This permit, issued on September 21, 2015 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Observation -Pier 1) This permit authorizes only the pier and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become. a permanent part of this observation pier without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permttee is not relieved of this requirement,if he abandons the permitted activity without having it transferred to a third party. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee Charles Hamrick III Permit No.103-15 ; Page 2 of 3 1 r Kul 01_1(11 /:\IIIIMI-0Ii�LC1]IM 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) This permit does not authorize any formalized boat slips. NOTE: The reference to Slip #1 on attached workplan drawing dated 6/25/09 is hereby considered null and void. 5) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 6) The roof of the covered platform/gazebo shall not be designed for second story use. 7) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 8) No portion of the pier and platform shall exceed one quarter of the width of the water, body as depicted on the attached workplan drawings. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 10) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 11) To reduce direct impacts to oyster resources, the permittee shall, in consultation with DCM, relocate all oysters falling within the footprint of pilings to an area immediately adjacent to the project area. General 12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 13) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 14) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2015-01793). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 3883 and assigned the project DWR Project No. 20150778. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. PROJECT SUN04ARY: The project is for a pier and platform with a covered area over a portion of the platform for lot 72 of the Mariners Point s/d. As a requirement of the original major permit for the s/d each lot would be required to apply for a major permit if individual docks were requested. Field Investigation Report: Hamrick Lot 72 Mariners Point Page 02 9. Narrative Description: The lot 72 project is located at 1510 Galley Circle of Oglesby Rd which is part of the existing Mariners Point subdivision. Mariners Point was permitted through major permit # 167-07 for infrastructure, 149 lots and a docking facility. Oglesby Rd. is found by turning right off of N. 20`a St. in Morehead City in the area locally known as Crab Point. Dill Creek borders this site to the east and north. Lot 72 is .396 acres in its entirety and is an average of 4' above NHW. A fringe of Coastal Wetlands is present along the shore adjacent to Dill Creek. This fringe contains Smooth Coordgrass (Snartina alterniflora), Black Needle Rush (Juncus roemerianus) and Salt Meadow Grass (Spartina patens). Within the waters of Dill Creek are large expanses of oyster beds. The water depths in Dill Creek are shallow but, according to the applicant, reach —2.9' NLW within the channel portion and —1.5 at NLW at the waterward end of the proposed structure. Extensive field work confirms the soundings. The substrate in this area is thick organic mud. This section of Dill Creek is a Primary Nursery Area as designated by the Division of Marine Fisheries and the Division of Water Quality classifies it as SA/HQW waters. The area in which the proposed project would take place is closed to the taking of shellfish. Morehead City's Land Use Plan dated 2007 classifies this area as Low Density Residential and Conservation within the AECs. 10. Project Description: The applicant is proposing a 6' x 232' pier and a 14' x 28.5' L- head platform which includes a 12' x 14' covered area. They are not proposing any upland development at this time. The pier would cross high ground for 15',coastal wetlands and oyster beds for approximately 207'and open water for 10' with a total length of 232'. It would then intersect a 14' x 28.5' platform that includes a 12' x 14' covered area along the western portion of the platform. There are no slips proposed. The water depths along the platform area are -1.5' nlw. The most water ward portion of the structure would be located 15' landward of the edge of the existing channel. The Division has determined that the configuration of marsh and oyster beds along the shoreline of this property establishes the point from which to measure the water body for the immediate area, creating a width of 106'. In consideration of this, the impedance into the water body by the structure consequently extends approximately 26' into the 106' body of water. The pier and platform would be located 80' from the west riparian corridor and 45' from the east riparian corridor. Riparian corridors where determined on the original major permit submittal for the subdivision as well as through field visits and aerial photography and are drawn relative to the channel location. All water depths as well as the outermost limit of the oyster rock, channel location and water body width have been field verified. Anticipated Impacts: The proposed pier as would incorporate 90 ft2 of high ground while shading and incorporating 400ft2 of coastal wetlands and oyster beds. A total 459 ftz of open water of would be shaded and incorporated by the pier. Large oyster beds containing healthy populations existing along the shoreline would be disturbed during the construction process as well as temporary turbidity during piling placement. The Division of Land Resources approved the Sedimentation and Erosion control plan (CARTE-2006-440) on 6/19/06 with the DWQ Stormwater permit #SW8060625 issued on 7/12/06 for the existing s/d. Based on the determination of the water body widths by the Division and the District, the structure should not cause a hindrance to navigation due to the location of the existing oyster beds. The oyster beds/coastal wetland area terminates approximately 207' waterward of NHW. The channel edge is located 45' from the edge of the oyster beds. The address for the project is 1510 Galley Circle, Morehead City, NC 28557. The Mariner's Point Subdivision's CAMA Major Permit conditions required that anytime development were to occur within the 75' AEC line and waterward that the work must be permitted through the CAMA Major process. The property's upland shoreline is 170LF along coastal wetlands that are part of Crab Point Bay, Stream Index #: 21-30; Class SA;HQW. The lot is currently vacant and there are no current plans for house construction. The owner is requesting to construct 232 LF of a 6' wide wooden pier from the upland of Lot 72 to a 28.5' x 14' (399 sf) platform that borders the "One Quarter Line" of the water body. The proposed platform will have a hip roof over a 12' x 14' portion of the platform. There are no proposed boat slips, boat lifts, tie piles or floating platforms with this pier construction. This platform is beyond the extent of the coastal wetland, beyond the oyster rock that is adjacent to the coastal wetland but not impacting the channel. The extent of the channel within this body of water is determined from previously approved CAMA Major Permits for adjacent lots within Mariner's Point Subdivision. This is generally where -2' at NLW is met and the bottom remains at this elevation or gets deeper going toward the center of the water body. Attached is an exhibit from a previously approved CAMA Major Permit for an observation pier on lot 56 of Mariner's Point Subdivision that demonstrates the extents of the channel. This is a vacant lot that the owner would like to construct an observation pier from the uplands portion over coastal wetlands to the edge of the channel per the attached drawings. In the future a home may be built but that is not part of the scope at this time. c. However, we would like to state our concerns with the project. The structure terminates in a 14' by 28.5' platform. Wetland and shallow water habitat shading could be minimized by reducing the width of this structure. Also, the water depths in the area are below - 2' NLW within a PNA. PNAs are defined as those areas inhabited by the embryonic, larval or juvenile life stages of marine or estuarine fish or crustacean species due to favorable physical, chemical or biological factors. Dill Creek is also home to a large population of oysters that have formed large bed along both side of the creek's main channel. In order to protect the oyster resource present in the project area care should be taken reduced the impacts to the oyster beds to the footprint of the pilings. This would mean physically moving only those oysters in the footprint of pilings; these oysters should be placed immediately adjacent to the project area. To reduce the area of direct impact to oyster bed pilings should be spaced a minimum of 10' on center. Additionally care should be taken when accessing this site with equipment that oyster beds not be crushed or buried. The Mariner's Point Subdivision's CAMA Major Permit conditions required that anytime development were to occur within the 75' AEC line and waterward that the work must be permitted through the CAMA Major process. The property's upland shoreline is 170LF along coastal wetlands that are part of Crab Point Bay, Stream Index #: 21-30; Class SA;HQW. The lot is currently vacant and there are no current plans for house construction. The owner is requesting to construct 232 LF of a 6' wide wooden pier from the upland of Lot 72 to a 28.5' x 14' (399 sf) platform that borders the "One Quarter Line" of the water body. The proposed platform will have a hip roof over a 12' x 14' portion of the platform. There are no proposed boat slips, boat lifts, tie piles or floating platforms with this pier construction. This platform is beyond the extent of the coastal wetland, beyond the oyster rock that is adjacent to the coastal wetland but not impacting the channel. Narrative Description: The lot 72 project is located at 1510 Galley Circle of Oglesby Rd which is part of the existing Mariners Point subdivision. Mariners Point was permitted through major permit # 167-07 for infrastructure,149 lots and a docking facility. Oglesby Rd. is found by turning right off of N. 20`s St. in Morehead City in the area locally known as Crab Point. Dill Creek borders this site to the east and north. Lot 72 is .396 acres in its' entirety and is an average of 4' above NHW. A fringe of Coastal Wetlands is present along the shore adjacent to Dill Creek. This fringe contains Smooth Coordgrass (Spartina alterniflora), Black Needle Rush (Juncos roemerianus) and Salt Meadow Grass (Snartinapatens ). Within the waters of Dill Creek are large expanses of oyster beds. The water depths in Dill Creek are shallow but, according to the applicant, reach —2.9' NLW within the channel portion and —1.5 at NLW at the waterward end of the proposed structure. Extensive field work confirms the soundings. The substrate in this area is thick organic mud. This section of Dill Creek is a Primary Nursery Area as designated by the Division of Marine Fisheries and the Division of Water Quality classifies it as SA/HQW waters. The area in which the proposed project would take place is closed to the taking of shellfish. Morehead City's Land Use Plan dated 2007 classifies this area as Low Density Residential and Conservation within the AECs. 10. Project Description: The applicant is proposing a 6' x 232' pier and a 14' x 28.5' L- head platform which includes a 12' x 14' covered area. They are not proposing any upland development at this time. The pier would cross high ground for 15',coastal wetlands and oyster beds for approximately 207'and open water for 10' with a total length of 232'. It would then intersect a 14' x 28.5' platform that includes a 12' x 14' covered area along the western portion of the platform. There are no slips proposed. The water depths along the platform area are -1.5' nlw. The most water ward portion of the structure would be located 15' landward of the edge of the existing channel. The Division has determined that the configuration of marsh and oyster beds along the shoreline of this property establishes the point from which to measure the water body for the immediate area, creating a width of 106'. In consideration of this, the impedance into the water body by the structure consequently extends approximately 26' into the 106' body of RECEIVED water. The pier and platform would be located 80' from the west riparian corridor and 45' SEp ®1015 from the east riparian corridor. Riparian corridors where determined on the original major permit submittal for the subdivision as well as through field visits and aerial photography and s: are drawn relative to the channel location. All water depths as well as the outermost limit of the oyster rock, channel location and water body width have been field verified. Anticipated Impacts: The proposed pier as would incorporate 90 ftz of high ground while shading and incorporating 400ft2 of coastal wetlands and oyster beds. A total 459 ftz of open water of would be shaded and incorporated by the pier. Large oyster beds containing healthy populations existing along the shoreline would be disturbed during the construction process as well as temporary turbidity during piling placement. The Division of Land Resources approved the Sedimentation and Erosion control plan (CARTE-2006-440) on 6/19/06 with the DWQ Stormwater permit #SW8060625 issued on 7/12/06 for the existing s/d. Based on the determination of the water body widths by the Division and the District, the structure should not cause a hindrance to navigation due to the location of the existing oyster beds. The oyster beds/coastal wetland area terminates approximately 207' waterw rd of NHW. The channel edge is located 45' from the edge of the oyster beds.
