1 has been revised per your email;
2. DCM Form MP-3 has been revised per your email;
3. The project narrative has been revised per your email;
4. We have included two additional drawings: a 404 crossing profile and trench section.
Also, we have sent via Certified Mail the CAMA package to the three adjacent property owners. Once
we receive all three green cards, we will submit them to your office. The NCDOT is currently reviewing
the encroachment agreement for construction within the right-of-way and we will submit that permit once
it is completed. The sewer transmission line permit has been submitted and is currently in the permit
process. We expect this permit to take the longest. Once we have received this permit, we will submit it

The Cape Lookout National Park Service (NPS) Lift Station & Force Main for Harkers Island
Sewer Company, LLC will provide sewer service to the facility located on the eastern end of
Harkers Island in Carteret County. The NPS has begun providing ferry services for visitors to
Cape Lookout and is expecting an increase in visitors to the facility. Additional bathroom
facilities are being developed for visitor use on the Harkers Island site. Collection of the
wastewater from the NPS office building and associated bathroom facilities will be conveyed by
two low pressure sewer to the lift station. A permit is requested for construction of a lift station
and approximate 12,597 linear foot 4" PVC force main to serve the Cape Lookout National
Seashore Facility at the east end of Harkers Island in Carteret County, North Carolina. The lift
station will be located outside of the 575' AEC line. Sewage disposal at the site is currently by
septic tanks which are failing. The lift station will pump wastewater from the NPS to the West
Bay Wastewater Treatment Facility located on West Bay Circle, Harkers Island within the North
Carolina Department of Transportation's right-of-way. The force main will discharge into the
equalization tank of the West Bay Treatment Facility.

The National Park Service facility includes offices, a visitor's museum, ferry service, and
recreational areas. Based on visitation data provided by Mike Baker, Facility Manager for the
NPS, the projected flow from the NPS is estimated to be 2,800 gallons per day. This includes 42
employees @ 25 GPD/employee and 350 visitors/day @ 5 GPD/visitor. Visitation is based on
the peak day for 2014 plus a growth factor based on the increase based on the actual growth in
visitation for a Saturday in the month of July. It was estimated that the peak day for 2014 had
320 visitors. The facility currently uses septic tanks to treat the wastewater generated by the site
which are currently failing.
PROJECT DESCRIPTION
This project includes construction of a 6 foot interior diameter wetwell and lift station with
duplex wastewater pumps pumping at a rate of 100 gpm at approximately 100 feet TDH. The lift
station pumps through 12,597 linear feet of 4 inch force main to an existing wastewater treatment
facility at the West Bay subdivision (WQ0024023). The lift station will be located outside of the
575' AEC buffer. The force main will be installed within the North Carolina Right -of -Way and
will not encroach on private property. The closest the force main will be to the normal high
water line is approximately 44'. The project includes installation of two sewer services on the
Park Service site to replace failing septic tanks and to provide sewerage to a new rest room
facility currently under development. The services are duplex grinder low pressure sewer units
that pump through approximately 881 linear feet of 2 inch force main directly to the lift station.
The closest the grinder stations will be to the normal high water line is approximately 150' on
National Park Service property. The closest the force main will be to the normal high water line
is approximately 44 ft as shown on Sheet 05.
EXISTING CONDITIONS
Site Topography and Hydrography - The topography at the lift station is relatively flat with an
elevation of +5 NAVD88. Along the route of the force main, the elevation varies between
approximately +1 NAVD88 at its' lowest to approximately +11 NAVD88 at its' highest. The
base flood elevation at the lift station site is 7 feet NAVD88.

Land Use —The site where the lift station will be located is currently wooded. There is no
development on the parcel. Adjacent to this parcel is the National Park Service's Cape Lookout
National Seashore Harkers Island Visitor Center. The island is adjacent to Back Sound which
along the route of the force main is SA;ORW waters. Along the route of the force main, land
uses vary between residential, commercial, and religious uses.
Wetlands - There are 404 wetlands on the parcel south of the proposed lift station. There will be
no impact to the wetlands on the site. There is one location on the south side of Island Road
where the force main may be bored beneath coastal wetlands. Wetlands are located
approximately 18 feet from the edge of pavement, adequate space for trenched construction. If it
is necessary to bore beneath the wetlands, the methods described in Methods of Construction
will be used.
Areas of Archeological or Historic Value — There are no known areas of archeological or
historic value known within the project site.
Navigation — There is no proposed construction within any navigable waters.
METHODS OF CONSTRUCTION
The lift station will be constructed using standard construction equipment including bull dozers
and graders. Construction methods to be used for force main installation will be open trench,
bore and jack and horizontal directional drilling installation primarily in the NCDOT rights -of -
way. At the wetland crossing on the south side of Island Road, the pipe will be bored using a
trenchless hydraulic boring machine so that there are no impacts to the wetlands. A bore pit will
be constructed on one side of the identified wetlands approximately 4' x 6' in size. The pipe will
then be pulled beneath the wetlands no less than 3' beneath the ground surface. Roads and
concrete & asphalt driveways will also be bored using the same methods. Construction of the
force main will be with a 2 foot wide bucket or a 6" trencher depending on the location and
existence of existing utilities in areas other than the wetlands and road crossings. Total disturbed

area for the trencher and backhoe work will be a work area approximately 10 feet in width.
Total disturbed area for the lift station and force main is approximately 2.97 acres, as indicated
on the submitted Erosion & Sediment Control plan. Encroachment agreements have been
applied for construction within the NCDOT rights -of -way including Island Drive, Guthrie Drive,
Fulford Street, Middle Street, and Old Ferry Dock Road.
PROJECT SCHEDULE
Construction of the lift station and force main is expected to start immediately once a permit is
issued and within the permitted time frame. The installation of the lift station and force main is
at the expense of the Harkers Island Sewer Company with reimbursement by the federal
government.
COMPLIANCE WITH THE N. C. ENVIRONMENTAL POLICY ACT
The Regulatory Reform Act of 2011 (SB 781) was passed by North Carolina Legislature in July
2011. This bill eliminates the requirement for an environmental assessment (EA) for any project
requiring a Major CAMA permit. Therefore, the proposed project is not subject to N. C.
Environmental Policy Act review.

Land Management Group completed a preliminary and general evaluation of portions of the Harkers Island National
Park Service properties (-4 acres) to determine the general limits of potential 404 or Isolated wetland areas. The
areas evaluated have been historically developed with roads, ditching, and buildings with the balance in unmanaged
mixed pine, hardwood, and underbrush.
Jurisdictional 404 wetlands and Waters of the U.S. come under the authority of the U.S. Army Corps of Engineers
(USACOE), EPA, and NCDENR-DWR. Jurisdictional 404 wetlands and Waters cannot be filled or massively disturbed
without Federal & State permit approvals. Isolated wetlands come under NCDENR-DWR jurisdiction only. This
evaluation was completed through limited geomorphic transects within the tract, aerial photo interpretation, and review
of existing information. A complete 404 wetlands evaluation and physical delineation of the upper limits of potential
404 wetland areas was not completed during this evaluation. The currently used U.S. Army Corps/EPA 1987 Federal
Wetlands Delineation Manual" and regional supplements were used as general guidelines to determine potential 404
Wetland, Isolated wetlands, and/or Waters of the U.S. areas. The enclosed map shows the general location of
uplands vs. the potential 404 wetlands within the specific areas evaluated (see map). These areas appear to be
potential jurisdictional 404 wetlands and not isolated wetlands. There were no Waters of U.S. found within the area
evaluated, including the existing adjacent roadside ditches.
Nationwide general fill permits without mitigation for wetland losses may be available for minor amounts <0.5 acre of
wetland fill or disturbance. An individual permit is typically required for fill amounts >1 acre with mitigation for wetland
losses. Private wetland mitigation is typically costly in both time and monies (12-18 months permitting time & costs).
Another mitigation alternative is to purchase wetland fill credits from NC's eco-enhancement program at costs of
—$20,000 - $50,000 /acre after avoidance and minimization criteria have been satisfied.
Any final 404 Wetland jurisdictional limits or "Waters of the U.S." will need to be physically delineated in the field,
approved by the USACOE, and then surveyed for final approval by the USACOE. Any final 404 wetland approval of a
wetland survey is typically valid for a 5 year time period before having to be reauthorized. This report and preliminary
map should be used for broad general planning purposes only, as specific on -site evaluations, delineations, approvals,
and permits are required by respective regulatory agencies before initiating any development activities.

The Division of Coastal Management hereby acknowledges receipt of your application, submitted on behalf of the applicant (Harkers Island Sewer
Company, LLC) for development activities in the NCDOT Rights of Way and on National Park Service property, in Harkers Island, Carteret County. It
was received as complete on June 4, 2015, and appears to be adequate for processing at this time. You have requested that the application be
processed under the Express Review Permitting Program. Under this expedited process, the projected date for making a decision will be on or
around July 6, 2015.
Please be advised that this project may also require authorization from the US Army Corps of Engineers. The majority of CAMA major permit
applications that also require Federal authorization are processed as a joint review under the CAMA Major Permit I Corps of Engineers 291 General
Permit process. Under most circumstances, the Federal review of these applications would be after July 6, 2015. If the US Army Corps of
Engineers does not render a decision on your project by the time a CAMA permit decision can be made, the Division of Coastal Management will
render a permit decision on the CAMA Permit only. Should that occur, the US Army Corps of Engineers would most likely process your project as a
General Permit 291. Should you wish to place your project on hold before July 6, 2015, pending the receipt of the Federal decision, the Division of
Coastal Management will render a decision once the Federal comments are received.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of
Permit Filing" postcard which must be posted at the property of your proposed development. Due to the nature of this proposed development,
additional placards are suggested to be posted at the Harkers Island Post Office and the National Park Service visitor Center. You should post these
notices at conspicuous points along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to
a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road right-of-way where a private road would lead
one into your property. Failure to post this notice could result in an incomplete application.

THIS AGREEMENT, made and entered into this the day of 20 by and between the Department
of Transportation, party of the first part; and Harkers Island Sewer Company, LLC
party of the second part,
WITNESSETH
THAT WHEREAS, the parry of the second part desires to encroach on the right of way of the public road designated as
Route(s) 1355, 1399, 1451, 1450, 1336 , located On Harkens Island, Carteret County
with the construction and/or erection of. A 4' force main constructed of schedule 80 PVC and ductile iron pipe
WHEREAS, it is to the material advantage of the party of the second part to effect this encroachment, and the party of
the first part in the exercise of authority conferred upon it by statute, is willing to permit the encroachment within the limits of the
right of way as indicated, subject to the conditions of this agreement,
NOW, THEREFORE, IT IS AGREED that the party of the first part hereby grants to the party of the second part the right
and privilege to make this encroachment as shown on attached plan sheet(s), specifications and special provisions which are
made a part hereof upon the following conditions, to wit:
That the installation, operation, and maintenance of the above described facility will be accomplished in accordance with the party of
the first parts latest POLICIES AND PROCEDURES FOR ACCOMMODATING UTILITIES ON HIGHWAY RIGHTS -OF -WAY, and such
revisions and amendments thereto as maybe in effect at the date of this agreement. Information as to these policies and procedures
may be obtained from the Division Engineer or State Utility Agent of the party of the first part.
That the said party of the second pan binds and obligates himself to install and maintain the encroaching facility in such safe and
proper condition that it will not interfere with or endanger travel upon said highway, nor obstruct nor interfere with the proper maintenance
thereof, to reimburse the party of the first part for the cost incurred for any repairs or maintenance to its roadways and structures
necessary due to the installation and existence of the facilities of the party of the second part, and 0 at any time the party of the first part
shall require the removal of or changes in the location of the said facilities, that the said party of the second part binds himself, his
successors and assigns, to promptly remove or alter the said facilifies, in order to conform to the said requirement. without any cost to the
party of the first part.
That the party of the second part agrees to provide during construction and any subsequent maintenance proper signs, signal lights,
flagmen and other warning devices for the protection of traffic in conformance with the latest Manual on Uniform Traffic Control Devices
for Streets and Hiahways and Amendments or Supplements thereto. Information as to the above rules and regulations may be obtained
from the Division Engineer of the party of the first part.
That the party of the second part hereby agrees to indemnity and save ham less the party of the first part from all damages and
claims for damage that may area by reason of the installation and maintenance of this encroachment
That the party of the second part agrees to restore all areas disturbed during installation and maintenance to the satisfaction of the
Division Engineer of the party of the first part. The party of the second part agrees to exercise every reasonable precaution during
construction and maintenance to prevent eroding of soil; silting or pollution of rivers, streams, lakes, reservoirs, other water
impoundments, ground surfaces or other property; or pollution of the air. There shall be compliance with applicable rules and regulations
of the North Carolina Division of Environmental Management, North Carolina Sedimentation Control Commission, and with ordinances
and regulations of various counties, municipalities and other official agencies relating to pollution prevention and control. When any
installation or maintenance operation disturbs the ground surface and existing ground cover, the party of the second part agrees to
remove and replace the sod or otherwise reestablish the grass cover to meet the satisfaction of the Division Engineer of the party of the
first part.
That the party of the second part agrees to assume the actual cost of any inspection of the work considered to be necessary by the
Division Engineer of the party of the first part.
That the party of the second part agrees to have available at the construction site, at all times during construction. a copy of this
agreement showing evidence of approval by the party of the first part. The party of the first part reserves the fight to stop all work unless
evidence of approval can be shown.
Provided the work contained in this agreement is being performed on a completed highway open to traffic; the party of the second part
agrees to give written notice to the Division Engineer of the party of the first part when all work contained herein has been completed.
Unless specifically requested by the party of the first part, wntlen notice of completion of work on highway projects under construction will
not be required.
That in the case of noncompliance with the terms of this agreement by the party of the second part, the party of the first part reserves
the right to stop all work until the facility has been brought into compliance or removed from the right of way at no cost to the parry of the
first part.
That it is agreed by both parties that this agreement shall become void if actual construction of the work contemplated herein is not
begun within one (1) year M1nm the date of authorization by the party of the first part unless written waiver is secured by the parry of the
second part from the party of the first part.
During the performance of this contract, the second party, for itself, its assignees and successors in interest (hereinafter referred to as
the 'contractor"), agrees as follows:
a. Compliance with Regulations: The contractor shall comply with the Regulations relative to nondiscrimination in Federally -
assisted programs of the U. S. Department of Transportation, Title 49, Code of Federal Regulations, Part 21, as they may be
amended from time to time, (hereinafter referred to as the Regulations), which are herein incorporated by reference and
made a part of this contract.
b. Nondiscrimination The contractor, with regard to the work pertormed by it during the contract, shall not discriminate on the

grounds of race, color, or national origin in the selection and retention of subcontractors, including procurements of materials
and leases of equipment. The contractor shall not participate either directly or indirectly in the discrimination prohibited by
Section 21.5 of the Regulations, including employment practices when the contract covers a program set forth in Appendix B
of the Regulations,
c. Solicitations for Subcontracts, includina Procurements of Materials and E ui men: In all solicitations either by competitive
bidding or negotiation made by the contractor for work to be performed under a subcontract, including procurements of
materials or leases of equipment, each potential subcontractor or supplier shall be notified by the contractor of the
contractors obligations under this contract and the Regulations relative to nondiscrimination on the grounds of race, color,
or national origin.
d. Information and Reports: The contractor shall provide all information and reports required by the Regulations, or directives
issued pursuant thereto, and shall permit access to its books, records, accounts, other sources of information, and its
facilities as may be determined by the Department of Transportation or the Federal Highway Administration to be pertinent to
ascertain compliance with such Regulations or directives. Where any information required of a contractor is in the exclusive

possession of another who fails or refuses to furnish this information, the contractor shall so certify to the Department of
Transportation, or the Federal Highway Administration as appropriate, and shall act forth what efforts it has made to obtain

e. Sanctions for Noncompliance: In the event of the contractors noncompliance with the nondiscrimination provisions of this

contract, the Department of Transportation shall impose such contract sanctions as it or the Federal Highway Administration
may determine to be appropriate, including, but not limited to,
(1) withholding of payments to the contractor under the contract until the contractor complies, and/or
(2) cancellation, termination or suspension of the contract, in whole or in part.
L Incorporation of Provisions: The contractor shall include the provisions of paragraphs 'a' through'P in every subcontract,
including procurements of materials and leases of equipment, unless exempt by the Regulations, or directives issued
pursuant thereto. The contractor shall take such action with respect to any subcontract or procurement as the Department
of Transportation or the Federal Highway Administration may direct as a means of enforcing such provisions including
sanctions for noncompliance: Provided, however, that, in the event a contractor becomes involved in, or is threatened with,
litigation with a subcontractor or supplier as a result of such direction, the contractor may request the Department of
Transportation to enter into such litigation to protect the interests of the State, and, in addition, the contractor may request
the United Stales to enter into such litigation to protect the interests of the United States.

INSTRUCTIONS
When the applicant is a corporation or a municipality, this agreement must have the corporate seal and be attested by the corporation
secretary or by the empowered city official, unless a waiver of corporate seal and attestation by the secretary or by the empowered City
official is on file in the Raleigh office of the Manager of Right of Way. In the space provided in this agreement for execution, the name of
the corporation or municipality shall be typed above the name, and this of all persons signing the agreement should be typed directly
below their signature.
When the applicant is not a corporation, then his signature must be witnessed by one person. The address should be included in this
agreement and the names of all persons signing the agreement should be typed directly below their signature.
This agreement must be accompanied, in the forth of an attachment, by plans or drawings showing the following applicable information:
1. All roadways and ramps.
2. Right of way lines and where applicable, the control of access lines.
3. Location of the existing and/or proposed encroachment.
4. Length, size and type of encroachment.
5. Method of installation.
6. Dimensions showing the distance from the encroachment to edge of pavement, shoulders, etc
7. Location by highway survey station number. If station number cannot be obtained, location should be shown by
distance from some identifiable point, such as a bridge, road, intersection, etc (To assist in preparation of the
encroachment plan, the Department's roadway plans may be seen at the various Highway Division Offices, or at the
Raleigh office.)
8. Drainage structures or bridges if affected by encroachment (show vertical and horizontal dimensions from
encroachment to nearest part of structure).
9. Method of attachment to drainage structures or bridges.
10. Manhole design.
11. On underground utilities, the depth of bury under all traveled lanes, shoulders, ditches, sidewalks, etc.
12. Length, size and type of encasement where required.
13. On underground crossings, notation as to method of crossing - boring and lacking, open cut, etc.
14. Location of vents.
1. Any attachment to a bridge or other drainage stmcure must be approved by the Head of Structure Design in Raleigh
prior to submission of encroachment agreement to the Division Engineer.
2. All crossings should be as mar as possible normal to the centerline of the highway.
3. Minimum vertical clearances of overhead wires and cables above all roadways must conform to clearances set out in
the National Electric Safety Code.
4. Encasements shall extend from ditch line to ditch line in cut sections and 5' beyond toe of slopes in fill sections.
5. All vents should be extended to the right of way line or as otherwise required by the Department.
6. All pipe encasements as to material and strength shall meet the standards and specifications of the Department.
7. Any special provisions or specifications as to the performance of the work or the method of construction that may be
required by the Department must be shown on a separate sheet attached to encroachment agreement provided that
such information cannot be shown on plans or drawings.
8. The Department's Division Engineer should be given notice by the applicant prior to actual starting of installation
included in this agreement.

This checklist is provided solely as an informational resource to assists in the preparation of
the permit application. Although this checklist is not required to be filled out as part of the tiiS
permitting process, nor is it required that this checklist be provided to the Division of /
Coastal Management (DCM), the items included within the checklist are required to
complete the permit application.
During the pre -application or application submittal meeting, a DCM representative will sit
down with you and review the application package for completeness. The Division
representative will refer to this checklist to determine whether or not an application is
deemed to be complete or to be insufficient. If an application package is deemed incomplete,
the specific deficiencies will be noted on the application checklist. A copy of the checklist will
be provided to the applicant, or applicant's agent, at the end of the meeting. Once the items
have been addressed, the applicant or agent should contact the local field representative to
schedule a final meeting.

The project includes a lift station to pump wastewater from the existing facility to an existing wastewater treatment facitlity on
Harkers Island. The existing septic tanks on the site are failing and the National Park Service wishes to have a long tern
solution to their wastewater needs. The force main will run approximately 12,597linear feet mainly along Island Road to the
lift station at the West Bay subdivision.
c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type
of equipment and where it is to be stored.
The lift station will be constructed using standard construction equipment including bull dozers and graders. Construction
methods to be used for force main installation will be open trench, bore and jack and horizontal directional drilling installation
primarily in the NCDOT rights -of -way. Encroachment agreements have been applied for construction within the NCDOT
rights -of -way including Island Drive, Guthrie Drive, Fulford Street, Middle Street, and Old Ferry Dock Road.

PROJECT NARRATIVE

INTRODUCTION
The Cape Lookout National Park Service (NPS) Lift Station & Force Main for Harkers Island
Sewer Company, LLC will provide sewer service to the facility located on the eastern end of
Harkers Island in Carteret County. The NPS has begun providing ferry services for visitors to
Cape Lookout and is expecting an increase in visitors to the facility. Additional bathroom
facilities are being developed for visitor use on the Harkers Island site. Collection of the
wastewater from the NPS office building and associated bathroom facilities will be conveyed by
two low pressure sewer to the lift station. A permit is requested for construction of a lift station
and approximate 12,597 linear foot 4" PVC force main to serve the Cape Lookout National
Seashore Facility at the east end of Harkers Island in Carteret County, North Carolina. The lift
station will be located outside of the 575' AECline. Sewage disposal at the site is currently by
septic tanks which are failing. The lift station will pump wastewater from the NPS to the West
Bay Wastewater Treatment Facility located on West Bay Circle, Harkers Island. The force main
will discharge into the equalization tank of the West Bay Treatment Facility.
HISCO is considered as a public utility by the N. C. Utilities Commission.
The National Park Service facility includes offices, a visitor's museum, ferry service, and
recreational areas. Based on visitation data provided by Mike Baker, Facility Manager for the
NPS, the projected flow from the NPS is estimated to be 2,800 gallons per day. This includes 42
employees @ 25 GPD/employee and 350 visitors/day @ 5 GPD/visitor. Visitation is based on

the peak day for 2014 plus a growth factor based on the increase based on the actual growth in
visitation for a Saturday in the month of July. It was estimated that the peak day for 2014 had
320 visitors. The facility currently uses septic tanks to treat the wastewater generated by the site
which are currently failing.
PROJECT DESCRIPTION
This project includes construction of a 6 foot interior diameter wetwell and lift station with
duplex wastewater pumps pumping at a rate of 100 gpm at approximately 100 feet TDH. The lift
station pumps through 12,597 linear feet of 4 inch force main to an existing wastewater treatment
facility at the West Bay subdivision (WQ0024023). The force main will be installed within the
P-0.'C
North Carolina Right -of -Way and will not encroach on private property. The project includes
installation of two sewer services on the Park Service site to replace failing septic tanks and to
provide sewerage to a new rest room facility currently under development. The services are
duplex grinder low pressure sewer units that pump through approximately 881 linear feet of 2
inch force main directly to the lift station.

Site Topography and Hydrography - The topography at the lift station is relatively flat with an
elevation of +5 NAVD88. Along the route of the force main, the elevation varies between
approximately +1 NAVD88 at its' lowest to approximately +11 NAVD88 at its' highest. The
base flood elevation at the lift station site is 7 feet NAVD88.
Land Use — The site where the lift station will be located is currently wooded. There is no
development on the parcel. Adjacent to this parcel is the National Park Service's Cape Lookout
National Seashore Harkers Island Visitor Center. The island is adjacent to Back Sound which
along the route of the force main is SA;ORW waters. Along the route of the force main, land
uses vary between residential, commercial, and religious uses.
Wetlands - There are 404 wetlands on the parcel south of the proposed lift station. There will be
no impact to the wetlands on the site. (Cl

Areas of Archeological or Historic Value — There are no known areas of archeological or
historic value known within the project site.
Navigation — There is no proposed construction within any navigable waters.
METHODS OF CONSTRUCTION
The lift station will be constructed using standard construction equipment including bull dozers
and graders. Construction methods to be used for force main installation will be open trench,
bore and jack and horizontal directional drilling installation primarily in the NCDOT rights -of -
way. Encroachment agreements have been applied for construction within the NCDOT rights -
of -way including Island Drive, Guthrie Drive, Fulford Street, Middle Street, and Old Ferry Dock
Road.
PROJECT SCHEDULE
Construction of the lift station and force main is expected to start immediately once a permit is
issued and within the permitted time frame. The installation of the lift station and force main is
at the expense of the Harkers Island Sewer Company with reimbursement by the federal

COMPLIANCE WITH THE N. C. ENVIRONMENTAL POLICY ACT
The Regulatory Reform Act of 2011 (SB 781) was passed by North Carolina Legislature in July
2011. This bill eliminates the requirement for an environmental assessment (EA) for any project
requiring a Major CAMA permit. Therefore, the proposed project is not subject to N. C.
Environmental Policy Act review.

The project includes a lift station to pump wastewater from the existing facility to an existing wastewater treatment facitlity on
Harkers Island. The existing septic tanks on the site are failing and the National Park Service wishes to have a long term
solution to their wastewater needs. The force main will run approximately 12,597 linear feet mainly along Island Road to the
lift station at the West Bay subdivision.
c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type
of equipment and where it is to be stored.
The lift station will be constructed using standard construction equipment including bull dozers and graders. Construction
methods to be used for force main installation will be open trench, bore and jack and horizontal directional drilling installation
primarily in the NCDOT rights -of -way. Encroachment agreements have been applied for construction within the NCDOT
rights -of -way including Island Drive, Guthrie Drive, Fulford Street, Middle Street, and Old Ferry Dock Road.

Development activities include the installation of a 6' interior diameter lift station and associated appurtenances and 12,597

PROJECT NARRATIVE

INTRODUCTION
The Cape Lookout National Park Service (NPS) Lift Station & Force Main for Harkers Island
Sewer Company, LLC will provide sewer service to the facility located on the eastern end of
Harkers Island in Carteret County. The NPS has begun providing ferry services for visitors to
Cape Lookout and is expecting an increase in visitors to the facility. Additional bathroom
facilities are being developed for visitor use on the Harkers Island site. Collection of the
wastewater from the NPS office building and associated bathroom facilities will be conveyed by
two low pressure sewer to the lift station. A permit is requested for construction of a lift station
and approximate 12,597 linear foot 4" PVC force main to serve the Cape Lookout National
Seashore Facility at the east end of Harkers Island in Carteret County, North Carolina. The lift
station will be located outside of the 575' AEC line. Sewage disposal at the site is currently by
septic tanks which are failing. The lift station will pump wastewater from the NPS to the West
Bay Wastewater Treatment Facility located on West Bay Circle, Harkers Island. The force main
will discharge into the equalization tank of the West Bay Treatment Facility.
HISCO is considered as a public utility by the N. C. Utilities Commission.
The National Park Service facility includes offices, a visitor's museum, ferry service, and
recreational areas. Based on visitation data provided by Mike Baker, Facility Manager for the
NPS, the projected flow from the NPS is estimated to be 2,800 gallons per day. This includes 42
employees @ 25 GPD/employee and 350 visitors/day @ 5 GPD/visitor. Visitation is based on

the peak day for 2014 plus a growth factor based on the increase based on the actual growth in
visitation for a Saturday in the month of July. It was estimated that the peak day for 2014 had
320 visitors. The facility currently uses septic tanks to treat the wastewater generated by the site
which are currently failing.
PROJECT DESCRIPTION
This project includes construction of a 6 foot interior diameter wetwell and lift station with
duplex wastewater pumps pumping at a rate of 100 gpm at approximately 100 feet TDH. The lift
station pumps through 12,597 linear feet of 4 inch force main to an existing wastewater treatment
facility at the West Bay subdivision (WQ0024023). The force main will be installed within the
North Carolina Right -of -Way and will not encroach on private property. The project includes
installation of two sewer services on the Park Service site to replace failing septic tanks and to
provide sewerage to a new rest room facility currently under development. The services are
duplex grinder low pressure sewer units that pump through approximately 881 linear feet of 2
inch force main directly to the lift station.
EXISTING CONDITIONS
Site Topography and Hydrography - The topography at the lift station is relatively flat with an
elevation of +5 NAVD88. Along the route of the force main, the elevation varies between
approximately +1 NAVD88 at its' lowest to approximately +11 NAVD88 at its' highest. The
base flood elevation at the lift station site is 7 feet NAVD88.
Land Use — The site where the lift station will be located is currently wooded. There is no
development on the parcel. Adjacent to this parcel is the National Park Service's Cape Lookout
National Seashore Harkers Island Visitor Center. The island is adjacent to Back Sound which
along the route of the force main is SA;ORW waters. Along the route of the force main, land
uses vary between residential, commercial, and religious uses.
Wetlands - There are 404 wetlands on the parcel south of the proposed lift station. There will be
no impact to the wetlands on the site.

Navigation — There is no proposed construction within any navigable waters.

PROJECT SCHEDULE
Construction of the lift station and force main is expected to start immediately once a permit is
issued and within the permitted time frame. The installation of the lift station and force main is
at the expense of the Harkers Island Sewer Company with reimbursement by the federal
government.
COMPLIANCE WITH THE N. C. ENVIRONMENTAL POLICY ACT
The Regulatory Reform Act of 2011 (SB 781) was passed by North Carolina Legislature in July
2011. This bill eliminates the requirement for an environmental assessment (EA) for any project
requiring a Major CAMA permit. Therefore, the proposed project is not subject to N. C.
Environmental Policy Act review.

Land Management Group completed a preliminary and general evaluation of portions of the Harkers Island National
Park Service properties (-4 acres) to determine the general limits of potential 404 or Isolated wetland areas. The
areas evaluated have been historically developed with roads, ditching, and buildings with the balance in unmanaged
mixed pine, hardwood, and underbrush.
Jurisdictional 404 wetlands and Waters of the U.S. come under the authority of the U.S. Army Corps of Engineers
(USACOE), EPA, and NCDENR-DWR. Jurisdictional 404 wetlands and Waters cannot be filled or massively disturbed
without Federal & State permit approvals. Isolated wetlands come under NCDENR-DWR jurisdiction only. This
evaluation was completed through limited geomorphic transacts within the tract, aerial photo interpretation, and review
of existing information. A complete 404 wetlands evaluation and physical delineation of the upper limits of potential
404 wetland areas was not completed during this evaluation. The currently used U.S. Army Corps/EPA "l987 Federal
Wetlands Delineation Manual" and regional supplements were used as general guidelines to determine potential 404
Wetland, Isolated wetlands, and/or Waters of the U.S. areas. The enclosed map shows the general location of
uplands vs. the potential 404 wetlands within the specific areas evaluated (see map). These areas appear to be
potential jurisdictional 404 wetlands and not isolated wetlands. There were no Waters of U.S. found within the area
evaluated, including the existing adjacent roadside ditches.
Nationwide general fill permits without mitigation for wetland losses may be available for minor amounts <0.5 acre of
wetland fill or disturbance. An individual permit is typically required for fill amounts >1 acre with mitigation for wetland
losses. Private wetland mitigation is typically costly in both time and monies (12-18 months permitting time & costs).
Another mitigation alternative is to purchase wetland fill credits from NC's eco-enhancement program at costs of
—$20,000 - $50,000 /acre after avoidance and minimization criteria have been satisfied.
Any final 404 Wetland jurisdictional limits or "Waters of the U.S." will need to be physically delineated in the field,
approved by the USACOE, and then surveyed for final approval by the USACOE. Any final 404 wetland approval of a
wetland survey is typically valid for a 5 year time period before having to be reauthorized. This report and preliminary
map should be used for broad general planning purposes only, as specific on -site evaluations, delineations, approvals,
and permits are required by respective regulatory agencies before initiating any development activities.
