NOTE: Signage or other means shall be installed to ensure the east side of the authorized marina
expansion is not used for dockage.
4) This permit authorizes an additional 6 formalized boat slips for a maximum of 41 boat slips.
5) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
6) This Minor. Modification/Renewal shall be attached to the original Permit No. 109-15, which was issued
on 10/l/15, and copies of all documents must be readily available on site when Division personnel
inspect the project for compliance.
7) All conditions and stipulations of the active permit remain in force unless specifically altered herein.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW-
2015-01527.

State Permit No. 109-15 was issued on 10/01/2015 for the expansion of docking facilities on Bogue Sound,
Carteret County. The permit expires on 12/31/2018.
The applicant is requesting to expand existing docking facility, add 6 additional slips (increase to a total of
41 docking spaces) and construct 6 additional finger piers.
A processing fee of $100 was received on 05/28/2017, #1949.

Please find enclosed a request from Mr. Ned Robie representing Gull Harbor Yacht Club, INC. to
modify the CAMA permit issued to Gull Harbor Yacht Club. This permit, #109-15, was issued on
10/1/15, and is set to expire on 12/31/18. The permit authorized the reconfiguration of an
existing 30 slip docking facility and the addition of 5 new slips for a total of 35 slips.
Subsequent to the issuance of this permit, the applicant is proposing to add six additional slips,
access pier extension and six additional finger piers for a total of 41 slips. The proposal is
consistent with the specific guidelines found in 15A NCAC 07H.0208. I recommend the
modification be authorized as proposed, contingent all original conditions as well as the following
specific conditions stated below are followed:
• All work must be done as shown on plan dated received by DCM on 6/1/17.
.. All portions of the proposed development shall be a minimum distance of 11' from
coastal wetlands along the east side of the proposal to allow kayaks, jon boats and similar
vessels access to the shallow (<1') tributary.
—• This permit does not authorize any formalized docking spaces along the east side of the
proposed dock.

Please consider the following request for modification to Gull Harbor Yacht Club Inc.'s (GHYC)
CAMA Major Permit #109-15.
A scoping meeting was held on February 10, 2017 at the CAMA offices in Morehead City, NC.
The scoping meeting request, GHYC's proposal, and the list of attendees at the meeting are
enclosed.
Representatives from the State considered GHYC's proposal for six slips to be added to the Gull
Harbor marina located in the Gull Harbor subdivision, in Newport, NC, at ICW channel marker
14 in Bogue Sound. CAMA requested that the design be changed so that the walkway for the
new slips be at least 10 feet from the marsh grass on the entrance to the tidal creek, and that
steps be taken to prevent vessels from being moored on the east side of the walkway to ensure
small craft may continue to have free and clear access to the tidal creek.
GHYC has modified its design so that the walkway is now 11 feet from the grass on the entrance
to the tidal creek. We will also ensure that no vessels are moored on the east side of the
walkway by posting signs on that section of the walkway stating, "No Mooring," and adding an
explicit GHYC marina rule that says such mooring is prohibited.
The new design and previously submitted additional depth information is enclosed.

The depth on the back side at low tide is 0 feet, at high tide is 1 foot.
The distance of the dredging for the basin from the marsh edge would be 16.5 feet.

Hi Heather,
You are correct in saying the creek can only accommodate canoes, kayaks and very small boats. What additional
information, if any, could we provide to show this? Taking water depths in this area is tricky, as only small craft can
navigate this creek, even at high tide, and even then taking depths in the shallow areas is dangerous because it
requires getting out in waders where it's easy to get stuck and fall on sharp shells. (I have scars from the last soundings
we took to prove it.)

From what I can remember this area is shallow (1.5' or less) at low tide, so only kayaks or very small boats could

I have reviewed the modification request for #109-15. The proposal includes the addition of 6 finger piers to outline 6
additional slips, increasing the marina's dockage to 41. A scoping meeting was conducted on 2.10.17 where concerns
were stated with regard to dredging and hindrance of navigation to a tidal creek from the position of the slip extension.
While NCWRC still has concern with access to the tidal creek and impacts to shallow water habitats, we will not submit
comments stating the project will have significant impacts to wildlife resources. The applicant has made attempts to
minimize impacts by removing dredging from the proposal and by positioning the dock spine 11' from marsh. We would
have concerns with dredging this area now or within the future.

Through coordination with the North Carolina Division of Coastal Management, we have
learned of your request to modify the work associated with your Department of the Army (DA)
permit issued on July 16, 2015. The proposed modification requires an additional 6 boat slips
and 3 finger piers at 127 Gull Harbor Drive, Gull Harbor Marina, along Bogue Sound, in
Newport, Carteret County, North Carolina. Coordinates are: 34.72973 N,-76.84667 W.
Your proposal continues to be consistent with the provisions and objectives of general
permit No. 197800056 (copy enclosed). The permit is hereby modified. It is understood that all
other conditions of your permit remain applicable. The expiration date of your DA permit is
December 31, 2021.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general and special conditions.
Please read the enclosed permit to prevent an unintentional violation of Federal law. As
this Department of the Army regional general permit does not relieve you of the responsibility to

1) Unless specifically altered herein, this Minor Modification authorizes the marina expansion, all as
expressly and specifically set forth in the attached letter and workplan drawing. Any additional
development activities may require a modification of this permit.
2) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
(See attached sheet for additional conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on

The enclosed permit constitutes authorization under the Coastal Area Management Act, and
where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you
will be helping to protect our vitally important coastal resources.
